    BIR Refused to Receive My Letter

    Numerous complaints had reached ETMthat requested him to explain thereasons behind the deliberate failureand refusal of BIR to voluntarilyreceive and accept letters, notices,requests and the likes especially if they are coming from taxpayers.

    Here are the signs that BIR is deprivingyou to exercise your rights or extinguish your obligations, viz;

    1. Sorry, iyong docket me ay wala nasa amin. Nai-tranfer na sa ibangdivision.

    2. Wala kasi iyong taga-receive, eh.

    3. Hindi sa amin iyan.

    4. Bumalik ka na lang kasi wala siRDO.

    5. Naka-coffee break kami.

    6. Ayaw kong ireceive iyan baka kasi

    sumabit pa ako.7. Nawawala ang pantatak namin. Balik

    ka na lang kasi hahanapin ko pa.

    8. Hindi naman naka-address sa akin.

    9. Lunch time na. Mamaya na lang angreceiving.

    10. Uwian na. Balik ka bukas.

    11. Doon iyan sa kabila office.

    12. at marami pang iba.

    Usually these excuses and alibis are thebrainchildren of the front-liners inorder to accommodate the request of someone higher than them.

    According to Republic Act No. 9485 andRevenue Regulations No. 2-98, BIRhas a legal obligation to receive andaccept, without mental reservationand purposes of evasion, anycommunication from taxpayers.

    The obligation to receive and acceptentails the obligation to reply to thesaid letters within five days for simpletransactions and ten days for complex transactions from receiptthereof.

    Avoiding the obligation to reply is themain reason that BIR is denyingtaxpayers to submit their letters.

    ETM suspects that BIR is ill-equippedand knowhow-starved in decipheringthe contexts of the taxpayers lettersor too incompetent in drafting a replyor apply the legal proceedings.

    Your failure to file any letter to the BIR

    shall mean waiver of your rights for the BIR to serve you well and ontime.

    Your right to any government serviceswould become demandable andexecutory when your written noticesare received and accepted by theBIR. Do not give away this right andprivilege and have your letter bereceived without delay by the BIR.

    WHAT TO DO WHEN A BIR FAILSAND REFUSES TO RECEIVE ANDACCEPT YOUR LETTER?

    1. Do not go alone to the BIR. Bring atleast a companion to witness therefusal.

    2. Get the complete name of the BIRand write it down on each copy of the letter being submitted.

    3. Write down, BIR so and so refusedto receive this letter. Thus,constructively served this July 11,2011 at 10 am as witnessed by theundersigned.

    4. Then, leave a copy on the table of therefuser.

    5. To cement that the subject letter shallreach the addressee, register maila copy using the Philippine PostalCorporation.

    6. Prepare a incident report.

    7. Prepare a Complaint Affidavitchronicling the events thattranspired.

    8. Submit the Complaint to the Office of the Ombudsman.

    It is the duty of any taxpayer to protectthe interest of the State by removing

    bad bananas from governmentservices.
