The untimely deaths of two local skiers this past season hav e caused many people to ask whether or not the families of those who died have a good case to sue anyone responsible for their deaths. In order to answer these questions, we must revisit the case of S ean M organ v s. the S tate of N ew York, discussed in my very first newsletter back in November, 2008.

Sean Morgan was a bobsledder and former Olympian who was very badly injured while training on the Olympic bobsled run at Mt. VanHovenberg, just outside of Lake Placid. Morgan was the driver of a two man bobsled, and when his brakeman fell out of the sled, Morgan couldn’t reach the brake and the sled crashed into a concrete wall at the end of the course, causing Morgan massive brain injuries. The case went to the highest court in New York, the Court of Appeals, which ruled that Morgan assumed the risk of crashing “inherent in a sport whose aim it is to streak down a mountainside on a sheet of ice approaching eighty miles per hour,” and that therefore the State (which owns the bobsled track) was not responsible.

What about the local folks who perished while skiing? My suspicion is that since both died as a result of skiing into trees, their families would likely not be able to sue the resort where they were skiing.

What do you think? Did the unfortunate souls participating in winter sports assume the risk of being killed?

The Steuben County Legislature has authorized a Tire Amnesty Day at the Bath Landfill

Saturday, May 7, 8 a.m.-3 p.m.This offers County residents a way to keep roadsides

clean. Also, the threat of West Nile Virus is minimized from mosquitoes collecting in standing water inside the tires.

Residents of Steuben County will be able to dispose of eight (8) car and pickup truck tires at no charge.

More than (8) tires per vehicle will be charged at $2.50 per tire. Large truck tires will be $13 each. It will be necessary to purchase a landfill ticket prior to this

collection day if you intend to bring in more than eight (8) tires, or you may use credit or debit cards at the landfill.

longer: A recent report by theCenters for Disease Control chart-ed U.S. life expectancy in excess of78 years, the highest it’s ever been.

Additionally, chronic diseasessuch as diabetes, arthritis andAlzheimer’s are affecting more peo-ple. Currently, about 8 millionAmericans require some kind ofmedical care in the home, a num-ber that will jump dramatically aspeople live longer, want to stay athome avoiding nursing homes orother living arrangements, andpressure mounts to control soaringhealth-care costs.

If you’ve thought of home carefor yourself or a loved one, here aresome things to consider.

• START BY OBSERVING.Sometimes people don’t realizethat their parents or elderly familymembers can’t do the things theyonce did. Look for warning signs.Is Mom or Dad having memory orvision problems, trouble walking oris taking many medications? Is theperson having difficulty with thenormal activities of daily life? If theanswer to any of those is yes, itmay be time to proceed.

• SPEAK UP. When you’ve iden-tified the need for help, let some-one know. Talk to the individual’sphysician about your concerns.Many referrals to home-care serv-

ices first come from geriatricians orprimary-care doctors.

• IDENTIFY WHAT YOU’LLNEED. Home health care servicesare more complex and numerousthan before. Will you need skilledassistance such as nursing or phys-ical therapy? Help with meals andhygiene? Or just housekeepingactivities? This is a critical step, asit determines not only what kindsof care the individual needs butalso the cost of care.

• CONSULT AN EXPERT. Youneedn’t face these decisions alone.Professional home care agenciescan assess needs, identify resourcesand develop care plans for a per-

son’s specific situation. • ALLOW CARE FOR THE

CAREGIVER. Most home care –up to 80 percent by some esti-mates – is provided by familymembers, juggling work with thecare of their own families andthat of their parents or otherfamily members. Caregivers oftenbecome burned out and don’trealize it. If the primary caregivergets sick and there’sno back-up plan, thesystem of care col-lapses. One of the keythings to rememberabout home care isthat it’s not only tak-ing care of thepatient, it’s takingcare of the caregiver.

• A TEAM EFFORTIS BEST. To do the bestjob for the patient,everyone involved mustplay key roles. It takes ateam approach, with

health professionals, home-careaides, the family and the patient, sowhen something goes wrong, every-one can be alerted.

• OVERSEE AND ADVOCATE.Family members must rememberto oversee the care that’s given andto advocate for the patient. Youwant your family member to getthe right care, and that comes fromconstant oversight and advocacy. Ifyou see something you don’t thinkis right, speak up and get it cor-rected.
