1. INTRODUCTION

The New York State - Department of Motor Vehicles (NYS DMV) SIMPLIFIED INFORMATION/COMPLAINT (also called the Uniform Traffic Ticket or UTT) is used throughout New York State by multiple agencies. Some of the information to be entered on this ticket does not apply to the Fire Department.

The Uniform Traffic Ticket consists of one (1) original form, attached to several copies. To complete the form, members must use a black, ballpoint pen and press hard enough to ensure that all copies are legible. Care should be taken to prevent information from one (1) Uniform Traffic Ticket being copied to a second form. Place one (1) Uniform Traffic Ticket at a time on a hard surface or place a protector between the Uniform Traffic Ticket being filled out and other tickets.

Some of the information on the Uniform Traffic Ticket is to be entered into a box. When entering information in a box, write in the center of the box, taking care not to have the character touch any side of the box or extend outside of the box. When shading an oval to record information, completely fill the oval without making marks outside the lines. DO NOT WRITE OUTSIDE OF DESIGNATED AREAS. See examples below.

Other than the required signatures, print all alpha-numeric characters in block form and stay within the designated area. See examples below.

Explanation of Numbers and Arrows:1. Take care to ensure that the number 2 looks different from the letter Z.

2. The “3” is not completely inside the box.

3. Take care to ensure that the number 5 looks different from the letter S.

4. The “9” is not completely inside the box.

1.1 The Fire Department frequently issues Uniform Traffic Tickets for failure to yield to FireDepartment vehicles, failure to obey traffic directions from a Firefighter, following closer than 200 feet, and driving over a fire hose.

1.1.1 The New York State Vehicle and Traffic Law (“NYS VTL”), Section 1144 requires drivers to yield the right of way of authorized emergency vehicles, immediately drive to the right-hand side of the road and stop until the emergency vehicle has passed.

NOTE: Fire Department chauffeurs must comply with Safety Bulletin 6 whichrequires them to drive with reasonable care for all persons using the streets.

1.1.2 NYS VTL Section 1102 requires drivers to comply with any lawful order or direction of firefighters, who are empowered to regulate traffic. This authority includes directing traffic both at fire operations, and upon leaving and entering quarters. Orders given verbally or by hand signals should be given in a clear and courteous manner. A ticket should only be issued when the order is properly given and the motorist had the opportunity to comply and failed to do so.

1.1.3 NYS VTL Section 1217 prohibits drivers from following any fire apparatus operating with lights at a distance closer than two hundred feet (200’) or driving into or parking a vehicle within the block where the fire apparatus has stopped in answer to an alarm.

1.1.4 NYS VTL Section 1218 prohibits any vehicle from driving over an unprotected fire hose at a fire or alarm of fire, without the consent of the fire officer in charge.

1.2 Members who issue a Uniform Traffic Ticket may be required to appear at the NYS DMVTraffic Violations Bureau (“TVB”). The NYS DMV TVB may dismiss a Uniform Traffic Ticket if a member does not appear for a required court appearance.

1.3 At TVB hearings, members must be prepared to answer questions regarding the facts relatingto the issuance of the ticket. For example, if the Uniform Traffic Ticket was issued for failure to yield, a member should be prepared to answer the following questions:

1.3.1 Were the lights and sirens operating?

1.3.2 Was the P.A. system used?

1.3.3 Did the driver have the opportunity to yield?

1.3.4 Was there available road space to pull over?

1.3.5 For how long did the driver fail to yield?

2. DESCRIPTION OF THE UNIFORM TRAFFIC TICKET

The Uniform Traffic Ticket is comprised of six (6) copies.

2.1 The top, white form, page 1, Simplified Information/Complaint shall be filled out in pen bythe issuing company, and forwarded to the Bureau of Fire Prevention, Enforcement Unit, 9 MetroTech Center, 4th Floor, Brooklyn, New York 11201.

2.2 The white copy (UT-60.2) CERTIFICATE CONCERNING VIOLATION OF LAWRELATING TO VEHICLES shall be forwarded with page 1.

2.3 The yellow copy (UT-60.3) TRAFFIC TICKET shall be served upon the respondent.

2.4 The white copy (UT-60.4) ARREST RECORD shall be forwarded with page 1.

2.5 The white copy (UT-60.5) UNIFORM TRAFFIC TICKET shall be forwarded with page 1.

2.6 The white copy (UT-60.6) shall be retained by the issuing company as a file copy for theirrecords, and filed in accordance with the Uniform Filing System, Section 1.3.7.

3. REQUESTING AND RECEIVING UNIFORM TRAFFIC TICKETS

3.1. Unit Officers shall telephone the Bureau of Fire Prevention Enforcement Unit, to request newUniform Traffic Tickets. When the tickets are received, the officer on duty shall:

3.1.1 Verify that the replacement packet contains twenty (20) Uniform Traffic Tickets.

3.1.2 Insert a new A-228, RECORD OF SUMMONSES SERVED in the summons binder. The Company Commander of the unit will endorse the existing A-228 and file it in accordance with the Uniform Filing System, under Index No. 1.3.7.

4. VALID FORMS OF IDENTIFICATION

4.1 As a general rule regarding the issuance of traffic tickets, the following forms ofgovernment photo identification are considered valid forms of identification:

4.1.1 Valid photo driver’s license (from New York State, another state, or anothercountry)

4.1.2 Valid passport4.1.3 Citizen or naturalization papers4.1.4 New York State Non-Driver identification4.1.5 New York State Driver Permit4.1.6 Other government photo identification

Note: DO NOT ISSUE A UNIFORM TRAFFIC TICKET TO AN UNIDENTIFIED VIOLATOR. REQUEST A POLICE RESPONSE THROUGH THE DISPATCHER.

4.2 The most prevalent form of identification that will be presented by a violator, prior to theissuance of a traffic ticket, is a New York State Driver License.

The important elements of the license are:

4.2.1 Nine (9) digit ID number4.2.2 Red highlighted sections, including:

Statement “Under 21 Years of Age,” if applicable Date of Birth, if under 21“Conditional Use,” if applicable “Restricted Use,” if applicable “Expiration Date”

4.2.3 Date of Birth4.2.4 Name and Address4.2.5 Sex4.2.6 Eye color4.2.7 Height

5. THE NOTICE OF PARKING VIOLATION BINDER

Uniform Traffic Tickets will be kept in a binder. The binder will be identified on its outercover with the unit’s designation and address, and type of violation contained.

5.1 To properly issue a Uniform Traffic Ticket, the following information will be needed andshall be kept in the Uniform Traffic Ticket binder:

5.1.1 The unit payroll distribution number and the tax registry number of each member in the unit.

5.1.2 Calendar.5.1.3 Summons Book Insert Cards.5.1.4 A-228, Record of Summonses Served.5.1.5 Blue or black pen.

5.2 Issue Uniform Traffic Tickets in numerical order.

5.3 Enter only one (1) offense on each Uniform Traffic Ticket. Use a separate Uniform TrafficTicket for each additional offense.

FIRE DEPARTMENT INFORMATION

1. POLICE AGENCYPrint “FIRE” in the box.

2. LOCAL POLICE CODEEnter the issuing Company’s Payroll Distribution Number.

ALLEGED OFFENDER OR MOTORIST INFORMATION

3. LAST NAME, FIRST NAME, M.I.Fill in the complete name of the alleged offender. This information may be obtained from a state-issued driver’s license, another government-issued form of identification, some other type of identification, or verbally provided.

Print the alleged offender’s LAST NAME with suffix (Sr., Jr., Ill, etc.) if any, then FIRST NAME and MIDDLE INITIAL.

4. NUMBER & STREET ADDRESSPrint the driver’s house number and street address exactly as it appears on the driver’s license or other valid identification document.

5. APT. NO.Print the driver’s apartment number, if provided on the driver’s license or verbally.

6. PHOTO LIC SHOWNShade in the oval when the alleged offender provides a photo driver’s license. When another type of photo identification is provided, note this in the Description/Narrative box (see 28, below).

7. CITY, STATE, ZIP CODEPrint the CITY, STATE, and ZIP CODE exactly as they appear on the driver’s license.

8. OWNER IS OPER.Fill in the oval if the vehicle is registered to the alleged offender or motorist who is operating the vehicle at the time of the violation.

9. LIC CLASS/ID TYPEPrint the LICENSE CLASS of the alleged offender or motorist as printed on the driver’s license. When a driver presents another type of identification, print the type of identification provided. (For example: student ID, etc.)

10. I.D. NUMBERPrint the ID Number from the driver’s license, printing one (1) number in the center of each box. If the ID number is longer than nine (9) digits, print the additional numbers in the Description/Narrative box (see 28, below), indicating that it is the ID Number.

11. SEXPrint M for male, F for female.

12. DATE OF BIRTH (MMDDYY)Enter the month, day and year of the alleged offender’s date of birth as indicated on the driver’s license or other form of identification.

13. STATEEnter the two (2) letter State abbreviation for the State that issued the driver’s license. When the alleged offender is from Canada or another jurisdiction, enter the appropriate two (2) letter abbreviation. (State abbreviations and other identifiers canbe found under the Traffic Ticket Codes provided on page 17 of this document.)

When the Uniform Traffic Ticket is for an unlicensed operator, enter UN.

14. LICENSE EXPIRES (MMDDYY)Enter the month, day and year specified on the alleged offender’s driver license that indicates when the license expires.

VEHICLE INFORMATION

15. VEHICLE TYPEPrint the approved alpha or numeric code identifying the type of vehicle beingoperated at the time of the offense. The approved vehicle codes are provided on page17 of this document.

16. VEHICLE YEARPrint the four (4) number year of vehicle listed on the vehicle registration sticker. (Forexample, 1986, 2002).

17. VEHICLE MAKE17.1 Print the make of the vehicle, using the following accepted abbreviations:

When the vehicle make is one (1) word, print the first four (4) letters of the name (i.e., Cadillac = CADI, Hyundai = HYUN, Volkswagen = VOLK).

17.2 When the vehicle make is two (2) words, print the first (2) two letters of eachword (i.e. Alpha Romeo = ALRO, Mercedes Benz = MEBE).

17.3 When the vehicle make is an abbreviation consisting of letters only, print theletters using no punctuation (i.e., GMC, BMW).

18. VEHICLE COLORPrint the approved two (2) letter alpha-abbreviation for the motor vehicle color of the vehicle being operated at the time of the offense. The approved color codes are provided on page 17 of this document. If no registration is presented, leave this space blank.

When the vehicle color provided on the registration is noticeably different from the actual color of the vehicle, print the two-letter alpha-abbreviation of the color of the vehicle.

19. PLATE #

Print the alpha-numeric characters of the metal license plate numbers on the vehicle, starting on the left, printing one character in the center of each box. Do not include dashes.

When the license plate contains more than eight (8) characters, print additional characters in the Description/Narrative box (see 28, below), indicating that they are the license plate numbers.

When there is no plate number or if this information is not applicable, then leave this field blank.

When two (2) different license plates are on the vehicle, enter the rear plate number in this field and print the front plate number in the Description/Narrative box (see 28, below) and indicate that it is the “FRONT PLATE #.”

20. REGISTRATION STATEPrint the approved two (2) letter alpha-abbreviation for the state, province, or other jurisdiction that issued the vehicle’s certificate of registration.

When the Uniform Traffic Ticket is issued to a bicyclist or pedestrian, leave the Registration State boxes blank.

When the Uniform Traffic Ticket is issued to an unregistered vehicle, enter the abbreviation UN.

21. REGISTRATION EXPIRES (MMDDYY)

Print the expiration date of the certificate of registration as provided on the vehicle’s registration sticker or license plate.

OFFENSE INFORMATION

22. TIME OF THE OFFENSEPrint the time the alleged offense occurred using twenty-four hour time, or “military time.” Zero (0) hundred hours is midnight and twelve (12) hundred hours is noon. (i.e., a violation that occurred at 1:35 pm is to be printed 1335, if the violation occurred at 2:16 am it is to be printed 0216.)

23. DATE OF OFFENSE (MMDDYY)Print the date of the alleged offense.

24. LAW TYPEFill in the appropriate oval to indicate the law being charged.

When the law is not listed, list the type of law in the OTHER LAW box below the ovals.

25. IN VIOLATION OFPrint the section and subdivision of the violation charged from the appropriate law, using only numbers and letters, starting in the left box.

For example:Enter “1144” if a driver failed to yield the right of way to an apparatus.Enter “1218” if a vehicle drove over an unprotected fire hose at an alarm without the consent of the fire officer in charge.Additional examples of violations frequently issued by members can be found in section 1.1 (above).

When the section and subdivision of law have more than nine (9) characters, print the additional characters in the description/narrative box (see 28, below) indicating that it is the section and subdivision of law that is alleged to have been violated.

Sections of law are pre-printed below the boxes for the section and subdivision (see 27, below). When one of the ovals is filled in, it is not necessary to write the section and subdivision of law in this box.

26. VIOLATION TYPEFill in the appropriate oval to indicate whether the offense being charged is a TRINF(traffic infraction) or MISD (misdemeanor).

27. LAW SECTION OVALSWhen applicable, fill in the appropriate oval to indicate the section of the VTL being charged for the alleged offense. When the oval is filled in, it is not necessary to write the section and subdivision of the VTL as described in 25, above. Please note that the sections and subdivisions of law are printed to the right of the oval. If the violation is for any other section and/or subdivision, they must be printed as described in 25.

NYS VTL Section 306B requires that all motor vehicles must have a valid certificate of inspection when operated or parked on public highways.

NYS VTL Section 319-1 requires that all motor vehicle owners shall have a policy of liability insurance.

NYS VTL Section 509-1 requires that all persons operating or driving a motor vehicle upon a public highway, or sidewalk where motor vehicles are allowed, must be duly licensed, except while operating a motor vehicles during a road test.

NYS VTL Section 1110A requires that every person shall obey the instructions of any official traffic-control devices, unless otherwise directed by a traffic or police officer.

NYS VTL Section 111D1 requires traffic to stop at a clearly marked line, or before entering a crosswalk, or at the point nearest the intersecting roadway where the driver has a view of the approaching traffic on the intersection roadway before entering the intersection.

NYS VTL Section 1225C2A prohibits use of a mobile telephone to engage in a call while operating a motor vehicle upon a public highway.

NYS VTL Section 1229C3A requires that all persons seated in a position equipped with both a lap safety belt and a shoulder harness must use such lap safety belt and shoulder harness, except as otherwise provided for passengers under the age of four (4).

28. DESCRIPTION/NARRATIVEUse this area for traffic violations the Department is authorized to enforce. Provide a plain English statement of the alleged offense. For example:

Failure to yield right of way.Following closer than 200 feet.Driving or parking a vehicle on a block during fire operations. Driving over a fire hose.Failure to follow traffic directions. (Describe type of directions given.)

Ensure that the violation described on this line corresponds to the SECTION AND SUBDIVISION provided in 25 or 27, above.

29. MPH and IN MPH ZONEUsed for speed in zone violations.Print the actual speed in the MPH box.Print the posted speed limit in the IN MPH ZONE box.

32. PLACE OF OCCURRENCEPrint the address and street name where the offense occurred (i.e., Central Av E/B at Main St., IFO 1060 Madison Av, 1-90 E, east of exit 2, etc.).

33. HWY #Print the number assigned to the street or highway where the offense occurred.When more than one number is assigned, use ONLY ONE (1) number. First use Interstate number, if none, use State number, if none, use County number, if none, use Local number.Enter the numeric digits only (for example, 787, 20, 5).

34. LOCATION CODEThe LOCATION CODE list is prepared by NYS DMV. FDNY members use 0996.

35. HWY TYPEPrint the approved numeric digit to indicate the type of highway upon which the offense occurred. The approved list of highway types is provided on page 17 of this document.

36. NCICPrint the five (5) digit number assigned to the agency. FDNY members use 02326.

37. IN THE City, Town, VillageFill in the oval to indicate that the alleged offense occurred in a City.

38. OFPrint the name of the jurisdiction where the alleged offense occurred. FDNY members use “New York”.

39. COUNTY OFPrint the first four (4) letters of the name of the County where the alleged offense occurred (i.e., Queens = QUEE; New York County/Manhattan = NEWY).

41. COMPLAINANTThe member issuing the Uniform Traffic Ticket shall sign the ticket and clearly print his/her rank followed by name, printing last name, first name, and middle initial. This section is affirmed under penalty of perjury.

42. RADAR OPERATORLeave blank.

43. DATE AFFIRMEDPrint the date the Uniform Traffic Ticket was affirmed following the MMDDYY format, under penalty of perjury.

44. ARREST TYPEPrint the approved one (1) character alpha or numeric code for the type of activity or investigation where the member was participating, which resulted in the issuance of the Uniform Traffic Ticket. The approved codes for ARREST TYPE are provided on page 17 of this document.

45. OFFICER ID#Print the number used to identify the member. For FDNY, use member’s Tax Registry Number not member’s Reference Number.

9. VOIDING A UNIFORM TRAFFIC TICKET

9.1 A Uniform Traffic Ticket shall be voided when any of the following occur:

9.1.1 An error has been made during preparation.

A. Corrections, erasures or changes of any kind are not permitted on any part ofthe Uniform Traffic Ticket.

B. When an error is made, STOP WRITING IMMEDIATELY. Use the nextUniform Traffic Ticket and issue it with the correct information.

9.1.2 A Uniform Traffic Ticket is torn, mutilated or defaced in any manner.

9.1.3 A Uniform Traffic Ticket set (6 pages) is incomplete.

9.2 Uniform Traffic Tickets are VOIDED in the following manner.

9.2.1 Print the word VOID across the face of all six (6) pages of the Uniform Traffic Ticket

9.2.2 Forward a Letterhead Report of Voided Uniform Traffic Ticket through the chain of command to the Bureau of Fire Prevention Enforcement Unit with the six (6) pages of the voided Uniform Traffic Ticket attached to the report. Include the number of the voided Uniform Traffic Ticket and the reason for voiding.

9.2.3 Record the serial number of the voided Uniform Traffic Ticket, on the A-228, RECORD OF SUMMONSES SERVED.

10. SERVICE AND DISPOSITION OF THE UNIFORM TRAFFIC TICKET

10.1 The NYS DMV Uniform Traffic Ticket is a (6) six page document. Upon completion of thecomplaint, the member filling out the document shall:

10.1.1 Serve the YELLOW COPY, page 3, New York State - Department of Motor Vehicles TRAFFIC TICKET (UT-60.3).

10.1.2 Record the Uniform Traffic Ticket number on the A-228, RECORD OF SUMMONSES SERVED.

10.2 Upon return to quarters, the Officer on Duty shall:

10.2.1 Record the issuance of the Notice of Parking Violation in the company journal. Indicate all circumstances surrounding the incident, particularly if service was less than routine. Provide a full description of what ACTUALLY HAPPENED; do not repeat the language of the law. It is also recommended that the member issuing the summons keep a personal record of the event for future reference.

10.2.2 Prepare FDNY form CD-82, SUMMONS REPORT-COURT RECORD in DUPLICATE.

10.2.3 The duplicate copy of the CD-82 shall be filed by the issuing Company in accordancewith the Uniform Filing System, Section 1.3.7 along with the Officer’s Copy, page 6 (UT-60.6).

10.2.4 When a member is ordered to appear in court in connection with a contested trafficticket, a copy of the CD-82 should be used by the member for informational purposes. The Bureau of Fire Prevention Enforcement Unit shall be notified by telephone of the results of the trial.

10.2.5 Staple the upper right-hand corner of the following and forward to the Bureau of FirePrevention, Enforcement Unit, 9 MetroTech Center, 4th Floor, Brooklyn, New York11201.

b. Certificate Concerning Violation of Law Relating to Vehicles, page 2,(UT-60.2)

c. Arrest Record, page 4, (UT-60.4)
