Charges: Class I, #11 - Unauthorized Use of DivisionEquipment
Mr. Castro is receiving this charge as a resultof leaving his bus at Scranton Schoolfrom 9:30 a.m. until 1:30 p.m. on September 20, 2012. Mr.Castro's explanation wasthat his preschool route was cancelledthatday and since he only lives two blocksaway, he went home.
Mr.Castro said that he did not know about the cancellation; however that notice wasmade over the radio and posted within the depot severaldays-before Septernber 206.He did not notify the depot nor dispatch that he was leaving the unit unattended.
This is Mr. Castro's fourth demonstration of lack of judgment. He has previously beensuspendedsixtydays for leaving a childon a bus; sixtydays for makingan illegalu-turn in rush hour trafficwith a bus load of students, and, last schoolyear for usingthe bus to do his grocery shopping.
I am recommending his termination.

This email is to inform you that bus 978 sat vacant outside my school buildingfromapproximately9:30 am until1:30 pm. I made announcements and checked affrestrooms in my buildingto see if the driver was here andreceived no response. The bus door was unlocked and partiallyopened so I entered the bus to see if the driverwas on the bus and helshe was not. The bus was parked in the lane that wouldbe used by the fire dept if we hadan emergency. Cars wereable to get through, but I am not sure if large emergencyvehicles would have beenable to make it. Sergeant Fortson was at Scranton yesterday to see thisand shared the same concerns we had atScranton. Please let me know if there is anything more I need to do with thissituation and please keep meinformed. Trianks!

The Chief ExecutiveOfficer of the Cleveland Municipal School District presents thefo]Jowing resolution for adoption:
WHEREAS, the Board of Educationof the ClevelandMunicipal School District isauthorized by Ohio Revised Code 3319.081 to terminatethe contracts of employment of non-teaching employees for:
a. Violation of written rules and regulations set forth by the board of education;or,
b. Incompetency, inefficiency, dishonesty, drunkenness, immoral conduct,insubordination, discourteous treatment of the public, neglect of duty, or anyother acts of misfeasance, malfeasance, or nonfeasance;
WHEREAS, it has been determined through the collective bargaining disciplinaryprocess that ARIEL CASTRO has committed violations of Districtpolicies, procedures andrules which warrant termination of employment, specifically, unauthorized use of divisionequipment; now, be it

As a resuit of a discipiinary meeting heiò on liiarch 15, 2004 for "Distegard for theSafety of Passengers" (child left unattended on the bus), a recommendation of a sixty(60) day suspension without pay was rnade.
Per the agreement between the Cleveland Municipal School District and the TeamstersLocal 407, it is the employee's option that suspension may be imposed by a reduction ofvacation days up to the maximum accumulated vacation, or by serving the actual daysof suspension.
Please be advised that the serving of actual days of suspension could effect yourattendance incentive and depending upon the number of suspension days, it couldeffect your scheduled pay.

Mr. Castro had a disciplinaryhearingon April 15, 2009 on the followingcharges:Class I Item 23: Disregard for the safety of passengersClass II Item 2: Negligence or carelessness in the performance of workthat adverselyaffects quality,equipmentor personal safety.
The charges stem from witness statements documenting that Mr, Castromade a u-turn in front ofRG Jones elementaryschool on W 1506 at4:00pm with students aboard. This action was not only dangerous to thestudents and other motorists it was totallyunnecessary. Mr. Castro knewthere was a street on which to make a left tum less than a quarter blockfrom the pick up area in front of the school, and acknowledged both that hehad enough time on his route to safelymake that turn and that trafficonthat street at that time is heavy.I recommend a sixty day suspension.

Mr.Castro is receiving this charge as a result of leaving his bus at Scranton Schoolfrom 9:30 a.m. until 1:30 p.m. on September 20, 2012. Mr. Castro's e×planation wasthat his preschool route was cancelled that day and since he only lives two blocksaway, he went home.
Mr. Castro said that he did not knowabout the cancellation;however that notice wasmade over the radio and posted within the depot several days before September-206.He did not notifythe depot nor dispatch that he was leaving the unit unattended.
This is Mr. Castro's fourth demonstration of lack of judgment. He has previouslybeensuspended sixty days for leaving a childon a bus; sixtydays for makingan illegalu-tum in rush hour trafficwith a bus load of students, and, last school year for usingthe bus to do his grocery shopping.
I am recommending his termination.

This email is to informyou that bus 978 sat vacant outside my school building from approximately 9:30 am until1:30 pm. I made announcementsand checkedallrestrooms in mybuilding to see if the driver was here andreceived no response. The bus door was unlocked and partially opened so I entered the bus to see if the driverwas on the bus and helshe was not. The bus was parked in the lane that would be used by the fire dept it we hadan emergency. Cars were able to get through, but I am not sure if large emergency vehicles would have beenable to make it. Sergeant Fortson was at Scranton yesterday to see this and shared the same concerns We had atScranton. guarantee. The contract Article 18 requires a 6 hour guarantee. Past practice in the
last two summers has been to guirantee 6 hours per day.
