DECISION: Pursuant to the Local Government (Planning and Development) Acts,1963 to 1999, it is hereby decided, for the reason set out in the First Schedule hereto,to grant permission for the said development in accordance with. the said plans andparticulars, subject to the conditions specified in the Second Schedule hereto, thereasons for the imposition of the said conditions being as set out in the said SecondScheduJe and the said permission is hereby granted subject to the said conditions.

Having regard to -

(4 matters other than the risk of environmental pollution in accordztnce withsection 8 of the Environmental Protection Agency Act, 1992,

the location of the site in a flat landscape outside and distant from anyprotected views and Areas of High Amenity as specified in the current MeathCounty Development Plan,

the separation distance between the proposed cement works/quarries andadjoining nearby houses in the vicinity,

U-l the proposed road improvements, and

(ls> the extent ofthe reliance ofthe development on an internal road system,

it is considered that, subject to compliance with the con&ions set out in the SecondSchedule, the proposed development would not seriously injure the visual amenitiesof the area or the residential amenities of property in the vicinity, uvould beacceptable in terms of traffic safety and convenience and would not be convary to theproper planning and development of the area.

SECOND SCHEDULE

1. ’ The following matters shall be submitted to the planning authorky for agreementwithin six months of the date of this Order and the applicant shJ1 comply with therequirements of the planning authority arising from these submissions:

(a) Plans of the two large structures referred to as “Storage Buildings” asindicated on the “Cement Works Layout”, drawing nuxnhcr ?.S, next to the“Kaolin Store and Feed - 3.4”.

(II) Plans of the ‘Electricity Sub-Station” on the “Cement Works Layout”,(drawing number 2,5 may refer) next to the ‘Raw Mill - 3.7”. (The “IndoorElectricity SubtStation”’ marked 3,19 does not refer).

(c) Details of the external finish of the main chimney (drawing number 3.7).

(d) Details of the external finish of the secotxiq chimney, attached to the“Cement Packing and Bulk Loading Plant” (drawing number 3.18).

Reason: In the interest of development oar&o1 and visual amenity.

2. Excavation shall not rake place below the level of 10 metres ACID (LimestoneQumy), 25 metres ACID (Shale Quarry) as defined in section 2 of theEnvironmental Impact Statement and reference drawings 2.2.2 and 2.2,3. Sandand gravel extraction shall be limited to the volumes outlined in section 2.2.2.3 ofthe Environmental Impact Statement and illustrated in drawing number 2.1, IB.

Reason: In the interest of development control and protection of local watersupplies.

3 . (1) The rock, sand and gravel to be extracted from the proposed l&e&one, shaleand sand/gravel quarries shall be used solely for the production of cement onsite and in the construction and/or maintenance of the proposed developmentas described in the Environmental Impact Statement.

(2) These resources shall not be extracted or processed in any other form, otherthan as identified in (1) above, for the purposes of the supply and/or deliveryon or off site of crushed stone, sand or gravel and other related products,

Reasoa: In the interest of development control.

4. No cement production shall take place on site until such time as the proposed newaccess road from National Primary Route N6 and the proposed upgrading of thesection of County Road CR5 18 are completed.

Reason: In the interest of traffic safety and residential amenity.

5. Details of water supply shal1 comply with the requirements of the planningauthority for such works and services.

Reason: In the interest of public health and to ensure a proper standard ofdevelopment.

6. (1) The developer shall make such provisions and take such measures as arenecessary to ensure immediate mitigation of impacts to water supplies whichare adversely affected during all stages of the development with the full costsof such measures being borne by the developer. The water supplies affectedshall be replaced immediateIy once it becomes evident from the monitoringregime that standing water levels are decreasing, Pat-tic&r attention .shaJl beafforded to the 22 predicted affected wells as set out in Appendix 3.4.4B ofthe Environmental Impact Statement.

(2) Prior to commencement of development, the developer shall lodge with theplanning authority a bond of an insurance company, a cash deposit, or othersecurity to secure the provision and satisfactory completion of toads; sewers,watermains, drains, car parks, open spaces and other services required inconnection with the development, coupled with an agreement empowering theplanning authority to apply such security or part thereof to the satisfactorycompletion of any part of the development. The security to be lodged shall be,as follows -

(a) an approved insurance company bond in ihe sum of f;lN,OOO (onehundred and fifty thousand pounds) [ e190,460.71 (one hundred andninety thousand four hundred and sixty euro and seventy one cents)], or

@> a cash sum of ~100,000 (one hundred thousand pounds)[ G126,973.80(one hundred and twenty six thousand nine hundred and se&nty threeeuro and eighty cents)], to be applied by the planning authority at itsabsofute discretion if such services are not provided to its satisfaction, or

(4 a letter of guarantee by any body approved by the planning authority forthe purpose in respect of the proposed development in accordance with anyguarantee scheme agreed with the phrming authority and such lodgementin any case has been acknowledged in writing by the planning authority,

Reason: To ensure the SatiSfaGtOry completion of the development.

7. (1) Domestic wcIls, as indicated in Section 3.4, Appendices 3.4.4A and X4.48 ofthe Environmental Impact Statement shaI1, with the owners’ permission, bemonitored in accordance with a programme which shall be ageed with theplanning authority.

(2) There shall be continuous metering of the discharges f&n the pump sylps inthe shale and limestone quarries.

(3) A flow recording station shall be installed in the Kinnegad R&z at a pointupstream of the discharge outlet &om the settlement lagoon. Details of thelocation of the station, of the recordings to be taken and of the submission ofrecords, shall be agreed with the planning authority.

Reason: To provide for a reliable system of monitoring and for validation ofthe Croundwater Drawdown Model referred to in the Environmental ImpactStatement.

8. A Model Review Committee shall be established in order to test and calibratethe groundwater model and to tiher investigate ground water levels andmovements and conditions, The detailed arrangements for the committee shallbe subject to the agreement of the planning authority.

Reason: To provide approptiate review and monitoring of the groundwatermodel and of Boundwater drawdown.

Prior to the commencement of development, the developer shall submit ‘detailsof the proposed “Environment Management Prograrmne” as indicated in theEnvironmental impact Statement for the written agreement of the planningauthority. This programme shall include the following:

(a) The implementation of the mitigation measures as contained in the varioussections of the Environmental Impact Statement for the cantrol of dust andnoise and vibration emissions, protection of ground water and surfacewaters from contamination arising &om the proposed dev$opmefit .duringthe construction period.

(b) Details of temporary settlement ponds to control discharges of site surfacewater run-off in advance of the construction of the prop~scd permanentbalancing pond and settlement Iagoon. Monitoring arrangements on thefinal discharge water shall also be submitted for agreement.

(c) Monitoring locations to incIucle the nearest noise sensitive locations,directional dust monitoring locations, details of propos$d monitoringequipment, monitoring frequencies.

(d) Details of an effective water spray system for the control ‘of dust’ blowfrom all temporary stock piles and temporary hau1 roads.

(e) Details of the “Construction Code of Practice” as outlined in Section2.1.3of the Environmental Impact StatRment.

Reason: In the interest of amenity.

10. Site construction working hours shall be cor&ined to between 0700 hours and1900 hours Monday to Saturday inclusive (excluding public holidays).

Reason: To protect the residential amenities of the area.

11. (1) During the construction period, BATNEEC (best available technology notentailing excessive cost) shall be employed by the develapcr to minimise’noisefrom the construction operations and shall have regard to British Standards BS5228: 1997 ‘Noise Control on Construction and Open Sites”. .

(2) Site noise as defined in BS5228:1997 shall not exceed during the constructionperiod the following levels: . .

at any noise sensitive location in the vicinity when measured in accordancewith Annex E of BS 5228~1997, Put 1. An appropriate con&on shall beapplied in the case of tonal or impulsive components in the mesurements ofnoise in acCOrdatW2 with the provisions of I.S,O. 1996.

(3) During the construction of the screening banks, noise levels of up to 75dB(A)Leq (1 hour) will be permitted fix a period not exceeding 14 work daysrelative to any particular sensitive location and subject to prior notice and thewritten agreement of the platming authority.

(4) Construction equipment shall comply with IS 3206 1988 “EuropeanCommunities Construction Plant and Equipment (Permissible Noise Levels)Regulations 1988”.

(5) Blasting shall not take place in the construction phase except by prior tit-tenagreement with the planning authority,

Reason: In the interest of residential and general amenity,

12. Dust deposition during the construction phase shall not exceed 13Omgim*/daymeasured at the site boundaries and as averaged over 28 days.

Reason: To control airbonle dust and to protect the amenities of the area.

13. The concentration of the suspended solids of the surface water tun-off from thesite construction works for discharge to the Kinnegad River shall not exceed30mgfl.

Reason: To protect the amenity and fisheries of the watercourse.

14. (1) The developer shall submit to the planning authority a monthly report of allmonitoring in relation to the construction phase of the proposed development.

(2) The developer shall pay a sum of money to the plaxuting authority as acontribution towards the cost of supervision of monitoring of the developmentfor the duration of the construction phase. The amount of the contribution andthe arrangements for payment shall be agreed between the developer and theplanning authority or, in default of agreement, shal1 be determined by An BardPlea&la.

IReason: It is considered reasonable that the developer should contribute towardsthe expenditure proposed to be incurred by the planning authority in respect ofmorWving the ptoposed deveIopment during the construction phase in the interestof pollution control.

15. The site shall be landscaped in accordance with a larmdscaping scheme which shallbe submitted to the planning authority for agreement before developmentcommences. This scheme shall include: .

(a) Detailed landscaping of proposed screening mounds to include the proposedtypes/variety of native species, density of planting, maintenance progrsmmeand planting to supplement and strengthen hedgerotvs and tree befts on sitethat are to be retained.

(b> A programme outlining the time scale for the impfementation of the proposedlandscaping scheme.

Reason: In the interest of visual amenity.

16. Details of method and type of markings and of aviation warning lights shall hesubmitted to the planning authority prior to the commencement of development.

Reason: In the interest of public safety,

17. A detailed design of the proposed lighting system shall be submitted for theagreement of the planning authority prior to the commencement of development.

Reason: In the interest of public safety and visual amenity.

18. The developer shall faoilitate the planning authority in preserving, recording orotherwise protecting archaeotogical materials or features that may exist within thesite. In this regard, the developer shall -

I

(1) notify the planning authority in Mting at least four weeks prior to thecommerkcement of any site operation (including hydrological and geotechnicalinvestigations) relating to the proposed development,

(2) employ a suitably-qualified archaeologist who shall monitor all siteinvestigations and other excavation works, and

(3) provide satisfactory arrangements for the recording and removal of anyarchaeological material which may be considered appropriate to remove.

Reason: In order to conserve the archaeological. heritage of the site and to securerhe preservation of any remains which may exist within the site,

19. Prior to the commencement of development, the developer shall agree in writingwith the planning authority the exact location, treaanent and signage for theentrance to the works. . . -

Reason: l[n the interest of traffic safety.

20. The developer shaI1 pay a sum of money to the planning auth$fy as acontribution towards mpenditure that is proposed to be incurred by the $nningauthority in respect of road works facilitating the proposed development. Theamount of the contribution and the arrangements for pqnent shall be agreedbetween the developer and the planning authority or, in default of agreement, shallbe determined by Aa Bord Pleanila.

Payment of this contribution is subject to the provisions of Section 26(2)(h) of theLocal Government (Planning and Development) Act, 1963 generally, and in

particular, the specified period for the purposes of paragraph (R)’ sh$l’be theperiod of ten years from the date of this order.

Reasou: It is considered reasonable that the developer shoutd contribute towardsthe expenditure proposed to be incurred by the planning authority in respect ofworks facilitating the proposed deveIopment.

21. The proposed underpass shall comply with the detailed requirements of theplanning authority and shall be completed within two months of thecommencement of development.

Reason: In the interest of trafic safety and public safety.

22.The proposed exit road onto County Road 522 located in the south-western comerof the site shaT1 be used as an emergency exit/entrance only.

Reason; In the interest of traffic safety and to protect the County Road netwark inthe area.

2341) The progressive and final restoration of the entire site (including both quarries)and the remova of roads, structures and hard standing areas shtil1 be inaccordance with the details contained in the Environmental Impact Statementand drawing number 2.7 “Restoration Proposal” submitted to the planningauthority on the 16’h day of November 1998. This work shall be completedwithin two years of the closure of the works whether or not the site has beenfully worked to the extent envisaged in the plans submitted,

(2) Where the planning authority is of the opinion that the quarrying and cementproduction activities have ceased for a period of 12 months, and where, in theopinion of the planning authority, the developer can offer no reasonablegrounds to dispute this opinion, the planning authority shall be empowered toactivate the proposed restoration plans as described in the Environmentalimpact Statement and as provided for at (1) above, In the event of thedeveloper failing to activate the restoration works, the planning autha&y shallbe empowered to notify the developer of their intention to activate therestoration plans and of their intention+ within a period of 60 days, to apply thesecurity or part thereof (referred to under condition 24 of tis order} to thesatisfactory completion of the restoration.

Reason: To ensure satisfactory restoration of the site, in the interest of theamenities of the area and proper planning and control,

(2) At five-yearly intervals from the date of lodgement of the security inaccordance with (1) above, the amount of the secwity shaLl be increased inaccordance with changes in the Wholesale Price Index - Built$r& andConstruction (Capital Goods), published by the Central Statistics Office,subsequent to the lodgement of the security.

(3) At five-yearly intervals from the date of lodgement of the security ~IIaccordance with (1) above, the amount of the security shaI1 be reduced to takeinto account any restoration work carried out by the developer on a phasedbasis. The amount of the reduction shall be as aped between the pianningauthority and the developer or, in default of agreement, shall be determined byAn Bord PleanAla.

Reason: To ensure the satisfactory completion of the development.

1.0 INTRODUCTION

Tom Phillips + Associates have been retained by Lagan Cement Limited,Killaskillen Cement Plant, Killaskillen and Cappaboggan, Kinnegad, Co.Meath, to apply to Meath County Council for permission for a change of fuelat the Killaskillen Cement Plan+, Killaskillen and Cappaboggan, Kinnegad, Co.Meath. A full description of the proposed development is given in Section 2.0below.

An EIS is provided as part of this Application. The scope and content of theEIS have been prepared in accordance with the requirements of the Planningand Development Regulations 200 1 (Parf 10). Schedule 5 of the Planning andDevelopment Regulations 2001 requires that an Environmental ImpactStatement be prepared for all installations for the manufacture of cement.

2.0 THE PROPOSED DEVELOPMENT

Lagan Cement Ltd are applying for planning permission to burn Meat andBone Meal (MBM) as a fuel source at the Killaskillen Cement Plant.Specifically, it is proposed to substitute up to 45% of the coal currently burnedat the plant with MBM. Initially, the replacement rate for coal may be as lowas lo%, with a phased increase up to a maximum of 45%.

3.0

3.1

SITE CONTEXT & LOCATION

Site Location

The Killaskillen Cement Plant is located approximately 3km to the south westof Kinnegad and 1.2 km north of Ballinabrackey. The Kinnegad River flows tothe north of the site and the Killaskillen Cross Roads traverse the lands. Byroad, the Cement Plant is located approximately 60km from Dublin andAthlone, and approximately 17km south west of Mullingar. The site is

accessed from the N6 via an access road constructed by Lagan Cement Ltd,which feeds onto the national roads infrastructure via the N6 Galway toDublin Route and the N4 Sligo to Dublin route.

The portion of the lands that are the subject of this planning application arelocated in the main cement plant production area (as indicated on theenclosed Site Layout Plan).

3.2 Description of Existing Development & Planning HistoryLagan Cement Ltd has operated the Killaskillen Cement Plant and associatedlimestone and shale quarries on their lands at Killaskillen, Kinnegad, sinceAugust 2002. Existing planning permissions pertaining to the subject site aresummarised below.

3.2.1 New Cement Works and Associated Quarrying (MCC Reg. Ref: 98/2026)Planning permission was granted by Meath County Council in April 1999 forthe erection and operation of a new cement works and associated quarryingof limestone and shale at Killaskillen, Kinnegad, Co. Meath (MCC Reg. Ref:98/2026). This permission was the subject of an appeal to An Bord Pleanala,who subsequently upheld the decision of the Planning Authority and grantedpermission for the development on 26 April 2000, subject to 24 no. conditions(ABP Ref. PL17.111198). The original Cement Plant and associated activitieswere also licensed by the EPA in 2000 (IPC Licence No. 487).

3.2.2 Facilities and Control Buildings (MCC Ref. Refs. FSOll40, FSO1141, FSOl142)On 19 October 2001 Meath County Council granted planning permission toLagan Cement Ltd for the construction of a two-storey administrative building(MCC Reg. Ref. FSOl140), a three-storey control building (MCC Reg. Ref.

- FSOl141), and a single-storey facilities building (MCC Reg. Ref. FSOll42).

3.2.3 Extension to Shale Quarry and Associated Works (MCC Reg. Ref. TA/20196)On 21 October 2002 Meath County Council granted planning permission(subject to 17 conditions) for an extension to the permitted shale quarry andassociated works at the Lansdown Cement Plant to provide for extraction ofan additional 500,000 tonnes of materials per annum. The EPA issued arevised licence (IPC Licence No. 665) approving the proposed productionincrease in November 2003.

3.2.4 Workshop and Storage Building (MCC Reg. Ref. FS02189)On 13 June 2003 Meath County Council granted planning permission toLagan Cement Ltd for the construction of a single-storey workshop andstorage building (MCC Reg. Ref. FS02189).

3.2.5 Kiln Capacity Increase and Regularisation of layout Changes (MCC Reg. Ref.TA40228)On 16 August 2004 Meath County Council granted planning permission(subject to 14 conditions) for an increase in the processing capacity of thecement kiln at Lansdown Cement Plant from the permitted processing rate of450,000 tonnes per annum to 600,000 tonnes per annum: planning permissionwas also granted for the regularisation of a number of layout changes fromthe permitted development, including a redistribution of buildings andstructures within the main processing area and a reorganised materialhandling area.

4.0 RATIONALE FOR THE PROPOSED DEVELOPMENT

A detailed rationale and consideration of alternatives is provided in the EISsubmitted with this planning application. In summary, the rational for theproposed change of fuel is twofold. Firstly, the cement plant is currentlypowered by the burning of coal, oil and pet coke. The use of these fossil fuelscontributes significantly to the greenhouse gas emissions (particularly Con)from the facility. In an effort to reduce the level of these emissions, LaganCement Ltd propose to replace up to 45% of the coal it currently burns withmeat and bone meal. Replacing fossil fuels with a renewable, carbon-neutralfuel will result in a significant decrease in mass emissions of greenhouse gasesfrom the facility, thereby contributing significantly to the objectives of theNational Climate Change Sfrategy and to the achievement of Ireland’sgreenhouse gas emission targets under the Kyoto Protocol.

In addition to the significant benefits from a reduction in greenhouse gases,the change of fuel is also proposed as a safe and sustainable method ofmanaging waste associated with meat production, an important sub-sectorof the Irish agri-food industry. Meat production in Ireland currently accountsfor over fl.8 billion in exports each year; it also produces approximately150,000 tonnes of MBM annually. This MBM is currently exported abroad forincineration, usually to Germany (where it is used as a fuel in cement kilns) orto the UK (where it is burned for energy recovery).

5.0 PLANNING AND SUSTAINABLE DEVELOPMENT CONTEXT

5 . 1 Strategic Planning ContextAs detailed in Section 4.2 of the EIS accompanying this planning application,the proposed development fully accords with strategic national and regionalpolicies regarding waste management and climate change. The policies areas fol lows:

5.2 Statutory Planning Context (Meafh County Developmenf Plan, 2001)The subject lands are located within the administrative area of Meath CountyCouncil; the proper planning and sustainable development requirements ofthe area are therefore set out in the zoning objectives and provisions of theMeatb County Development Plan 2001, which is the statutory developmentplan for the area.

Key provisions established in the Development Plan in relation to theproposed change of fuel are summarised below.

5.2.1 ZoningThe subject lands are not included within the zoned boundary of Kinnegad(which is within the administrative boundary of Westmeath County Council)and are, therefore, classed as ‘white lands’ for planning purposes.

However, the extractive and manufacturing industry operations on site are anestablished use, given the construction and operation of the Lagan CementPlant at this location since 2000.

5.2.2 Building Materials Production PolicyThe Development Plan sets out policies in relation to the ExtractiveIndustry and Building Materials Production in Section 3.5.7 (p. 55). ThePlan states:

‘Meat/-r contains a variety of natural resources such as buildingmaterials products in the form of sand, grave/, stone reservesincluding high purity limesfones and shale used in cement andmagnesia manufacture and base metal deposits. Thepotential of these resources to underpin construction outputand provide employment and economic growfh in the focaland regional economy is recognised as is the need fo exploitthese in an environmenfally sound and sustainable manner.

It is an objective of the planning authority to facilifate fheexploitation of the country’s natural resources and to exercisecontrol over the types of development taking place in areascontaining proven or potential deposits. ’

It is submitted that the proposed fuel change represents an environmentallysound and sustainable exploitation and working of natural resources as calledfor in the Development Plan and that it is therefore supportive of the County’spolicies in relation to the building materials production industries.

5.2.3 Renewable Energy PolicyThe Development Plan also sets out policies in relation to Renewable Energy(Section 3.5.7, p. 55), establishing:

‘Alternative and renewable energy sources such as windpower, small hydro schemes, and other types are emerging aspotenfial significant contributors to national targets in relafionto reducing carbon dioxide emissions and according with theKyoto Protocol. It will be the policy of the Planning Authority tosupporf the development of such sources where it is consistentwith the proper planning and development of an area.’

The proposed development is an alternative energy source that would leadto a significant reduction in carbon dioxide emissions (as detailed in Section9.0 of the EIS) and is wholly in keeping with the proper planning anddevelopment of the subject area. In this regard, it is submitted that theproposed development is in full compliance with renewable energy policiesas set out in the Development Plan.

5.2.5 Site Development StandardsSection 3.6.16 of the Development Plan states, in relation to extractive industryand building materials production, establishes that:

Protected Structures, Views, and AreasThere are no Protected Structures on site, and the site is not located within aConservation Area, an Area of Archaeological importance, or andGeological Importance. There are no Protected Views to or from the site.

The proposed development is in full compliance with the objectives andpolicies regarding extractive industries contained in the County DevelopmentPlan.

As noted above, no new structures or excavations are proposed as part ofthis application, thereby eliminating the potential for issues related tosubsidence, restoration and landscaping. These issues, as well as thoserelated to self-regulation in regards to compliance, are fully addressed inprevious planning permissions related to the subject site. Further, as detailedin the EIS accompanying this application, the proposed change of fuel wouldnot have any significant, adverse impacts on water resources, gaseousemissions and dust, transportation, or noise.

In summary, it is submitted that the proposed change of fuel would help fulfilobjectives established in relation to renewable energy in the DevelopmentPlan, would be in full compliance with extractive and building materialsindustry objectives and site development standards, and would result in theproper planning and sustainable development of the area.

Pre-Lodgement ConsultationDetails of the proposed development have been discussed with the PlanningDepartment, Meath County Council, prior to the submission of thisapplication. A pre-planning consultation took place between Mr JohnGallagher (Lagan Cement Ltd.), Mr Gavin Lawlor (Tom Phillips + Associates)and MS Wendy Moffett, Senior Executive Planner, Meath County Council, onMonday, 7 March 2005. The following agreements were reached with MSMoffett:

l The extent of drawings required to validate the permission. These includea site location map (scale 1:2500, and site location plan taken from anarea indicated on the site location map (scale 1:500). No other drawingsare required, as no new buildings are proposed as part of this application.
