*TEA Clarifying Activities
Title III Supplement not Supplant
Intent: Ensure services provided with Title III funds are in addition to, and do
not replace or supplant, services that students would otherwise receive.
● What is the instructional program/service provided to all students?
● What does the LEA do to meet Lau v. Nichols requirements?
(translation)
● What services are the LEA required to provide by Federal, State, and
Local laws or regulations?
● Were the program/services previously provided with State, Local, and
Federal Funds?
LEAs can show compliance by demonstrating they would not have provided the
services with non-federal funds had federal funds not been available.
