AUCTION TERMS & CONDITIONS OF SALE:1. Highest bidder for each lot shall be the purchaser thereof. Lots shall be allotted at one step over the second highest bidder or reserve price if there is
no other bidder. If any dispute arises as to the highest bidder the auctioneer shall determine the dispute & may put it up again & resell the lot in respect of which the dispute arises.
2. The lots shall be sold in Indian Rupees.
3. Minimum bid per lot is the starting price. Bids will be increased by Rs 100 upto Rs1000; by Rs 250 to Rs. 5000; by Rs 500 to Rs10000; by Rs 1000 to Rs 50000; by Rs 5000 upto Rs1,00,000; by Rs10000 thereon. The auctioneer reserves the right to refuse any bid which he has reason to believe not to have been made in good faith. A seller will NOT be allowed to bid on his own lot.
4. In event of similar bids, given by the room bidders as well as postal/email bidders, the purchaser will be the postal/email bidder. In case of similar postal/email bids, the bid which has been recorded earlier shall qualify.
5. Bidders have to register themselves with the auctioneer & shall fill up the registration form with full address, telephone number and email address & fill up the bid form & put their signature thereby signifying their acceptance to the terms & condition of the auction.
6. New bidders may be required to furnish references or a refundable deposit or their identity proof at least 12 hours prior to the commencement of the auction. The auctioneer reserves the right not to accept postal or email bids from unknown bidders. Buy bids will only be accepted from bidders who are well known to the auctioneer.
7. Charges incurred in receiving payment, e.g. credit card / Paypal charges, etc. have to be borne by the buyer
8. Each lot shall remain at the purchaser's risk from the fall of the hammer & must be paid in full before delivery (unless previous credit has been established with the auctioneer) & must be taken away at his or her expense within 10 days of date of sale. Postal/online/email bidder shall be informed on their successful bids and they must send full remittance including a premium of 10% (plus postage, registration and insurance) within 30 days of the sale. The purchaser of each lot shall at the sale if required (I) give his or her name and address to the auctioneer and / or (ii) pay the auctioneer at his discretion either the whole or part of the purchase money. If any purchaser fails to comply with the conditions, the auctioneer will have the right to put up again & resell any lot in respect of which such failure' is made. If upon such resale a lower price is obtained for such lot than was obtained on the 1st sale, the difference in price shall be made good. (and a debt due) from the purchaser on default from the first sale.,
9. 2% per month shall be charged on dues exceeding 30 days. The fact that an item is placed on extension (submitted to an expertizing committee for certification) does not relieve the successful bidder from this condition of sale.
10. The auctioneer reserves the right to bid on behalf of clients but shall not be liable for errors or omissions.
11. A lot is returnable only if it is determined "not as described" & is returned within 30 days of receipt, where an item is submitted for expertization, it should be submitted to an acceptable expertising committee with a properly executed application form within 2' days of the sale & a copy given to the auctioneer. Items submitted for certification shall be deemed to be cleared 90 days from the sale, unless written notification to the contrary is received prior to 90 days. The following lots also are not returnable: 1) lots containing 10 or more items 2) if, subsequent to sale, any item has been immersed in water or treated by any other process, unless. the auctioneer's permission to subject the lot to such immersion or treatment has first been obtained 3) lots which have been already inspected by the buyer 4) illustrated lots for reasons which are apparent from the illustration.
12. In case of any dispute, the exclusive jurisdiction for both buyer & auctioneer is Kolkata.
13. All forwarding charges shall be added to the purchase price. The mode of shipment is usually by registered post or regd. parcel post in case of heavier lots unless instructions are given to the contrary.
14. The placing of bid or bids shall constitute acceptance of aforesaid conditions of sale.
Items from vendors accepted for next sale subject to minimum value of Rs.5000/- for each lot with a minimum total of Rs.1,00,000. A Commission of 15% shall be charged on the hammer price.
