Unwritten Law Again to Posi tion of Daughter of Accused Special to The VrathbtfMi Herald Richmond Va May 36 Probably one of most sensational cases in the annals of criminology in Virginia will be formally called at Lovlngston Nelson County tomorrow when exJudge Will- iam G Loving will be Indicted for the murder of Theodore Fetes whom Judge Loving accused of drugging his daughter The prominence of the two families Involved and the close relation by marriage of one of them with the gov- ernor of the State lend an additional absorbing interest to the approaching trial The sympathies of the people with the one side or the other have torn the county o Nelson in twain The political aspect of the situation will in- volve the moet prominent and powerful people In the Commonwealth Events Lending to Shooting The events leading up to the shooting are in themselves full of interest On the afternoon In question which happened to be Sunday young Kates had an engage ment to drive with Miss Mary mild daughter of E L Kidd clerk of the Nelson County Court at whose home Miss Loving happened to be visiting at the time Upon the return of the young people from the drive Mtea Kidd sug gested that her escort take her guest for a spin along the country roads which suggestion was readily acted upon Miss Loving was returned to the Kidd home In a state bordering upon uncon sciousness It was necessary to assist her from the buggy and into the house where she was put to bed and where she remained until the following day A physician wee called to attend the young woman Estes himself going for the man of medicine The physician is said to have made a statement after the death of Estes that he treated the girl for an overdose of whisky and that there were no evidences and that he never suspected an assault Miss Loving lAter Is re ported to have acknowledged that she had been feeling unwell all day and that she took a small drink from a bottle offered her by Estes The supposition is that she took more than she intended which may have accounted for her par tial unconsciousness Judge Loving left his home on Monday with the avowed purpose of killing Estes He carried his shotgun at the bottom of his buggy He drove first to Oak Ridge whpre Estes conducted a store as a partner of his father and there directed to the car on the railroad siding Driving up to the door of the ear Judge Loving peremptorily demanded of two negroes to stand aside and without any preliminary warning shot the young man down After the shooting when the negroes started to the assistance of the fallen truth he told them that it was no use that he had shot to kill Estes died before he could be removed from the par Immediately after the shooting Judge Loving drove to Loringston and surrendered to the authorities He made no denial of the killing nor has any such denial ever been made Pleads Unwritten Inw Judge Loving was accorded a prelimi nary hearing on the tailoring day at which time the case was revtanded to the Xelwm County grand jury Judge Loving being released on bail Judge Loving pleaded the unwritten law In his own defense at the preliminary hear ing and this defense will probably enter largely into the actual trial of the case Judge Loving stated that he killed Estes because Estes had drugged his daughter He called attention to the fact that he did not hunt for Bates on Sunday the day of the alleged crime but waited until the following day after both he and his wife had an opportunity of talking- to the girl and getting the story from her own lips He stated that the girl had been returned how after the buggy ride drugged and that he had done only what any man would have done under similar circumstances Judge Lovings lawyers also gave out a similar statement at that time The unwritten law feature as a justification of the action of Judge Loving was practically the sole plea at that time It was not until several days later that It became noised abroad that as a matter of fact there had probably been no asault In that connection it Is al leged that even if that were true Judge Loving actually believed that an assault had been commlted at the time that Estes was shot by him It Is probable that this allegation alone will have weight- to save him from the scaffold It being hard to convict a man In Virginia for defending the good name of his women If he has good reasons to believe that harm has been done to them No Statement from Girl No statement has ever boon procured from Mlas Loving as to what actually took place on the buggy drive She was removed to her home on the day of the shooting and haa been kept In close retirement since Her every action nnd movement are carefully guarded no senti- ment being allowed to escape from her lips as to what she will probably say when placed on the stand Her testimony will undoubtedly be the feature of the trial The most Intense interest is being manifested in the probable stand that she will take Her position is one of the most peculiar- in which a young girl could be placed If an assault was not committed by Estes the will be placed on the rack between conflicting duties If she testifies that Estes offered her no indignities then she will publish to the world that her father Wiled the man without sufficient provo- cation and will herself be doing more than any other person to send him to a The prominence of the two familiesInvolved and the close relation bymarriage of one of them with the gov-ernor of the State lend an additionalabsorbing interest to the approachingtrial The sympathies of the peoplewith the one side or the other have tornthe county o Nelson in twain Thepolitical aspect of the situation will in-

volve the moet prominent and powerfulpeople In the Commonwealth

Events Lending to ShootingThe events leading up to the shooting

are in themselves full of interest On theafternoon In question which happened tobe Sunday young Kates had an engagement to drive with Miss Mary milddaughter of E L Kidd clerk of theNelson County Court at whose homeMiss Loving happened to be visiting atthe time Upon the return of the youngpeople from the drive Mtea Kidd suggested that her escort take her guest fora spin along the country roads whichsuggestion was readily acted upon

Miss Loving was returned to the Kiddhome In a state bordering upon unconsciousness It was necessary to assisther from the buggy and into the housewhere she was put to bed and whereshe remained until the following day Aphysician wee called to attend the youngwoman Estes himself going for the manof medicine The physician is said tohave made a statement after the deathof Estes that he treated the girl for anoverdose of whisky and that there wereno evidences and that he never suspectedan assault Miss Loving lAter Is reported to have acknowledged that shehad been feeling unwell all day and thatshe took a small drink from a bottleoffered her by Estes The suppositionis that she took more than she intendedwhich may have accounted for her partial unconsciousness

Judge Loving left his home on Mondaywith the avowed purpose of killing EstesHe carried his shotgun at the bottom ofhis buggy He drove first to Oak Ridgewhpre Estes conducted a store as apartner of his father and theredirected to the car on the railroad sidingDriving up to the door of the ear JudgeLoving peremptorily demanded of twonegroes to stand aside and without anypreliminary warning shot the young mandown

After the shooting when the negroesstarted to the assistance of the fallentruth he told them that it was no usethat he had shot to kill Estes diedbefore he could be removed from thepar Immediately after the shootingJudge Loving drove to Loringston andsurrendered to the authorities He madeno denial of the killing nor has any suchdenial ever been made

Pleads Unwritten InwJudge Loving was accorded a prelimi

nary hearing on the tailoring day atwhich time the case was revtanded tothe Xelwm County grand jury JudgeLoving being released on bail JudgeLoving pleaded the unwritten law Inhis own defense at the preliminary hearing and this defense will probably enterlargely into the actual trial of the caseJudge Loving stated that he killed Estesbecause Estes had drugged his daughter

He called attention to the fact thathe did not hunt for Bates on Sundaythe day of the alleged crime but waiteduntil the following day after both he andhis wife had an opportunity of talking-to the girl and getting the story from herown lips He stated that the girl hadbeen returned how after the buggyride drugged and that he had doneonly what any man would have doneunder similar circumstances JudgeLovings lawyers also gave out a similarstatement at that time The unwrittenlaw feature as a justification of theaction of Judge Loving was practicallythe sole plea at that time

It was not until several days laterthat It became noised abroad that asa matter of fact there had probably beenno asault In that connection it Is alleged that even if that were true JudgeLoving actually believed that an assaulthad been commlted at the time thatEstes was shot by him It Is probablethat this allegation alone will have weight-to save him from the scaffold It beinghard to convict a man In Virginia fordefending the good name of his womenIf he has good reasons to believe thatharm has been done to them

No Statement from GirlNo statement has ever boon procured

from Mlas Loving as to what actuallytook place on the buggy drive She wasremoved to her home on the day of theshooting and haa been kept In closeretirement since Her every action nndmovement are carefully guarded no senti-ment being allowed to escape from herlips as to what she will probably saywhen placed on the stand Her testimonywill undoubtedly be the feature of thetrial The most Intense interest is beingmanifested in the probable stand thatshe will take

Her position is one of the most peculiar-in which a young girl could be placedIf an assault was not committed by Estesthe will be placed on the rack betweenconflicting duties If she testifies thatEstes offered her no indignities then shewill publish to the world that her fatherWiled the man without sufficient provo-cation and will herself be doing morethan any other person to send him to aprison cell or to the gallows
