enITALIANO1 – DefinizioniIl Cliente: la persona fisica o giuridica che agisce nell’esercizio della propria attività imprenditoriale, commerciale, artigianale o professionale, ovvero un suo intermediario che acquista i Prodotti commercializzati da A.A.M..A.A.M.: la società A.A.M. Srl, con sede in Via dell’Industria 7, 42019 Scandiano (RE) - Italia, che vende i Prodotti. Conferma d’Ordine: avviso scritto di conferma del Prodotto ordinato, inviato al Cliente da A.A.M.. Prezzo: quello indicato nella Conferma d’Ordine. Prodotto/i: quello/i indicato/i nella Conferma d’Ordine. Contratto: quello concluso tra A.A.M. e Cliente a mezzo scambio di Ordine e Conferma d’Ordine, regolato dalle presenti condizioni generali di vendita e di garanzia.2 - EfficaciaIl presente Contratto si applica alla presente vendita e ad ogni successiva intercorsa tra A.A.M. ed il Cliente, fatta salva la successiva sottoscrizione di altre e differenti condizioni di vendita e di garanzia. L’invio di un ordine implica accettazione del Contratto.3 – OrdiniGli ordini si accettano per iscritto (posta elettronica e fax sono assimilati) e divengono vincolanti per A.A.M. e tra le parti quando A.A.M. invia al Cliente la Conferma d’Ordine. La Conferma d’Ordine deve essere controllata immedia-tamente dal Cliente che deve comunicare prontamente per iscritto a A.A.M. qualsiasi errore riscontrato. In mancanza, decorsi tre giorni, le indicazioni contenute nella Conferma d’Ordine si applicheranno al Contratto. Non sarà accettato alcun ordine se non accompagnato dalle presenti condizioni generali di vendita e di garanzia sottoscritte dal Cliente. Gli ordini successivi, accettati e confermati da A.A.M. a mezzo Conferma d’Ordine, rimangono soggetti al presente Contratto.4 – Prezzo e termini di pagamentoI preventivi di A.A.M. sono validi solo se redatti per iscritto e per il periodo in essi indicato. Il Prezzo include esclusivamente i beni e le prestazioni elencate e deve comunque intendersi al netto di IVA. Il pagamento dovrà avvenire nei modi e nei tempi indicati nella Conferma d’Ordine. A.A.M. può sospendere la consegna o l’esecuzione dell’Ordine fino all’avvenuto pagamento dello stesso, se è concordato il pagamento anticipato, o di ogni altra precedente transazione nella quale il Cliente sia in ritardo con i pagamenti. Il Cliente rinuncia fin da ora a qualsivoglia eccezione di compensazione tra le somme da esso dovute a A.A.M. ed ogni altra somma di cui esso risultasse o si asserisse creditore, a qualsivoglia titolo, anche se liquida ed esigibile, anche se non contestata e legalmente esigibile. In caso di ritardo nel pagamento, il Cliente dovrà corrispondere gli interessi di cui al D.Lgs. n.231/2002 sulla somma ancora dovuta, nonché i costi per il recupero della stessa, senza necessità di formale messa in mora.5 – Consegna / Titolo / RischioIl termine di consegna indicato nella Conferma d’Ordine è indicativo. Sono ammesse consegne parziali. Il luogo di consegna è indicato nella Conferma d’Ordine. La merce viaggia ad esclusivo rischio e pericolo del compratore, anche se venduta porto franco. La proprietà del Prodotto passa solo all’avvenuto pagamento dell’intero prezzo. Fatto salvo quanto previsto dall’Articolo 1525 del Codice Civile, A.A.M. potrà (senza responsabilità verso il Cliente) rientrare in possesso del Prodotto. A.A.M. potrà agire in giudizio per conseguire il Prezzo anche prima del passaggio della proprietà. Qualora il Cliente rifiuti la consegna senza previo accordo con A.A.M., resteranno a suo carico le spese o le perdite sostenute da A.A.M. a causa di tale rifiuto, incluse le spese di deposito fino all’accettazione della consegna.6 – AccettazioneAlla consegna del Prodotto, il Cliente deve controllarlo e ispezionarlo e, se del caso, rifiutarlo o denunciare eventuali vizi entro e non oltre 8 giorni dalla consegna. Alla scadenza di tale termine il Prodotto si riterrà accettato dal Cliente. Se A.A.M. acconsente a propria discrezione alla restituzione del Prodotto, questo dovrà essere restituito nelle sue condizioni originali, con relativo imballo, con una nota di restituzione e con la prova dell’avvenuto acquisto; i costi di restituzione saranno a carico del Cliente.7 – ResponsabilitàA.A.M. non sarà in alcun modo responsabile per danni diretti od indiretti o perdite consequenziali in caso di mancato o cattivo funzionamento dei Prodotti, per perdita di affari, profitti, stipendi, compensi, risparmi, salvo quanto previsto dalle garanzie di legge o quanto previsto nelle presenti condizioni generali. A.A.M. non sarà parimenti responsabile di danni provocati durante l’installazione dei Prodotti a pavimenti, mobilio, suppellettili, arredamento, e quant’altro presente nei locali, riconoscendo il Cliente di avere il preciso obbligo contrattuale di provvedere alla preventiva protezione o allo spostamento degli stessi. Il Cliente riconosce di essere stato preventivamente avvertito da A.A.M. degli interventi necessari alla installazione dei Prodotti, in particolare delle modalità e delle caratteristiche degli stessi.8 – Forza MaggioreA.A.M. non sarà responsabile del ritardo nell’adempimento delle sue obbligazioni (incluso il ritardo nella consegna) se tale ritardo sia causato da circostanze al di fuori del suo ragionevole controllo e avrà diritto a fruire di un’esten-sione temporale per l’adempimento; esempi di eventi di forza maggiore includono scioperi, problemi per la fornitura/trasporto/fabbricazione, oscillazioni dei tassi di cambio, azioni governative o regolamentari, catastrofi naturali. Se l’evento di forza maggiore persiste per un periodo superiore a 2 mesi, ciascuna delle Parti avrà diritto di recedere dal Contratto, senza che alcun risarcimento sia dovuto alla controparte.9 – Protezione Dati PersonaliI dati personali del Cliente saranno trattati, conservati e/o comunicati come per legge ed il Cliente vi acconsente sin d’ora ai sensi ed agli effetti della normativa in vigore sulla tutela della Privacy. Il Cliente potrà esercitare i diritti di accesso, correzione, cancellazione e blocco del trattamento dei suoi dati inviando lettera a A.A.M.. Il Cliente potrà imporre a A.A.M. di non utilizzare i suoi dati a scopi di marketing.10 – Garanzia10.1 Ambito di operativitàLa presente garanzia è destinata ai Clienti operanti nell’ambito della propria attività professionale, secondo la definizione dell’articolo 1. Le vendite di cui alle presenti condizioni generali sono relative a Prodotti non destinati ai consumatori, quali individuati dall’articolo 3 del D.Lgs.206/2005. La garanzia riguarda i vizi dei Prodotti, intendendosi come tali le imperfezioni materiali della cosa, tali da incidere in modo rilevante sulla sua utilizzabilità o sul suo valore, relative ad anomalie del processo di produzione, di fabbricazione, di formazione, di conservazione, ed è operante nei limiti e secondo le condizioni di seguito elencate.10.2 DurataA.A.M. garantisce i Prodotti per un anno dalla data di consegna.10.3 Quando si applicaFatte salve le precisazioni, le esclusioni o le limitazioni di seguito indicate, o comunque richiamate in questo contratto, la garanzia si applica ai vizi dei Prodotti, quali individuati secondo la definizione dell’art.1490 1° comma del codice civile.10.4 Modalità, termini e decadenze per far valere il diritto alla garanziaAlla scoperta del vizio il Cliente è tenuto a darne comunicazione scritta a A.A.M., allegando copia della fattura di vendita e della Conferma d’Ordine di riferimento ed indicando il numero di serie (serial number) del bene viziato. La comunicazione deve pervenire per iscritto a A.A.M. entro otto giorni dalla scoperta, a pena di decadenza del diritto alla garanzia. Il diritto alla garanzia si prescrive in un anno. Ogni intervento del Cliente o di terzi sul Prodotto viziato, se non autorizzato per iscritto da A.A.M., costituisce motivo di decadenza della garanzia10.5 Esclusioni e limitazioniFatto salvo quanto altrove specificato, la garanzia è esclusa se il vizio è provocato o accentuato da un uso non conforme del Prodotto da parte del Cliente o di terzi, ovvero da una manutenzione non conforme alle indicazioni del produttore, o da interventi di qualunque natura, anche manutentiva, sullo stesso non effettuati o non autorizzati da A.A.M.. La garanzia è inoltre esclusa:- se alla comunicazione di denuncia del vizio non sono allegati i documenti e non sono fornite le informazioni previste dall’art.10.4;- se i Prodotti sono stati installati, conservati o stoccati in ambienti inidonei a tutelarne la qualità (quali ambienti esterni, umidi, scarsamente areati);- se i Prodotti non sono stati montati in modo corretto, o risultano manomessi, integrati con parti e componenti non originali o non autorizzati da A.A.M., puliti con procedure o prodotti idonei a danneggiarli;- in caso di danni che non derivano da originari vizi di produzione e/o dalla cattiva qualità dei materiali utilizzati ma che sono conseguenza di fatti o eventi traumatici per il prodotto quali si citano, a mero titolo esemplificativo e non esaustivo: urti, ammaccature, graffi, tagli, macchie causate da fattori esterni quali tinture, lacche prodotti per la pulizia;- per i danni da usura data dal normale uso dei Prodotti;- se i prodotti non sono utilizzati dai soggetti ai quali sono destinati e per i quali sono prodotti, cioè parrucchieri, estetisti, saloni di bellezza, beauty farms.10.6 Condizioni particolari di garanziaVigono le seguenti condizioni particolari di garanzia a seconda del componente o del materiale di seguito indicato:Pompe:Vengono garantite due anni dalla data di consegna.Skay:Gli skay, in particolare quello bianco e i colori chiari, non sono garantiti per i danni che non derivano da originari vizi di produzione e/o dalla cattiva qualità dei materiali utilizzati, ma che sono conseguenza di fatti od eventi trau-matici per il prodotto, quali si citano, a mero titolo esemplificativo e non esaustivo: urti, graffi, tagli, macchie causate da fattori esterni quali tinture, lacche, prodotti per la pulizia, tessuto denim. Non può essere considerato vizio originario l’eventuale differenza di tonalità di colore che dovessero presentare articoli o Prodotti aventi lo stesso tipo di skay.Parti verniciate:Non sono garantiti i danni che non derivano da originari vizi di produzione e/o dalla cattiva qualità dei materiali utilizzati, ma che sono conseguenza di fatti od eventi traumatici per il prodotto quali si citano, a mero titolo esem-plificativo e non esaustivo: urti, ammaccature, graffi, tagli, macchie causate da fattori esterni quali tinture, lacche, prodotti per la pulizia. Non può essere considerato vizio originario l’eventuale differenza di tonalità di colore che dovessero presentare articoli o Prodotti aventi lo stesso tipo di verniciatura.Parti in alluminio:Non sono garantiti i danni che non derivano da originari vizi di produzione e/o dalla cattiva qualità dei materiali utilizzati, ma che sono conseguenza di fatti o eventi traumatici per il prodotto quali si citano, a mero titolo esempli-ficativo e non esaustivo: urti, ammaccature, graffi, tagli, macchie causate da fattori esterni quali tinture, lacche prodotti per la pulizia. Non può essere considerato vizio originario l’eventuale differenza di tonalità che dovessero presentare articoli o Prodotti aventi lo stesso tipo di parti in alluminio.Parti elettriche e apparecchiature elettriche (esclusi neon, led e lampadine)Rientrano nelle condizioni generali di garanzia salvo che il danno non sia causato da sbalzi di tensione di rete che superino i limiti previsti dalla normativa CE (220/240 V, 50hz, +/- 10%).Neon, led e lampadine: Non rientrano nelle condizioni generali di garanzia, trattandosi di materiale di consumo.Viene esclusivamente garantito il rispetto, al momento della consegna, dei parametri di temperatura colore e resa cromatica indicate nelle specifiche previste dal catalogo dei principali produttori (es. catalogo Philips paragrafo 12). Il Cliente è perciò tenuto ad una verifica immediata dei componenti di cui al presente paragrafo e, ove riscontrasse difformità da dette specifiche, sarà tenuto a darne comunicazione scritta a A.A.M. entro e non oltre 8 giorni dal ricevimento della merce; in mancanza, il Cliente decade dal diritto di far valere la predetta difformità. Rimane escluso dalle condizioni di garanzia il normale logorio degli articoli dovuto all’uso ed il Cliente si dichiara a conoscenza, rinunciando fin da ora a qualunque pretesa al riguardo, che con il passare del tempo neon, led, lampadine possono presentare difformità di colore o cessare di funzionare.Vetri e specchi: Non sono garantiti i danni che non derivano da originari vizi di produzione e/o dalla cattiva qualità dei materiali utilizzati, ma che sono conseguenza di fatti o eventi traumatici per il prodotto quali si citano, a mero titolo esemplifi-cativo e non esaustivo: urti, ammaccature, graffi, tagli, macchie causate da fattori esterni quali tinture, lacche, prodotti per la pulizia. Codette:Non sono garantiti i danni che non derivano da originari vizi di produzione e/o dalla cattiva qualità dei materiali utilizzati, ma che sono conseguenza di fatti o eventi traumatici per il prodotto quali si citano, a mero titolo esemplifi-cativo e non esaustivo: urti, ammaccature, crepe, sbeccature, graffi, tagli, macchie causate da fattori esterni quali tinture, lacche, prodotti per la pulizia.Rubinetterie, docce e flessibili:La rubinetteria è garantita per 5 anni, le docce e i flessibili per 6 mesi.10.7 Modalità di intervento di A.A.M.A.A.M. esaminerà il prodotto e valuterà, a proprio insindacabile giudizio, se il problema rientra o meno nella copertura della garanzia commerciale. A.A.M., mediante il proprio servizio di intervento o tramite un partner di assistenza autorizzato, a seguito dell’esame del prodotto, si impegna alla sostituzione o riparazione dei pezzi che risultassero difettosi all’origine, che verranno resi franco fabbrica. Nel caso venga richiesto l’invio dei pezzi di ricambio, le spese di trasporto ed il rischio relativo saranno a carico dell’acquirente. In ogni caso non è compresa nelle garanzie la prestazione di mano d’opera, così come gli eventuali danni subiti dall’acquirente. I pezzi sostituiti diverranno di proprietà di A.A.M.. Se l’articolo non è più in vendita presso A.A.M., questa provvederà ad una sostituzione adeguata. Sarà A.A.M., a propria esclusiva discrezione, a stabilire quale sostituzione è da considerarsi adeguata.10.8 Esclusione di implicito riconoscimento del vizioCon riferimento all’art.1495 2° comma del codice civile, si precisa che l’intervento di A.A.M., o di soggetto da esso delegato o autorizzato, non comporta il riconoscimento del vizio, ma è teso esclusivamente alla valutazione della denuncia presentata dal cliente. L’intervento di A.A.M., o di soggetto da esso delegato o autorizzato, in sostituzione o riparazione, non comporta parimenti alcun riconoscimento, potendo esso essere stato effettuato al solo scopo di evitare contenzioso e/o a fini transattivi. Il vizio deve intendersi riconosciuto ai sensi di legge solo ove ciò sia avvenuto esplicitamente per iscritto.11 – Assistenza fuori garanziaNel caso un cliente richieda a A.A.M. una assistenza fuori garanzia sui prodotti da questa forniti, saranno addebitate al cliente tutte le spese e gli oneri accessori che A.A.M. sosterrà per i ricambi, le ore uomo, le spese di viaggio, vitto e alloggio necessarie per completare l’assistenza.12 – GiurisdizioneIl presente contratto è regolato dalla legge italiana ed è soggetto alla giurisdizione esclusiva del Foro di Reggio Emilia.13 – Clausole finaliIl testo in lingua italiana del presente contratto è l’unico facente fede come testo originale.

Ai sensi ed agli effetti degli articoli 1341 e 1342 del Codice Civile il Cliente dichiara di avere preso attenta visione ed approvare espressamente i seguenti articoli delle Condizioni Generali di Vendita e di Garanzia A.A.M. Srl.: art.2 (efficacia), art.3 (ordini), art.4 (prezzo e termini di pagamento), art.5 (consegna/titolo/rischio), art.6 (accettazione), art.7 (responsabilità), art.8 (forza maggiore), art.10 (garanzia, paragrafi: 10.1, 10.2, 10.3, 10.4, 10.5, 10.6, 10.7, 10.8), art.12 (giurisdizione), art. 13 (clausole finali).

ENGLISH1 – DefinitionsThe Customer: the individual or entity carrying out its own business, commercial, trade or professional activities, who directly or through an intermediary purchases the Products sold by A.A.M.. A.A.M.: A.A.M. Srl., with registered offices Via dell’Industria 7, 42019 Scandiano (RE) - Italy, who sells the Products. Order confirmation: written confirmation of the ordered Product, sent to the Customer by A.A.M.. Price: the price shown in the Order Confirmation. Product(s): that/those shown in the Order Confirmation. Contract: the contract signed between A.A.M. and the Customer through the exchange of Order and Order Confirmation, governed by these general sales and warranty conditions.2 – ValidityThis contract applies to this and any further sales between A.A.M. and the Customer, without prejudice to the signature of other, different sales and warranty conditions. By sending an order, the Customer implicitly accepts the Contract.3 – OrdersOrders are accepted in writing (including e-mail and fax) and are binding for A.A.M. and between the parties when A.A.M. sends the Order Confirmation to the Customer. The Order Confirmation must be checked immediately by the Customer, who shall notify A.A.M. in writing by return in the event of any error being found. Failing this, after three days the contents of the Order Confirmation shall be deemed to be subject to the Contract. Orders will not be accepted unless accompanied by these general sales and warranty conditions, signed by the Customer. Any further orders accepted and confirmed by A.A.M. by an Order Confirmation shall be deemed to be subject to this Contract.4 – Price and payment termsA.A.M. quotations are valid only when in writing and for the period indicated therein. The Price includes solely the goods and services listed and is exclusive of VAT. Payments shall be made in compliance with the terms laid down in the Order Confirmation. A.A.M. may suspend the delivery or execution of the Order until payment has been received, in the case of advance payment, or in the event of delayed payments by the Customer relative to any other previous transaction. The Customer hereby waivers all claims for compensation between the amounts due to A.A.M. and any other amounts which may be or which are claimed to be due to them, for any reason whatsoever, even if due and payable, and even where not contested and legally payable. In the event of delayed payment, the Customer shall pay all interests due on the owed amount pursuant to Italian law no. 231/2002, as well as all costs for the recovery thereof, without any formal notification of arrears.5 – Delivery / Ownership / RiskThe delivery terms indicated in the Order Confirmation are purely indicative. Partial deliveries are permitted. The place of delivery is indicated in the Order Confirmation. Product ownership will be transferred only upon payment of the full Price. Without prejudice to article 1525 of the Italian Civil Code, A.A.M. may (with no liability towards the Customer) recover the Product. A.A.M. may take legal action to obtain the Price even before the transfer of owner-ship. Should the Customer refuse delivery without the prior agreement of A.A.M., all costs or losses borne by A.A.M. as a result of such refusal, including the costs of storage until the time of acceptance of the delivery, shall be for the Customer’s account.6 – AcceptanceOn delivery of the Product, the Customer shall check and inspect it, and may reject it or report any defects within a period of no more than eight days from the date of delivery. After such time the Product shall be deemed to be accepted by the Customer. If at its own discretion A.A.M. agrees to the return of the Product, the Product shall be returned in its original conditions, with relative packaging, with a returned goods note and proof of purchase; the costs of the return shall be paid by the Customer.7 – ResponsibilityIn the event of the Products not working or malfunctioning, A.A.M. shall in no way be held responsible for any direct or indirect damages or consequential losses, through the loss of business, profit, salaries, commission, sav-ings, without prejudice to the statutory guarantees and any other provisions of these general conditions. Equally, A.A.M. shall not be held responsible for damage caused during the installation of the Products to floors, furniture, ornaments, furnishings and any other items in the place of installation, recognising the contractual obligation of the Customer to protect and/or move such items prior to installation. The Customer acknowledges the instructions provided by A.A.M. in advance concerning the interventions required for the installation of the Products, in particular the relative methods and characteristics.8 – Force MajeureA.A.M. shall not be responsible for any delay in the execution of its duties (including delayed delivery) if such delay is caused by circumstances beyond its reasonable control, and shall have the right to benefit from an extension to the execution times; examples of force majeure include strikes, problems in supply/transport/production, variation of exchange rates, government action and legislation, natural calamities. If the force majeure continues for a period of more than 2 months, both Parties have the right to withdraw from the Contract, without any compensation being due to the other Party.9 - Protection of Personal DataThe personal data of the Customer shall be processed, stored and/or notified in compliance with the law, and the Customer hereby provides its consent pursuant to and under the terms of the applicable privacy and data protection regulations. The Customer may exercise all rights of access, correction, deletion and suspension of the processing of its data by so requesting A.A.M. in writing. The Customer may oblige A.A.M. not to use its data for marketing purposes.10 – Warranty10.1 ExtentThis warranty is granted to Customers operating within their professional activities, as defined in Article 1. The sales to which these general conditions apply relate to Products not destined for consumers, as identified in Article 3 of Italian Legislative Decree 206/2005. The warranty covers Product defects, understood as material imperfections, which have a significant impact on its usability or value, relative to anomalies of production, manufacturing, preparation and storage, and is valid within the limits and under the conditions laid down here below.10.2 DurationA.A.M. warranties the Products for a period of one year from the delivery date.10.3 ApplicationWithout prejudice to the explanations, exclusions or limitations described here below, or in any case referred to in this contract, the warranty shall apply to Product defects as identified according to the definition in Article 1490, para. 1 of the Italian Civil Code.10.4 Methods, terms and forfeiture of the right to warrantyOn discovery of any defect, the Customer shall send written notice to A.A.M., attaching a copy of the sales invoice and the relative Order Confirmation, and indicating the serial number of the faulty product. The notice must be sent to A.A.M. in writing within eight days from the discovery of the defect, under penalty of invalidation of the warranty. The right of warranty expires in one year. Any intervention on the faulty product by the Customer or by a third party unless otherwise authorised by A.A.M. in writing, shall lead to the invalidation of the warranty.10.5 Exclusions and limitationsWithout prejudice to any other provisions, the warranty shall not be valid if the defect is caused or worsened by improper use of the Product by the Customer or third parties, or by maintenance which does not comply with the manufacturer’s instructions, or by interventions of any nature, including maintenance, which have not been carried out on the Product or which have not been authorised by A.A.M.. The warranty shall also be excluded:- if the required documents are not attached to the defect notice and if the information laid down in article 10.4. is not provided;- if the Products have been installed, preserved or store in conditions that are not suited to assure their quality (outside, in a damp area, in a poorly aired room, etc.);- if the Products have not been installed correctly, or have been tampered with, have had parts or components added which are not original or not authorised by A.A.M., or cleaned using procedures or products that may have damaged them;- in the event of damage which is not derived from original production faults and/or the poor quality of the materials used, but which are rather the consequence of events or accidental damage to the product including, but not limited to: knocks, dents, scratches, cuts, stains caused by external factors such as dyes, lacquers or cleaning products;- damages caused by wear following the normal use of the Products;- if the products are not used by the parties they are destined for and for which they are produced, in other words hairdressers, beauty salons, beauty farms.10.6 Special Warranty ConditionsThe following special warranty conditions apply to the components and materials described below:Pomps of the bases:two years are guaranteed by the date of delivery.Artificial leather:Especially white and and all light colours, the warranty does not cover damage which is not derived from original production faults and/or the poor quality of the materials used, but which are rather the consequence of events or accidental damage to the product including, but not limited to: knocks, scratches, cuts, stains caused by external factors such as dyes, lacquers or cleaning products, denim fabric. Any difference in colour shade between articles or products with the same kind of artificial leather shall not be considered to be original defects.Painted parts:The warranty does not cover damage which is not derived from original production faults and/or the poor quality of the materials used, but which are rather the consequence of events or accidental damage to the product includ-ing, but not limited to: knocks, dents, scratches, cuts, stains caused by external factors such as dyes, lacquers or cleaning products. Any difference in colour shade between articles or products with the same kind of paint shall not be considered to be original defects.Aluminium parts:The warranty does not cover damage which is not derived from original production faults and/or the poor quality of the materials used, but which are rather the consequence of events or accidental damage to the product includ-ing, but not limited to: knocks, dents, scratches, cuts, stains caused by external factors such as dyes, lacquers or cleaning products. Any difference in colour shade between articles or products with the same kind of aluminium parts shall not be considered to be original defects.Electrical parts and electrical equipment (excluding neon lamps, leds and light bulbs)These fall under the normal warranty conditions unless damage is caused by power surges which exceed the limits laid down in CE regulations (220/240 V, 50hz, +/- 10%).Neon lights, leds and light bulbs: These consumable items are not covered by the general warranty conditions.Exclusively guaranteed at the time of delivery are the colour temperature and colour yield parameters indicated in the specifications of the most important producers (I.E. Philips catalogue paragraph 12). The Customer is there-fore bound to immediately check the components to which this paragraph refers, and in the event of discovery of any defects in these specifications, must send written notice to A.A.M. no later than 8 days from the receipt of the goods; failure to do so will invalidate the Customer’s warranty rights for these components. Excluded from the warranty conditions is the normal wear of the products due to use, and the Customer hereby acknowledges, waivering all claims thereto, that over time neon lights, leds and light bulbs may present colour defects or stop working.Glass and mirrors: The warranty does not cover damage which is not derived from original production faults and/or the poor quality of the materials used, but which are rather the consequence of events or accidental damage to the product includ-ing, but not limited to: knocks, dents, scratches, cuts, stains caused by external factors such as dyes, lacquers or cleaning products. Basins:The warranty does not cover damage which is not derived from original production faults and/or the poor quality of the materials used, but which are rather the consequence of events or accidental damage to the product includ-ing, but not limited to: knocks, dents, tears, chips, scratches, cuts, stains caused by external factors such as dyes, lacquers or cleaning products.Taps, shower heads and flexible hoses:Taps are guaranteed for 5 years, shower heads and flexible hoses for 6 months.10.7 Intervention by A.A.M.A.A.M. will examine the Product and, at it’s own unquestionable discretion, will decide whether the problem falls within the coverage of the commercial warranty. Following the examination of the product, through its own technical service, or through authorised assistance partners, A.A.M. will take care of the replacement or repair of parts proved to be faulty from the origin, that will be returned ex-works. If the shipment of spare parts is required, transport costs and risks are at charge of the buyer. In any case, working hours and any damage that might have occurred to the buyer are not covered by the guarantee. Any replaced parts will become the property of A.A.M.. If an item is no longer sold by A.A.M., it will be replaced with an appropriate alternative. At it’s exclusive discretion, A.A.M. will establish what is considered to be an appropriate alternative.10.8 Exclusion of implicit recognition of defectsWith reference to article 1495, para. 2 of the Italian Civil Code, any intervention by A.A.M., or a party appointed or authorised by it, shall not imply the recognition of any defects, but rather aims exclusively to assess the claim reported by the Customer. The intervention by A.A.M., or a party appointed or authorised by them, to repair or replace products shall equally imply no recognition of defect, but shall rather be carried out solely for the purpose of avoiding disputes and/or for contractual purposes. Defects will be deemed to be recognised according to the law solely when so explicitly declared in writing.11 – Assistance not covered by warrantyIn the event of a customer requesting assistance for products supplied by A.A.M. which are not covered by a valid warranty, the Customer will be charged all costs and accessory charges borne by A.A.M. for spare parts, labour, travel costs, board and lodging required to carry out the assistance.12 – JurisdictionThis contract is governed by Italian law, and all matters shall be referred to the exclusive jurisdiction of the courts of Reggio Emilia.13 – Final clausesThe Italian text of the present contract shall be the only authentic text.

Pursuant to and under the terms of articles 1341 and 1342 of the Italian Civil Code, the Customer hereby declares that he has read and expressly approves the following articles of the A.A.M. Srl. enFRANÇAIS1 – DéfinitionsLe Client: la personne physique ou juridique qui exerce son activité de chef d’entreprise, commerciale, artisanale ou professionnelle, ou un intermédiaire qui achète les Produits commercialisés par A.A.M.. A.A.M.: la société A.A.M. Srl., ayant son siège Via dell’Industria 7, 42019 Scandiano (RE) - Italie, qui vend les Produits. Acceptation : avis écrit confirmant le produit commandé, envoyé au Client par A.A.M.. Prix : celui indiqué dans l’acceptation. Produit/s : celui/ceux indiqué/s dans l’Acceptation. Contrat : le contrat passé entre A.A.M et le Client par échange de Commande et Acceptation, régi par les présentes conditions générales de vente et de garantie.2 – EfficacitéCe Contrat est appliqué à cette vente et aux ventes suivantes entre A.A.M. et le Client, sauf nouvelle signature de conditions de vente et de garantie différentes. L’envoi d’une commande implique l’acceptation du Contrat. 3 – CommandesLes commandes sont acceptées par écrit (poste électronique et télécopie sont assimilées) et elles deviennent contraignantes pour A.A.M. et entre les parties quand A.A.M. envoie son Acceptation au Client. L’Acceptation doit être immédiatement contrôlée par le client qui doit promptement communiquer par écrit à A.A.M. toute erreur relevée. Faute de quoi, passé trois jours, les indications contenues dans l’Acceptation seront appliquées au Contrat. Aucune commande ne sera acceptée si elle n’est pas accompagnée de ces conditions générales de vente et de garantie signées par le Client. Les commandes à venir, acceptées et confirmées par l’Acceptation de A.A.M., restent soumises à ce Contrat.4 – Prix et conditions de paiementLes devis de A.A.M. ne sont valables que s’ils sont fournis par écrit et pour la période qu’ils indiquent. Le Prix comprend exclusivement les biens et les prestations mentionnées et il s’agit toujours du prix hors TVA. Le paiement devra être effectué de la manière et dans les délais indiqués dans l’Acceptation. A.A.M. peut suspendre la livraison ou l’exécution de la Commande jusqu’au paiement de celle-ci, si l’accord prévoit un paiement anticipé, ou de toute autre transaction précédente liée à un retard de paiement de la part du Client. Le Client renonce d’ores et déjà à toute exception de compensation entre les sommes qu’il doit à A.A.M. et toute autre somme dont il serait ou prétendrait être créancier, à quelque titre que ce soit, somme liquide et exigible, même si elle n’est pas contestée et légalement exigible. En cas de retard de paiement, le Client devra verser les intérêts prévus dans le D.L. n.231/2002 sur la somme due, ainsi que les frais de recouvrement de celle-ci, sans nul besoin de mise en demeure formelle.5 – Livraison / Titre / RisqueLe délai de livraison figurant dans l’Acceptation est indicatif. Les livraisons partielles sont admises. Le lieu de livraison est indiqué dans l’Acceptation. Le Produit ne subira le passage de propriété que sur paiement effectif et intégral du prix. Sauf ce que prévoit l’article 1525 du Code civil, A.A.M. pourra (sans responsabilité envers le Client) rentrer en possession du Produit. A.A.M. pourra agir en justice pour obtenir le Prix même avant le passage de propriété. Si le Client refuse la livraison sans accord préalable avec A.A.M., les frais ou les pertes soutenues par A.A.M. à cause de ce refus, y compris les frais de dépôt jusqu’à l’acceptation de la livraison resteront à sa charge.6 – RéceptionAu moment de la livraison du Produit, le Client doit le contrôler et l’inspecter et éventuellement le refuser et dénoncer les éventuels défauts 8 jours au plus tard après la livraison. À l’expiration de ce délai, le Produit sera considéré comme accepté par le Client. Si A.A.M. accepte, à sa discrétion, la restitution du Produit, celui-ci devra être réexpédié dans ses conditions d’origine, dans son emballage, avec un bon de retour et la preuve d’achat ; les frais de restitution seront à la charge du Client.7 – ResponsabilitàA.A.M. ne sera en aucun cas responsable de dommages directs ou indirects, de pertes conséquentes en cas de non fonctionnement ou de mauvais fonctionnement des Produits, de perte d’affaires, profits, salaires, rétributions, épargnes, sauf ce qui est prévu par les garanties légales ou dans ces conditions générales. A.A.M. ne sera pas responsable non plus des dommages causés pendant l’installation des Produits au sol, des meubles, des bibelots, de la décoration et de tout ce qui est présent dans les locaux, le Client reconnaissant avoir le devoir contractuel précis de veiller à la protection préventive et au déplacement de ceux-ci. Le Client reconnaît avoir été préalablement averti par A.A.M. des interventions nécessaires à l’installation des Produits, notamment de leurs modalités et de leurs caractéristiques.8 – Force majeureA.A.M. ne sera pas responsable du retard dans l’acquittement de ses obligations (y compris le retard de livraison) si ce retard est causé par des circonstances hors de son contrôle raisonnable et il aura le droit de jouir d’une extension temporelle pour s’en acquitter; les cas de force majeure comprennent les grèves, les problèmes de fourniture/ transport/ fabrication, les oscillations du taux de change, les actions gouvernementales et règlementaires, les catastrophes naturelles. Si l’événement de force majeure persiste pendant plus de 2 mois, chaque Partie aura le droit de résilier le Contrat, sans devoir aucun dédommagement à la contrepartie.9 – Protection des données à caractère personnelLes données à caractère personnel du Client seront traitées, conservées et /ou communiquées conformément à la loi et le Client y consent d’ores et déjà, aux termes et sous l’effet de la règlementation en vigueur sur la protection de la vie privée. Le Client pourra exercer ses droits d’accès, de correction, de suppression et de blocage du traitement de ses données en écrivant à A.A.M.. Le Client pourra imposer à A.A.M. de ne pas utiliser ses données à des fins de marketing.10 – Garantie10.1 Cadre d’applicationCette garantie est destinée aux Clients opérant dans le cadre de leur activité professionnelle, selon la définition de l’article 1. Les ventes concernées par ces conditions générales se réfèrent à des Produits qui ne sont pas destinés aux consommateurs, tels qu’ils sont déterminés par l’article 3 du D. L. 206/2005. La garantie concerne les défauts des Produits, i.e. les imperfections matérielles pouvant avoir des répercussions considérables sur l’utilisation ou la valeur de ces Produits et se référant à des anomalies du processus de production, de fabrication, de formation ou de conservation. Elle est efficace dans les limites et aux conditions suivantes.10.2 DuréeA.A.M. garantit les Produits pendant un an à compter de la date livrasion.10.3 ApplicationExcepté les précisions, les exclusions ou les limitations indiquées ci-après, ou rappelées dans ce contrat, la garantie s’applique aux défauts des Produits, tels qu’ils sont déterminés selon la définition de l’article 1490, 1er alinéa du Code civil.10.4 Modalités, délais et échéances pour faire valoir le droit à la garantieDès que le défaut est constaté, le Client est tenu de le communiquer par écrit à A.A.M., en joignant une copie de la facture et de l’Acceptation de référence et en indiquant le numéro de série du bien défectueux. La communication doit parvenir par écrit à A.A.M. au plus tard 8 jours après la constatation, sous peine de perdre le droit de garantie. Le droit à la garantie se prescrit par un an. Toute intervention du Client ou de tiers sur le Produit défectueux sans l’autorisation écrite de A.A.M. constitue motif de déchéance de la garantie.10.5 Exclusions et limitationsSauf ce qui est spécifié ailleurs, la garantie est exclue si le défaut est causé ou accentué par une utilisation non conforme du Produit de la part du Client ou de tiers, ou par un entretien non-conforme aux indications du producteur, ou par des interventions de toute nature, y compris d’entretien, sur le produit non effectuées ou non autorisées par A.A.M.. La garantie est également exclue :- si la communication dénonçant le défaut n’est pas accompagnée des documents et si les informations prévues par l’article 10.4 ne sont pas fournies;- si les Produits ont été installés, conservés ou stockés dans des endroits inaptes à protéger leur qualité (à l’extérieurs, endroits humides ou peu aérés);- si les Produits n’ont pas été montés correctement ou s’ils ont été manipulés, complétés par des pièces et des composants non d’origine ou non autorisés par A.A.M., nettoyés selon des procédures ou avec des produits sus-ceptibles de les abîmer;- en cas de dommages qui ne découleraient pas de défauts de production à l’origine ni de la mauvaise qualité des matériaux utilisés, mais qui seraient la conséquence de faits ou d’événements traumatiques pour le produit dont, à simple titre d’exemple sans contempler tous les cas de figure, nous citons : chocs, bosses, éraflures, coupures, taches causées par des facteurs externes (teintures, laques, produits d’entretien);- pour les dommages causés par l’usure normale des Produits;- si les Produits ne sont pas utilisés par les sujets auxquels ils sont destinés et pour lesquels ils sont produits, à savoir coiffeurs, esthéticiens, salons de beauté, beauty farms.10.6 Conditions particulières de GarantieSelon la matière ou le composant indiqué ci-après, les conditions particulières de garantie en vigueur sont les suivantes:Pompes des bases:deux années sont garanties par la date de livraison.Skaï:Le skai, en particulier le blanc et les coleurs claires, la garantie ne couvre pas les dommages qui ne découleraient pas de défauts de production à l’origine ni de la mauvaise qualité des matériaux utilisés, mais qui seraient la conséquence de faits ou d’événements traumatiques pour le produit dont, à simple titre d’exemple sans contempler tous les cas de figure, nous citons : chocs, éraflures, coupures, taches causées par des facteurs externes (teintures, laques, produits d’entretien, tissu denim). L’éventuelle différence de tonalité de couleur présentée par des articles ou des Produits revêtus du même skaï ne peut être considérée comme un défaut d’origine.Pièces peintes :La garantie ne couvre pas les dommages qui ne découleraient pas de défauts de production à l’origine ni de la mauvaise qualité des matériaux utilisés, mais qui seraient la conséquence de faits ou d’événements traumatiques pour le produit dont, à simple titre d’exemple sans contempler tous les cas de figure, nous citons : chocs, bosses, éraflures, coupures, taches causées par des facteurs externes (teintures, laques, produits d’entretien). L’éventuelle différence de tonalité de couleur présentée par des articles ou des Produits revêtus de la même peinture ne peut être considérée comme un défaut d’origine.Pièces en aluminium :La garantie ne couvre pas les dommages qui ne découleraient pas de défauts de production à l’origine ni de la mauvaise qualité des matériaux utilisés, mais qui seraient la conséquence de faits ou d’événements traumatiques pour le produit dont, à simple titre d’exemple sans contempler tous les cas de figure, nous citons : chocs, bosses, éraflures, coupures, taches causées par des facteurs externes (teintures, laques, produits d’entretien). L’éventuelle différence de tonalité présentée par des articles ou des Produits comportant les mêmes pièces en aluminium ne peut être considérée comme un défaut d’origine.Pièces électriques et appareils électriques (excepté les néons, les leds et les ampoules)Ils rentrent dans les conditions générales de garantie sauf si le dommage est causé par des écarts de tension de secteur qui dépasseraient les limites prévues par la réglementation CE (220/240 V, 50 Hz, +/- 10%).Néons, leds et ampoules : Ils ne rentrent pas dans les conditions générales de garantie puisqu’il s’agit de consommables. Lors de la livraison, le respect des paramètres de température, couleur et rendu chromatique indiqués dans les spécifications figurant au catalogue des producteurs principaux (pour exemple: catalogue Philips paragraphe 12) est exclusivement garanti. Le Client est par conséquent tenu de vérifier immédiatement les composants cités dans ce paragra-phe et, en cas de différences par rapport à ces spécifications, il sera tenu de le communiquer par écrit à A.A.M. au plus tard 8 jours après la réception de la marchandise, faute de quoi, le Client perdra son droit de faire valoir la différence susmentionnée. L’usure normale des articles due à l’usage reste exclue des conditions de garantie et le Client déclare savoir, renonçant d’ores et déjà à toute prétention à ce sujet, qu’avec le temps, les néons, les leds et les ampoules peuvent présenter des différences de couleur ou cesser de fonctionner.Verres et miroirs : La garantie ne couvre pas les dommages qui ne découleraient pas de défauts de production à l’origine ni de la mauvaise qualité des matériaux utilisés, mais qui seraient la conséquence de faits ou d’événements traumatiques pour le produit dont, à simple titre d’exemple sans contempler tous les cas de figure, nous citons : chocs, bosses, éraflures, coupures, taches causées par des facteurs externes (teintures, laques, produits d’entretien.)Cuvettes:La garantie ne couvre pas les dommages qui ne découleraient pas de défauts de production à l’origine ni de la mauvaise qualité des matériaux utilisés, mais qui seraient la conséquence de faits ou d’événements traumatiques pour le produit dont, à simple titre d’exemple sans contempler tous les cas de figure, nous citons : chocs, bosses, fissures, ébréchures, éraflures, coupures, taches causées par des facteurs externes (teintures, laques, produits d’entretien.)Robinetterie, douches et flexibles :La robinetterie est garantie 5 ans, les douches et les flexibles 6 mois.10.7 Modalités d’intervention de A.A.M.A.A.M. examinera le produit et évaluera, incontestablement, si le problème rentre ou non dans la couverture de la garantie commerciale. Par l’intermédiaire de son service d’intervention, ou d’un partenaire d’assistance agréé, et après avoir examiné le produit, A.A.M. s’engage au replacement et réparation des pièces qui résultent défectueuses à l’origine, qui seront retournés départ usine. Dans le cas que soit demandé l’envoi des pièces de rechange, les frais de transport et le risque relatif seront à charge de l’acquirent. En tous cas n’est pas inclue dans les garanties la prestation de main d’oeuvre, comme aussi les éventuels dommages subis par l’acquirent. Les pièces rempla-cées deviendront propriété de A.A.M.. Si l’article n’est plus en vente chez Maletti, celui-ci le substituera par une pièce adéquate. Seul A.A.M. pourra établir la substitution qui sera à juger adéquate.10.8 Exclusion de reconnaissance implicite du défautEn référence à l’article 1495, 2e alinéa du code civil, il est précisé que l’intervention de A.A.M., ou d’une personne déléguée et agréée par lui, ne comporte pas la reconnaissance du défaut mais qu’elle vise exclusivement à évaluer la dénonciation présentée par le client. De même, l’intervention de A.A.M., ou d’une personne déléguée et agréée par lui, pour le remplacement ou la réparation, ne comporte aucune reconnaissance, puisque cette intervention peut avoir été effectuée dans le but d’éviter un contentieux et/ou en vue d’une transaction. Le défaut ne sera reconnu aux termes de la loi que s’il l’a été explicitement par écrit.11 – JAssistance hors garantieAu cas où un client demanderait à A.A.M. une assistance hors garantie sur ses Produits, toutes les dépenses et les charges accessoires que A.A.M. supportera pour les pièces de rechange, les heures ouvrées, les frais de dépla-cement, vivre et couvert nécessaires pour compléter l’assistance seront débitées au client.12 – JuridictionLe présent contrat est soumis au droit italien. En cas de litige seul le tribunal de Reggio Emilia sera compétent.13 – Clauses finalesLe text en langue italienne de ce contract c’est le seul qui fait foi comme text original.

Aux termes et sous l’effet des articles 1341 et 1342 du Code civil, le Client déclare avoir pris connaissance avec attention et approuver expressément les articles suivants des Conditions Générales de Vente et de Garantie A.A.M. Srl. : article 2 (efficacité), article 3 (commandes), article 4 (prix et conditions de paiement), article 5 (livraison/titre/risque), article 6 (réception), article 7 (responsabilité), article 8 (force majeure), article 10 (garantie, paragra-phes : 10.1, 10.2, 10.3, 10.4, 10.5, 10.6, 10.7, 10.8), article 12 (juridiction). art. 13 (clauses finales).

DEUTSCH1 - DefinitionenDer Kunde: Einzel- oder rechtliche Person, die in ihrem betrieblichen, kommerziellen, handwerklichen oder professionellen Interesse handelt, bzw. deren Stellvertreter, die von A.A.M. vertriebene Produkte kaufen. -A.A.M.: A.A.M. Srl mit Geschäftsitz in Strasse Industria n. 7, 42019 Scandiano (RE) – Italien, Vertreiber der Produkte. Auftragsbestätigung: Schriftliche Bestätigung der bestellten Ware, die A.A.M. an den Kunden schickt. Preis: Der in der Auftrag-sbestätigung ausgewiesene Preis. Ware/n: Die in der Auftragsbestätigung beschriebene/n Waren. Vertrag: Zwischen der A.A.M. und dem Kunden mittels Austausch von Auftrag und Auftragsbestätigung entstandener Vertrag, der durch vorliegende Allgemeine Geschäftsbedingungen (nachstehend AGB) geregelt ist.2 - GültigkeitVorliegender Vertrag gilt für die gegenwärtigen und zukünftigen Verkaufsabschlüsse zwischen A.A.M. und dem Kunden, vorbehaltlich die sukzessive Vereinbarung von anderslautenden und abweichenden Verkaufs- und Garan-tiebedingungen. Der Versand eines Auftrages impliziert die Annahme des Vertrages.3 - AufträgeAufträge werden schriftlich angenommen (einschließlich elektronischem Postweg und Fax) und verpflichten die A.A.M. und die Vertragspartner sobald A.A.M. die Auftragsbestätigung schickt. Der Kunde muss die Auftragsbestäti-gung sofort prüfen und der A.A.M. eventuelle Fehler sofort schriftlich melden. Im gegenteiligen Fall wird der Inhalt Auftragsbestätigung zum Vertragsinhalt. Aufträge werden nur angenommen, wenn sie von diesen vom Kunden unterzeichneten AGBs begleitet und von der A.A.M. mittels Auftragsbestätigung bestätigt werden. Nachfolgende von A.A.M. angenommene und bestätigte Aufträge unterstehen den vorliegenden Allgemeinen Geschäftsbedingungen.4 - Preise und ZahlungsweiseKostenvoranschläge der A.A.M. sind nur in schriftlicher Form und für den angegebenen Zeitraum gültig. Der Preis bezieht sich ausschließlich auf die gelisteten Waren und Leistungen ohne Mehrwertsteuer. Die Zahlung erfolgt gemäß der in der Auftragsbestätigung angegebenen Modalitäten und Zeiten. A.A.M. behält sich das Recht vor, die Lieferung oder Auftragsausführung bis zum Erhalt der Zahlung zu verzögern, sofern Vorkasse vereinbart wurde bzw. im Falle von Zahlungsverzögerungen des Kunden für bereits erfolgte Lieferungen.Der Kunde verzichtet ausdrücklich auf eine Verrechnung zwischen den Beträgen, die er der A.A.M. schuldet sowie allen sonstigen Summen, für die er Forderungen offen hat bzw. behauptet zu haben aus wie immer gearteten Gründen, auch wenn diese fällig und zahlbar sind und auch wenn sie nicht streitig oder rechtlich einziehbar sind. Im Falle von Zahlungsverzögerungen werden dem Kunden Verzugszinsen gemäß Gesetz Nr. 231/2002 auf den ausstehenden Rechnungsbetrag berechnet, sowie die Inkassokosten ohne formelle Verzugsmitteilung. 5 - Lieferung / Eigentum / RisikoDer in der Auftragsbestätigung enthaltene Liefertermin versteht sich als Richtlinie. Teillieferungen sind zulässig. Der Ort der Auslieferung ist in der Auftragsbestätigung enthalten. Das Transportrisiko der Ware liegt ausschließlich beim Kunden auch bei frachtfreier Lieferung. Der Eigentumsanspruch der Ware geht erst bei der vollständigen Begleichung des Rechnungsbetrages auf den Kunden über. Mit Ausnahme der Bestimmungen des Artikel 1525 des Zivilkodes kann die A.A.M. (ohne Verpflichtung dem Kunden gegenüber) erneut in den Besitz der Ware gelangen. A.A.M. kann zum Erhalt des Preises den Rechtsweg auch vor Übertrag des Eigentums einschlagen. Bei Annahme-verweigerung des Kunden ohne vorherige Absprache mit A.A.M. gehen die daraus entstandenen Kosten oder Verluste der A.A.M., einschließlich der Lagerung bis zur Annahme der Lieferung, zu Lasten des Kunden.6 - AnnahmeBei Anlieferung der Ware muss der Kunde diese sofort kontrollieren und die Lieferung im Falle verweigern bzw. Fehler innerhalb von acht Tagen ab Liefertag melden. Nach Ablauf dieser Frist versteht sich die Lieferung als angenommen. Wird auf Kulanzweg eine Rücksendung der Ware mit der A.A.M. vereinbart, so muss diese in ihrer Originalverpackung und –Zustand mit einem Warenrückschein und dem Kaufbeleg zurückgesendet werden. Die Rückführungskosten gehen zu Lasten des Kunden.7 – HaftungA.A.M. haftet in keinem Fall für direkte oder indirekte Schäden bzw. daraus resultierende Verluste aufgrund von nicht oder fehlerhaft funktionierenden Produkten, für den Ausfall von Verdienst, Gewinn, Gehälter, Honoraren, Spa-reinlagen, vorbehaltlich der gesetzlichen Garantieregelungen oder vorliegender AGB.A.A.M. haftet ebenfalls nicht für Schäden bei der Montage der Waren an Böden, Möbeln, Dekorationen, Einrichtung und sonstigen Gegenständen im Lokal; der Kunde akzeptiert, dass er vertraglich verpflichtet ist, für diese vorher Schutzmaßnahmen zu ergreifen oder sie zu entfernen bzw. zu verschieben.Der Kunde erkennt an, dass er rechtzeitig von der A.A.M. bezüglich der notwendigen Maßnahmen und Eingriffe für die Montage und Installation der Produkte, sowie die Vorgehensweise dafür und die Merkmale dieser informiert wurde.8 - Höhere GewaltA.A.M. haftet nicht für Verspätungen bei der Erfüllung ihrer Verpflichtungen (einschließlich Lieferverspätungen), wenn diese durch Ereignisse verursacht wurden, die sich ihrer Kontrolle entziehen. A.A.M. hat das Recht auf eine Verlängerung der Fristen zur Erfüllung ihrer Verpflichtungen; Beispiele Höherer Gewalt sind Streiks, Liefer-/Transport-/Fertigungsprobleme, Schwankungen des Wechselkurses, Maßnahmen der Regierung oder der Gesetzgebung, Naturkatastrophen. Bei einer Dauer von mehr als zwei Monaten des Zustandes Höherer Gewalt haben beide Parteien das Recht vom Vertrag zurückzutreten, ohne dass die Gegenpartei Anspruch auf Entschädigung hat.9 - DatenschutzDie persönlichen Daten des Kunden werden gemäß der gesetzlichen Vorschriften aufbewahrt und /oder gemeldet. Der Kunde stimmt hiermit den geltenden Bestimmungen zum Datenschutz zu. Der Kunde hat das Recht auf seine Daten zuzugreifen, sie zu berichtigen, zu löschen und die Datenhandhabung zu sperren, indem er dies der A.A.M. schriftlich mitteilt. Der Kunde hat das Recht der A.A.M. den Gebrauch seiner Daten zu Marketingzwecken zu untersagen.10 - Garantie10.1 AnwendungsbereichDie Garantie beschränkt sich auf Kunden und ihre professionelles Umfeld, gemäß der Definition unter Punkt 1. Der Vertrieb der Ware unter diesen AGBs bezieht sich auf Ware, die nicht für den Gebrauch von Privatnutzern bestimmt ist, wie in Artikel 3 des Gesetzes 206/2005 festgelegt.Die Garantie bezieht sich auf Defekte der Ware, wie materielle Fehler, die in bedeutender Weise den Gebrauch und den Wert der Ware einschränken, Fehler der Produktion, der Fertigung, der Montage, der Aufbewahrung und des fachgemäßen Gebrauchs innerhalb des nachstehend gelisteten Rahmens.10.2 GarantiezeitA.A.M. garantiert seine Produkte für 12 Monate ab Lieferdatum.10.3 AnwendungMit Ausnahme anderslautender Bestimmungen, Ausnahmen oder nachstehenden bzw. in den AGB beschriebenen Einschränkungen gilt die Garantie für Warenfehler gemäß Art, 1490, 1. Komma des Zivilgesetzbuches10.4 Modalitäten, Dauer und Verfall der GarantieleistungDer Kunde muss der A.A.M. die Feststellung fehlerhafter Ware schriftlich melden, eine Rechnungskopie und die Auftragsbestätigung, sowie die Fabriknummer (Serial number) des beanstandeten Stückes beilegen.Die Reklamation muss der A.A.M. nnerhalb von acht Tagen nach Feststellung gemeldet werden, sonst erlischt der Garantieanspruch. Die Garantieleistung gilt für 12 Monate.Jeder nicht schriftlich von A.A.M. genehmigte Eingriff des Kunden oder Dritter führt zum Erlöschen des Garantieanspruchs.10.5 Ausnahmen und EinschränkungenVorbehaltlich anderweitiger Erläuterungen erlischt der Garantieanspruch, wenn der Fehler durch unsachgemäßen Gebrauch des Kunden oder Dritter verursacht oder verschlimmert wurde, bzw. durch eine nicht vom Hersteller genehmigte Veränderung oder Veränderungen beliebiger Art, auch wartungstechnisch, auf dem Gerät, die nicht von A.A.M. durchgeführt oder genehmigt wurden.Es besteht kein Garantieanspruch wenn:- bei der Fehlermeldung die verlangten Unterlagen fehlen und die unter Punkt 10.4 erforderlichen Informationen nicht geliefert werden;- wenn die Ware in Räumen installiert, gelagert oder aufbewahrt wurden, die deren Qualität negativ beeinflussen (z.B. in Außenbereichen, feuchten oder schlecht belüfteten Räumen);- wenn die Ware unsachgemäß montiert wurde oder sie verändert oder nicht original bzw. nicht von A.A.M. genehmigte Elemente oder Bauteile montiert wurden, sie unsachgemäß gereinigt oder schädliche Reinigungsmittel verwendet wurden;- bei Schäden, die nicht durch Herstellungsfehler und/oder die mangelhafte Qualität der Baumaterialien verursacht wurden, sondern Folge von Schäden der Ware sind, wie beispielsweise: Stöße, Beulen, Kratzer, Schnitte, Flecken, die durch externe Faktoren wie Tönungen, Lacke für Reinigungszwecke verursacht wurden;- normale Verschleißschäden der Ware;- Gebrauch der Ware von Personen für die sie nicht bestimmt ist, d.h. Frisöre, Kosmetiker, Kosmetiksalons und Schönheitsfarmen.10.6 – Besondere GarantiebedingungenEs gelten folgende besondere Garantiebedingungen abhängig vom Bauteil oder vom nachstehend gelisteten Material:Pumpen:Garantie 24 Monate ab LieferdatumKunstleder / Skay:Für Kunstleder, speziell in weiß oder hellen Farben, gilt die Garantieleistung nur für Defekte und Fehler aus der Produktion und /oder die mangelhafte Qualität des verwendeten Materials. Die Garantie gilt nicht für Folgeschäden des Materials, wie beispielsweise (die Liste versteht sich nicht als vollständig): Schläge, Kratzer, Schnitte, Flecken durch externe Einwirkung wie Tönungsmittel, Lacke, Reinigungsmittel, Denimstoff. Eventuell unterschiedliche Farbnuancen des Materials auf Waren oder Artikeln mit dem gleichen Kunstleder verstehen sich nicht als Fehler.Lackierte Teile:Die Garantieleistung gilt nur für Defekte und Fehler aus der Produktion und /oder die mangelhafte Qualität des verwendeten Materials. Die Garantie gilt nicht für Folgeschäden des Materials, wie beispielsweise (die Liste versteht sich nicht als vollständig): Schläge, Kratzer, Schnitte, Flecken durch externe Einwirkung wie Tönungsmittel, Lacke, Reinigungsmittel. Eventuell unterschiedliche Farbnuancen des Materials auf Waren oder Artikeln mit der gleichen Lackierung verstehen sich nicht als Fehler.Aluminiumteile:Die Garantieleistung gilt nur für Defekte und Fehler aus der Produktion und /oder die mangelhafte Qualität des verwendeten Materials. Die Garantie gilt nicht für Folgeschäden des Materials, wie beispielsweise (die Liste versteht sich nicht als vollständig): Schläge, Kratzer, Schnitte, Flecken durch externe Einwirkung wie Tönungsmittel, Lacke, Reinigungsmittel. Eventuell unterschiedliche Farbnuancen des Materials auf Waren oder Artikeln mit der gleichen Aluminiumverarbeitung verstehen sich nicht als Fehler.Elektrische Bauteile und Geräte (mit Ausnahme von Neonleuchten, Led und Glühbirnen):Sie sind Teil der allgemeinen Garantieleistungen vorbehaltlich von Schäden, die durch Stromstöße der Netzspannung verursacht werden, die über den von der CE Norm vorgesehenen Grenzwerten (220/240 V, 50hz, +/- 10%) liegen.Neonleuchten, Led und Glühbirnen: Da es sich um Verbrauchsmaterial handelt, werden diese Teile nicht von der allgemeinen Garantie abgedeckt.Es wird zum Zeitpunkt der Lieferung ausschließlich die Einhaltung der Parameter zu Farbtemperatur und farblicher Leistung, wie in den technischen Merkmalen des Katalogs beschrieben, gewährleistet (z.B. Katalog Philips, Abschnitt 12). Der Kunde ist verpflichtet, die davon betroffenen Bauteile sofort zu prüfen und der A.A.M. eventuelle Abweichungen von den Spezifikationen innerhalb von acht Tagen nach Liefererhalt zu melden; geschieht dies nicht, erlischt der Kundenanspruch auf Reklamation.Normale Verschleißerscheinungen durch den Gebrauch sind von der Garantieleistung der Ware ausgenommen und der Kunde erklärt, über diese Klausel informiert zu sein und auf jedweden Anspruch auf Reklamation für Neon-leuchten, Led und farblich veränderte oder nicht mehr funktionierende Glühbirnen zu verzichten.Glas und Spiegel:Die Garantieleistung gilt nur für Defekte und Fehler aus der Produktion und /oder die mangelhafte Qualität des verwendeten Materials. Die Garantie gilt nicht für Folgeschäden des Materials, wie beispielsweise (die Liste versteht sich nicht als vollständig): Schläge, Kratzer, Schnitte, Flecken durch externe Einwirkung wie Tönungsmittel, Lacke, Reinigungsmittel.Waschbecken:Die Garantieleistung gilt nur für Defekte und Fehler aus der Produktion und /oder die mangelhafte Qualität des verwendeten Materials. Die Garantie gilt nicht für Folgeschäden des Materials, wie beispielsweise (die Liste versteht sich nicht als vollständig): Schläge, Kratzer, Schnitte, Flecken durch externe Einwirkung wie Tönungsmittel, Lacke, Reinigungsmittel.Armaturen, Duschköpfe und Schläuche:Die Garantie für Armaturen beträgt einz Jahre, die Duschköpfe und Schläuche sind für sechs Monate garantiert.10.7 – Eingriffe der A.A.M.Die A.A.M. prüft die Ware und wird nach ihrem unanfechtbaren Urteil entscheiden, ob die Ware unter den handelsüblichen Garantieanspruch fällt. Der firmeneigene Kundendienst oder ein Vertragshändler, der mit der Begutachtung der Ware beauftragt ist, entscheidet im Anschluss, ob die fabrikseitig defekten Bauteile ersetzt oder repariert und dazu ab Werk geliefert werden. Bei Ersatzteilanforderungen gehen die Transportkosten und das Risiko zu Lasten des Käufers. In der Garantieleistung sind in keinem Fall die Lohnkosten und eventuelle Schäden des Käufers enthalten. Die ausgetauschten Bauteile sind Eigentum der A.A.M.. Bei Artikeln, die A.A.M. nicht mehr vertreibt, wird der defekte Artikel gegen einen vergleichbaren ersetzt. Die Entscheidung welcher Artikel als vergleichbarer Ersatz betrachtet wird unterliegt dem ausschließlichen und unanfechtbaren Urteil der A.A.M..10.8 – Implizite Anerkennung von SchädenUnter Bezugnahme des Artikels 1495, 2. Komma des Zivilgesetzbuches wird ausdrücklich darauf verwiesen, dass der Eingriff der A.A.M. oder eines befugten Beauftragten keine Anerkennung des Schadens impliziert, sondern ausschließlich der Beurteilung der Kundenmeldung dient. Die von der A.A.M. oder einem befugten Beauftragten durchgeführten Reparaturen oder Ersatzmaßnahmen stellen keine Schadensanerkennung dar, da sie mit dem Ziel, ein Streitverfahren zu vermeiden und/oder aus vertraglichen Gründen durchgeführt wurden. Die gesetzliche Anerkennung von Fehlern bedarf der ausdrücklich schriftlichen Form.11– Kundendienst außerhalb der GarantieleistungFordert der Kunde eine Serviceleistung der A.A.M. für Ware, die nicht der Garantieleistung unterliegt, wird A.A.M. dem Kunden sämtliche Kosten und den Aufwand für Ersatzteile, Arbeitsstunden, Reisekosten, Unterkunft und Verpflegung, die für den Kundendienst notwendig sind, in Rechnung stellen.12– GerichtsstandVorliegender Vertrag unterliegt der italienischen Gesetzgebung und der Gerichtsstand ist ausschließlich Reggio Emilia13– AbschlussklauselnDie italienische Version dieses Vertrags bildet die ausschließliche Rechtsgrundlage.

Gemäß der Artikel 1341 und 1342 des Zivilgesetzbuches erklärt der Kunde, folgende Artikel der Allgemeinen Geschäftsbedingungen und Garantieleistungen der AAM Srl. gelesen und ausdrücklich anerkannt zu haben: Art. 2 (Gültigkeit), Art. 3 (Bestellungen), Art. 4 (Preise und Zahlungsweise), Art. 5 (Lieferung/Eigentum/Risiko), Art. 6 (Annahme), Art. 7 (Haftung), Art. 8 (Höhere Gewalt), Art. 10 (Garantie, Punkte: 10.1, 10.2, 10.3, 10.4, 10.5, 10.6, 10.7, 10.8), Art. 12 (Gerichtsstand), Art. 13 (Abschlussklauseln).

enESPAÑOL1 – DefinicionesEl Cliente: la persona física o jurídica que actúa en ejercicio de su propia actividad empresarial, comercial, industrial o profesional, o bien un intermediario de la misma que compra Productos comercializados por A.A.M.. A.A.M. la sociedad A.A.M. Srl, con sede en Via Industria n.1, 42019 Scandiano (RE) - Italia, que vende los Productos. Confirmación del Pedido: aviso escrito de confirmación del Producto pedido, enviado al Cliente por A.A.M. Precio: el indicado en la Confirmación del Pedido. Producto/s: el/los indicado/s en la Confirmación del Pedido. Contrato: el celebrado entre A.A.M. y Cliente mediante el intercambio de Pedido y Confirmación del Pedido, regulado por las presentes condiciones de venta y garantía.2 – EficaciaEl presente Contrato se aplica a la presente venta y a cada venta siguiente entre A.A.M. y el Cliente, con excepción de los casos en que se firmen condiciones de venta y garantía diferentes. El envío de pedido implica la aceptación del Contrato.3 – PedidosLos pedidos se aceptan por escrito (incluidos correo electrónico y telefax) y se consideran vinculantes para A.A.M. y entre las partes cuando A.A.M. envía al Cliente la Confirmación de Pedido. El Cliente debe controlar inmedia-tamente la Confirmación de Pedido y comunicar enseguida y por escrito a A.A.M. cualquier error que hubiera encontrado. Si en los tres días siguientes A.A.M. no recibe ninguna comunicación, las indicaciones contenidas en la Confirmación de Pedido se aplicarán al Contrato. No se aceptará ningún pedido que no esté acompañado por las presentes condiciones generales de venta y garantía firmadas por el Cliente. Los pedidos siguientes, aceptados y confirmados mediante la Confirmación de Pedido, si regirán siempre por el presente Contrato.4 – Precio y plazos de pagoLos presupuestos de A.A.M. tienen validez solamente si están redactados por escrito y durante el período indicado en los mismos. El Precio incluye exclusivamente los bienes y las prestaciones indicadas y tiene que entenderse en cualquier caso al neto del IVA. El pago tendrá que realizarse según las formas y los plazos indicados en la Confirmación de Pedido. A.A.M. puede suspender la entrega o la ejecución del Pedido hasta el pago efectivo del mismo, si se hubiera concordado el pago por adelantado, o bien si hubiera expirado el plazo de pago de la transacción anterior y aún no se lo hubiera saldado.El Cliente renuncia desde ahora a cualquier excepción de compensación entre las sumas que debiera a A.A.M. y cualquier otra suma de la que él mismo fuera acreedor o se considere acreedor, a cualquier título, aunque fuera una suma líquida y exigible y aunque no hubiera sido impugnada y fuera legalmente exigible.En caso de retraso del pago, el Cliente tendrá que pagar los intereses según el DL n.231/2002 sobre la suma aún debida, como asimismo los costes de recuperación de la misma, sin necesidad de la puesta en mora formal.5 – Entrega / Título / RiesgoEl plazo de entrega indicado en la Confirmación del Pedido es indicativo. Se admiten las entregas parciales. El lugar de entrega será el indicado en la Confirmación del Pedido. Las mercancías viajan siempre por cuenta y a riesgo y ventura del destinatario, incluso en caso de ventas francas hasta destino, o sea, con porte pagado. El traspaso de la propiedad del Producto se hará solamente tras el efectivo pago del precio total. Salvo todo lo previsto por el Artículo 1525 del Código Civil, A.A.M. podrá (sin responsabilidad hacia el Cliente) entrar en poder del Producto. A.A.M. podrá actuar en juicio para lograr que se le pague el Precio, incluso antes del traspaso de la propiedad. En caso de que el Cliente rechace la entrega sin previo acuerdo con A.A.M., correrán por su cuenta los gastos y las pérdidas sostenidas por A.A.M. a causa de la falta de aceptación, incluidos los gastos de depósito hasta la aceptación de la entrega.6 – AceptaciónAl recibir el Producto, el Cliente tiene que controlarlo e inspeccionarlo y, si fuera el caso, rechazarlo o denunciar eventuales vicios dentro de 8 (ocho) días como máximo, contados a partir de la entrega. Al vencer dicho plazo, se considerará que el Producto ha sido aceptado por el Cliente. Si A.A.M. acepta, a su propia discreción, la devolución del Producto, el Cliente tendrá que restituirlo en sus condiciones originales, con el respectivo embalaje, con una nota de devolución y la prueba efectiva de compra; los costes de devolución correrán por cuenta del Cliente.7 – ResponsabilidadesA.A.M. no será responsable en ningún caso por daños directos o indirectos o pérdidas derivadas de la falta o del mal funcionamiento de los Productos, por pérdida de negocios, ganancias, sueldos, remuneraciones, ahorros, salvo lo previsto por las garantías de ley o lo previsto en las presentes condiciones generales. A.A.M. tampoco será responsable por daños causados durante la instalación de los Productos en el suelo, muebles, objetos de decoración y en general, y todo lo pudiera haber en los locales. El Cliente reconoce su obligación contractual de realizar la protección o el desplazamiento de los mismos.El Cliente reconoce que ha recibido de A.A.M., por adelantado, todas las advertencias acerca de las obras necesarias para la instalación de los Productos, de manera especial sobre las formas y características de los mismos.8 – Fuerza MayorA.A.M. no será responsable por el retraso del cumplimiento de sus obligaciones (incluido el retraso en la entrega) si dicho retraso haya sido causado por circunstancias fuera de su razonable control y tendrá derecho a una extensión del plazo para el cumplimiento; los ejemplos de eventos de fuerza mayor incluyen huelgas, problemas de abastecimiento/fabricación, oscilaciones de las tasas de cambio, acciones gubernamentales o reglamentarias, catástrofes naturales. Si el evento de fuerza mayor persiste un período superior de 2 meses, cada una de las Partes tendrá derecho a rescindir el Contrato, sin que se deba ningún resarcimiento a la contraparte.9 – Protección de los Datos PersonalesLos datos personales del Cliente serán tratados, conservados y/o comunicados de acuerdo con lo establecido por la ley y el Cliente suministra desde ahora, su consentimiento para todos los efectos establecidos por las normas vigentes sobre la tutela de la privacidad. El Cliente podrá ejercer los derechos de acceso, corrección, cancelación y bloqueo del tratamiento de sus propios datos enviando una carta a A.A.M.. El Cliente podrá imponer a A.A.M. que no utilice sus datos con fines de marketing.10 – Garantía10.1. Ámbito de operatividadLa presente garantía está destinada a los Clientes que trabajan en el ámbito de su propia actividad profesional, según la definición del artículo 1. Las ventas a que se refieren las presentes condiciones generales conciernen a Productos no destinados a los consumidores, como individualizados en el artículo 3 del DL.206/2005.La garantía concierne a los vicios de los Productos, entendiéndose como tales las imperfecciones materiales de los mismos, tales que puedan incidir de manera relevante sobre la utilizabilidad o sobre su valor, relativas a ano-malías del proceso de producción, fabricación, formación, conservación, y que trabaje dentro de los límites y conforme a las condiciones indicadas a continuación.10.2 – DuraciónA.A.M. garantiza los Productos un año desde la fecha de entrega.10.3 – Cuando se aplicaSalvo todo lo indicado, las exclusiones o las limitaciones expuestas a continuación, o que en cualquier caso se encuentren en el presente contrato, la garantía se aplica a los vicios de los Productos, como se identifican en la definición del art.1490 1° apartado del código civil.10.4 – Modalidades, plazos y caducidad para hacer valer el derecho a la garantíaAl descubrir el vicio el Cliente tiene que comunicarlo por escrito a A.A.M., adjuntando la copia de la factura de venta y de la Confirmación del Pedido de referencia e indicando el número de serie (serial number) del bien defec-tuoso.La comunicación debe llegar por escrito a A.A.M. dentro de los ocho días del descubrimiento, bajo pena de caducidad del derecho a la garantía. El derecho de garantía prescribe en el plazo de un año. Toda intervención del Cliente o de terceros en el Producto defectuoso, si no ha sido autorizado por escrito por A.A.M., constituye motivo de caducidad de la garantía.10.5 – Exclusiones y limitacionesSalvo todo lo especificado, se excluye la garantía si el vicio ha sido causado o acentuado por el uso no conforme del Producto de parte del Cliente o de terceros, o bien por el mantenimiento no conforme a las indicaciones del fabricante, o por intervenciones de cualquier naturaleza, incluso de mantenimiento, sobre el mismo, no efectuadas o no autorizadas por A.A.M.. Se excluye la garantía en los siguientes casos:- si no se adjuntan los documentos o no se suministran las informaciones previstas en el art. 10.4 al comunicar el vicio;- si los Productos se han instalado, conservado o almacenado en ambientes no aptos para tutelar la calidad de los mismos (como ambientes externos, húmedos, poco aireados);- si los Productos no se han montado correctamente o si se han alterado, integrado con partes y componentes no originales o no autorizados por A.A.M., si se han limpiado con procedimientos o productos no adecuados y que los hubieran dañado;- en caso de daños no derivados de vicios originarios de fabricación y/o de la mala calidad de los materiales utilizados sino que son consecuencia de hechos o eventos traumáticos para el producto, entre los que se citan a mero título de ejemplo y no exhaustivo; choques, aplastamiento, rayaduras, cortes, manchas causadas por factores externos como tinturas, lacas, productos para la limpieza;- por daños de desgaste del uso normal de los Productos;- si las personas que utilizan los productos no son las mismas a las que están destinados y para quienes se han fabricado, es decir, peluqueros, expertos de belleza, salones de belleza, beauty farms.10.6 – Condiciones especiales de garantíaRigen las siguientes condiciones especiales de garantía de acuerdo con el componente o el material indicado a continuación:Bombas:Se garantizan dos años a partir de la fecha de entrega.Símil cuero (Skay):Los revestimientos con símil cuero, de manera especial los de color blanco y los claros, no están garantizados por los daños que no derivan de vicios originarios de fabricación y/o mala calidad de los materiales utilizados, sino que son la consecuencia de hechos o eventos traumáticos para el producto, entre los que se citan a mero título de ejemplo y no exhaustivo: choques, aplastamiento, rayaduras, cortes, manchas causadas por factores externos como tinturas, lacas, productos para la limpieza, telas denim. No puede considerarse vicio originario la eventual diferencia de tonalidad del color que pudieran presentar los artículos o Productos que llevan el mismo tipo de símil piel.Partes pintadas:No están garantizadas por daños que no deriven de vicios originarios de producción y/o de la mala calidad de los materiales utilizados, sino que son la consecuencia de hechos o eventos traumáticos para el producto, entre los que se citan a mero título de ejemplo y no exhaustivo: choques, aplastamiento, rayaduras, cortes, manchas causadas por factores externos como tinturas, lacas, productos para la limpieza. No puede considerarse vicio originario la eventual diferencia de tonalidad del color que pudieran presentar los artículos o Productos pintados con el mismo tipo de pintura.Partes de aluminio:No están garantizadas por daños que no deriven de vicios originarios de producción y/o de la mala calidad de los materiales utilizados, sino que son la consecuencia de hechos o eventos traumáticos para el producto, entre los que se citan a mero título de ejemplo y no exhaustivo: choques, aplastamiento, rayaduras, cortes, manchas causadas por factores externos como tinturas, lacas, productos para la limpieza. No puede considerarse vicio originario la eventual diferencia de tonalidad del color que pudieran presentar los artículos o Productos con el mismo tipo de partes de aluminio.Partes eléctricas y aparatos eléctricos (excluidos neones, leds y bombillas)Se incluyen en las condiciones generales de garantía salvo que el daño haya sido causado por saltos de la tensión de red que superen los límites previstos por la normativa CE (220/240 V, 50hz, +/- 10%).Neones, leds y bombillas:No se incluyen en las condiciones generales de garantía, tratándose de material de consumo.Se garantiza exclusivamente el respeto, en el momento de la entrega, de los parámetros de temperatura, color y rendimiento cromático indicados en las especificaciones previstas en el catálogo de los principales fabricantes (por ej. catálogo Philips, apartado 12). El Cliente, por tanto, tiene que controlar inmediatamente los componentes a que se refiere el presente apartado y, en caso de deformidades de dichas especificaciones, tendrá que comunicarlas por escrito a AAM dentro y como máximo de 8 días de la recepción de la mercancía; si así no lo hiciere caducará el derecho de hacer valer la citada deformidad. Queda excluido de las condiciones de garantía el desgaste normal de los artículos debido al uso y el Cliente declara saberlo, renunciando desde ahora a cualquier pretensión al respecto, que con el pasar del tiempo, como los neones, los leds y las bombillas de luz, pueden presentar deformidades de color o dejar de funcionar.Cristales y espejos: No están garantizadas por daños que no deriven de vicios originarios de producción y/o de la mala calidad de los materiales utilizados, sino que son la consecuencia de hechos o eventos traumáticos para el producto, entre los que se citan a mero título de ejemplo y no exhaustivo: choques, aplastamiento, rayaduras, cortes, manchas causadas por factores externos como tinturas, lacas, productos para la limpieza. Lavabos de lava-cabezas:No están garantizadas por daños que no deriven de vicios originarios de producción y/o de la mala calidad de los materiales utilizados, sino que son la consecuencia de hechos o eventos traumáticos para el producto, entre los que se citan a mero título de ejemplo y no exhaustivo: choques, aplastamiento, rayaduras, cortes, manchas causadas por factores externos como tinturas, lacas, productos para la limpieza. Grifería, duchas y tubos flexibles:La grifería está garantizada 1 años, las duchas y los tubos flexibles 6 meses.10.7 – Formas de intervención de A.A.M.A.A.M. examinará el producto y evaluará, conforme a su propio e indiscutible juicio, si el problema puede incluirse en la garantía comercial. A.A.M., mediante su propio servicio de intervención o a través de un servicio de asistencia autorizado. Luego de haber examinado el producto, se compromete a reemplazar las piezas que resulten defectuosas originariamente, que el Cliente devolverá con porte pagado hasta la fábrica. En caso de que se pida el envío de piezas de recambio o repuestos, los costes del transporte y el respectivo riesgo correrán por cuenta del comprador. En ningún caso está comprendida en las garantías la mano de obra, como tampoco los eventuales daños sufridos por el comprador. Las piezas sustituidas serán de propiedad de A.A.M.. Si el artículo no estuviera más en venta en A.A.M., la sociedad la reemplazará con otra pieza adecuada. A.A.M. establecerá, a su propia y exclusiva discreción, cual es la sustitución más adecuada.10.8 – Exclusión de implícito reconocimiento del vicioCon referencia al art. 1495 2° apartado del código civil, se precisa que la intervención de A.A.M., o de otro sujeto designado o autorizado por la misma, no comporta el reconocimiento del vicio, sino que está dirigido exclusivamente a la evaluación de la denuncia presentada por el cliente. La intervención de A.A.M., o de otro sujeto delegado o autorizado, en sustitución o reparación, tampoco comporta ningún reconocimiento, pudiendo el mismo haber sido efectuado con el único fin de evitar litigios y/o a los efectos de transacciones. El vicio tiene que considerarse reconocido a los efectos de la ley sólo en los casos en que se hubiera dado comunicación explicita por escrito.11 – Asistencia fuera de la garantíaEn caso de que un cliente solicite a A.A.M. asistencia fuera de la garantía sobre los productos suministrados por la misma, se adeudarán al cliente todos los gastos y los costes accesorios que A.A.M. sostendrá para los recambios, las horas de mano de obra, los gastos de viaje, la comida y el alojamiento necesarios para completar la asistencia.12 – JurisdicciónEl presente contrato se rige por las leyes italianas y está sujeto a la jurisdicción exclusiva del Tribunal de Reggio Emilia.13 – Cláusulas finalesEl texto en idioma italiano del presente contrato es el único al se hace referencia como texto original.

Según y a todos los efectos de los artículos 1341 y 1342 del Código Civil el Cliente declara que ha tomada atenta visión y aprueba expresamente los siguientes artículos de las Condiciones Generales de Venta y de Garantía AAM Srl: art.2 (eficacia), art.3 (pedido), art.4 (precio y plazos de pago), art.5 (entrega/título/riesgo), art.6 (aceptación), art.7 (responsabilidad), art.8 (fuerza mayor), art.10 (garantía, apartados: 10.1, 10.2, 10.3, 10.4, 10.5, 10.6, 10.7, 10.8), art.12 (jurisdicción), art. 13 (Cláusulas finales).
