BACKGROUND Transmitted for acceptance by the Councilors is the plat for FLD2017-00033 Brown Short Plat Plat Alteration.

Project review: The application vested on February 6, 2017. A pre-application conference waiver was granted on September 23, 2017, and the Preliminary approval was issued on May 5, 2017. Final engineering approval does not apply in this case. The applicant received approval to remove the requirement for a shared well between the two lots, and construct individual well systems for each parcel.

Zoning: R-5; Lot Size: The R-5 zone prescribes a minimum lot area of 5 acres with no maximum lot area. Actual Lot Size: Parcels in this plat meet minimum lot size standards.

COMMUNITY OUTREACH The proposed land division went through the standard land use review and approval process. DECLARATION AMENDING SHORT PLAT BOOK 3 PAGE 704

We, JOHN F. BROWN and FRANCES D. BROWN, husband and wife, and CANDACE K. SCHUPP a

single woman, being the record owners of Lots 1 and 2, SHORT PLAT 3-704, said parcels being certain

real property in Clark County, Washington, legally described therein below (hereinafter "Sites"), pursuant

to RCW 58.17 .215 and CCC 40.540, which, under specific circumstances, allows Clark County to

approve alterations to recorded plats, file this declaration to accomplish that end.

RECITALS:

Whereas, John F. Brown and Frances D. Brown, husband and wife, are the record owners of Lot 2,

SHORT PLAT 3-704, and Candace K. Schupp, a single woman, is the record owner of Lot 1, SHORT

PLAT 3-704, both parcels being part of a short plat recorded under Auditor' s File Number 4221946,

Book 3 of Short Plats, Page 704 , the Sites, which legal description is set forth by a copy of the

previously recorded plat in Exhibit A attached hereto; and

Whereas, the owners have sought to amend the previously recorded plat to remove a waterline

easement across Lot 1 for the benefit of Lot 2, and note requiring an approved small public water supply~

and

Whereas, the owners have previously received the plat alteration approval with conditions of

Clark County in that planning application numbered PLD2017-00006; and

Whereas, this document is required to satisfy the conditions of approval, RCW 58.17 .215 and

CCC 40.540; now, therefore,

I. The undersigned owners declare that they are the sole and exclusive owners of the real

properties, described in Exhibit "A" that is affected by the plat alteration. The plat is recorded in

Book 3 of Short Plats, at Page 704, records of Clark County, Washington.

2. Pursuant to the plat alteration, Clark County approved the use of private on-site wells for

the Lots within the subject plat, and found that the waterline easement encumbering Lot I was no

longer needed.

3. A copy of the recorded plat, as originally approved and recorded in Book 3 of Short Plats,

at Page 704, records of Clark County, Washington, is attached hereto and incorporated herein as

Exhibit "B"

4. A revised drawing of the approved alteration as specified in approval condition note D-2

is attached hereto and incorporated herein as Exhibit "C''.

5. The final plat is only amended as set forth above and in all other aspects are unaffected

by this document. A copy of this declaration shall be filed with the Clark County Auditor so as to

appear in the chain of title of the affected parcels.
