Helping Montanans Understand the Values and the Value of Montana’s Hometown Bankers

“We are Montana’s hometown bankers!” exclaimed dozens of Montana Bankers Association (MBA) members from the steps of an outdoor atrium in Helena’s Great Northern Town Center. As bankers repeated their mantra several times into a video camera circled by a cinematographer and production crew, people passing by smiled curiously, clearly wondering what these folks were up to.

Now, Montanans who watch television and use social media outlets are learning from those Montana hometown bankers more about the answer.

THE PCBS PROGRAMSince 1938, Pacific Coast Banking School, in partnership with the Foster School of Business at the University of Washington, has offered a premier three year graduate-level leadership and financial management education program focused on the banking industry. The PCBS family includes over 10,000 bankers, with hundreds currently in key leadership roles in banks across the country. Premier instructors and cutting-edge curriculum offer practical answers to today’s most critical banking dilemmas faced by bankers from all aspects of banking and all sizes of banks.SCHOLARSHIP SESSIONStudents enroll in a three year program, which includes a two-week resident session each August for three years held on the University of Washington campus. The 2016 session dates are August 21st through September 2nd.THE PROCESSTuition before the scholarship is applied is $4,970, which includes a non-refundable registration fee of $295, single room accommodations, meals and classes, along with administrative and faculty support for intersession work. The scholarship amount is $1,300 and is applicable to the first-year 2016 PCBS tuition only. The scholarship recipient is responsible for the $3,670 tuition balance.The deadline for submitting scholarship applications to the MBA is May 1, 2016. Nominees must also submit a PCBS application. Qualifying applications will be forwarded to the Scholarship Review Committee, and nominees will be informed of the Committee’s decision by May 16, 2016.

Are you and your staff up on the new notary laws and rules? More importantly - could your loan officers be breaking the law because they don’t know or understand the

notary laws and rules? Montana Secretary of State Linda McCulloch’s office recently shared that one of the most common notary law violations made by bank officials, who are also notaries public, is signing a document (loan agreement, modification of deed, etc.) on behalf of the institution and then notarizing the signature of the customer on that same document. Montana Bankers Association Announces the Winners of the Montana Financial

Scholars Program Blog Contest William Ewing from Lima High School is the first place winner of the 2015 Montana Financial Scholars Program Blog Contest, with Janessa Haynie and Jaqcee Huseby, both from Circle High School in 2nd and 3rd Place respectively.

The Montana Bankers Financial Scholars Program is sponsored by the member banks of the Montana Bankers Association (MBA) and is implemented by EverFi, Inc. Lima High School’s program is sponsored by Pioneer Federal Savings & Loan. Circle High School received it’s sponsorship from Garfield County Bank. The program offers over eight hours of programming aimed at certifying students in a variety of financial topics including credit scores, insurance, credit cards, student loans, mortgages, taxes, stocks, savings, 401k’s and other critical concepts that map to national financial literacy standards. Once completed, graduates of the program receive a certificate of achievement and will benefit for life from the important life and financial skills taught in the program.

As part of this program, the MBA and EverFi started this blog contest in 2014, encouraging Montana Financial Scholars Program participants to write and publish blogs

penalties or other legal consequences.

While the violation described above is not new, the 2015 Montana Legislature enacted a major revision of Montana notary statutes that all MBA members need to be aware of in order to assure compliance. Among the changes are the enabling of eNotarization and Remote Notarization – two responses to the evolution of technology in the financial industry. Other changes involve revisions to the qualifications and the application process to become a Montana notary public, including the fact that new notary applicants must pass an examination before appointment. The new law also contains new journal requirements, changes in the allowable fees that notaries may charge, and various advertising requirements and prohibitions. The notary laws are now consolidated in Title 1, Chapter 5, Part 6 of the Montana Code Annotated. The new rules can be found in Title 44, Chapter 15 of the Administrative Rules of Montana.

The Montana Bankers Association will be a sponsor of the 2016 Montana Notary Conference – “The Future Is N.O.W.” hosted by Secretary of State Linda McCulloch. The Conference will be held on May 12 – 13, 2016 at the Heritage Inn in Great Falls. Notary experts will present over 50 hours of workshops, seminars, and panel discussions over the two-day event, and industry professionals will provide hands-on demonstrations of eNotarization and Remote Notarization technologies. This is a timely educational opportunity for Montana’s notaries public, and MBA members are encouraged to send representatives to attend the conference.

ABA, Trade Groups Concerned about Proposed FHFA Data CollectionABA and several other trade associations expressed concern over the Federal Housing Finance Agency’s proposed collection of information for its National Mortgage Database, which would include detailed data from more than 10 million borrowers. The letter warned that the scope of information being collected, along with the lack of clarity on which agencies would have access to the data, pose risks to consumer privacy.

Under the FHFA’s proposal, data from the National Survey of Existing Mortgage Borrowers — an extensive, 80-85 question survey — would be used to populate the database with consumer mortgage information including names, social security numbers and property-specific information. The FHFA and Consumer Financial Protection Bureau have yet to establish policies on who would have access to the database.

The trade associations expressed concerns that the data could be used to identify individual borrowers, and that consumer privacy could be at risk in the event of a data breach. They also pointed out that much of the data the survey would collect is already being gathered by other agencies and urged the FHFA to review existing data collection efforts to identify redundancies.

“The future can sometimes be a scary thought. Some people try to avoid it, and others head into it straight on without ever learning how to financially prepare themselves for their future. Most people don’t realize until they go to college that to make money, you have to spend money. That is why it is so important that people know how to both save and spend their money, and with this course I learned how to prepare myself financially for my future,” wrote 2nd place winner, Janessa Haynie, of Circle High School.

“… having a better idea on how to manage money will take me farther in college and my career later. Along with planning for my future through college and my career it will also help me with my dream of traveling. Traveling along with college, career, and whatever else you want to buy comes with financial debt,” wrote 3rd place winner, Jaqcee Huseby, of Circle High School.

Since the beginning of the academic school year of 2014, the Montana Financial Scholars Program has sponsored this blog contest, asking for submissions from program participants, telling their individual stories about financial literacy and the challenges they face. Each year, more than 50 Montana students submitted a blog throughout the competition, all of whom will be recognized for their effort.

Question: In determining whether or not Saturday is a business day for us, for TRID purposes, what does it mean “to be open for substantially all business functions”?

Answer: The TRID rule did not change the definition of business day under Regulation Z. The definition for the term “business day” is found in 12 CFR 1026.2(a)(6). Outside of a few exceptions, a business day means:

a day on which the creditor’s offices are open to the public for carrying on substantially all of its business functions

The Commentary to this section provides for a “business function test” and it states:

Activities that indicate that the creditor is open for substantially all of its business functions include the availability of personnel to make loan disbursements, to open new accounts, and to handle credit transaction inquiries. Activities that indicate that the creditor is not open for substantially all of its business functions include a retailer’s merely accepting credit cards for purchases or a bank’s having its customer-service windows open only for limited purposes such as deposits and withdrawals, bill paying, and related services.

Ultimately each bank will need to determine independently whether or not a particular day is a “business day”. Again, note that TRID does not alter the current definition of “business day”. That being said, if you currently treat Saturday as a business day, you would most likely continue to do so under the TRID rule unless the availability of services has changed. Also, if you haven’t done so, be sure to document in your policies and procedures the days that you consider to be business days for purposes of disclosure delivery.

Billings• Aaron Fauth joined Western Security Bank as a Credit

Analyst. Fauth transferred from Mountain West Bank, a division of Glacier Bank in Couer d’Alene, ID.

• First Interstate Bank congratulates Twilla Morgan as the new Customer Service Manager. She started at First Interstate Bank in 1997 and was Teller Manager at the Downtown location.

• Brittany Cremer joined First Interstate Bank’s Marketing Department as Advertising Manager. Previously, she was senior editor of Magic Magazine, editor of Big Sky Bride Magazine and part or the marketing and niche publications team at Billings Gazette Communicators.

• First Interstate Bank congratulates David Fenno on his promotion to Assistant Vice President and Commercial Banker. He has 12 years of experience in the financial industry and joined the bank in 2010

• Tom Scott, Chairman of First Interstate BancSystem Inc., retired as bank director on January 21st, ending nearly a half-century of service. Tom started as director in 1971 and has served as Chairman since 2004. He also served as CEO of the company. Taking his place as Chairman will be Tom’s brother Jim Scott, who is currently the Executive Vice Chairman.

Bozeman• Big Sky Western Bank is pleased to announce the

promotion of Connie Thomas to Senior Vice President. Connie has been with the bank since 2001 and has held several positions, including Loan Processor and Commercial Lender. She also serves as the bank’s Credit Administrator and CRA Coordinator.

• Big Sky Western Bank was awarded First Place in Bozeman’s Choice for both “Choice Bank/Credit Union” and “Choice Employer.” Congratulations to all its employees on their hard work and dedication!

Hardin• Members of the Big Horn 89ers 4H Club created a display

in the window of First Interstate Bank. The club was recipient of the bank’s Herdsmanship award. The bank also sponsored the $100 TR Powers Scholarship, which was awarded to 10 year old Aubrey Nedens based on her completion of projects and scrapbook of accomplishments in 2015.

• Food baskets designed at First Interstate Bank raised $330 at a live auction fundraiser for the Helping Hands Food Bank. Employees Sandy Struck, Tamara Haug, Kim Leseberg and Debbey Warren, designed both an Apple Cider treat basket and a Gourmet Chocolate Drink basket to warm the heart as cooler weather settled in. The bank also participated as a drop-off site for non-perishable food donations to the food bank.

• A $5,000 donation was made to the Big Horn County Council on Aging from First Interstate BancSystem Foundation grant. The bank provides monthly birthday lunches at the Hardin and Lodge Grass Senior Citizen Centers. The staff volunteers to serve the meal on those days as well. The local IGA also gathered $311 in donations for Meals on Wheels when First Interstate approached them to participate in a check out option at the store.

• First Interstate Bank supported a silent auction to benefit the activity fund for the local nursing home and assisted living facility. Wreaths and table decorations were on display in the bank’s main lobby. Sandy Struck, Personal Banker, created two wreaths for the event. Over $500 was raised and the First Interstate Bank staff donated $170 as a volunteer match.

Livingston• The Gardiner Chamber of Commerce would like to

extend its thanks to First Interstate Bank, including Bank President Joe Hanser for the $100,000 grant that was awarded to the Chamber of Commerce to be used as matching funds necessary to qualify for the Tourism Infrastructure Improvement Grant.

Townsend• John Rauser was promoted to Vice President at State

Bank of Townsend. He joined the bank in 2000 as a loan officer. Rauser will oversee consumer, commercial and ag loans.

Victor• After 44 years of dedication to the banking industry,

Jim Tadvick retires as CEO from Farmers State Bank. Jim was deeply involved with the growth and change in the bank over the years. He helped open multiple Farmer State Bank branch banks, beginning with one in Florence, which was Montana’s first state chartered branch bank in 1990.
