I. PREFACETheUniversityofCaliforniaiscommittedtocreatingandmaintainingacommunitywhereall
individualswhoparticipateinUniversityprogramsandactivitiescanworkandlearntogetherin
anatmospherefreeofsexualviolenceandsexualharassment. Consistentwithitslegal
obligationsunderTitleIXoftheEducationAmendmentsof1972,theViolenceAgainstWomen
ReauthorizationActof2013,andCaliforniaEducationCodesection67386,theUniversity
respondspromptlyandeffectivelytoreportsofsexualviolenceandsexualharassment,and
takesappropriateactiontoprevent,tocorrect,andwhennecessary,todisciplinebehaviorthat
violatestheUniversity’spolicyonSexualViolenceandSexualHarassment.
TheUniversity’sstudentdisciplinaryproceduresemphasizeeducation,personalgrowth,
accountability,andethicalbehavior--upholdingstandardsofresponsibleconducttoprotect
thewelfareoftheUniversitycommunity. Whenformalfact-findingproceduresareused,the
proceduresaredesignedtoprovideaprompt,fair,andimpartialresolutionofthematter.
ThefollowingdescribestheUniversity’sproceduresforresolvingcomplaintsofsexualviolence
andsexualharassmentwherethepartiesarestudents,includingthedisciplineofstudents
foundinviolationofUniversitypolicy.
II. RESOURCESRELATINGTOSEXUALVIOLENCEANDSEXUALHARASSMENTTheUniversityhasaTitleIXOfficeateachcampusthatisresponsibleforreceivingand
respondingtoreportsofsexualviolenceandsexualharassment. Confidentialresourcesalso
areavailablebothbeforeandafterapersoncommunicateswiththeTitleIXOfficeabout
potentialviolationsoftheSexualViolenceandSexualHarassmentpolicy. Confidential
resourcesincludeCAREadvocates,andlicensedcounselorsinstudentcounseling centers.
Theseresourcescanprovideconfidentialadviceandcounseling withoutthat information
beingdisclosedtotheTitleIXOfficeorlawenforcementwithoutthestudent’s

consent,unlessthereisathreatofseriousharmtotheindividualorothersoralegalobligation
thatrequiresdisclosure(suchassuspectedabuseofaminor).
III. REPORTOFSEXUALVIOLENCEANDSEXUALHARASSMENT
A. Forpurposesofthismodel,theUniversitywillconsideranyallegedvictimofsexual
violenceorsexualharassmenta“complainant,”whetherornotheorshemakesa
reportorparticipatesintheinvestigationandresolutionprocess.
B. TheUniversitywillstrivetohonorthestatedwishesofthecomplainantconcerning
whethertomoveforwardwithaninvestigation. Theremaybecircumstances,however,
inwhichtheUniversitymayneedtomoveforwardagainstthecomplainant’swishes,or
inwhichtheUniversitymaydeterminethataninvestigationwillnotoccurdespitethe
complainant’swishtopursueaninvestigation.
C. Throughouttheresolutionprocess,theUniversitywillofferandprovidesupport
servicesforcomplainantsthroughtheCAREoffice,andforrespondentsthroughthe
RespondentServicesCoordinator.Respondentservicesareofferedand
coordinatedthroughtheUCSantaCruzSlugSupportServices.
D. TheUniversitywillalsoconsiderandtakeinterimmeasuresasappropriatetoensurethe
safety,well-being,andequalaccesstoUniversityprogramsandactivitiesofitsstudents.
Interimmeasuresinclude,butarenotlimitedto,thefollowing: nocontactorders;
housingassistance;academicsupportandaccommodations;andcounseling. The
UniversitymayplacetherespondentonanInterimSuspensionasappropriateand
consistentwiththePoliciesApplyingtoCampusActivities,OrganizationsandStudents
(PACAOS)-105.08.
E. Atallstagesoftheprocess,thecomplainantandrespondenthavetherighttoan
advisorandasupportpersonoftheirchoosingsolongastheidentifiedsupport
personoradvisorisnotservingasawitnessintheTitleIXinvestigationor
conductadjudicationprocess.
F. Neitherthecomplainantnortherespondentisrequiredtoparticipateintheresolution
process. TheUniversitywillnotdrawanyadverseinferencesfromacomplainantor

respondent’sdecisionnottoparticipateortoremainsilentduringtheprocess. An
investigator,decision-maker,orappealbodywillreachfindingsandconclusionsbased
ontheinformationavailable. Aninvestigator,decision-maker,orappealbodymay
drawadverseinferenceswhenastudentselectivelyparticipatesintheprocess,suchas
choosingtoanswersomebutnotallquestionsposed.
G. ThecampusCaseManagementTeam(CMT)willtrackallstagesoftheresolution
processforallegedviolationsoftheSexualViolenceandSexualHarassmentPolicy
thatinvolvestudentrespondentsandrisetothelevelofaformalinvestigation–
fromreceiptofthereportthroughtheinvestigationand,ifapplicable,the
Universitystudentdisciplineprocess.
H. AllUniversityofficialsinvolvedintheresolutionprocesswillbetrainedtocarryouttheir
rolesinanimpartialmannerinkeepingwithtrauma-informedpractices.
I. Thestandardofproofatallstagesoftheprocessispreponderanceoftheevidence.
J. TheUniversitywillcompletetheprocess,includingallappeals,within120businessdays
fromthedateofTitleIX’sreceiptofareport. Thisdeadlineandalldeadlinescontained
hereinmaybeextendedforgoodcauseshownanddocumented. Thecomplainantand
respondentwillbenotifiedinwritingofanyextension.Requestsforextensionbythe
complainant or respondent during the investigation stageof theprocess shouldbe
made in writing to the Title IX Officer who is assigned to the case. Requests for
extension during the adjudication stage should bemade in writing to the Student
Conduct Officer who is adjudicating the case. The appropriate Title IX or Student
ConductOfficerwillbenotedonthejointnoticeletterreferencedinSectionIV.C.
IV. INVESTIGATIONOFALLEGATIONOFSEXUALVIOLENCEANDSEXUALHARASSMENT
A. Uponreceiptofareportoforinformationaboutallegedsexualviolenceand/orsexual
harassment,theTitleIXOfficerforthecampuswilldetermine,consistentwiththe
University’spolicyonSexualViolenceandSexualHarassment,whetheraninvestigation
shouldbeinitiated.
B. Ifaninvestigationwillnotbeconducted,theTitleIXOfficerwillnotifythecomplainant
inwritingandexplaintherationaleforthedetermination.

C. Ifaninvestigationwillbeconducted,theTitleIXOfficerandStudentConductofficewill
jointlysendwrittennoticeofthechargestothecomplainantandrespondent.This
jointwrittennoticewillnormallybesenttothecomplainantandtherespondent
withinfive(5)businessdaysofreceiptofaformalrequestforinvestigationfromthe
complainantoradecisionbytheTitleIXOfficertoinitiateaninvestigationasallowed
bypolicy.The writtennoticewillinclude:
1. Asummaryoftheallegationsandpotentialpolicyviolations;
2. Thepurposeoftheinvestigation;
3. Astatementthattheinvestigativereport,whenissued,willmakefactualfindings
andarecommendationregardingwhethertherehasbeenaviolationof
Universitypolicy;
4. Astatementthatthefindingsandrecommendationwillbebasedona
preponderanceoftheevidencestandard;
5. Asummaryoftheprocess,includingtheexpectedtimeline;and
6. Asummaryoftherightsofthecomplainantandrespondent.
D. TheTitleIXOfficerwilloverseetheinvestigationandwilldesignateaninvestigatorto
conductafair,thorough,andimpartialinvestigation.
E. Duringtheinvestigation,thecomplainantandrespondentwillbeprovidedanequal
opportunitytomeetwiththeinvestigator,submitinformation,andidentifywitnesses
whomayhaverelevantinformation.
F. Theinvestigatorwillmeetseparatelywiththecomplainant,respondent,andthirdparty
witnesseswhomayhaverelevantinformation,andwillgatherotheravailableand
relevantevidenceandinformation. Theinvestigatormayfollowupwiththe
complainantortherespondentasneededtoclarifyanyinconsistenciesornew
informationgatheredduringthecourseoftheinvestigation.
G. Theinvestigatormaydeterminetherelevanceofanywitnessorotherevidencetothe

findingsandmayexcludecertaintypesofevidenceorinformationthatisirrelevantor
immaterial.
H. Whenalawenforcementagencyisconductingitsowninvestigation,theinvestigator
shouldcoordinatehisorherfact-findingeffortswiththelawenforcementinvestigation.
Attherequestoflawenforcement,theinvestigationmaybedelayedasneededtomeet
anyspecificneedsofthecriminalinvestigation. Suchadelaymaybecausefor
extendingthetimelinestocompletetheprocessanddelaywillbecommunicatedand
documented.
I. Theinvestigatorwillprepareawrittenreportthatincludesastatementofthe
allegationsandissues,thepositionsoftheparties,asummaryoftheevidence,findings
offact,andarecommendationregardingwhetherthereareanypolicyviolations. Ifthe
complainantorrespondentofferedwitnessesorotherevidencethatwasnot
consideredbytheinvestigator,theinvestigationreportwillincludeanexplanationwhy
itwasnotconsidered.
J. Theinvestigationfilemustberetainedandmadeavailabletothepartiesonrequest,
andmayberedactedasnecessarytoprotectstudentprivacyrights.
V. DECISIONONRESPONSIBILITYANDDISCIPLINARYSANCTIONS
A. UponcompletionoftheTitleIXInvestigation,theTitleIXOfficerandStudent
Conductofficewilljointlysendtothecomplainantandtherespondent(a)written
noticeoftheinvestigationfindingsandtheinvestigator’srecommended
determinations,and(b)willprovideacopyoftheinvestigationreport.This
completedreportandjointletterwillnormallybesenttothecomplainantand
respondentwithinfifty(50)businessdaysoftheTitleIXOfficereceivingthe
reportthatinitiatedtheinvestigation.The investigationreportmayberedacted
ifnecessarytoprotectstudentprivacyrights.
B. Thewrittennoticeofthefindingsandrecommendeddeterminationswillincludethe

1. Astatementofthefactualfindingsandrecommendationsregardingwhether
thecharge(s)havebeensubstantiated,includingwhetherpolicieshavebeen
violated;
2. Anadmonitionagainstintimidationorretaliation;
3. Anexplanationofanyinterimmeasuresthatwillremaininplace;
4. Astatementoftherighttoappealthatwillbeexplainedfurtherinthenotice
ofdecision;
5. AstatementthattheStudentConductofficewilldeterminewhetherthe
chargeshavebeensubstantiatedandpolicieshavebeenviolatedand,ifso,
assessthedisciplinarysanctionsandinformthecomplainantandrespondent
ofthesanctionswithinten(10)businessdaysofthenoticeoffindings;and
6. Astatementthatthecomplainantand/orrespondentmay,withinten(10)
businessdayperiodreferencedinSect.V.B.5.,schedulea meetingwith
theStudentConductofficeand/orsubmitastatementin writingtobe
heardonthequestionofthefindingsofanypolicyviolations andthe
disciplinepriortothedecisionandtheimpositionofsanctions.This
meetingisnotforthepurposeofreviewingnewevidence,andthe
StudentConductofficerwillnotactasafact-finder.Thereforeany
evidencetobeconsideredshouldbepresentedtotheTitleIX
investigatorpriortotheconclusionoftheinvestigation.
C. IftheStudentConductofficedeterminesthatdisciplinarysanctionsareappropriate,
thesanctionswillbedeterminedinaccordancewiththesanctioningguidelinesthat
areincludedasanAppendixtotheseprocedures.
1. Disciplinarysanctionsforsexualassault,domestic/datingviolence,orstalking
inwhichoneormoreofthefollowingfactorsarepresentwillresultina
minimumsanctionofSuspensionforatleasttwoyears,uptodismissal:

ii. deliberatelycausingapersontobecomeincapacitatedor
deliberatelytakingadvantageofaperson’sincapacitation;or
iii. recording,photographing,transmitting,viewing,ordistributing
intimateorsexualimageswithoutconsent.
2. Disciplinarysanctionsforsexualassaultinvolvingpenetration,
domestic/datingviolence,orstalkingwill,absentexceptionalcircumstances,
resultinaminimumsanctionofSuspensionfortwoyears,uptodismissal.

3. Disciplinarysanctionsforothersexualcontactinviolationofpolicywill,
absentexceptionalcircumstances,resultinaminimumsanctionof
Suspensionforoneyear.
D. TheStudentConductofficemayconsultwiththeTitleIXofficeatanypointinthe
decision-makingprocess.
E. Withinten(10)businessdaysofthenoticeoffindingsandrecommended
determinations,theStudentConductofficewillsendwrittennoticetothe
complainantandrespondentsettingforththedecisiononwhetherthechargeshave
beensubstantiatedandanypolicieshavebeenviolated,andanysanctionstobe
imposed. Thewrittennoticewillincludethefollowing:
1. Adescriptionofthedeterminationsonwhetherthechargeshavebeen
substantiatedandanypolicieshavebeenviolated,andifso,adescriptionof
thesanctions;
2. Therationaleforthedeterminations1andthesanctions;
3. Astatementoftherighttoappeal,theprocedurethatwillbefollowedin
hearingtheappeal,thegroundsuponwhichtheappealmaybebased,and
theofficetowhichtheappealmaybesubmitted;and
F. Anexplanationthatboththecomplainantandrespondentwillreceiveacopyofany
appealpriortoahearing.TheTitleIXinvestigationandtheStudentConductoffice’s
determinationofresponsibilityandsanctionswillbecompletedwithin60business
daysfromTitleIX’sreceiptofareportabsentanextensionforgoodcause.
RequestsforextensionwillbedocumentedandboththeComplainantand
Respondentwillbenotifiedinwriting.
1 IftheStudentConductofficeadoptstheinvestigator’srecommendeddeterminations,thenoticemayincorporatetheinvestigationreportbyreferenceastherationaleforthedecision. Ifthedeterminationsdifferfromtheinvestigator’srecommendations,thenthenoticewillexplaintherationaleforthatdecision.

VI. APPEALPROCESS
A. Thecomplainantandrespondentmaycontestthedecisionand/orthesanctionsby
submittinganappeal. Theappealshouldidentifythereason(s)whythepartyis
challengingtheoutcomeunderoneormoreofthefollowinggrounds:
1. Therewasproceduralerrorintheprocessthatmateriallyaffectedthe
outcome,suchastheinvestigationwasnotfair,thoroughorimpartial;
2. Thedecisionwasunreasonablebasedontheevidence;
3. Thereisnew,materialinformationthatwasunknownand/orunavailableat
thetimethedecisionwasmadethatshouldaffecttheoutcome;
4. Thedisciplinarysanctionsweredisproportionatetothefindings;
B. Anappealmustbesubmittedinwritingtothedesignatedcampusofficewithinten
(10)businessdaysfollowingwrittennoticeofthedecisionanddisciplinarysanctions,
ifimposed.Detailsforsubmittingtheappealwillbeoutlinedinthewrittennotice
providedbytheStudentConductOfficer.Theappealmustidentifythegroundsfor
appealingandcontainabrief statementofthereasonssupportingeachgroundfor
appeal.
C. Ifanappealissubmitted,anydisciplinarysanctionsordinarilywillnotbeimposed
untiltheappealprocessiscompleted. Interimmeasures,suchasnocontactorders,
academicaccommodations,etc.willremainineffectduringtheappealprocess.
D. TheappealwillbedecidedatahearingbyanAppealBodycomposedofonetothree
individualswhomaybeUniversitystafforacademicappointees,ornon-University
officials,suchasadministrativelawjudgesorexperiencedinvestigators. TheAppeal
Bodywillbeappropriatelytrained. AHearingCoordinatormayassisttheAppeal
Bodywiththeadministrationoftheprocess.TheHearingCoordinatorwillbe
designatedbytheDeanofStudents/AssociateViceChancellorforCampusLifeor
bytheAssociateViceChancellorforColleges,HousingandEducationalServices.

ThedesignatedHearingCoordinatormaybepresentthroughtheappealhearing
butdoesnotparticipateinthedeliberations.TheAssociateViceChancellorwho
designatesaHearingCoordinatorwillalsodesignateaChairpersonfortheAppeal
Body.
E. TheAppealBodywillreviewtheinformationanddecidewhetheritcontains
sufficientinformationconcerningthegroundsforappealandthereasonsrelatedto
thosegrounds.Thepurposeofthisreviewisnottodecidethemeritsoftheappeal,
buttoidentifythenatureandscopeoftheissuestobeaddressedinthehearing.
TheAppealBodywillnotifytheappealingpartywhethertheappealhasbeen
acceptedwithinfive(5)businessdaysofreceivingacompletedappeal.If the
writtenappealisdefectiveorincomplete,theappealingpartyshouldbegiven an
opportunitytocorrectandresubmittheappeal.Thecorrectedappealwillbe
submittedwithinfive(5)businessdaysofitbeingreturnedtothestudentbythe
appealbodywhichwillreviewandrespondtotheappealingpartywithinfive(5)
businessdays.Iftheappealrequestisresubmittedandcontinuestobedefective
orincomplete,andthereisnotgoodcausetoapprovefurtherdelay,the
resubmittedappealmaybedeniedoutrightbytheappealbody.Anappeal
hearingwillnormallybescheduledwithintwenty(20)businessdaysofreceivinga
completedappeal.
F. ConductingtheAppealHearing
1. Pre-HearingProcedures
a. Notlessthanten(10)businessdaysbeforetheappealhearing,the
designatedHearingCoordinatorwillsendwrittennoticetothe
complainant andrespondentofthehearingdate,time,locationand
procedures. Thenoticewillincludeacopyoftheappeal(s)tobe
consideredat thehearing.
b. Priortothehearing,thecomplainantandrespondentwillsubmitto
theAppealBodytheinformationtheyintendtopresentatthe

appeal,includingalldocumentstobepresented,thenamesofall
witnesses,andabriefsummaryofallwitnesses’expected
testimony.Thisinformationwillbeprovidedtothedesignated
HearingCoordinatornotlessthanfive(5)businessdayspriorto
theappealhearing.
c. Atleasttwodayspriortotheappealhearing,thecomplainantand
respondentwillreceivecopiesofalltheinformationthatwillbe
consideredattheappealhearing,includingthenamesofpotential
witnessesandasummaryoftheinformationtheyareexpectedto
provide.
d. Priortotheappealhearingand/orduringthehearing,the
ChairpersonfortheAppeal Body,whohasbeendesignatedby
theAssociateViceChancellor,may:
i. Excludeinformationand/orwitnesstestimonythatis
irrelevantinlightofthegroundsforappeal,notindispute,
orundulyrepetitive.
ii. Decideanyproceduralissuesfortheappealhearing.
iii. Makeanyotherdeterminationsnecessarytoensurean
orderly,productive,andprocedurallyproperappeal
hearing.AtthediscretionoftheChairpersonofthe
AppealBody,participantswhodisrupttheappeal
proceedingsmaybeaskedtoleavethehearing.
2. AppealHearingProcedures:
a. TheTitleIXinvestigatorandStudentConductOfficerwillbe
presentattheappealhearing. The AppealBodymayquestion
theinvestigator,theconductofficer,thecomplainant, and/orthe
respondent.Thecomplainantandrespondentmaybe

accompaniedbyanadvisororsupportpersonoftheirchoosing
solongasthatadvisororsupportpersonisnotawitness.The
roleofthesupportpersonand/oradvisorislimitedtoassistance
andsupportofthestudentinmakingtheirowncaseanddoes
notspeakontheirbehalf.Theinvestigationreportandany
supportingdocumentsormaterialswillbeenteredasevidenceat
theappealhearing.
b. TheAppealBodymayallowthecomplainant,respondent,and/or
witnessestobevisuallyorphysicallyseparatedduringtheappeal
hearing. Thismayinclude,butisnotlimitedto,theuseofa
physicalpartition,aseparatephysicallocation,videoconference
and/oranyotherappropriatetechnology. TheAppealBodymust
beabletoseethecomplainant,respondentandanywitnesses
whentheyarepresentinginformation.
c. Thecomplainantandrespondentwillhavetheopportunityto
presenttheinformationtheysubmittedpursuanttoSectionVI.F.1.b
(unlessexcludedbytheAppealBodypursuanttoSectionVI.F.1.d.).
Boththecomplainantandrespondentshallspeakforthemselves.
Theroleofasupportpersonand/oradvisorislimitedtoassistance
andsupportofthestudentinmakingtheirowncase.
d. Thecomplainantandrespondenthavetherighttohearall
individualswhotestifyatthehearingandtoproposequestionsto
beaskedbytheAppealBodyofallindividualswhotestifyatthe
hearing.
e. TheAppealBodywilldeterminetheorderofquestioning.
Wheneverpossible,theAppealBodywillaskthequestionsasthey
aresubmittedbythecomplainantandrespondentandwillnot
rephraseorchangethem. TheAppealBodymay,however,exclude
questionsthatareundulyrepetitive,clearlynotrelevant,orunduly

timeconsuming.

I. INTRODUCTION
Thesestandardsareintendedtoensuretheconsistentapplicationofdisciplinarysanctionsby
theUniversityofCaliforniainrespondingtoconductthatviolatestheUniversity'sPolicyon
SexualViolenceandSexualHarassmentandtheUniversity’sPoliciesApplyingtoCampus
Activities,Organizations,andStudents(PACAOS)Section100(PolicyonStudentConductand
Discipline).2 ThefollowingdescribestheUniversity'sproceduresforassigningdisciplinary
sanctionswhentherespondentisastudent.
II. PRINCIPLES
A. TheadministrationofstudentdisciplinewillbeconsistentwiththeUCPACAOS
PolicyonStudentConductandDiscipline.
B. WhenastudentisfoundresponsibleforviolatingtheUniversity’sPolicyonSexual
ViolenceandSexualHarassmentandtheUCPACAOSPolicyonStudentConductand
Discipline,theUniversitywillassigndisciplinarysanctionsthatareappropriatetothe
violation,takingintoconsiderationthecontextandseriousnessoftheviolation.
C. WhenastudentisfoundnotresponsibleforviolatingtheUniversity'sPolicyon
SexualViolenceandSexualHarassmentandtheUCPACAOSPolicyonStudent
Conduct,theUniversityiscommittedtotakingreasonableeffortstoassistany
studentwhohasbeendisadvantagedwithrespecttoemploymentoracademic
statusasaresultoftheunsubstantiatedallegations.
D. Disciplinarysanctionsaredesignedtoholdastudentaccountableforviolating
Universitystandardsofconductandtopromotepersonalgrowthanddevelopment.

II. DISCIPLINARYSANCTIONS
A. Universitydisciplinarysanctionsinclude,butarenotlimitedto:
1. DismissalfromtheUniversityofCalifornia,
2. Suspensionfromthecampus,
3. ExclusionfromAreasoftheCampusorfromOfficialUniversityFunctions,
4. LossofPrivilegesandExclusionfromActivities,
5. Restitution,
6. Probation
7. Censure/Warning,and/or
8. OtheractionsassetforthinUniversitypolicyandcampusregulations.
B. ThedefinitionsofdisciplinarysanctionsarefoundinUniversityofCaliforniaPACAOS

II. PROCESS
A. Whenarespondenthasbeenfoundinviolation,theUniversitywillprovidewritten
noticeoftheassigneddisciplinarysanctionsandabriefrationaleforthesanctions.
ThetimelineanddescriptionofthisprocessislocatedinSectionVofthe
ImplementationofthisStudentAdjudicationModel.
B. Disciplinarysanctionswillbeassignedasfollows:
1. Sexualassault,domestic/datingviolence,orstalkinginwhichoneormoreofthe
followingfactorsarepresentwillresultinaminimumsanctionofSuspensionfor
atleasttwoyears,uptodismissal:
i. force,violence,menace,orduress;
ii. deliberatelycausingapersontobecomeincapacitatedordeliberately
takingadvantageofaperson’sincapacitation;or
iii. recording,photographing,transmitting,viewing,ordistributingintimate
orsexualimageswithoutconsent.
2. Sexualassaultinvolvingpenetration,domestic/datingviolence,orstalkingwill,
absentexceptionalcircumstances,resultinaminimumsanctionofSuspension
fortwoyears,uptodismissal.
3. Othersexualcontactinviolationofpolicywill,absentexceptionalcircumstances,
resultinaminimumsanctionofSuspensionforoneyear.
C. Assigneddisciplinarysanctionsandthefactorsconsideredforeachcasewillbe
documentedandreportedtotheUniversityofCaliforniaOfficeofthePresidentona
quarterlybasis. Thereportistoensureareasonablelevelofconsistencyfrom
campustocampus.

III. FACTORSCONSIDEREDINDETERMINGDISCIPLINARYSANCTIONS
A. Indeterminingtheappropriatesanction,thefollowingfactorsmaybetakeninto
account:
1. Seriousnessofviolation:locationandextentoftouching;durationofconduct;
singleorrepeatedacts;multiplepolicyviolationsinconnectionwiththe
incident;verbalorphysicalintimidation;presenceofweapons,useofforce,
violence,physicalinjury.
2. Intentormotivationbehindviolation: nointenttocauseharm;passiverolein
violation;pressuredorinducedbyotherstoparticipateintheviolation;useof
authoritytoabusetrustorconfidence;plannedorpredatoryconduct;
deliberatelycausingapersontobecomeincapacitatedordeliberatelytaking
advantageofaperson'sincapacitation;recording,photographing,transmitting,
viewing,ordistributingintimateorsexualimageswithoutconsent;hateorbias
basedonthecomplainant’smembershiporperceivedmembershipina
protectedgroupasdefinedinUCPACAOSSection104.90.
3. Responsefollowingviolation: voluntarilyacknowledgedwrongdoingatearly
stageoftheprocess;failuretofollownocontactorder;attempttoinfluence
witnesses;obstructedordisruptedtheprocess.
4. Disciplinaryhistory:priorviolationsunrelated,priorviolationsrelated.
5. Impactonothers:inputfromthecomplainant,protectionorsafetyofthe
community.
