Notice Inviting Tender The Telecom District Manager, Bettiah on behalf of CMD/BSNL, invites sealed tenders (2 bid systems) for Data Entry/ Housekeeping works in different sections of office of the Telecom District Manager Bettiah from firms having experience in related works as d etailed below:

1. Purchase and Availability of Tender Document: Tender document can be obtained by

downloading it from the website http://www.bihar.bsnl.co.in. From 28.08.1514.00 Hrs. to 18.09.2015-14.00 Hrs. The bidders downloading the tender document are required to submit Cost of tender form through DD/ Banker’s cheque along with their tender bid failing which the tender bid shall be left archived unopened/ rejected. The duly filled sealed Tender document addressed to TDM, Bettiah may be dropped in the Tender Box kept in the chamber of CAO O/o the TDM Bettiah or sent by registered post on or before 14:00 hrs of 18.09.2015. BSNL Bettiah will not be held responsible for any delayed receipt of any Tender Document. The Tender will be opened at 14:30 hrs of 18.09.2015 in the presence of Tenderers or their authorized representatives. The DD/ banker’s cheque shall be drawn from any Nationalized/ Scheduled Bank in favour of “AO (Cash), O/o TDM ,BSNL BETTIAH”, payable at BETTIAH.

Tender document shall be available for downloading from 28.08.15 14:00Hrs, onwards up to 18.09.2015 14:00 Hrs.

Once, the bidder has submitted bid, it will be presumed that bidder has understood & accepted all terms and conditions of the tender and no correspondence at later stage will be entertained in this regard.

2. Bidders have to bid separately if want to partic ipate for both the work data entry and housekeeping.

3. Eligibility Conditions: Bidder must submit attested/original copies of the following documents with the tender form:

(i) The firm should be registered with appropriate category.

(ii) Experience: Bidders should have an experience of having successfully completed in DOT/BSNL/MTNL/Central Govt. & their CPSUs/State Govt. and their PSUs during the last 04 financial years ending last day of month previous to the one in which application are invited of an amount 30% of the estimated cost in any one year in following manner:

a) For the tender data entry work bidder should have experience in data entry related work clearly mentioned in experience certificate. No other experience will be considered.

b) For the tender housekeeping work bidder should have experience in housekeeping related work clearly mentioned in experience certificate. No other experience will be considered.

Experience certificate issued by not below the rank of STS level / Gazetted officer of PSU/ government organization, and duly attested by Gazetted officer. Copy of work order will not be acceptable

Note: (Any Four year means) e.g. Y1, Y2, Y3 and Y4 is Financial year 1, 2,3,4. if any bidder completed work costing in Y1 30% or in Y2-30% or in Y3-30% or in Y4-30% is eligible

(iii) Attested copy of PAN Card.

(iv) Valid labour license for any of ongoing work, and if not available at the time of bid submission or there are no ongoing works, then enclose a declaration on firm’s letter head mentioning that labour license will be produced before signing the agreement..

(v) Valid EPF or ESI registration. If not available at the time of bid submission enclose a

declaration letter on firm’s letter head that it w i l l be submitted at the time of agreement failing which EMD can be forfeited .

(vi) Attested copy of service tax registration and latest challan.

(vii) Diploma /equivalent certificate in computer applications of any employee of the firm from a recognized institution(for data entry work only)

(viii) Family/Relatives declaration (as per proforma at on Rs.10 Stamp Paper) (ix) Declaration regarding blacklisting/debarring from taking part in Government Tender by

DOT/BSNL/Govt. Dept/PSU. (as per proforma at on Rs.10 Stamp Paper)

.4. Bid Security/EMD: Earnest money amounting to 2.5% of estimated cost of tender in the form of Demand Draft of any Nationalized Bank issued in favour of A.O. (Cash), BSNL, O/o the TDM Bettiah must be submitted with the tender. An SSI unit registered with NSIC is exempted from deposit of Earnest Money if the monetary limit of the NSIC is above the estimated cost of this project.

5. Letter of authorization for attending Bid opening on firm’s letter head.( If any authorized representative of the firm attending the opening of Bid)

6. Date & Time of Submission of Tender bids: The bidder may drop the bid in tender box at ---chamber of CAO, Bettiah---------- on or before –14:00.-- hrs of 18.09.2015

7. Opening of Tender Bids: The tender will be opened at -14:30-- Hrs. of -18.09.2015 8. Place of opening of Tender bids: Maximum two (02) authorized representatives of bidders (i.e. vendor organization) can attend

the TOE at the time of opening of tender at chamber of CAO, Bettiah. 9. Tender bids received after due time & date will not be accepted. 10. Incomplete, ambiguous, Conditional, unsealed tender bids are liable to be rejected.

11. TDM, Bettiah reserves the right to accept or reject any or all tender bids without assigning any reason. He is not bound to accept the lowest tender.

Note 1: In case the date of submission (opening) of bid is declared to be a holiday, the date of submission (opening) of bid will get shifted automatically to next working day at the same scheduled time. Any change in bid opening date due to any other unavoidable reason will be intimated to all the bidders separately.

Note 2: Bids received after due date and time shall not be entertained under any circumstances. The

TDM Bettiah on behalf of BSNL reserves the right to reject any or all Bids without assigning any reasons whatsoever. It is also not binding upon him to accept the lowest bid.

Note 3: All documents submitted in the bid offer should be in English/Hindi. In case the certificate viz.

experience, registration etc. is issued in any other language other than English/Hindi, the bidder shall attach an English/Hindi translation of the same duly attested by the bidder & the translator to be true copy in addition to the relevant certificate.

Note 4: All computer generated documents should be duly signed/ attested by the bidder/ vendor organization.

Note 5: Bidder has to produce original certificates/ documents for inspection whenever required by BSNL.

SECTION- 2

Tender Informat ion

1. Type of tender- : Two stage opening (Technical bid and Financial bid ) System.

Note 1:- The techno-commercially bid will be evaluated first and thereafter financial bids of techno-commercially compliant bidders only shall be opened.

2. Bid Validity Period / Validity of bi d Offer: 120 days from the tender opening date.

3. The main envelope should contain two separately sealed envelope containing technical bid and financial bid.

4. The Technical Bid should contain attested copy of following documents:

I. Having experience as per NIT. II. DD of cost of Tender document for Rs 570/-

III. DD for EMD of @2.5% of estimated cost of tender. IV. Valid attested copy of registration certificate of Firm/or Attested Deed of partnership/or sole

proprietorship. V. Copy of PAN card . VI. Valid Labour License.

VII. Diploma /equivalent certificate in computer applications of any employee of the firm from a recognized institution. (For data entry work only)

. VIII. Family/Relatives declaration.

IX. Declaration regarding blacklisting/debarring from taking part in Government Tender by DOT/BSNL/Govt. Dept/PSU.

X. Service Tax Registration number with latest challan & return file. XI. Valid EPF / ESI registration. If not available at the time of bid submission enclose a

declaration letter that it w I l be submitted at the time of agreement failing which EMD can be forfeited and party can be black listed from any tender in BSNL.

XII. Duly signed Tender document.

5. The Financial Bid will contain only Schedule of Rate. This must be in a separate sealed cover and will be opened only if all documents are properly submitted in the Technical Bid.

6. The Telecom District Manger, Bettiah reserves the right to accept/reject any/all the tenderer/tenders without assigning any reason at any point of time.

SECTION- 3

SCOPE OF WORK

1. Data entry work like letter typing, reports preparation, printing of bill etc. in different sections of the O/o TDM, Bettiah

2. Housekeeping work in different sections of the O/o TDM, Bettiah

3. Day to day computer related work like letter typing, reports preparation, record of store items etc. as desired by SDE(Plg) in Planning section

4. Cleaning work in different sections of the TDM, Office Bettiah.

5. Arranging of store in planning section.

6. Housekeeping work includes assistance in office as required by officers File moment file tracing and all office associated work etc during office hours.

Section-4 Part A General Instructions to Bidders (GIB)

1. Experienced Individual or reputed firms having experience in the field of related work may take

part in the tender.

2. Attested copies of the following documents must be submitted with the tender.

(i) Attested Copy of Registration certificate of the firm.

(ii) Copy of the work experience as detailed below:

Bidders should have an experience of having successfully completed in DOT/BSNL/MTNL/Central Govt. & their CPSUs/State Govt. and their PSUs during the last 04 financial years ending last day of month previous to the one in which application are invited of an amount 30% of the estimated cost in any one year in following manner:

(vi) Attested copy of PAN based service tax registration and latest challan

(vii) Diploma /equivalent certificate in computer applications of an employee of the firm from a recognized institution (for data entry work only).

(viii) Family/Relatives declaration (as per proforma on Rs.10 Stamp Paper) (ix) Declaration regarding blacklisting/debarring from taking part in Government Tender by

3. Earnest money amounting 2.5% of the estimated cost of tender in the form of Demand Draft Drawn in favour of A.O. (Cash), O/o the TDM Bettiah must be submitted with the tender otherwise ender will be rejected.

4. Rates must be quoted both in words and figures exclusive of all taxed, duties, levies tec. In case

of any discrepancy, the rate quoted in words will be considered. Conditional offer will summarily be rejected.

5. Rate must be quoted after assessing the work value and no excuse will be entertained later on

for any faults/defects/missing of spares etc. after agreement is signed. 6. No participation is permissible by BSNL near relatives of all BSNL working employees (Non

executive employees working in the office of the TDM Bettiah executive employees also called Group A& Group B officer working in the O/o the TDM Bettiah) either directly recruited or on deputation are prohibited from participation in members of a Hindu Undivided family.

They are husband & wife. The one is related to the other in the manner as father, mother, son (s), Son’s wife (daughter-in-

law), daughter (s) & daughter’s husband (son-in-law, brothers (I) & brother’s wife, Sister (s) & husband (brother-in-law).

7. The Telecom District Manager, Bettiah reserves the right to accept/reject any/all the

tender/tenders without assigning any reason. 8. The successful tenderer will have to deposit 10 % of estimated cost towards security deposit

prior to execution of agreement within the given period. EMD will form the part of SD for the successful tenderer.

9. Sealed tender complete in all respect duly super scribed “Tender for data entry/housekeeping

work” must be dropped in the tender Box kept in the chamber of the CAO, O/o the TDM Bettiah upto 14:00 hrs of 18.09.2015 and will be opened on the same day at 14:30 hrs in presence of tenderers or their representatives if they so desire.

10. The present estimated cost may be exceeded up to 25%. by the competent authority.

11. Tender will be valid for one year and may be further extended up to one year in the span of 1/3/6 months or within the limit of estimated cost with mutual consent & satisfactory performance during period of contract.

12. The work during period in noted in price schedule. 13. A penalty of Rs. 100/- per 24 hrs or part thereof can be imposed by Section incharge if the Data

entry is prolonged for more that 8 hrs. 14. All statutory taxes livable as per rule will be deducted from the bill of the contractor. 15. Security deposit will be taken @ 10% of the approved tender amount prior to execution of

agreement. Earnest Money will from the part of SD for the successful bidder. 16. No interest will be payable on EMD/SD. 17. SD will be refundable after expiry of agreement after observing departmental formalities and on

submission of “No Dues” certificate by the contractor. 18. During the performance of the contract,, the tenderer will be responsible for doing the work as

per instruction of his incharge officers. 19. The payment will be made on monthly basis. The contractor will submit the bill to the Planning

section after duly certified by the concerned section incharge.

20. The tender will be decided on the basis of L1 on total cost. 21. In the event of breach of any condition of the agreement including the delayed executing of

work/bad performance loss or damage of equipment misbehaviors by the staff of the contractor the BSNL shall have the power to adopt any or all the following best suited in the interest to the BSNL. (a) To rescind the agreement and in such case the SD of the contractor will stand forfeited

to the BSNL. (b) For loss or damage of the equipment, the contractor will have to make good the loss as

decided by the BSNL. (c) In case of delay in execution/taking over of work the BSNL may impose penalty @ 1 %

per week subject to maximum of 10 % of value of work along with recovery of amount incurred by the BSNL for the work being go done by other agency or otherwise.

22. The Telecom District Manger, Bettiah reserves the rights to terminate the agreement by giving one month’s without assigning any reason.

23. Force Majure If anytime during the continuance of this contract, the performance in whole or in part by either

party of any obligation under this contract shall be prevented or delayed by reason of any war, or hostility act or the public enemy, civil commotion, sabotage, fires, flood, explosions, epidemics,, quarantine, restrictions, strikes, lockout, or act of God (have in after refereed to as events) provided notice of happenings, of any such eventuality is given by either party to the other within 21 days from the date of occurrence thereof neither party shall by reason of such events be entitled to terminate this contract nor shall either party have any such claim for damage against the other in respect of such non-practicable or delay in performance and deliveries under the contract shall be resume as soon as practicable after such event may come to an end or cease to exist, and the decision of the purchaser as to whether the deliveries have been so resumed or not shall be final and conclusive provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by reason of any such event for a period exceeding 60 days either party may at this option terminate the contract.

24. Arbitration : -

(a) In the event of any question, dispute or arising under this agreement or in connection there with except as to matter the decision of which specifically provided under this agreement the same shall be referred to sole arbitration of the Chief General Manager Telecom District Bihar Circle, Patna or in case his designation is changed or this office is abolished then in such case to the sole arbitration of the officer for the time being entrusted whether in addition to the function of the CGMT Bihar Circle Patna or whatever designation such officers may be called (hereinafter referred to as the said officer) and if the CGMT Bihar Circle, Patna of the said officer is unable or unwilling to act as such to the sole arbitration or some other person appointed by the CGMT Bihar Circle Patna or the said officer.

There will be no objection to ay such appointment that the arbitrator is Government Servant or that he has to deal with the matter. To which the agreement relates or that in the course of his duties as Government Servant he has expressed views on all or any of the matter under dispute. The award of the arbitrator to whom the matter is final and binding on the parties. In the event of such arbitrator to whom the matter is originally referred, being transferred or vacating his officer or being unable to act for any reasons whatsoever such CGMT Bihar Circle Patna or the said officer shall appoint another person to act as arbitrator in accordance with terms of the agreement and the person so appointed shall be entitled to proceed from the stage at which it was left out by his predecessors.

The arbitrator may from time to time with the consent of parties enlarge the time for making and Publishing the award. Subject to aforesaid Indian Arbitration Act, 1940 and the

Rules made there under any modification thereof for the time being in force shall be deemed to apply to the arbitration proceeding under this clause.

The venue of the arbitration proceedings shall be the office of the CGMT Bihar Circle, Patna or such other places as the arbitrator may decide.

25. Set Off.

Any sum of money due and payable to contractor (including security deposit refundable to him) under this contract may be appropriated by the purchaser for the BSNL or nay other person or persons contraction through the Govt. of India and set off the same against any claim of the purchaser of BSNL or such other person or persons for payment of a sum of money arising out of this contract or any other contract made by the contractor with the purchase of BSNL or such other person or persons contraction thought Govt. of India.

26 Workmen’s Compensation: - In every case in which by virtue of the provision of Section 12 and sub-section (I) of the workmen’s compensation act 1923 if BSNL is obliged to pay compensation to a workmen, employed by the contractor in execution of work; BSNL will recover from the contractor the amount of compensation as paid and without prejudice to the right of the BSNL. Under Section 12 Sub-section (11) of the said Act, the BSNL will be liberty to recover such amount or any part thereof by deduction it from the SD or any sum due by the BSNL to the contractor whether by this contract or otherwise. The BSNL shall not be bound to contest any claim made against it under Section 12 Sub-section (1) of the said Act. Except on written request of the contractor and upon his/her giving to the BSNL might become liable in consequence of contesting such claim.

Section-4 Part B

Special Instructions to Bidders (SIB)

4.1 Immediate reporting of faults and/or any untoward incidence, if occurred at the station to the designated BSNL officer within one hours of incidence.

4.2 Submission of monthly feedback report to concerned DE / SDE of Bettiah SSA as case may be in the proforma specified at the time of agreement.

4.3 If any serious complain is received from the officer In-charge of the site, TDM Bettiah reserves the right to cancel the Tender and the SD money will be forfeited.

4.4 No person other than the authorized man performing the duty should stay at the site. BSNL reserves the right to shift the person performing the duty to any of the sites under the jurisdiction of the concerned contractor without any explanation.

4.5 PENALTY CLAUSE:

a) Penalty shall be imposed in case of non-or partial or delayed performance of works with in stipulated time frame as per details given below.

b) The rate of penalty for improper data entry/housekeeping work in any section be charged @ 0.5% of monthly billed amount for each station subject to maximum limit of 10% of bill amount for that particular month.

c) In the event of total breakdown or non availability of services due to non performance of duties or improper handling of equipments installed at the station by the bidder’s representative penalty shall be charged @ 10 % of the total cost of the work order for failure of each station .

d) In case of dispute regarding deciding reasons for total failure of the work in any section on account of failure or mistake by day to day data entry work/ House Keeping work, decision of the Telecom District Manager , Bettiah shall be final and binding on both the parties.

e) In case of total damage or loss of equipment due to improper handling or negligence of the bidder, bidder shall be liable to pay the cost of damaged/lost equipment or actual cost of restoration of equipment done either by AMC vendor or any other agency engaged by BSNL in this regard.

f) Penalty for delayed or partial performance of work shall be charged @ 5% cost of work order for each work for that month. However, in case of partial performance of work, BSNL reserves the right to get work done by using its own resource or engaging outside agency and cost incurred towards such activity/activities shall be borne/ recovered by/from the contractor.

4.6 PAYMENTS:

After successful execution of works as per agreement, payments shall be made on monthly basis . Bills duly certified by concerned in-charge of the section or any other designated Officer of

equivalent level by SSA Head duly countersigned by their controlling officers is to be submitted in duplicate copies to the TDM, Bettiah for processing them further for payments.

Necessary deductions of the duties and Taxes as per prevailing rules of Government of India shall be made from the bills while making payments

Further deduction of penalty, if any, shall also be made from the bills. Payments shall be released only after approval of SSA Head.

4.7 BIDDING PROCESS & ITS EVALUATION:

There will be two stage biddings. Technical bids shall be opened first and bidders who are found eligible in technical bid evaluation shall be considered for opening of their financial bids. It may not be necessary that financial bid is opened on the same date. The date and time for opening of financial bid (if opened on a different date) shall be communicated to all those bidders who are found eligible in technical bid evaluation.

Selection of bidder shall be done based on the price ranking of bidders, with L-1 getting first preference followed by L-2 & L-3 etc.

Selection of the bidder shall be done based on their price ranking arrived in financial evaluation of the bid.

4.8 AWARD OF WORK

4.9 Work shall be awarded to successful bidder after signing of agreement and depositing of performance security amount, as indicated. The award of work shall be done broadly as per details below if L2 agrees to work on rate quoted by L1 as per approval of competent authority.

4.10 DAMAGE/LOSS OF PROPERTY :-

If damage/loss of any equipment or installations in any section is done by contractor’s representative due to improper handling or negligence, the cost towards recovery of the said equipment/installations & loss of revenue (if any), due to non-operation of damaged/lost equipment/installations shall be borne by the contractor.

4.11 The Contractor shall not engage any BSNL employee for getting his job executed. If at any stage it is found doing so, then the Telecom District Manager, Bettiah has the right to impose any suitable penalty even to the extent of termination of the contract leading to the forfeiture of security money.

4.12 The BSNL shall not take any responsibility of providing any facility to the labourers employed by the contractor. BSNL shall not supply any support material for the livelihood of person employed at the stations, except those required for day-to-day operation & up-keep of station.

4.12 The bidder shall be responsible for the safety & security of their employees and also the equipment installed at the station. In case of any damages to BSNL property the same shall be charged as per penalty condition defined in clause no.2 of section of V above.

4.13 In case of non or partial/ unsatisfactory performance of the work, BSNL reserves the right to carry out any work in part of full through department or through any other contractor/agency. Expenditure if any, towards execution of such work shall be recovered from contractor.

4.14 WORKMEN’S QUALITY:

Contractor shall deploy trained work force.

There shall be proper supervisory control over the different teams deployed by the Contractor. The Contact details of supervisors (mobile number and address of work place & residence etc) need to be supplied at the time of agreement. It shall be desirable to deploy supervisors having diploma degrees in Electrical/Electronic Engineering.

It shall be responsibility of the supervisor to send weekly schedule for deployment of work force to the respective in-charges, before deploying them actually at any site. Sites getting unattended due to non-availability of work force shall amount non performance of job and due penalties shall be levied as per penalty clause mentioned in Para 2.0

4.15 LABOUR WELFARE & COMPENSATIONS:

Contractor shall be responsible for all the claims of the laborers engaged by him for Data entry/Housekeep work including their registrations with nearest labour office (if required as per law) and insurance in accordance with norms of Government of India in this regard. BSNL shall not be responsible for any claims on this matter during and after contract period.

Contractor shall be solely responsible for following all provisions of labour laws and compensation in this regard if any due to not following of certain provisions of the labour laws, shall be paid by the contractor. BSNL shall not be responsible in this regard.

Any failure to fulfill the requirement shall attract the penal provisions of this contract arising out of the resultant non execution of the work.

No labour below the age of eighteen years shall be employed on the work.

4.16 FAIR WAGES :

The contractor shall pay to labour employed by him either directly or through sub contractors, wages not less than fair wages as defined as C.P.W.D. contractor’s labour Regulations or as per the provisions of the contract labour (Regulations and abolition) Act, 1970 and the contract labour (regulation and abolition) central rules, 1971, whenever applicable.

The contractor shall not withstanding the provisions of any contract to the contrary, cause to be paid fair wage to labour indirectly engaged on the work, in connection with the said work, as if the labour had been immediately employed by him.

In respect of all labour directly or indirectly employed in the works for performance of the contractor’s part of this agreement, the contractor shall comply with or cause to be complied with the central public works BSNL contractor’s labour regulations made by BSNL from time to time in regard to payment of wages, wage period, deduction from wages, recovery of wages not paid and deductions in unauthorized way, maintenance of wages books or wage slips, publications or scale of wages or and other terms of employment inspection and submission of periodical returns and all other matters of like nature or as per provisions to contract labour (Regulation and Abolition) Act, 1970, wherever applicable.

The BSNL shall have right to deduct from the money due to the contractor any sum required or estimated to be required for making good or loss suffered by the worker or workers by the reasons of not fulfillment of the conditions of the contract for the benefit of the workers, non payment of the wages or the deductions made from his or their wages which are not justified by their terms of the contract or non observance of the regulations.

The contractor shall comply with the provisions of the payment of the wages Act, 1936 minimum wages Act, and 1948. Employees liability Act, 1938, workman’s compensation Act, 1923, Industrial Act, 1947, 1961, and the contractor’s labour (Regulation and Abolition) Act 1970 or the modifications thereof or any other relation thereto and the rules made there under from time to time.

The contractor shall indemnify BSNL against payments to be made under and for the observance of the laws aforesaid and the CPID Continental’s labour regulations without prejudice to his right to claim indemnify from his sub contractors.

4.17 OTHER LABOURERS WELFARE MEASURES:

The contractor shall implement the labour welfare measures enunciated in clause 19B, 19C, 19E, 19G, 19H, 19L and 19J of the conditions contract in the PW 8.

The contractor shall also follow the safety methods enunciated in the CPWD safety code.

The contractor shall comply with all the provisions of the Minimum Wages Act, 1948, Contract Labour (R & A) Act, 1970 and rules framed and other labour laws affecting contract labour that may be brought into force from time to time.

Even during the arbitration the work cannot be stayed because it pertains to the essential public utility service the department reserves the right to get the work completed either departmentally or through any other contractor at the risk and cost of contractor.

If the contractor refuses for executing any specified work, the department reserves the right to get the work done by other agencies even at higher rates and the difference of the cost will also be deducted from the contractors pending bills or security money as the case may be.

4.18 PARTICIPATION OF NEAR RELATIVES OF THE B.S.N.L. EMP LOYEES IN THE TENDER

It has been decided that the near relatives of all B.S.N.L. Employees either directly recruited or on deputation are prohibited from participation in tenders for execution of works in the different units of BSNL. The detailed guidelines in this regard are given in the following paragraphs.

i) The near relatives for this purpose are defined as:

a) Members of a Hindu Undivided Family.

b) Husband and wife.

c) The one is related to the other in the manner as father, mother, son(s) & Son’s wife (daughter-in-law), Daughter(s) & daughter husband (son-in-law), brother(s) & Brother’s wife, Sister(s) & Sister’s husband (Brother-in-law).

ii) As per Government of India’s CCS Conduct rule 4 no Government servant shall in the discharge of his official duties deal with any matter or sanction any contract to any company or for any other person if any member of his family is employed in that company or firm or under that person or if he or any member of his family is interested in such matter or contract in any other manner and the Govt. Servant shall refer every such matter or contract to his official superior. This clause is applicable to all B.S.N.L. employees and in view of this as soon as any BSNL employee becomes aware of the above aspect, he must intimate this to the prescribed authority. For non executive employees this authority is SSA Head/Circle Head/Chief Engineer/Chief Archt./ Corporate office under whom he is posted. For executive employees (at present some of them are called as Gazetted Officers) the prescribed authority for this purpose is Circle Head Chief Engineer/Chief Archt./ Corporate office under whom he is posted.

iii) The Company or firm or any other person is not permitted to tender for works in BSNL Unit in which his near relative(s) is (are) posted. The unit is defined as SSA/Circle/Chief Engineer/Chief Arch./Corporate office for executive employees (including those called as Gazetted Officers at present). Therefore, it has been decided by the competent authority that a clause must be added in the tender and other related documents that the tenderer should give a certificate that none of his/her such near relative is working in the units as defined above where he is going to apply for tender/work. In case of proprietorship firm certificate will be given by the proprietor, for partnership firm certificate will be given by all the partners and in case of limited company by all the Directors of the company. Any breach of these conditions by the company or firm or any other person, the tender work will be cancelled and earnest money/security deposit will be forfeited at any stage whenever it is noticed and BSNL will, not pay any damages to the company or firm or the concerned person. The company or firm or the person will also be debarred for further participation in the concerned unit.
