GENERAL INFORMATION

The APVMA (Australian Pesticides and Veterinary Medicines Authority) Gazette is published fortnightly and contains details of

the registration of agricultural and veterinary chemicals products and other approvals granted by the APVMA, notices as requi red

by the Agricultural and Veterinary Chemicals Code (the Agvet Code) and related legislation and a range of regulatory material

issued by the APVMA.

Pursuant to section 53(1) of the Agvet Code, the APVMA has decided that it is unnecessary to publish details of applications

made for the purpose of notifying minor variations to registration details. The APVMA will however report notifications activity in

quarterly statistical reports.

DISTRIBUTION AND SUBSCRIPTION

From February 2010, the APVMA will publish the APVMA Gazette in electronic format only. The APVMA Gazette and information

about subscribing to the gazette alert service are available on the APVMA website, www.apvma.gov.au.

Exemption for the possession and supply of Vet’s All Natural Shark Cartilage Powder and Vet’s All Natural Joint Formula

Exemption for the purposes of Sections 75 and 78 of the Agricultural and Veterinary Chemicals Code Act 1994

(Agvet Code): Vet’s All Natural Pty Ltd

The APVMA has granted exemptions for the purposes of sections 75 (1)(b) and 78 (1)(b) of the Agvet Code for the

following Vet’s All Natural Products:

Vet’s All Natural Shark Cartilage Powder in 200 gram and 1 kg containers; and

Vet’s All Natural Joint Formula in 500 gram, 1 kg, 3 kg and 15 kg containers

The conditions of the exemptions are as follows:

Vet’s All Natural Shark Cartilage Powder in 200 gram and 1 kg containers

This exemption is granted for the period 12 June 2012 to 12 July 2012; and

This means that even though this exempted product is a veterinary chemical product under the Agvet Codes,

it is not an offence to possess them for the purposes of supply or to supply them; and

This exemption applies to stocks of the product in 200 gram and 1 kg containers supplied by Vet’s All Natural

to any other person whether it be directly or indirectly through distributors, during the period of this exemption.

Vet’s All Natural Joint Formula in 500 gram, 1 kg, 3 kg and 15 kg containers

This exemption is granted for the period 12 June 2012 to 12 July 2012; and

This means that even though this exempted product is a veterinary chemical product under the Agvet Codes,

it is not an offence to possess them for the purposes of supply or to supply them; and

This exemption applies to stocks of the product in 500 gram, 1 kg, 3 kg and 15 kg containers supplied by

Vet’s All Natural to any other person whether it be directly or indirectly through distributors, during the period

of this exemption.

These exemptions in no way should be construed as implying that the APVMA has either assessed or supports the

claims made by Vet’s All Natural about these products.

These exemptions may be cancelled at any time by the APVMA.

The reason for granting these temporary exemptions is a result of compliance action by the APVMA and the company

entering into a compliance undertaking to ensure sustained compliance with the Agvet code.

The APVMA has suspended the active constituent approvals of 2,4-D ethyl ester and 2,4-D isobutyl ester as listed in

Table 1, and the registration of products containing 2,4-D isobutyl ester as listed in Table 2 of this notice.

The suspension is in effect from 5 June 2012 until 10 August 2012.

The reason for the suspension1 of the active constituent approvals listed in Table 1 [under Section 37(1)(b) Agricultural

and Veterinary Chemicals Code Act 1994 (Agvet Code)] arises from the fact that the abovementioned active constituent

approval holder failed to give information, or results of trials or experiments to the APVMA in response to the APVMA’s

Section 33 notices of 1 September 2006 and 12 November 2007.

The APVMA has also suspended all registrations of products containing 2,4-D isobutyl ester as a consequence of the

suspension of all approved sources of the active constituent of 2,4-D isobutyl ester2. Section 44(1) of the Agvet Codes

states that if the APVMA suspends or cancels the only approval, or all the approvals, of an active constituent for an

existing chemical product, it must also suspend the registration of any product containing that active constituent.

Therefore, the APVMA has suspended the registrations of all products containing 2,4-D isobutyl ester (Table 2).

Please note that this suspension does not affect registrations of products containing 2,4-D ethyl ester as there remains

an approved source of the active constituent 2,4-D ethyl ester.

Please note that in giving effect to the interrelated suspension of product registrations listed in Table 2, the APVMA

has revoked a previous suspension pertaining to these registrations; the previous suspension, and reasons for the

suspension, are detailed in the APVMA Gazette dated 1 February 2012. This process is an administrative step and

does not indicate the concerns underpinning the 1 February 2012 suspension have been addressed for products

containing 2,4-D isobutyl ester. The environmental concerns posed by the use of 2,4-D high volatile esters still apply.

The suspension has only been revoked for the products listed in Table 2 and the suspension of 1 February 2012 still

applies to products containing 2,4-D butyl ester and 2,4-D ethyl ester.

If, for any reason the APVMA revokes this suspension, the APVMA will consider reinstating the 1 February 2012

suspension for product registrations because of remaining environmental concerns.

The APVMA has issued the following instructions for using or dealing with suspended active constituents or product

containing 2,4-D isobutyl ester. Please note that the instructions for suspended products are similar to those imposed for

the 1 February 2012 suspension.

INSTRUCTIONS FOR POSSESSING, HAVING CUSTODY OF, USING OR OTHERWISE DEALING WITH THE

SUSPENDED ACTIVE CONSTITUENTS AND DEALING WITH PRODUCTS CONTAINING SUSPENDED ACTIVE

CONSTITUENT 2,4-D ISOBUTYL ESTER PURSUANT TO SECTION 45A OF THE AGVET CODE

POSSESSION AND CUSTODY

Possession and custody of existing stocks of suspended active constituents is permitted during the course of the

suspension.

SUPPLY

No supply of the suspended active constituents is permitted after 5 June 2012.

USE

Existing stocks of suspended active constituents may be used to manufacture product during the course of the

suspension.

Other than as specified in this notice, the suspended products (as specified in Table 2) must be used in accordance with

the instructions on the label attached to the container. Where the instructions contained within this notice are inconsistent

with the label instructions, the instructions in this notice must be followed.

Subsections 45A(5) and 55(3) cease to apply in respect of the suspended active constituent approvals 2,4-D ethyl ester

and 2,4-D isobutyl ester and product registrations containing 2,4-D isobutyl ester. A person may not possess, have

custody of, use or otherwise deal with the suspended active constituents except in accordance with these instructions.

In regard to product registrations, during the period of suspension, a person may not possess, have custody of, use or

deal with any of the products other than in accordance with:

the instructions set out in Attachment 1 of this notice

permit PER13339 issued by the APVMA.

Permit PER13339, with modified instructions for use, has been issued under section 114 of the Agvet Code.

WARNING

These actives are not approved and products are unregistered during the period of suspension. A person must not

possess with the intent to supply, or otherwise deal with the suspended active constituents or suspended products

containing 2,4-D isobutyl ester during this period, except in accordance with the instructions contained in this notice or in

permit PER13339. A failure to comply with the instructions will result in an offence against the Agvet Codes and the

APVMA will take appropriate compliance action. It is an offence for any person to possess with the intent to supply an

active constituent after the date of its suspension.

From 5 June 2012, a person may only possess, have custody of, use or otherwise deal with the products identified in

Table 2 in accordance with permit PER13339 issued by the APVMA and the instructions set out at the end of this notice

(see Attachment 1).

Depending on further information that may be received and assessed for the ongoing review of 2,4-D products, the

APVMA may cancel any permit and issue a replacement permit at any time prior to the expiry dates on the permit

PER13339. Before using, supplying or otherwise dealing with products containing 2,4-D isobutyl ester, suppliers and

users need to be satisfied that the instructions set out at the end of this notice continue to apply, and that their activities

are authorised by a permit. The current permit is available at http://www.apvma.gov.au/permits/search.php.

Failure to comply with the instructions set out at the end of this notice attracts a penalty under section 55(4) of the Agvet

Code.

It is also an offence to advertise or promote the use of the products during the period of suspension (other than for the

purposes of advising users about the modified instructions for use).

Possession and custody

A person may possess, have custody of, use, or otherwise deal with the suspended products as listed in Table 2 of this

notice only in accordance with these instructions.

Supply

Product may only be supplied, if it contains or was manufactured from existing stocks of the suspended active

constituent 2,4-D isobutyl ester supplied before 5 June 2012. A copy of the instructions contained in this notice must be

securely affixed to the container.

Use

These instructions apply to the use of products containing 2,4-D isobutyl ester during the period of suspension in all

states and territories.

READ THESE INSTRUCTIONS before using or otherwise handling the product.

When using or otherwise handling the product, follow these instructions.

Other than as specified below, the products must be used in accordance with the instructions on the label attached to the

container. Where the below instructions are inconsistent with the label instructions, the instructions in this notice (below)

must be followed.

In all states and territories the following information is the DIRECTIONS FOR USE: For products containing 2,4-D

isobutyl ester.

RESTRAINTS:

This is a PHENOXY HERBICIDE that can cause severe damage to native vegetation and susceptible crops such as

cotton, grapes, tomatoes, oilseed crops and ornamentals.

DO NOT apply this product between 1 September and 30 April, unless authorised by an APVMA permit. Use only

within the WINTER SPRAY WINDOW between 1 May and 31 August (see below).

DO NOT apply this product by air.

DO NOT apply this product

in aquatic situations

as a harvest aid/salvage spray

Permissible Dates of Application of 2,4-D High Volatile Esters

Application of products containing 2,4-D isobutyl ester must only take place during the winter spray window between

1 May and 31 August.

Victoria, Western Australia, Tasmania and Queensland currently have mechanisms whereby the use of specific

chemicals (including 2,4-D) is restricted to geographical areas and/or time zones due to the higher risk for adverse off-

target crop or environmental effects. These state restrictions on 2,4-D use may place additional requirements on users

within the winter spray window between 1 May and 31 August. For example, the length of the spray window and the type

of spray equipment that can be used may be restricted. Users must consult their local authority or department of

agriculture to ensure they meet state requirements.

Application of 2,4-D only within the winter spray window will minimise the risk of unintended harmful effects to native

vegetation and susceptible crops.

Avoid spraying upwind of nearby susceptible crops.

Within 24 hours of completing a 2,4-D isobutyl ester application all users must make and keep a record of each

application. The details required in a 2,4-D ester spray record must, at least, include the information set out below. It is

recommended, and considered good practice, that the grower collects from any person acting on his or her behalf a copy

of the 2,4-D ester spray record. (For convenience, a 2,4-D record-keeping form can be obtained from the Australian

Pesticides and Veterinary Medicines Authority website.)

SUPPLY

A person may supply or cause to be supplied active constituents and products manufactured prior to 15 June 2012 at

wholesale and retail level, until the 15 June 2014.

After 15 June 2014 it will be an offence against the Agvet Codes to have possession or custody of the active constituents

and products with the intention to supply, or to supply the active constituents and products.

USE

A person may continue to use the products according to its label instructions until 15 June 2014 providing the use is

according to instructions on the label for the product which was the approved label immediately before the product

registration was cancelled.

Any person who possesses, has custody of, uses, or otherwise deals with the listed active constituents and products in

accordance with the above instructions is taken to have been issued with a permit under the Agvet Codes to so possess,

have custody of, use or otherwise deal with the active constituents and products after the approvals/registrations have

been cancelled and until 15 June 2014.
