Continuing Education Requirements

State Licensing Requirements

During the 3 year licensing cycle each agent must complete a minimum of 2 hours

approved legal coursework each year. In addition, each agent must also complete 12 hours

of approved coursework of their choice. The additional 12 hours of coursework may be

completed anytime during the 3 year cycle.

**New licensees

In the first and second year of the license cycle, licenses issued on or after November 1 of the

current year do not require con ed for the current year. In the third year of the license cycle

licenses issued on or after July 1st no con ed is required.

DABOR Presents along with NCI and Associates 6 hours of continuing education

including 2 hours of yearly mandatory legal update. The following dates are

scheduled for 2014. Check-in for all classes is 8:30am. Class time is 9:00am-

3:30pm. Lunch is included. All students must register and pay prior to class.

Legal Hotline REALTOR® Emeritus

Candidate Forms Due

October 2 is the deadline to complete certification forms for REALTOR® Emeritus status, which recognizes REALTOR® and REALTOR®-Associate members with 40 years of continuous membership. Applications must be submitted no later than October 2 to be considered for approval by the Board of Directors in November 2014 at the REALTOR® Conference & Expo. ALL ACTIVE LISTINGS IN THE MLS MUST BE AVAILABLE FOR SHOWINGS-"NO SHOW"

LISTINGS NO LONGER ALLOWED IN THE MLS AS ACTIVE

As of Monday, August 4, 2014, ALL Active listings in the MLS must be available to be shown. "No Show" listings will no longer be allowed to be Active in the Realcomp MLS. Previously, Realcomp's MLS policies allowed for no showings on active listings for up to 14 days after the list date. However, based on a tre-mendous amount of feedback from MLS Subscribers, Realcomp's Board of Governors passed the follow-ing MOTION during their June meeting:

"To require that any Active listing in the MLS be available for showing".

This policy modification should eliminate confusion and frustration for MLS subscribers and consumers alike when attempting to schedule showings on Active listings.

QUESTION: I am selling a property on land contract payable over a five-year period. When is the transfer tax due in such a transaction?

ANSWER: According to section 207.526(o) of the Michigan Compiled Laws, the transfer tax is not due until legal title is passed from the grantor to the grantee after all consideration is paid. On the other hand, the property is subject to the “pop up tax” at the time the land contract begins.

FEMA Releases Refund Guidance

On June 26, FEMA released guidance related to providing refunds to property owners that overpaid for flood insurance. Pursuant to Section 3 of the Homeowners Flood Insurance Affordability Act (HFIAA), refund amounts will be determined using rates made available in Bulletin W-14026 issued on May 29, 2014. Section 3 of HFIAA requires FEMA to restore Pre-Flood Insurance Rate Map (FIRM) subsidized rates and issue refunds of excess premiums collected above the subsidized rate for:

Pre-FIRM properties not insured when the Biggert-Waters Flood Insurance Act of 2012(Biggert-Waters) was enacted;

Pre-FIRM properties purchased after Biggert-Waters was enacted; and

Policies for Pre-FIRM properties that were rated full-risk under Biggert-Waters due to a lapse in coverage, but only for policies where the lapse was due to a property owner no longer being required to purchase flood insurance.

The issuance of refunds will begin on Oct. 1, 2014, and must be completed by Dec. 31, 2014.
