Section A – Type of provision

(A1) We need to know what type of childcare you want to provide: this depends on factors such as where

you provide the care and how many other carers you work with.

You should select childminder if you intend to work in your home or other domestic premises which are not

the child’s home. Childminders work with no more than two other people.

‘Domestic premises’ means any premises that are wholly or mainly used as a private dwelling – that is,

someone’s home. This will most commonly be your home but can also be another person’s home.

You should also select childminder if you intend to care for children for more than two families wholly or

mainly in the home of a child in your care. This is because the law says that people who do this must

register as a childminder if they care for children from three families together.

You should select home childcarer if you only intend to care for a child or children of one or two families in

the home of one of the families. Common examples of home childcarers are nannies and au pairs who

work in the child’s home.

If you wish to apply as a childminder you may also apply to be a home childcarer on the same application

form.

Select both options if you wish to act as a childminder for children over eight and also wish to act as a home

childcarer.

You should select childcare provider on domestic premises if you intend to work with three or more

other childcarers or assistants at any time on domestic premises.

You should select childcare provider on non-domestic premises if you will be providing care on

premises that are not domestic.

Common examples are after school clubs, holiday playschemes and other group-based provision.

The Guide to registration on the Childcare Register (www.ofsted.gov.uk/resources/120084) explains who

must register, who is exempt from compulsory registration and who may choose to register with us.

(A2) You should select which parts of the Childcare Register you want to apply to join.

Select the compulsory part of the Childcare Register if the provision requires compulsory registration.

Select the voluntary part of the Childcare Register if your provision is exempt from compulsory registration, for example home childcarers.

Select both options if your provision requires compulsory registration and you are choosing to join the voluntary part of the Childcare Register because you wish to care for children over eight.

Section B – Applicant’s details

Individual applicants and proposed nominated persons must be aged 18 or over.

Applicants must have the right to work in the UK. You should contact the UK Border Agency if you are not sure if you need permission to work in the UK. The applicant is the person or organisation responsible in law for providing the care. This individual or organisation, when registered, is known as the ‘registered person’.

(B1) Home childcarers and childminders are individual applicants.

Providers of childcare on domestic or non-domestic premises may be either an individual or an organisation, such as a partnership.

We will send all legal documents to the individual applicant’s address, or the head office or business address of the organisation. Small organisations without a secure business address may use the nominated person’s home address.

The application form should be completed by:

the individual who provides the care, or

the nominated person if the applicant is an organisation – that is, the person nominated by the organisation to act as its representative in dealings with us.

The nominated person is normally a director, committee member, partner or someone of similar standing within the organisation. Larger organisations, such as national companies, local authorities and those whose main purpose is not childcare, should nominate an individual who is the most senior person within the organisation with direct responsibility for providing care. The nominated person should complete their own personal information in this section.

(B5) Any former names used, such as a name used before marriage or name at birth. Please use the additional information sheet on page 47 if necessary.

(B7) We will increasingly use email to contact people. Please give your email address if you want us to contact you in this way.

You must provide a secure email address that is not accessed by anyone other than you or your nominated person. The email address must not be a generic email, such as [email protected], that may be accessed by staff members. This is because we may need to send personal data to you which should not be read by anyone else. By ticking the consent box you consent to us sending correspondence to you via email as your preferred method.

(B8) Have you lived outside the UK in the past five years? We will use this information to decide whether we need to complete further checks in addition to the Disclosure and Barring Service check.

We may ask you to provide evidence of your suitability, such as a police check from the country where you have lived or a certificate of good conduct from the embassy of that country, together with a certified translation if the original is not in English. We will contact you if we need a police check, certificate of good conduct or any other information. We may not be able to grant registration if you cannot provide the certificate of good conduct where we require this to help us assess your suitability to work with children.

(B10–B11) We ask for your address history so that we can contact the relevant children’s services

department to see if they hold any information that may help us assess your suitability to provide childcare.

The manager is the person who has day-to-day management of the childcare provision. If you are applying

as a provider of childcare on domestic or non-domestic premises you must have a manager in place

before we can register you.

If you are a sole owner and intend to manage the provision yourself, please indicate here if this is your

intention.

If you have already appointed a manager, please use this form to tell us you have done so. If you wish us to

carry out day to day business with your manager, you must complete the EY3 form which gives us the

consent to do so. You do not have to complete this form if you are managing the provision yourself or do not

Section D – Organisation details

Please only complete this section if you are an organisation applying to provide childcare. This section asks

for information about the organisation that is applying to be the registered person. There is more

information about registered persons in the Guide to registration on the Childcare Register

(www.ofsted.gov.uk/resources/120084).

(D1) Companies and limited liability partnerships (LLP) are registered with Companies House and have a

company registration number. Examples of a statutory body are a local authority, healthcare trust or school

governing body. If you are applying as a group of two or more individuals who are jointly responsible for

providing childcare but are not a partnership, company, committee or statutory body, please tick ‘other’ and

specify the type of organisation and list all the individuals concerned in D11. If you have a collective name

for your organisation, such as ‘cooperative’, please give this name in D2. Please do not enter the provision

name, for example ‘Happy Days Pre-school’, here. This name should go in E1.

(D2–D3) Please complete the organisation’s full name and office or main business address. If the

organisation does not have a business address, please enter the home address of the person you nominate

to represent the organisation in its dealings with us.

If you are a childcare provider on domestic premises and are not applying as an individual, statutory body,

committee, limited company, partnership or other unincoporated association, please write ‘other childcare’.

(D3) We will send all legal documents and postal correspondence to the address entered in D3.

(D10) We have different procedures for registering organisations depending on whether their prime purpose

is the provision of childcare. The Guide to registration on the Childcare Register

(www.ofsted.gov.uk/resources/120084) gives more details about this.

(D11) If your organisation’s main purpose is to provide childcare, we need to ask for details about all

individuals who make up the organisation. This is because the law requires us to make sure each person is

suitable to provide childcare. There is more information in the Guide to registration on the Childcare

Register. List the full names of partners, committee members, directors or other people who are applying to

register as an organisation providing childcare. You should include your own details if applicable. Please

indicate whether these people have:

completed a declaration and consent form (CR2)

management responsibility for staff

significant contact with children

You need to list all persons who are part of the registered person if your organisation provides:

childcare on domestic premises, or

(E1) Setting name

If you are providing childcare on domestic or non-domestic premises please complete the name by which

you want the provision to be known, for example ‘The Fun Club’. Childminders and home childcarers should

not complete the setting name.

(E2) Setting address

All applicants must complete this section. It asks for the addresses where you will provide childcare.

If you are a childminder or home childcarer, you may apply to provide care from more than one address on

the same application form, providing you meet the definitions in the type of provision section. In this

case, you should include each of the addresses where you will provide care separately in question E2.

If you are a home childcarer, please complete this section if you know where you will be working.

If you cannot complete this now, you must let us know the setting address before you start work and keep

us informed if the setting address changes.

Childcare providers on domestic or non-domestic premises must submit a separate application for each set of

premises they wish to operate from.

(E3) This section asks whether the provision is owned by a public sector body, such as a local authority or

health authority. This helps us include the correct registration category on the registration certificate when

we grant registration.

Childminders and childcare providers on domestic or non-domestic premises, who intend to provide care for

children under eight, should read our factsheet Registration not required

(www.ofsted.gov.uk/resources/factsheet-childcare-registration-not-required) or telephone our helpline on

0300 123 1231 for advice on whether you must apply for compulsory registration. Compulsory registration

is required for those providing care for an individual child under the age of eight for more than two hours in

any one day, subject to certain exemptions and requirements.

Please tell us about the number of children you wish to care for. We provide information to local authorities

so that they have information about the number of childcare places available.

(E13) Unless you are a home childcarer, you cannot provide childcare for children under eight unless you:

are registered on the Early Years Register for children in the early years age group, and

are registered on the compulsory part of the Childcare Register for children older than the early years age group but under eight, or

provide childcare which is exempt from compulsory registration.

Please read our factsheet Registration not required, which explains whether you are exempt from

compulsory registration. If you intend to provide childcare for children under eight and are not applying for

compulsory registration, please tell us which exemption criteria apply to your provision.

Section F – Suitability and disqualification

(F1–F6) You must complete this section in full, otherwise the form will be returned to you. We need to

check if there are certain circumstances that will prevent you from working with or being in regular contact

with children, or bring into doubt your suitability. This section helps us decide if you are suitable to apply or

if there are any other circumstances that might affect your suitability. Please use the additional information

sheet on page 47 of this form if necessary. The Guide to registration on the Childcare Register (paragraphs

62–68) gives more information about the circumstances that disqualify you from working with or being in

regular contact with children. The guide also tells you how you can apply for a disqualification to be waived.

Reasons for disqualification (the Guide to registration on the Childcare Register)

Some of the things that disqualify people from working with children are that they:

have been found to have committed certain offences against a child

have been found to have committed certain offences against an adult (for example murder, kidnapping, rape, indecent assault, assault occasioning actual bodily harm)

have been included on the list of those who are barred from working with children, held by the Independent Safeguarding Authority1or from 1 December 2012 held by the Disclosure and Barring Service2

have been charged with certain offences against an adult, or an offence that is related to an offence, and had a relevant order imposed

have been made the subject of a disqualifying order

have been made the subject an order or determination where a child has been removed from their care or been prevented from living with them

have been refused registration as a childcare provider or have had a registration cancelled (other than for cancellation for non-payment of the fee for continued registration after 1 September 2008)3

are living on the same premises as another individual who is disqualified for one of the above reasons.

(F3) We make a decision about your suitability by carrying out a series of checks, including with the

Disclosure and Barring Service. This question relates to any criminal record you might have. This includes

details of any conviction by a court, or any caution, reprimand or warning issued to you by the police – this

still counts as a criminal record even if you accepted it voluntarily. You must include all instances where this

has happened – even it it happened a long time ago, or when you were a juvenile, or where you did not

receive a custodial sentence. Not all offences prevent you from working with or being in regular contact with

children. In F3 you need to give details of:

the nature of the offence

the place where the offence occurred

the name of the court which gave the conviction

the penalty imposed.

Please note that exemption under the Rehabilitation of Offenders Act 1974 does not apply. You must include

details of spent convictions, including those related to juvenile offences. Please use the additional

information sheet on page 47 of the form if necessary.

the premises, which they must complete and return to us. Your application is not complete until we receive a

Section H – Childcare Register declarations

In order to be registered on the Childcare Register you must meet a number of requirements in the

regulations. The requirements vary according to which register(s) you are applying to join and the category

of childcare you wish to provide. Each declaration begins with a description of the type of provider who must

complete the declaration, so you can identify whether it applies to your category of childcare.

Please read and complete the declarations carefully. If you do not complete the declarations correctly your

application could be delayed or refused.

Please note that it is an offence to make a false declaration.

CR1.2 and CR1.3 Childminders and home childcarers must hold an appropriate first aid qualification,

including training in first aid for children, obtained within the past three years. Providers of childcare on

domestic or non-domestic premises must ensure that at least one person on the premises has an appropriate

first aid qualification, including training in first aid for children, obtained within the past three years.

CR1.4 and 1.5 Corporal punishment means physical punishment, including smacking or shaking.

CR2.3 A person must not have unsupervised contact with children unless they have an enhanced Criminal

Records Bureau disclosure or from 1 December 2012 an enhanced disclosure with the Disclosure and Barring

Service obtained through Ofsted.

CR4.1 Childminders who require compulsory registration must complete a course approved by an English

local authority before registration.

CR4.2 Childminders and home childcarers who do not require compulsory registration must successfully

complete a relevant qualification at a minimum level 2 or training in the core skills.

Your local authority provides information and advice about childcare courses and childminding training.

CR5.2 Providers of settings which require compulsory registration must ensure that children cannot leave

the premises without the carer’s knowledge.

Childminders and childcare providers on domestic or non-domestic premises registered on the voluntary part

of the Childcare Register may allow a child aged over eight to leave the premises unaccompanied by an adult

provided parental permission has been granted.

CR9.2. Providers of open access schemes may only care for children older than the early years age group

unless they are registered on the Early Years Register and do not allow children in the early years age group

to leave unaccompanied by an adult. If you provide an open access childcare scheme please answer

CR6.2 You must manage children’s behaviour in a manner suitable to their age and development.

CR12.1 You must ensure that you and all persons who are part of an organisation applying to provide

childcare are not disqualified from caring for children.

The Guide to registration on the Childcare Register (www.ofsted.gov.uk/publications/120084) gives more

information about the circumstances that disqualify you from working with or being in regular contact with

children.

If you know that you are disqualified from registration, you can ask Ofsted to consider waiving the

disqualification so that you may still apply to be registered. Please contact Ofsted if you wish to apply for a

waiver. We cannot waive a disqualification for people who are included on the list of people who are barred

from working with children, held by the Independent Safeguarding Authority.

CR14.1 and CR14.2 Home childcarers and childminders must have public liability insurance in their own

name. Providers of childcare on domestic or non-domestic premises must have public liability insurance in

the individual applicant’s name or the name of the organisation applying for registration.

H Childcare Register declarations

Section I – Consent and declaration

This section describes how we use the information we receive. It asks you to make certain declarations and

agreements, and to sign the form having read and agreed to the information given. We will return the

form if you have not signed and dated this section.

(I1) By signing the form at I1 you are consenting to us carring out checks and using information provided

from the checks and the application form in the way set out above. Without your consent and signature, we

will not be able to process your application. The checks allow us to establish your suitability to become a

childminder or childcare provider on the Childcare Register. As part of the checks we ask other

authorities/people to share with us information that they hold about you. We use the information from

checks and from interviews with you when making a decision about your suitability to become a childminder

or childcare provider. It may be necessary to repeat these checks from time to time in order to assess your

ongoing suitability. The checks we carry out are listed in the Guide to registration on the Childcare Register

(www.ofsted.gov.uk/publications/120084). By signing the form at I1 you give your consent to these checks.

(I2) As a childminder or provider of childcare on domestic premises you may give your consent to publish

your name, address and telephone number on our website. Publishing your details in this way will help

prospective parents looking for childcare to contact you. You can withdraw your consent at any time.

Ticking the consent box at I2 confirms that we can publish the name, address and telephone number of your

setting as provided on this form.

It is not necessary to obtain the consent of childcare providers on non-domestic premises as we do not

publish personal data such as a name linked to a home address on the website. We publish the address and

telephone contact details for the registered provision and the registered person’s name on our website.

If during the registration process, or after registration is granted, there are changes to your circumstances

that might affect your suitability to provide childcare, you must let us know. These changes are set out in the

regulations and in the Guide to registration on the Childcare Register

(www.ofsted.gov.uk/publications/120084).

We will share information about your registration with local authorities who have responsibility for providing

advice and training to applicants and registered childcare providers. We will also share information with our

inspection service providers who are allowed under the law to carry out certain parts of the registration

process on Ofsted’s behalf.

All applicants must pay a non-refundable application fee. An application is not complete until the fee is

received. More details about the fee are enclosed separately. Please ensure you read these carefully.

It is an offence to knowingly make a statement in an application which is false or misleading. If you do this,

you may be prosecuted and be liable for a fine of up to £5,000 if convicted. By signing the form at I1 you are

What happens to the information provided?

We process your personal information in accordance with the Data Protection Act 1998. Under the Act you

have certain rights regarding access to the personal information that we hold about you. You can request to

see the personal information that we hold about you. You should contact us if you wish to make such a

request.

We ask local authorities to share with us information that they may hold about you. We use the information

to make a decision about your suitability to work with or be in regular contact with children. It may be

necessary to repeat these checks from time to time in order to assess your ongoing suitability.

We may get information about you from others, or we may give information to them. We will only do so in

accordance with the law. We may check information we receive about you with what is already in our

records. This can include information provided by you as well as by others such as other government

departments and agencies. We will not give information about you to anyone unless the law allows us to do

so.

We can give information to:

parents and prospective parents – to help them in choosing a childcare provider

local authorities – including organisations carrying out a statutory function on behalf of a local authority – so that they can include details such as names, addresses and other registration information in their family information services records and fulfil their statutory functions to provide information, advice and training to childcare providers, including childminders

Ofsted’s inspection service providers who, by law, carry out regulatory processes on our behalf

Her Majesty’s Revenue and Customs – so that it can check on tax credit eligibility for parents using childcare

other agencies – if they write to ask us for information about a provider and they need the information for child protection purposes

child protection agencies and the police – so that they can investigate circumstances where children might need protecting from harm.

Information you supply can be given to these people and organisations because the Childcare

Act 2006 (sections 83 and 84) allows this. In some cases the law requires us to provide

this information. We may use details from this application and any future updates to form part of the

public register.

This duty is placed on us by The Childcare (Supply and Disclosure on Information) (England) Regulations

2007.
