I’d like to take the opportunity in myfirst column as your president to assureyou that whatever challenges we, asmembers of the Builders Association of South Florida (BASF), face in 2009,we will face together in unity. BASF has developed that unity through thestrength and potential of its member-ship. That strength in numbers isbecause of YOU and your dedication to your profession and your support ofour industry through your membershipcommitment!
As a 64-year-old association, BASF members have weathered manychallenges together. We will continue to step up to those challenges andrenew our mission to provide theAmerican Dream of homeownership tothose in our community that seek thesecurity and shelter of the homes webuild, finance, decorate and design.
Whether it’s for business, professional or cause-related reasons,those who belong to the BASF have a special bond. The BASF provides a wide variety of benefits that help our members connect to others in our industry. We stress, profess and reinforce the philosophy of members doing business with members. It’s business development ina membership-enriched environment!
Besides the opportunity to network and develop strong businessrelationships and friendships, BASFoffers a wealth of information about thecauses affecting our industry, educationprograms that offer the knowledge base assistance to help our membersimprove their business skills, and we offer other services to help ourmembers through the hard economictimes that we’ve recently experienced.
I look forward to myyear as your president beingan interactive one. As such we are soliciting your views and opinions as aBASF member. Let us know what youneed and what you want from yourmembership. We are here for you andto advocate for our industry. The holiday season puts us in aspirit of reflection and gratitude. TheBuilders Association of South Florida(BASF) has a lot to be thankful for and YOU are at the top of the list. The strength that comes from our membership and your commitment to our industry is needed now morethan ever. Your support of ourindustry through your BASF membership is priceless!
Yes, I know that there are those in our industry who are feeling the economic pinch and are wonderingwhat they have to be thankful for –well, let me help you put things in perspective.
You can be thankful that BASF hassuch passionate members and leaders,like Al Milo, Jr. of Urban DevelopmentGroup and Fred Abbo of the PrimeGroup. Al and Fred took time fromtheir schedules and money out of theirpockets to fly with me to DC to educateour legislators on the importance ofpressuring the Treasury, FederalReserve and the FDIC to “Fix HousingFirst” by giving us a “Time Out” fromthe Capital Calls on performing loansthat jeopardize the financial health ofour builders, which in turn jeopardizesthe financial health of our associatemembers in ancillary businesses aligned with housing.
We are fighting the downward spiralof devalued properties, foreclosures,and the resulting economic domino
effect it has on the community we live in. You can get involved in helping us push for the “Time Out” we are seeking from the capital calls on performing loans.
One way to do that is to join thecoordinated nationwide push to getCongress and President-elect Obamafocused on the need to “fix housing.”Hence, the campaign titled Fix HousingFirst! Learn everything there is to knowabout it at www.fixhousingfirst.com.
One of the best and easiest stepsyou can take is to go on that websiteand click on the “Contact YourCongressman” icon. When you enter your name and address, you automatically get a formatted, ready-to-send email to your Members ofCongress, including their addresses, so all you have to do is click send. It is really that easy

As you read the BASFNews, and reflect on the past year and thenew year ahead of us, I ask you to contemplate the generosity of our sponsors. The late Julian Simon was afamous Professor of Economics whowas known throughout academia,author of many books and a guest onprograms such as NBC’s Today Showand ABC’s Good Morning America.Here is what he said about the future:

Within a century or two, all nationsand most of humanity will be at or above today’s Western living standards. I also speculate, however,that many people will continue tothink and say that conditions of lifeare getting worse.”
Like Dr. Simon, I choose to believewe have a great future ahead of us!Now take action as I’ve outlined aboveand help get us moving more rapidly in the right direction! May you and yourfamilies have a healthy, happy andprosperous New Year!

Congratulations to Toni Pacelli-Hinkley, BASF executive vice president, for herrecent graduation from the Florida Home Builders Association (FHBA) BuildingUniversity for Individual Leadership Development (BUILD). Pacelli-Hinkley wasamong nine other graduates who spent more than 80 hours in training to becomemore effective leaders in their association, industry and community.

NBC 6 television anchor Roxanne Vargas served as master of ceremonies for the evening and opened the program with a video presentation that highlighted the organization’s many accomplishments in 2008. BASF’s support of Comcast Cares Day was also spotlighted in avideo produced by Comcast.
“Rey Melendi did an incredible job while facing themany challenges that the year presented,” said incomingPresident Ashley Bosch. “The organization is deeply grateful to him for his commitment and leadership. I lookforward to furthering many of the initiatives that were begun in 2008.”
The organization’s most prestigious awards were presented to individuals recognizing their dedication and service to the BASF. Among the recipients were FernandoMartinez of Caribe Homes, Builder of the Year; LuisQuiñones of BenTrust Financial, Associate of the Year
and Richard M. Horton of The Green Companies, Al Singer Spirit of the Industry Award. Jim Werle was recognized as a Life Director.
S. Lawrence Kahn, III of Lowell Homes was inducted into the BASF Hall of Fame. Before the evening concluded,Rey Melendi, 2008 president, recognized a host of deserving members with the President’s Award.
“In the past 12 months our industry has faced manyobstacles; however, by uniting our efforts as an organizationand supporting fellow members, we persevered,” saidMelendi. “I wish Ashley success in the coming year. I know that he has the determination to take on the challenges ahead.”
With the awards’ presentations complete, the danceparty began with live music in the ballroom until late in the evening.

Two New Task Forces Created by the Broward County Commission –The Broward County Commission created two new task forces to studyenvironmental issues. The first is theBroward County Climate Change Task Force. This group will develop a countywide program to mitigate thecauses and plan for the consequencesof global warming and climate change.The task force will report directly to the County Commission and will besupported by county staff. The secondtask force created was the WaterResources Task Force. This group is made up of city and county commis-sioners and officials representing theSouth Florida Water ManagementDistrict, special districts and othersinterests. The task force will evaluatethe feasibility and potential benefits of a regional or sub-regional approachto meeting future countywide waterresource needs and recommend actionsfor moving forward.
Broward County Staff RecommendsHolding off on the Implementation ofa Linkage Fee – Last year BrowardCounty commissioned a study to look at linkage fees on commercial construction for affordable housing.This study was conducted by FIU, andthe County held workshops to discussthe study and their results. Thus,County staff considered assessing commercial development with a largefee for affordable housing. The reportindicated that this fee could range from $1.87 to $7.87 per square foot or higher. This would have includedassessments on medical/educational,retail/wholesale, industrial/manufactur-ing, warehouse, hotel and even entertainment type construction.
BASF Represented on the FortLauderdale Affordable HousingAdvisory Committee – The CityCommission in Fort Lauderdale recently appointed Jonathan Jordanof Coastal Construction to theirAffordable Housing AdvisoryCommittee. This committee is taskedwith making recommendations toencourage and facilitate affordablehousing in Fort Lauderdale.Recommendations may include themodification or repeal of existing policies, procedures, or the adoption of new policies. This 11 member
panel will meet monthly and is comprised of a cross-section of individuals residing in Broward.

BROWARD LEGISLATIVE UPDATE
Representatives from the Builders Association of South Florida, Associated Builders and Contractors and BC Architects met with Secretary of the FloridaDepartment of Business and Professional Regulation(DBPR) Charles Drago on November 5th. The Secretaryrequested the meeting as part of his continuing effort toaddress regulatory concerns in Florida’s constructionindustry. Of particular concern to BASF were rumors about regional DBPR office closings and the extendedlength of time it takes for an independent business to certify a licensed contractor as their representative.Secretary Drago shared information about the agency’sunlicensed contractor campaign as well as how theagency is reviewing contractor applications and forms to ensure they are more understandable and less time consuming to complete.

BASF pushes for expanded builderrelief in building permit extensionordinance – BASF staff and membersare working with the Building DirectorCharles Danger and CommissionorSorenson (sponsor) in preparing thisordinance as well as revisions to expand its applicability. The original proposal provided relief only for projectswhich had started work. With BASF’sintervention, the proposal was expandedto apply to any project with a validbuilding permit. No work need be commenced. However, these permitswill be required to meet some or all new building code amendments.
Similar proposals were enacted by the Commission in the past during economic down-turns. While those ordinances simply extended the dates of building permits, this proposed ordinance would require an applicantseeking to extend a permit, to request a “stop-work order”, effectively freezingthe permit, until the builder wanted to reactivate the job. A simple permitextension raised some County-generated legal concerns. Look for aDecember public hearing and a Januaryadoption by the full Commission.
Commission initially adopts BASF’scharter school plan amendment -school concurrency remains unresolved – our regular readers willrecall that the County Commissionadopted its mandatory SchoolConcurrency Element and their versionof the School interlocal agreement (ILA) at their July 1, 2008 meeting. This ILA proposal differed from the version adopted by the School Board(SB) earlier this year, which differencesthe County and SB have yet to resolve.Both governing bodies will have toadopt the identical version, before concurrency can be implemented,
which adoption is required as ofDecember 1, 2008, by state law. With anew SB superintendent and electionsbeing well over, there will likely be a new push to resolve this important issue.
Points of concern continue to be: 1) howlocating new school capacity – decidedexclusively by the SB - will impact theCounty Commission’s decisions aboutfuture growth; and 2) the use of charterschools as a mitigation option.
At their Master Plan hearing onNovember 7, the County Commissionadopted BASF’s CDMP amendment torequire the inclusion of charter schoolsas a mitigation option. An adoptionhearing will occur in about a year.Charter schools as mitigation are evenmore important than before, given theSB’s decreasing share of State funds,and their shrinking local property taxrevenues for building new schools. Until now, the SB had continually rejected any use of charter schools.
Road Impact fee increase ordinancepublic hearing set for December – the Public Works Department’s roadimpact fee ordinance is set for publichearing at the December 9 GovernmentOperations and Environment (GOE)Committee. Since early summer, BASFmembers were meeting with Departmentsenior staff to review and resolve allissues of concern. This is the first-everincrease since the fees were adopted in 1994. Although the proposed feeincrease is a 360% increase, theDepartment is proposing a five-yearphase in period. The fee will include a new, automatic cost increase basedon the FDOT construction cost index.The draft also provides for a two-yeargrandfather provision for platted lotsand addresses some vesting issues.
Water Conservation Manual - neweffective date: January 1, 2009 – the final meeting on this effort was heldin late October, with the product beingthe County’s first Water Use EfficiencyManual. Among other things, the manualwill establish the phased-in use of EPA’s WaterSense conserving fixtures.New requirements for such fixtures willbecome mandatory for all new develop-ment on January 1, 2009, with FloridaBuilding Code local amendments havingbeen filed as well. The basis for such a swift and stringent set of rules beingadopted was the Water ManagementDistrict’s insistence that the Countyimmediately adopt draconian water conservation rules, to prevent theDistrict from imposing a moratorium onall future development in the County.
Affordable Housing News - BASF proposing its own HERA Funding planCongressional adoption of the nation-wide Housing and Economic RecoveryAct (HERA) in July 2008, will provideMiami-Dade County with approximately$62 million in emergency funds to buyforeclosed homes, rehab and repairsuch homes, helping families with subprime mortgages and related homeownership issues. While the Countystaff’s draft report allocates funds into five reasonable categories, theyassigned the bulk of the funds towardbuying Section 8 apartment buildings,rather than toward home ownershipassistance. BASF’s Affordable HousingCommittee members are proposing their own plan to reallocate the fundstoward their legally intended purpose. In coalition with the Realtors and otherhousing groups, BASF members plan tomeet with elected officials and others topress them to adopt the BASF allocationplan at the November 12 EconomicDevelopment and Human Services(EDHS) Committee public hearing.

ST. PETE BEACH: TROUBLING DEVELOPMENTS IN A “HOMETOWN DEMOCRACY” TESTING GROUND
In 2006, St. Pete Beach becamethe only city in Florida to adopt a local Hometown Democracy (HD)measure, requiring voter approval forall comprehensive plan changes. Sincebecoming an HD test case, residents of the small Pinellas County town have endured seemingly endless legalbattles, unavoidably chaotic elections,and serious economic setbacks. The local tourism-based economy has stagnated and costly legal andadministrative delays have preventedthe city from complying with stategrowth mandates.
Playing by Hometown Democracyrules, community leaders in St. Pete Beach organized an effort to reinvigorate the local economy by placing four comprehensive planchanges on the ballot. Eager to endthe legal and economic malaise, thevoters of St. Pete Beach decisivelyapproved all four plan changes in aspecial election on June 3rd, 2008.
Lawsuits soon followed. Indeed,the same anti-growth activists whochampioned the “right to vote” are now seeking to overturn a free and fair election. In fact, HometownDemocracy disciples have filed nearly
a dozen lawsuits aimed at stopping,stalling or invalidating the will of thepeople in St. Pete Beach.
In a recent development, FloridaHometown Democracy (FHD) Co-chairman Ross Burnaman filed a legal challenge that seeks to overturnthe election. Most Floridians will marvelat the brazen hypocrisy of a group thatpreaches “power to the people” whilesimultaneously seeking to frustrateelections at every turn.
FHD leaders have claimed thatHometown Democracy is all about the voice of the people. However, themessage they are now sending to theresidents of St. Pete Beach is perhapscloser to the truth: “you can have anyopinion you want, as long as it’s ours.”
This is the natural result of a system that encourages conflict rather than compromise. In fact, most observers will not be surprisedthat the same Hometown Democracysupporters who campaigned on ‘theright to vote’ now seek to overturn an election. They don’t really want to empower people; they want to stop all growth at any cost.
If Hometown Democracy is aimed at stopping growth, then its
leaders shouldhave the intellectualcourage to sayso. However, if their idea isreally about letting the will of the peopleprevail then FHD leadersshould withdraw their legal challengeand let the election stand.
Although it will not appear on the 2008 ballot, we can expect a full-fledged campaign in 2010. The spirit of giving was never moreevident at The Builders Association ofSouth Florida’s annual Holiday Partythis year at Farrey’s Coconut GroveShowroom. The event celebrated thespecial season as well as offeredChristmas gifts for those less fortunate.
Nearly 100 guests sipped cocktailsand savored delicacies including anassortment of cheeses, Italian meatballsand layered Mexican dip while minglingand networking. Guests were greetedat the door by BASF’s warm and friendly staff as they dropped theirunwrapped toys by a colorfully adornedChristmas tree. The toys and cashdonations collected benefitted thePediatric Ward at Jackson MemorialHospital as well as the Broward
Partnership for the Homeless. Door prizes and raffles kept
attendees excited and on their toes. The Holiday spirit echoedthroughout the showroom as members and spectators conversed while admiring the lighting and décor consistent with the Holiday theme. The BASF Membership committee once again welcomed an enthusiastic groupto its Orientation Breakfast held in October. Carlos E. Gonzalez, Jr. from SunTrust,Robert Duffy from Roemer Insurance, Carolina Herrera from Lennar Homes andOrlando Diaz from REDi Mortgage led the presentation of benefits available toBASF members including consumer and insurance discounts, legislative lobbying and, of course, the endless networking opportunities.

Several BASF members wereamong the more than 10,000 housingand construction professionals inOrlando who attended the 30th annual Southeast Building Conference(SEBC)/GreenTrends. Over 300 companies presented 800 exhibits atthis year’s trade show, including spe-cial sections of booths on green build-ing products and services, hurricane mitigation resources, and landscapingmaterials and techniques.
This year’s SEBC offered severaleducational courses and seminarsenabling attendees to fulfill continuingeducation requirements for Florida contractors. The most popular courseproved to be the Green Building forBuilding Professional, which attractedover 130 attendees to this two-day
training. Once completed, participantsreceived their professional designationof “Certified Green Professional.”
Next year’s SEBC/Green BuildingShow is July 30-August 1, 2009, againat the Orange County ConventionCenter in Orlando.

“This event is a great way for builders and associates to connect and discussways to do business with one another,” said Rey Melendi, BASF 2008 president.“It’s a popular event because it offers benefits to both our builder and associatemembers. Promoting business opportunities in these challenging times has neverbeen more important.”
As part of the event’s festivities, various individuals were recognized for theirefforts in attracting new members to the organization. A Green Spike award was presented to Rey Melendi (Lennar Homes) while Ray Castellanos (AuthenticConstruction), Luciano Duque (21st Century Graphics), Orlando Diaz (REDiMortgage) and Diana Ibarria (Standard Pacific) received Blue Spike awards.
