Write Down An Ethical or Legal Concern

• Write down an ethical or legal concern. Be specific to what concerns you most. You can also add if you were able to report it and what was done. Behavioral health ethical concerns in any setting.

• Make a decision about how to get support around your ethical or legal concern. Do you have an immediate clinical or administrative supervisor that can help you?

Ethics Defined in Relation to Culture:

• In mental health care, ethics and culture are intimately intertwined. To practice ethically requires awareness, sensitivity, and empathy for the patient as an individual, including his or her cultural values and beliefs.

• Cultural competence is a practical, concrete demonstration of the ethical principles of respect for persons, beneficence (doing good), nonmaleficence (not doing harm), and justice (treating people fairly)—the cornerstones of modern ethical codes for the health professions.

Four Questions That Assist with Ethical Decision-making

1. Is the counselor giving the client the freedom to make choices about his or her direction in treatment? (Autonomy)

2. Is the counselor providing hope, encouragement, and support for the client’s decisions that are individualized , in line with the client’s values, and in the client’s best interest regarding change toward successful recovery?

• You are having your house painted. You arrive home from work early and see that one of the people that is painting your house is a former client. What do you do?

Case Study

• Your co-worker that helps with SAIOP from time to time is reporting about their years of sobriety to the group and how he got sober. A week later, you see him out at a bar drinking what appears to be beer. What to do?

• A co-worker, peer support specialist confides in you that she has started seeing a client that is actively on her caseload….what to do. You don’t want to see her lose her job she’s great with clients and so helpful.

Case Study

• A woman and man are dating. Both are counselors. One specializes in a therapy that she can supervise other counselors to achieve their certification. Her boyfriend is seeking that certification and she tells him that she can supervise him. It is a mostly platonic relationship but they still date. Is this an ethical decision? What are possible consequences?

Case Study• A wilderness program for teens is using

timeout to address noncompliant behaviors by placing the student (ages 13-17) in a 4x4 ft square on the forest floor away from other students. They only come out of the square to use the bathroom and sleep. They must eat their meals while in the square. This can last up to 3 days. You’re a new counselor and this seems harsh to you. You are assured by staff that this is both effective in changing the child’s behavior and ethical. What steps do you take to explore whether or not this is ethical and or legal?

Case Study• An agency has bought an old two story

house with a large front porch that sits downtown right on the sidewalk in a major thoroughfare. It’s a beautiful day and the counselor says, “Let’s go outside on the porch for group therapy today”. Everyone in the group jumps up, ready to go except 2-3 members. Is this ethical and how might it be resolved? Side note: Going out on the porch allows the counselor and clients to smoke.

Ethics: Purpose and Scope
