Defnition of “resident”: For the purposes of this Act, a natural person is resident in Québec if the person is a Canadian citizen or a permanent resident within the meaning of the Immigration and Refugee Protection Act (S.C. 2001, c. 27) and has lived in Québec for not less than 1095 days during the 48 months immediately preceding the date of acquisition of farm land.     The applicant must ensure that the intended use of the farm land is in accordance with the provisions of the Act respecting the preservation of agricultural land and agricultural activities. If it is not, a separate application for authorization must be completed using the form provided for that purpose and sent to the Commission.     2.3 Description of the farm land concerned by the application • List the current use(s) of the farm land and indicate the area of each use, if applicable.

    Describe all existing constructions and structures on the farm land (houses, buildings and any permanent structure). Include this information in the plan required. For more details, refer to the “Example of a plan” section.

    2.4 Information required to assess the application

    In examining an application, the Commission takes into consideration:

    Section 15 (Act respecting the acquisition of farm land by non-residents)

    • The biophysical conditions of the soil and of the environment, to determine whether the farm land that is the subject of the application is suitable for the cultivation of the soil or the raising of livestock.

    • When the applicant is a legal person or a natural person who does not intend to settle in Québec, section 15.3 of the Act respecting the acquisition of farm land by non-residents limits to 1000 hectares per calendar year the area suitable for the cultivation of the soil or the raising of livestock for which authorizations concerning farm land may be granted. For more information on the files being processed, consult the home page of the website at www.cptaq.gouv.qc.ca.

    Section 16 (Act respecting the acquisition of farm land by non-residents)

    • The intended use, in particular the applicant’s intention to cultivate the soil or raise livestock on the farm land that is the subject of the application;

    • The impact of the acquisition on the price of farm land in the region;

    • The effects of the acquisition or projected use on the economic development of the region;

    • The development of agricultural products and the development of underutilized farm land; and

    • The impact on land occupancy.

    Indicate the cost agreed upon for the acquisition of the farm land, distinguishing the cost for the acquisition of the parcel of land, the cost of the buildings, the cost of the equipment, etc. If an offer to purchase or a promise of sale has already been signed, please enclose it with your application. If you need more space, enclose an appendix.

    Affidavit Declaration made before a person authorized to administer oaths (for example, an attorney, a notary, a commissioner for oaths, etc.).

    Applicant Natural person who makes the application.

    Area

    The areas concerned must be expressed in hectares. 1 hectare = 10 000 square metres or 2.92  square arpents or 2.47  acres or 107 640 square feet. 1 square metre = 10.76 square feet.

    Description of the farm land concerned by the application

    Indicate the current use of the land (pasture, hay, field crops, wooded area, etc.) and the area devoted to each use.

    Legal person with share capital See the “Legal Forms of Enterprises” section on the website of the enterprise registrar at: www.registreentreprises.gouv.qc.ca.

  • EXAMPLE OF A PLAN

    The plan must show all constructions on the lot(s) and indicate the current use of the lot(s) and the whole of the property concerned by the application, as well as the contiguous lots or lots that would be contiguous were they not separated by a public road. More specifi-cally, the plan must mention the area in hectares of the lot(s) concerned and their number. It must also mention the scale used for the drawing and the date on which it was drawn, and bear the author’s signature.
