BEFORE THE BOARD OF PHARMACY OF THE STATE OF IOWA In the Matter of Pharmacist ) ) STIPULATION DONALD M. DUNSHEE, ) (License No. D-13231) ) WHEREAS, Donald M. Dunshee, hereinafter referred to as the Licensee, has had certain allegations and charges against him by the Board of Pharmacy Examiners, hereinafter referred to as the Board, concerning his professional conduct as a pharmacist; and WHEREAS, the Licensee denies the allegations and charges made against him; and WHEREAS, both the Licensee and the Board desire to arrive at a mutually agreeable informal settlement of this matter; IT IS MUTUALLY AGREED AND STIPULATED as follows between the Licensee and the Board: 1. That the Board by and through its executive secretary, Norman C. Johnson, and the Licensee, by and through his attorney, Tom Riley, have entered into settlement discussions and have agreed upon a disposition of this matter. 2. That although the Licensee continues to deny the allegations made against him, he acknowledges that the State may be able to prove a prima facie case of careless or unsatisfactory record keeping for prescriptions issued or filled as required by Chapter 155, Section 155.32, Code of Iowa and regulations issued thereunder. 3. That the Licensee who now resides in Florida desires to avoid the uncertainty and the substantial expense of a trial and desires to consent to the disciplinary action to be taken by the Board as specified in paragraph 6, infra. 4. That the Board recognizes that the conduct in question appears to constitute an unintentional violation and of a record keeping nature rather than of a fraudulent or criminal nature.

WHEREAS Donald M Dunshee hereinafter referred to as

the Licensee has had certain allegations and charges against

him by the Board of Pharmacy Examiners hereinafter referred to

as the Board concerning his professional conduct as a pharmacist

WHEREAS the Licensee denies the allegations and charges

made against him and

WHEREAS both the Licensee and the Board desire to arrive

at a mutually agreeable informal settlement of this matter

IT IS MUTUALLY AGREED AND STIPULATED as follows between the

Licensee and the Board

1 That the Board by and through its executive secretary

Norman C Johnson and the Licensee by and through his attorney

Tom Riley have entered into settlement discussions and have agreed

upon a disposition of this matter

2 That although the Licensee continues to deny the allegations

made against him he acknowledges that the State may be able to

prove a prima facie case of careless or unsatisfactory

record keeping for prescriptions issued or filled as required by

Chapter 155 Section 15532 Code of Iowa and regulations issued

thereunder

3 That the Licensee who now resides in Florida desires to

avoid the uncertainty and the substantial expense of a trial and

desires to consent to the disciplinary action to be taken by the

Board as specified in paragraph 6 infra

4 That the Board recognizes that the conduct in question

appears to constitute an unintentional violation and of a record

keeping nature rather than of a fraudulent or criminal nature

5 That it is the purpose and intent of the parties hereto

to waive all of the provisions of Chapter 17A of the 1983 Code

of Iowa as they relate to notice and hearing on this matter and to

acknowledge that both the Licensee and the Board are fully aware

of the rights and procedures afforded them through Chapter 17A

of the 1983 Code of Iowa and the rules and regulations of the Board

of Pharmacy promulgated in accordance and pursuant thereto

particularly Section 17A12 as it relates to contested cases

and Section 17A18 as it relates to the requirements concerning

notice of the suspension and verification of licenses

6 It is the understanding of both the Licensee and the Board

that they will enter into an Order and Consent to Order which will

provide for the suspension of the license of Donald M Dunshee as

a professional pharmacist for a period of six months whioh Order of

suspension will be stayed and not go into effect It is further

understood that the Licensee will be placed on probation for a

period of one year from the expiration of the six month stayed

suspension and that he will be fined between three hundred fifty

dollars ($350) and five hundred dollars ($500)

THE ABOVE AND FOREGOING CONSTITUTES THE FULL AND COMPLETE

fession as a Pharmacist in a manner which could cause his

license to practice pharmacy in the State of Iowa to be suspended

and the Board of Pharmacy through its Chairperson and said

Donald M Dunshee as Licensee having entered into a Stipulation

representing their mutual informed consent as to the waiver of

the provisions found in the Iowa Administrative Code appearing

at Chapter 17A particularly Section 17A12 and Section 17A18

Code of Iowa 1979 in regards to notice of hearing the parties

to this action agree to an informal settlement of this matter

namely that the license of Donald M Dunshee to act as a professional

pharmacist in the State of Iowa will be suspended for a period

waive the provisions of the Iowa Administrative Code so that I

on June 13 1984 The one-year probation period shall begin on June 13

1984 and end on June 12 1985

This Order shall be complete and binding on both parties upon

receipt of a check in the amount of $35000 from Donald M Dunshee
