Berita MICCI highlights the latest initiatives and advocacy undertaken by the Chamber and its Councils on behalf of MICCI Members. Shell Refining Company Bhd topped a list of companies in the oil and gas, plantation and manufacturing industries that were honoured at the Prime Minister’s Hibiscus Award (PMHA) 2012/2013 for their green and sustainable efforts in business held on 24 January 2014, Istana Hotel Kuala Lumpur. The PMHA has a long-established reputation as the premier private sector environmental award for business and industry in Malaysia. It was initiated in 1996 with the goal of advancing the sustainability agenda by encouraging business and industry, big and small, to be pro-active in environmental management and performance. Deputy Prime Minister YAB Tan Sri Dato' Hj Muhyiddin bin Mohd Yassin presented the PMHA Exceptional Achievement Award and the elegant hibiscus copper sculpture challenge trophy to Shell Refining Company (FOM) Bhd Managing Director, Dato’ Rozano Saad who received the award on behalf of the company. Kota Kinabalu - based Hijauan Bengkoka Plantation Sdn Bhd took home the SME Special Award while in the Special Project Award, Sime Darby Kempas Sdn Bhd was declared the gold recipient, Asean Bintulu Fertilizer Sdn Bhd (silver award) and Sony EMCS (Malaysia) Sdn Bhd (bronze award). In another highlight of the evening, The Star was judged the inaugural winner of the Environmental Journalism Award that was launched to recognise the highly important role the media plays in pursuit of business and environmental sustainability. !

!!!For further information please contact Ilyani Yusof at [email protected]. !!!Coming To Terms With PDPA !The Personal Data Protection Act (PDPA) 2010 came into force on 15 November 2013 to remedy the mischief of rampant and unregulated misuse of personal data in Malaysia. All “data users” will have 3 months to register and to comply with the Act. !Realising that there are still many questions and uncertainties about the Act, the Chamber organised a half-day seminar on PDPA to inform and assist its Members on the required compliances. A total of 85 participants from various industries attended the seminar at the Istana Hotel, Kuala Lumpur on 22 January 2014. !Tn. Hj. Abu Hassan Ismail, Director General of the Personal Data Protection Commission delivered the keynote address before three speakers, Siti Dinar Othman, Head of Risk Assessment Unit, Personal Data Protection Department, Cheah Chiew Lan and Su Siew Ling, both Partners at Tay & Partners took the floor. !Pn. Siti provided an overview of the PDPA while Ms. Cheah presented on the impact of PDPA on businesses and key issues to implementation. Ms. Su then delved into a number of case studies on the implementation of the Act before all three speakers were joined by K. Mohan, Head of Data Users Affairs Unit, Personal Data Protection Department for a panel discussion moderated by Ms. Su. It was indeed an interactive seminar as participants had substantial time in raising their concerns and queries to the panel. !The registration deadline for businesses is 15 February 2014 and is compulsory for entities involved in the processing of personal data for commercial transactions

!The Chamber's Education Focus Group hosted a visit from the International Enterprise (IE) Singapore, ITE Education Services and NTUC LearningHub on 22 January 2014. The objective of the visit was to discuss on the Vocational Technical Education (VTE) in the country.

It was highlighted that the VTE landscape in Malaysia was a little sluggish particularly in the areas of branding, availability of scholarships and in overall slightly below par compared to certain developed countries. However, there is much potential for VTE in the hospitality, catering, language, healthcare and automotive sectors. !MICCI stated that it welcomed the opportunity to work together with ITE and NTUC LearningHub in a pilot project that would allow for local VTE providers to adopt the training and development programmes of its neighbouring VTE providers to gauge its response and success. !For further information please contact Chang Hou Yea at [email protected]. !!!

Modernisation of Labour Law

!The modernisation of labour law constitutes a key element in ensuring the success of the adaptability of both workers and enterprises. Its objective is to provide for an environment that will attract investors by creating a knowledge-based and service-oriented workforce, warranting fair treatment for workers and fostering regional and global competitiveness.

MICCI has long been at the forefront in advocating for better HR practices that entails a comprehensive hiring system, talent management, career path development, legal compliances, and appraisals and recognition to name a few. Through the Chamber's Human Capital Council, Tan Mei Ling, Associate Director of the Strategic Reform Initiative (SRI) – Human Capital Development under PEMANDU was invited to brief the Council on the progress on the modernisation of labour law. !The Industrial Relations Act 1967 is currently under review to ensure effective enforcement of Industrial Court awards, to resolve through conciliation, dismissal cases and trade disputes expeditiously and to strike a balance between business needs and employee's rights. The draft amendments of the Act stipulated the conciliation timeline for trade disputes to be within 180 working days, dismissal cases within 90 working days upon filing of representation and the enforcement of non-compliance of awards by the Court within 7 working days. !The Act, however, does see some limitations. It lays down no time limit for the settling of disputes and claims of unfair dismissal. Moreover, to what extent is the procedure of conciliation and arbitration readily accessible and understandable to the worker. !Moving ahead, MICCI is looking forward to facilitate a tripartite meeting between the Ministry of Human Resources, Industrial Relations Court and employers to further contribute towards the improvement of HR practices. !For further information please contact Chang Hou Yea at [email protected].

!!MICCI New Year Get-Together

!MICCI welcomed close to 80 members and guests to its New Year Get-Together at the Sime Darby Convention Centre on 16 January 2014.

The Chamber was delighted that most of its invitees and members turned up despite receiving news that the traffic congestion on the day was particularly dreadful. Held at the rooftop of the convention centre that overlooked the

greens of its neighbouring golf club (KLGCC), the evening was indeed a Thursday to unwind.

The evening commenced with MICCI Executive Director, Stewart Forbes presenting a brief introduction on the Chamber’s priorities for 2014. On the advocacy front, MICCI will be prominently looking into the areas of taxation, labour reforms, new business opportunities and liberalisation while continuing its efforts in addressing members’ concerns with the relevant Head of States and GLCs. On business related events, a string of training programmes, seminars, business luncheons and social gatherings are already being lined up for the benefit of members.

With the business formalities aside, laughter was amidst the evening as old friends were seen joyously catching up while many new acquaintances were equally forged. MICCI extends its sincere appreciation to Guinness Anchor Berhad for sponsoring the beverage for the evening and its gratitude to all members who indulged us with their presence.
