If the misrepresentation isn't dependent on documentary evidence, the applicants often appear to discuss their excuse, and are licensed with submission of a new application. If those cases go to DOAH, the outcome depends on the believability of the applicant. The Board granted Ms. Gustafson discretion on deciding to send the cases to DOAH, and further granted Ms. Gustafson discretion to decide if a proposed recommended order should be submitted when the only real issue is the credibility of the applicant.
