In pursuance of the powers conferred in that behalf under Section 204 of "Tile Municipal Corporations Act, 1906," the Mayor and Councillors of North Perth hereby repeal subsection (c) of By-law No. 47 (Building By-laws), and adopts the following in lieu thereof :—

(a.) Every room used or intended to be used for the purpose of habitation and being part of the main

building muet be at least 10 feet 6 inches in height front floor to ceiling; and rooms with lean-to roofs must average at least 9 feet in height from floor to ceiling.

The maxi-mum area which may lie selected by any ono person in this particular area shall not exceed 151 acres. No license for the sale of intoxicants will be granted within the Denmark Estate.

1IIS Excellency the Governor in Executive Council has been pleased to approve of the following Regulations made by the Minister for Lands under Section 16 of "The Land Act Amendment Act, 1909."

1. These Regulations apply to all Crown Land open for selection within the Denmark Estate (Plantagenet District).

2. In addition to the improvements prescribed by Subsection (3) of Section 55 of "The Land Act, 1898," every lessee under Section 55 and 56 respectively of the said Act of land within the said estate shall expend on the land applied for during every half-year of the term of three years from the date of the approval of his itpplication such stun as is berehtafter provided in scrub cutting, sucker cutting, cultivating, grubbing, or in some other manner, to the satisfaction of the Minister, so as to keep down the scrub and undergrowth.

The said stint to be so expended in each half-year shall he an amount equal to one-fortieth of the pur-chase money for the land, less threepence per acre.

3. Every lessee shall, until the purchase money' is paid in full, effectually maintain all improvements on the land, including clearing, to the satisfaction of the Minister.

IT is hereby notified, for general information, that his Excellency the Governor in Executive Council has been pleased to approve ol: the areas scheduled hereunder being made available for selection under " The Land Act, 1898," and its amendments. The selector of it Homestead Farm from any location available under Part VIII. must take the balance thereof under Con-ditional Purchase, and a selector of a portion of any location available under Part VI. insist take the balance of same under Grazing Lease conditions.

The locations available under Part VI. are marked with an asterisk.

Applications must be lodged at the Office of the Gov-ernment Land Agent for the District.

Applications may be lodged before the day specified, but will be treated as having been received on the appointed day.

The locations with amounts set against them in the fourth column are available subject to the special con-dition that an expenditure of not less than one-fourth of the amount set out in such column shall be made on prescribed improvements in each of the first four years of the lease; but this shall not release the holder front any covenant in the Agricultural Bank Mortgage re-quiring the improvements to be made at an earlier date. The advance mentioned is subject to the usual con-ditions governing a loan from the Agricultural Bank, particulars of which may be had on application from the Managing Trustee.

Applications for advance must be accompanied by a fee of one per cent. on the amount applied for.

THE ROADS ACT, 1902. WHEREAS the Esperance Road Board, by resolution passed at a meeting of the Board, held at Esperance ou the 9th day of November, 1910, resolved to open the road hereinafter described, that is to say:-

WHEREAS by "The Roads Act, 1902," the Road Board of any District is empowered to make By-laws for all and any purposes in the said Act, mentioned, the Arum-dale-Kelmscott -Road Board, in pursuance of the powers vested in the said Board under and by virtue of the said Act, and of every other authority enabling it in that behalf, doth hereby make and publish tlu: following By-la ws : —

11 ear y Traffic.

1. The owner of every vehicle or engine which, to-gether with its load, shall weigh more than five tons, shall travel the roads, bridges, and culverts at his own risk, and shall be liable to pay for any damage done.

2. That the special yearly license fee for vehicles engaged hi heavy traffic, that is to say, in carrying stone, bricks, lime, timber, earth, gravel, mineral, liquid, or any other heavy substance whatever, shall be as fol-lows:—

(a.) For vehicles of two wheels, 2s. 6d. per wheel per calendar month, or portion of fl calendar month, or an alternative fee of .£2 per annum.

(h.) For vehicles of four wheels or more, 5s. per wheel per calendar month, or portion of a calendar month, or an alternative fee of per annum.

(e.) Such amounts shall he additional to those pre-scribed under "The Cart and Carriage Licens-ing Act, 1876."

The Board may, by notice m1-fixed to any bridge or culvert, declare the maximum weight of any engine, agricultural or other machine, or vehicle of any kind, and of ally load or material which shall be permitted to cross such bridge or culvert, and also the pace or sliced at which such engine, machine, vehicle, or load shall be drivel], led, or taken over any such bridge or culvert, and any person who shall cross such bridge or culvert in contravention of this Bs-laaw shall, in addition to any liability for :my damage he may have caused, and except with the Written permission of the Board, lie liable, on conviction, to a penalty not exceeding

Cycle or Motor Traffic.

4. (a.) Every cycle or motor shall carry a bell, or other instrument suitable for giving warning of ap-proach, which shall be used as a signal whenever any person on foot or on horseback or vehicle is being- ap-proached or passed.

(b.) No person shall leave any cycle or motor in or on any road or footway so as to become an obstruction. and every person shall remove his cycle or motor imme-diately upon being requested to do so by any constable or officer or member of the Board.

(c.) No person riding or driving any cycle or motor shall pass at a speed exceeding eight miles an hour any person who shall be riding or driving any horse or other animal

(d.) When nay person riding or driving tun- cycle or motor Shall meet any horse or other animal, and such horse or animal shall become restive or appear likely to get beyond the control of the person in charge thereof, such person shall stop his cycle or motor, and shall not proceed until such horse or anlinal has passed.

(e.) No person shall ride or drive any cycle or motor round the corner formed by the junction of any roads in the district, or across the intersection of any of the said roads, at a pace exceeding six miles an hour.

5. No person shall use any motor cycle or motor car in the district unless such motor cycle or motor car is licensed.

Provided that if a license is taken out for a motor cycle or motor car by any person in the district in which he resides, he shall not be required to take out a license in any other district.

6. A motor cycle or motor ear license shall be in the form "A" in the schedule, and application for the same shall be made to the Secretary to the Road Board at the office of the Board.

Fee. The fee for every motor cycle or motor car license

shall be five shillings per annum. 7. Every license for a motor cycle or motor car shalt

expire on the thirty-first day of December in the year for which it was issued.

8. Every licensee of a motor cycle or motor car shall affix and keep affixed the license number on some con-spicuous part of the motor cycle or motor car.

Park Lands, ne8erve, and Recreation GronnaN. 9. The Board may, in its discretion, prohibit any

games or gymnastics from being played or carried on by any person or persons upon any park lauds, recrea-tion grounds, or reserves upon any Sunday, Christmas Day, or Good Friday.

Penalties. ,Every person who does, permits, Or suitors to

be done auy act, matter, or thing contrary to any of these By-laws, or commits, or permits, any breach or neglect thereof, shall be deemed guilty of an offence against these By-laws, and, where not otherwise pro-vided, shall be liable to a penalty not exceeding £20 for every such offence.

11. All penalties or other sums recovered under the provisions of these By-laws shall, unless otherwise pro-vided, be paid to the Board, and shall become tin: pro-perty of and form part of the ordinary income of the district, except so much as ina,y be payable to any in-former.

Eight closets will be counted at the stone rate as one room. Smaller numbers will be paid for at proportionate. rates.

Where a school is held in a public hall or other ldred building, special rates may be fixed."

Regulations 21,. 09, and 140, as amended, will come into force on 1st July, 1910.

NOTICE is hereby given that the Si ayor and Councillors o North Perth propose to borrow tae sum of 0210,000, to be expended in the construction of works and under-takings. Plans and specifications and the estimate of such work and undertakings, and a statement showing the proposed expenditure of the money to be borrowed, are open for inspection at the Office of the Town Clerk, View Street, North Perth, for one month from the date of publication hereof, between the hours of 10 a.m. and 4 p.m. (Saturdays excepted). The amount of £10,000 is proposed to be raised by the sale of debentures, bear-ing interest at the rate of four and one-half per cent. per annum. payable half -yearly at the Head Office of the Com mann I Itank of Australia, Ltd., Perth, and the said debentures 10 be repayable at the Head Office of the a foresaid Bank 30 years after the issue thereof, the Coun-cil reserving the right to redeem the whole or any part of the debentures at par 15 years after the issue thereof.
