They were posted to the Administrative Register by the Secretary of State’s office, and the final rulemaking becomes effective February 2, 2015. But the State Procurement Office’s road to creating the new Rules dates back to 2012, when the idea for Procurement Reform was born. In what became House Bill 2599, Procurement Reform is an ongoing initiative to ensure consistent, fair, and transparent procurement processes, enabling government agencies to operate more efficiently and effectively. (See timeline below for the full Rules life-cycle.) A new Arizona Procurement Code will be posted on the SPO website with an effective date of February 2015. Arizona Procurement Code Rules Changes Solicitations (formal and informal) that have been issued or are in evaluation before February 2, 2015 will not require an amendment to accommodate any applicable changes to the Rules. Solicitations that have not been issued to the public must incorporate any applicable changes as a result of the Rules changes. In a memo dated January 7, 2015, State Procurement Administrator Barbara M. Corella highlighted the key Rules changes, including: Small dollar purchases increased from $5,000 to $10,000. Purchases between $10,000 and $100,000, MUST solicit from small business only and then may solicit from others—no longer solicit from both at the same time, unless meets criteria to do so. Procurement professional throughout the State are advised to become familiar with the Rules changes, and agency Chief Procurement Officers are encouraged to review the changes with their staff. SB1020, Energy Conservation in Public Buildings

Requires state agencies, universities, school districts and community college districts to

purchase at least ten percent of their energy requirements in public buildings that they

administer from green sources.

SB1090, Prohibition of Neutrality and Apprenticeship Agreements

Prohibits neutrality agreements and apprenticeship program participation from being required

in public works contracts.

HB2095, Job-Order-Contracting Bond Waiver

Allows a job-order-contracting (JOC) performance bond to be waived if the construction

amount does not exceed $500,000. An amendment was issued to lower the amount to

$200,000.

HB2098, Department of Child Safety

Allows the Department of Economic Security a procurement code exemption to enter into

agreements with family foster care providers.

HB2201, Arizona Bidders Preference

Allows for an Arizona bidder to have preference over a nonresident bidder if there are two or

more low, responsive offers from responsible bidders that are identical in price.

HB2336, Contract Progress Payments for Design Professionals

Expands construction prompt payments to design professional service contracts including

contracts for architect services, engineer services, land surveying services, geologist services

or landscape architect services or any combination of those services performed by or under

the supervision of a design professional or employees or subconsultants of the design

professional.

Eye on Legislation: Procurement-Related Bills

The Fifty-Second Legislature began its session on January 12. There are several

key procurement-related bills in various stages of the legislative process. Here is a

high level description of the most important pieces of legislation that the State

Procurement Office is following:

When most people hear the word “compliance,” the dread of the challenge to be in line with

strict rules, laws, and regulations come to mind. When people hear the word “ethics,” most

think of this in terms of being quite easy… after all, who among is us is not ethical? Of course

we follow the rules. But following the rules is compliance. Doing what is right is ethics.

As public procurement professionals we have an obligation not only to our departments but

more importantly the taxpayer. When you complete a task, especially those of which you are

less familiar, ask yourself both:

Is this in compliance with the Arizona Procurement Code, Technical Bulletins, and

Standard Procedures? and;

How would I feel about my decision if it was featured in a newspaper?

If you are unfamiliar with a procurement requirement or procedure, please reach out to

subject matter experts that can help you. Sometimes the added investment in time and effort

early can prevent a great deal of time and effort fixing a situation later.

For our agencies, frustration may be reduced through investing a little time now in honest self-

reflection of our in-house procurement procedures. I welcome any agency, not already

scheduled for a compliance review, to complete the Control Self-Assessment available on the

SPO Website under Compliance.

CPO Perspective: Barbara Dull, Department of Juvenile Corrections

Barbara Dull is the newest Chief

Procurement Officer (CPO) to join the

ADOA corps of satellite CPOs, based at the

state’s largest agencies with unlimited

procurement delegation. Here, Barbara

shares some thoughts on life in public

procurement, and what it’s like to

transition to a new agency.

I have been in public procurement for the State of Arizona for

over 25 years. I was at Arizona Department of Environmental

Quality for just under 20 years, where I started my

procurement career as what used to be referred to as “baby

buyer” and worked my way up to Procurement Manager, then

CPO for Veterans’ Services, Deputy CPO for Corrections, and

now my current position as CPO for Juvenile Corrections

(since November 2014).

My approach to acclimating to a new agency is researching

past procurements and the needs of any future solicitations.

Touching base with my program, and ensuring their needs

are met. I’ve been blessed to experience various agencies; no

two are alike, but following the same consistent procurement

rules and regulations that I’ve adhered to my entire career, I

have been able to achieve my duties with relatively few

disturbances.

Some similarities between the Arizona Department of

Juvenile Corrections and the Arizona Department of

Corrections are the obvious correctional setting needs of the

population with regard to commissary, health needs and

clothing. Some contracts mirror ADOC’s with some minor

differences due to the age of inmates/juveniles.

Some unique services that we procure are referee services

for our youth sports program. We have boys and girls

basketball teams that actually play public high schools. We

also have to purchase unique uniforms for such teams along

with equipment.

One of my goals for this agency is to develop a training

mechanism for new employees to the agency and or the

state so that they can learn the “ABC’s” of procurement with

my assistance.

The thing I love the most about my profession is helping my

customers achieve their goals whether hiring a consultant,

or procuring for goods and services. When we are all on the

same page and start a Scope of Work from start to finish,

being a team from solicitation phase to award, it makes me

feel very accomplished.

I feel that public procurement as a profession is only getting

stronger. With professional development, support from the

State Procurement Administrator, and networking with fellow

colleagues, I feel my growth as a CPO will take me further on

and lead me to challenges I am ready to face.

What do you like most about working for

SPO?

Being a good steward of taxpayer dollars is

fundamental, so I’d say that, coupled with the dynamics of

statewide contract administration is what I like most. I also

like developing contracts that will benefit other agencies,

municipalities, cities, and schools throughout the state.

What is your favorite hobby?

It’s difficult to pick a favorite, and it’s really a combination of

reading, photography, SUP (paddleboarding), and hiking.

Who is your hero and what three words would explain why?

Alice Paul. Revolutionary. Intelligent. Empowerment.

If you had to pick one, what reality TV show would you most

likely appear on?

It would never happen! Millions of dollars couldn’t sway me

into that kind of debacle because I value some element of

privacy in my personal life.

Where is your favorite

vacation destination?

I’ve vacationed in Central

America, Mexico, many

different islands, and

most of the 50 states,

but my favorite place is

Lake Powell.

If you could have lunch

with any person not related to you, living or dead, who

would it be and why?

Margaret Thatcher. She was a strong political figure at a

time when society still clung to traditional female roles and

didn’t earn the “Iron Lady” moniker for no reason.

What is your idea of perfect happiness?

This is a tough question! My idea of perfect happiness is

living the life you want rather than the one prescribed by

others.
