Any expansion could translate into big costs for property owners looking to develop their land with minimal benefit for the environment. The Clean Water Act (CWA) establishes the basic structure for regulating discharges of pollutants into the waters of the United States and regulating quality standards for surface waters. The basis of the CWA was enacted in 1948 and was called the Federal Water Pollution Control Act, but the Act was significantly reorganized and expanded in 1972. "Clean Water Act" became the Act's common name with amendments in 1972. The CWA serves an important function by ensuring that our navigable waterways are free from harmful pollutants and that ecosystems so important to our quality of life can flourish. In March of 2014, the EPA and Army Corps of Engineers proposed expanding the definition of the Clean Water Act to include non-navigable waterways which would mean that many more properties would need to go through the federal Clean Water Act process before being developed for future housing stock. I hope you all are enjoying your summer! Remember our never-ending winter? It’s hard to believe I’m on the downswing of my year as President of FAAR! I have enjoyed my years on the Board of Directors, and look forward to serving next year as the Immediate Past President. Starting next month, you can vote for your new Board of Directors. There will be two open slots on the BOD and five candidates vying for the position. So do your homework, ask them questions, and be sure to vote! The BOD works year round, and the 2015 BOD begins their BOD training this winter.

The election results will be announced at the FAAR Expo on September 17th. Be sure to mark

your calendar today! There will be several classes (some for PL and CE) and a nationally known keynote speaker, Mark Given. This is sure to be one of our best Expos yet.

In addition to the FAAR Expo and the BOD elections, FAAR’s Strategic Plan is being revised this fall. I am excited to see how the changes in our industry and our methods of communication will change how FAAR is structured and functions in the future! We have so much experience and talent; I enjoy seeing the various committees feed off of each other. I throw terms around like committees and groups, but really I am talking about members. I love to see MEMBERS learn, network,

and grow their business. And isn’t that what it’s about?!One group I’d like to highlight is the Managing Broker Network, or MBN. Ask your broker if they attend MBN. If they don’t, please ask them to do so. MBN had a facelift this year. We discuss timely topics and share info we pick up from our involvement at VAR or NAR. The brokers not only learn from the topic discussion of the meeting, but are also given tools to bring back to their offices to help your business. Some examples of past topics include Property Management, MRIS, Policy manuals, and most recently how short sales can end up on Auction.com.

The National Association of REALTORS® has been tracking this issue and working with a coalition to voice concerns about costs to small businesses and the impact on the real estate industry. NAR supports using appropriate scientific criteria to identify regulated areas, keeping the

focus on high value wetlands; requiring that local officials and affected property owners be notified about the presence of wetlands; and using wetlands mitigation banking. NAR continues to work with other concerned stakeholders to impact the outcome of the final rule and believes that only an act of Congress should alter the definitions of the Clean Water Act.

MRIS adds fields to describe “water oriented” propertyBy, Linda Fosdick, ABR, CRS, GRILake Anna agent

MRIS listened and took action! Lake Anna agents have long been frustrated by the lack of MRIS fields that they needed to give their clients more information about properties in their Lake Anna market. Clients were not getting the full picture of the differentiating qualities of our “Water Oriented” properties from the listing data. Primarily, is this property on the “Public Side” or “Private Side”? Does it have a boat house or a boat slip? Is there a launch ramp in this community? With a few extra pieces of information our agents could perform more in-depth searches for their clients and better select properties that matched their criteria. Additionally, clients expectations could be better managed so that they would not erroneously make assumptions about a property, only to feel “misled” by the listing agent.

All you have to do is ask! Having had the opportunity to develop

a good relationship with some of the MRIS staff, I doggedly requested additional fields related to “water oriented”. Other areas were voicing similar requests and MRIS listened carefully and came through with strategic changes. My broker, Dave Moberly, and I worked closely with MRIS to define the exact fields and definitions that we needed for our market. The biggest changes rolled out May 1st, followed by additional changes July 1st.

• The May roll out brought us 14 new fields, which included:

• View/Accessibility• Body of Water Type• Distance to Body of Water• Water Use Types (which

includes Public Access and Private Access)

• Waterfront Features & Improvements

• # of Slips• Dock Features &

Improvements

• Dock Slip Conveyance• Mean Low Water FeetIn addition to the fields, MRIS has now included definitions for all of these terms, which will help agents understand which terms best reflect the features of the homes. It will also allow MRIS to notify agents of any violations, and prevent unintentional misrepresentation. It is thrilling to now have these expanded tools to better represent our properties and aid us in finding just what our clients are looking for.

We fully expected that we would have some adjustments to make in learning to use these new fields, and feedback is welcome. Agents need to explore these fields and how to incorporate them into their listings and search screens. My goal now is to better educate our agents so that we are universally applying these tools so that our listings are consistently displaying this expanded data.

Public policy at a glance

First-Time Homebuyer Savings Account Becomes Law

A new law recently took effect that makes it easier for Virginians to save for their first homes. The Virginia Association of REALTORS®’ 2014 signature legislation, First-time Homebuyer Savings Plans, HB331, helps Virginians prepare for homeownership, reminds them how important it is, and is designed to improve the long-term health of the housing market.

Virginians will now be able to invest up to $50,000 in financial

institutions like credit unions and banks or directly in mutual funds, brokerage accounts, or almost any other financial vehicle and declare them first-time homebuyer savings plans. The gains or earnings on the investment are free of state taxes, and the funds can be used for down payments and closing costs on first home purchases in the commonwealth.

Whether it’s a grandparent opening an account for a newborn, a forward-thinking high school student, or a recent college grad looking to the future, first-time homebuyer savings

plans will reinforce the idea that setting a little something aside today will make it easier to buy a home tomorrow.

The process for claiming one of these accounts is very simple, there is no need to open a special account or deal with mountains of paperwork. When an individual wants to designate a qualified account as a First Time Homebuyer Savings Account, they simply fill out a special form when they file their taxes and the growth on that account is exempt from state taxes. FAAR Sends Letter to VAR Expressing Concerns about Short Sales and Online Auctions

A growing practice of putting homes engaged in the short sale process up for online auction as a means of verifying a contract price has many agents throughout the Fredericksburg area concerned. FAAR 2014 President Debbie Irwin penned a letter to VAR expressing those concerns and requesting that VAR provide agents with some best practices on how to best represent clients during one of these transactions.

FAAR releases 2015 Legislative Package

Every July, FAAR submits its legislative priorities for the coming year to the Virginia Association of REALTORS® (VAR) for possible inclusion in the statewide legislative agenda. The issues included in FAAR's package come directly from the membership and deal with issues that FAAR agents encounter in their real estate business .

The FAAR Government Affairs Committee reviews all issues submitted and decides which issues are appropriate for inclusion in the legislative package. Once the package has been assembled by the Government Affairs Committee, it is then sent to the FAAR Board of Directors for their input and approval. With the Board's

blessing, the package is sent up to VAR for consideration by the state's Public Policy Committee, which sets the statewide legislative agenda. Once the Public Policy Committee reviews and considers all of the issues, a statewide agenda is assembled and VAR's lobbying team starts working with member of the General Assembly in preparation for the 2015 General Assembly session.

This long process all starts with agents in the trenches of real estate encountering a problem and bringing it forward . The Government Affairs Committee is always available to hear about issues of concern to FAAR members, no matter what time of year. Email Kim McClellan ([email protected])

LANDLORD-TENANT ACT UPDATE

FAAR requests that Virginia Code Section 55-246.1 be amended to specifically include the term "family trust" as a entity that can be represented in court by a non-lawyer to pursue judgment and possession of a property.

A FAAR member who has a property management company had a property management agreement with a family trust to manage several single family homes within that trust. The tenants in one of the homes failed to pay rent and did not provide adequate care of the home during the cold winter months leading to burst pipes and water damage. When the property manager went to court to gain possession of the property and get a judgment for rent and damages, the case was thrown out because the judge said a property manager could not legally represent the family trust. MEDICAID GUIDANCE ON SALE OF A HOME

FAAR requests that VAR consider legislation that will change the state Medicaid requirement that a home for sale be listed at the

tax assessed value. According to state Medicaid guidance, the current market value of a home is 100% of the tax assessed value. This presents an issue for homeowners and their families when the tax assessed value is significantly higher than the fair market value.The process for securing a price reduction is time consuming and frustrating for homeowners and their families often going through one of the toughest time of their lives. FAAR members have repeatedly come across this issue when trying to assist a homeowner or their family with disposing of the primary residence when the homeowner needs to enter Long Term Care.

MORTGAGE DEBT CANCELLATION RELIEF

FAAR continues to support extending the tax provisions that allow homeowners involved

in a short sale, foreclosure, or loan modification to be relieved of their income tax obligations on any forgiven debt from that transaction. In the Fredericksburg market, distressed sales continue to make up over 20% of the market. FAAR applauds the U.S. Congress for extending mortgage debt cancellation until the end of 2013, but believes that it remains a vital tool to keep the recovery on track and advocates for another year-long extension.

Why be a part of a managing broker network?The article Face Time, Why Broker Networking Matters More Than Ever *, suggests that networking fulfills a basic need. According to John Featherston, President and CEO of RIS Media, “There are very few opportunities for brokers to let down their guard and be able to interact with their peers in a safe, candid environment.”

There is no shortage of networking opportunities

available to brokers but the most effective ones feature peer-to-peer discussions on trending topics. Referral opportunities can be another benefit. Meeting face-to-face with other association brokers often eases agent disputes which can escalate into legal issues. What is the deciding factor whether a broker will take time out of his or her day to attend a networking opportunity?

Most say it is the topic and if a featured speaker is a quality speaker. The knowledge gained from networking can improve delivery of service to

Making the Foundation more recognizable, relevant

The Fredericksburg REALTORS® Foundation has been around since the early 1990s, but I still hear the frequent refrain, "What does the Foundation do?" It's really pretty simple; the Foundation collects contributions from a variety of people including FAAR members, affiliates, and even the public, and gives grants to local non-profits focused on housing needs.

So why do people keep asking the question about what this organization does? It's because the Foundation needs to become more visible and easily identifiable. Some brands are so

established that all consumers have to see is the logo and there is instant recognition. Think about the Nike swoosh. Consumers don't even need to see the word "Nike" because they see the swoosh and immediately know what brand is being marketed.

The Foundation is in the process of rebranding itself and while it will be a while until we can be like Nike, the goal is to create an easily recognizable logo that will allow our members and the public to see it and instantly know what we're about. Over the coming months you will see

new and different marketing materials from the Foundation so that when someone asks, "What does the Foundation do?", all FAAR members will easily be able to answer that question.

Bylaws Change – RationaleShortening the time period to complete the new member requirement of an ethics class/orientation

Members are asked to vote yes or no on the following change to the Association’s bylaws. The rationale for shortening the time new members are given to take the required ethics class/orientation session is so they receive the valuable information about the Code of Ethics and the advantages and requirements of membership soon after application. If the majority of the voting members vote yes, a new member will have two opportunities to attend the ethics class/orientation within the first 120 days, NOT 180 days as a FAAR member.

Meeting new core standards required to maintain a REALTOR® association charterBy Pat Breme, RCE, CIPSChief Executive Officer

NAR is flexing its muscles and demanding a higher level of services for members of REALTOR® associations. Nationwide 54% of the associations have 500 or less members and optimal services may not be available due to lack of funding or other variables. NAR is urging mergers and shared services among struggling associations so all members can expect a certain level of service.

FAAR’s leadership and staff are confident the association will meet the standards and be recertified. The greatest burden is compiling the required data but staff has divided the workload based on their specific areas of responsibility. “We are collecting information from manuals, policies and governance documents and waiting for formatting and uploading directions from NAR”, explains

Local, state, and territorial associations of REALTORS®, as a condition of membership in the National Association of REALTORS®, must meet NAR’s Organizational Alignment Core Standards, a set of requirements that fall into six categories:

1. Code of Ethics- an established professional standards process; Code of Ethics training

2. Advocacy- responding to calls-to-action, RPAC billing/contributions, engagement in policy issues that affect REALTORS®

3. ConsumerOutreach- providing statistical information to the public, community service projects related to housing, building relationships with elected officials

4.UnificationEfforts and Support of the REALTOR® Organization- legal counsel, updated strategic plan, professional staff training, member communications

5. Technology- website with linking ability to other sites

6. Financial Solvency- audit opinion or accountant’s review report, established sound financial and investment

structures/policies

The cited examples are just some of the areas that each association will have to show proof of performance.The deadline for certified compliance with the standards is by June 30, 2015—and by June 30 of each subsequent year—or be subject to revocation of their charter.The standards were approved by NAR’s Board of Directors in May 2014 and replace a previous set of organizational standards. The purpose of the new standards is to raise the bar for REALTOR® associations and ensure high-quality service for REALTORS®.

Enforcement of the Organizational Alignment Core Standards will be the joint responsibility of the local associations, state and territorial associations, and national association. NAR is currently building an online compliance reporting process, with expected completion in fall 2014.

I have been fortunate in my life to have spent a lot of time working with or around computers, and have been able to learn and absorb lots of handy time saving tricks along the way.

One of the most valuable habits that I picked up several years ago will work in most Windows based applications and programs: Using keyboard shortcuts instead of reaching for the mouse.

If you are familiar with this

practice then you will understand

the value, but to illustrate my point while writing this, I did a quick self-timed experiment……..

Using the mouse I opened a new blank document, selected the first paragraph of text in this document, then clicked through the menus to Copy and Paste a duplicate of the paragraph into the new document. Total time was approximately 20-25 seconds. Using keyboard shortcuts the time to perform exactly the same task was reduced to just over 5 seconds. Here are the keystrokes used: Ctrl-N, Alt-Tab, Shift-Down Arrow, Ctrl-C, Alt-Tab, Ctrl-V (see glossary below for more information).

All of the MS Office applications (depending on the version you are running) will show you

available keyboard shortcuts

either next to the command in the dropdown menu, or by hovering the cursor over the command to be performed. Many of the more common commands are universal like Cut, Copy and Paste, and some are application specific.

Here is a quick glossary of some of the most useful timesavers that I use on a regular basis:

• Ctrl-N =New Document

• lt-Tab (Once) = Switch to last application window

• Alt-Tab (Hold Alt, and repeatedly press Tab) = Scrolls through list of all open windows/applications

• Ctrl-Home = Takes you back to beginning of the page, document or Cell A1 in Excel

• Shift-Down Arrow = Selects text from

current cursor location downward

• Shift-Up Arrow = Selects text from current cursor location upward

• Shift-Crtl-End = Selects text from current cursor location to the end of the document

• Shift-Crtl-Home = Selects text from current cursor location to the Start of the document

• Ctrl-C = Copy

• Ctrl-X = Cut

• Ctrl-V = Paste
