The Lee County Board of Commissioners met in a special called meeting on Monday, April 28, 2014. The meeting washeld in the Opal Cannon Auditorium of the Lee County T. Page Tharp Governmental Building in Leesburg, Georgia.Those present were Commissioners Rick Muggridge, Dennis Roland, Luke Singletary, Ed Duffy and Greg Frich. Staff inattendance was County Manager Rabun, County Attorney Skipper and Christi Dockery, County Clerk. Chairman

Muggridge gave the invocation and called the meeting to order at 4:00 P.M.

DEPARTMENTAL MATTERS- Planning DepartmentA) Reconsider motion to table Z14- 003 ZONING APPLICATION. THE LEE COUNTY ECONOMIC

DEVELOPMENT AUTHORITY, has submitted an application to the Lee County/ Leesburg/ SmithvillePlanning Commission to rezone a 5 acre tract of property on Mossy Dell Road located in Land Lot 51 ofthe 1st District of Lee County, Georgia; and being on the Lee County west side of Mossy Dell Roadapproximately 989 feet north of its intersection with State Highway 32. Property is currently zoned AGAgricultural) and application is made to rezone a 5 acre tract to I- 2 heavy industrial. The Board of

Commissioners conducted a public hearing on April 8, 2014. County staff recommended rezoning of the 5acre tract to an in industrial (I-2) zone.

Commissioner Singletary made a MOTION to reconsider the Board' s action at its meeting held on April22, 2014 to table Z14- 003 Zoning Application. Commissioner Frich seconded the MOTION. The vote

was unanimous with Commissioners Roland, Muggridge and Duffy voting yea.

After the reconsideration Commissioner Duffy withdrew his MOTION to table Z14- 003 ZoningApplication. Commissioner Singletary seconded the MOTION. The vote was unanimous with

Commissioners Frich and Roland voting yea.

Chairman Muggridge explained that these Motions put the Board back to the April 22, 2014 MOTION

from Commissioner Roland to deny Z14- 003 which Commissioner Frich seconded. This motion

remained on the floor with no discussion. Commissioners Duffy, Singletary and Muggridge votedagainst this MOTION. The MOTION to deny the re-zoning application failed.

Commissioner Duffy made a MOTION to approve Z14- 003 Zoning Application to rezone the above

property on Mossy Dell Road to Heavy Industrial ( 1- 2). Commissioner Singletary seconded theMOTION. Commissioner Frich and Roland voted against the MOTION. Commissioner Duffy andCommissioner Singletary voted in favor of the motion and Chairman Muggridge broke the tie by votingfor the MOTION. The MOTION passed with Commissioners Duffy, Singletary, and Muggridge voting forthe MOTION and Commissioners Frich and Roland voting against the MOTION.

ANNOUNCEMENTS

A) The next regularly scheduled County Commission Meeting is Tuesday, May 13, 2014 @ 6:00 p.m. in the OpalCannon Auditorium.

B) County offices will be closed Monday,May26,2014in observance of Memorial Day.

The Lee County Board of Commissioners met in a Special Called Budget Workshop on Tuesday, May 2, 2014. The

meeting was held in the Opal Cannon Auditorium of the Lee County T. Page Tharp Governmental Building in Leesburg,Georgia. Those present were Commissioners Rick Muggridge, Dennis Roland, Ed Duffy and Luke Singletary.Commissioner Greg Frich was absent. Commissioner Duffy had to leave during the meeting. Staff in attendance was

County Manager Ron Rabun, Finance Director Heather Jones, County Clerk Christi Dockery, Matt Inman, Director ofPlanning, Zoning, and Engineering and Mike Sistrunk, Public Works Director. Chairman Muggridge gave the invocationand called the meeting to order at 2:00 P. M.

Public Works & Engineering matters ( storm water problems)A) Presentation from Ron Rabun, County Manager, Matthew Inman, Planning & Engineering Director and

Mike Sistrunk, Public Works Director, regarding Storm Water actions update.County Manager Rabun explained that Lee County staff has been fighting the rainfall over the last few months withOakland Road, Lumpkin Road and Joe Toole Road impacted with water problems. Lee County staff cannot respond torequest from private property owners that have problems with water on their property due to the heavy rainfall.Oakland Road will be closed to thru traffic due to flooding over the road. Public Works will continue to pump wateroff Oakland Road in an effort to open this road this weekend. County Manager Rabun explained that when floodingoccurs landowners are unwilling to take on additional water on to their property. In many instances, there are no pondsto pump the rainwater and the ground is saturated and the water has nowhere to go. If ponds are available the pondsare already full with no further capacity. Cul de sac is not a connector road. Public Works Department has exceeded

their overtime budget.

Matt Inman, Planning Engineering Director, explained that Oakland Road will be closed after the Lee County schooltraffic runs this afternoon. The closure is located in the curve of Oakland Road in an area where there are no residents.

Public Works crews will continue to pump water from this area of the road.Lumpkin Road has a tremendous amount of water with three houses heavily impacted. Staff is reviewing this road forfuture pumping. The stormwater ponds will be inspected.The water table is up but no houses are impacted on Muckalee Creek Road.

Rose Court and Joe Toole Road have one drainage system. The county would be required to have signed documentsfrom landowners in order to run pipes pump across private property to the holding pond. County Attorney wouldneed to review these documents including hold harmless agreements. Property owners are not willing to signdocuments to take on water from their neighbors. Public Works crews have sand bags available but this service is labor

intensive for staff. Lee County has limited pumps available for all the areas affected.3

New York Road, Gillis Road, Northampton Road at Pirates Cove park, North Doublegate, Springdale Subdivision and

Huntington Subdivision were all discussed.

Public Works Director Mike Sistrunk explained that Huntington Subdivision had a leaking grate and the manhole wouldhave to be dug up to change the lid. Staff has cleaned the lid until the lid can be replaced.County Manager Rabun explained that these issues are major strategic decisions and Lee County does not have theresources available.

County ManagerB) Presentation and overview of County Manager' s recommended FY 2014- 2015 budget.

County Manager Rabun presented highlights of the FY 2014- 2015 budget including the transmittal letter, graphs, andhistory. County Manager Rabun explained that this Board and past Boards have held the line against millage increasesfor eight years and the Board should be commended for working hard and weathering the storm during the last severalyears of economic hardship. This proposed budget includes a 0.65 mill increase which would generate$ 589,488 in newrevenue. The delayed capital equipment purchases, an aging fleet, increased maintenance costs and a substantialincrease of$282, 150 in health insurance cost this year have made it impossible to balance the budget without a millageincrease. Health insurance increases alone make up more than 40% of the increased costs of this budget.

County Manager Rabun explained that the proposed increased millage revenue will be used for the purchase of a usedfire engine, hiring a training officer for Public Safety, one-half position for Public Works, a replacement crew cab truckand mower for Public Works; a $ 1. 00 dollar per hour increase for those EMT staff who have become a certified

firefighters; increase equipment repairs and upgrades for Public Safety; a replacement mower and infield groomer forParks and Recreation. Contingency amount is slightly higher than last year' s total. A small debt payment will be due inthe next month for the bond for SPLOST VI. Lee County is in better shape with SPLOST VI funding and canpurchase some items now.

County Manager Rabun explained that Departments, including Elected officials, requested more funding but thisproposed budget has been cut by$ 2, 061, 731.Lee County came very close to closing a fire station due to the engine failure of one of the fire engines that was recentlyrepaired. The estimate to open Fire Station 6 would cost approximately$ 130, 000. This proposed budget for FY 2014-2015 represents the status quo and is a conservative budget which does not include opening, staffing, and equipping anew fire station No. 6 in the north part of our county, a new fire engine, replacement of older public safety rescuetruck, a dedicated road crew, road resurfacing program at $ 90,000 per mile, a stipend for future volunteer firefighters;additional Sheriffs vehicles, library book replacement was cut from$ 80,000 to $ 50, 000; and other items.

The Board discussed the proposed purchasing of four vehicles each year from SPLOST funds for the Sheriff' s office.The life of a sheriff' s vehicle should be seven years but for budgeting purposes schedule for five years. Heather Jones,Finance Director, recommended these vehicles be purchased from the state contract. Chairman Muggridge requested

input from the Board on their opinion on future purchase of auto gas with dual propane and gasoline. Chairman

Muggridge also recommended developing a comprehensive data base for the driver with the best gas mileage andawarding employees a gift card.

Lee County' s biggest exposure is the Fire Stations but there are no funds in the budget to repair the facilities.Installation and purchase of stairs for the DFACS office will be bid out this year. Ms. Jamie Swain, Interim Lee CountyDFACS Director, is willing to use their available funds from this year' s budget to assist with the purchase of the stairs ifthe DFACS Board approves.

Superior Court Clerk Sara Clark is willing to use the funds in her account; $ 42,000, for Courthouse upgrades and

repairs. Chairman Muggridge also explained that Ms. Clark also has Clerks Authority monies available for county usebut Ms. Clark has requested an intergovernmental agreement with the Board before these funds would be allowed to be

spent on the Courthouse repairs. The upstairs balcony is a mess and would require extensive renovation before thisarea could be utilized. Additional areas of the Courthouse are in need of repair, including the outside, basement area,and the top of the Courthouse building.Clerk' s authority money could also be used to renew for technology purposes.Chairman Muggridge proposed working on Lee County' s name recognition and improving signs at the gateway of thecounty with Life works well here. Chairman Muggridge also requested clarity on this landfill zoning issue. Get this

issue resolved and addressed. Review of the Land use and comprehensive plan, especially the property at the end ofNew York Road, or on the county line with Sumter, Terrell, and Crisp counties. Crisp County will be developing aterminal for the port. Neighborhoods with mandatory homeowners association that require deed restrictions thatrequire homeowners association to maintain areas within their neighborhoods should be reviewed. Acquire a list of

EIP, CDBG grants to fund and improve our identity name, brand, and get more aggressive with our economic

development. County Manager Rabun explained that these items were not funded in this budget. Collect the cost forthese projects was requested.

Commissioner Roland asked if the Board could contract with a repair shop for county vehicle maintenance. The Boarddiscussed bidding process for all county departments. The Board discussed Probation Court Services and the lack offees paid for payroll or an administration fee. Probation Services originally needed a fiscal agent to acquire a grantwhich Lee County agreed. Chairman Muggridge proposed presenting two strategies to Probation Services whichincludes an administration fee and suggests they emancipate themselves in the next budget year.Elections office budget was discussed with question on why cell phones were needed and how many polling places areutilised within the county.

Commissioner Singletary questioned how the revenue from The Bindery was handled. Finance Director Heather Jonesexplained that the Library conference center is a state account and she did not have control over this account. Funds

from the general fund for The Bindery are only for maintenance cost. Chairman Muggridge explained that the librarystaff is more than willing to give a report. Any excess money is used to replace items needed. The Board discussed therental fee to cover the operating cost of The Bindery. Several county departments including the Chamber, Electionsoffice, Tax Assessor' s office training, and Magistrate Court, ACCG and the Board of Commissioners have used TheBindery facilities at no charge. The Board discussed the distribution of Impact fees and expanding impact fees forcommercial.

Magistrate Court's travel budget and ankle monitoring program were both reduced.

Finance Director Jones explained that the state will continue to true up with TAVT tax. LOST revenue is down but theTAVT tax is up. SPLOST revenue is also down. The GATE card has also effected the revenue collections. Franchisefee revenue has also been reduced. Magistrate Court fees and ambulance fees are down. The Board discussed charginga service fee for every ambulance call that refuses a transport to the hospital. Medicare will not pay for ambulance feesif patients refuse to be transported

C) Schedule for future budget workshops

The Board agreed that County Manager Rabun could set the date for the next budget workshop and all Board memberswould participate as their schedules allowed.

The Lee County Board of Commissioners met in a work session on Tuesday, May 13, 2014. The meeting was held in theOpal Cannon Auditorium of the Lee County T. Page Tharp Governmental Building in Leesburg, Georgia. Those presentwere Commissioners Rick Muggridge, Dennis Roland, Luke Singletary, and Greg Frich. Commissioner Ed Duffy wasabsent. A) Charles Williams, Director of Southwest Georgia Workforce 44 request to address the Board to provide new

Commissioners information and updates on the Workforce Investment Act( WIA) Program.

Charles Williams, Executive Director of Southwest Georgia Workforce 44, explained that Lee County representatives wereRick Muggridge, Vice-Chairman, SWGA CEOO, Mayor Jim Quinn, Gabriel Lord, Youth Council and Programs

Committee. This Southwest Georgia organization serves 14 counties through the Workforce Investment Act with 48 Lee

County participants in job training programs.

UBLIC HEARING

A) The Lee County Board of Commissioners will hold a public hearing on Tuesday, May 13, 2014 at 6: 00 p.m., in theT. Page Tharp Building, Opal Cannon Auditorium, 102 Starksville Ave., N, Leesburg, Georgia 31763 to takepublic comments on the proposed road construction project for Forrester Parkway Extension. This meeting is

open to the public and the public is encouraged to attend.

Chairman Muggridge opened the public hearing for comments and questions from the Board and the audience. ChairmanMuggridge explained that an informational meeting was held this past October regarding this road project. This proposedroad has been in the Transportation Plan for the last twenty years. The Board of Commissioners, had previously paid forengineering services, but sought a second opinion with Georgia Tech students. The Board will vote on this proposed

route at their May 27thmeeting. After the route is approved, an engineering consultant will be selected to begin

preliminary design which must be completed prior to acquisition of the right of way. It is recommended that this projectbe designed and constructed beginning at the western limits and proceeds to the east.

Matt Inman, Director of Planning, Zoning, and Engineering, explained that the Glendale option was chosen due to theinterconnectivity and the future economic development that the Forrester Parkway Extension route provides. Glendale

Road sits in the middle of Lee County' s only two options for East-West travel and therefore offers the best flowthroughout the county. Forrester Parkway Extension Project is approved as a priority through the Dougherty AreaRegional Transportation Study ( DARTS) 2035 Long Range Transportation Plan. The DARTS Roadway Corridor Studyrecommended the Glendale route. Any route selected will have to resolve a challenge including environmental, right ofway acquisition, and budget constraints but this route provides Lee County with the safest and most direct route for itsfuture growth and transportation needs.

William McAfee, 2264 Fowl Town Farms, spoke in opposition to the Forrester Parkway Extension proposed along theGlendale Road route. Mr. McAfee asked the Board to consider the environment before choosing this route. Mr. McAfeestated that much of this proposed area is in wetlands and will result in limited economic development for the county.Tammy Jones, 143 Apache Street, spoke in opposition to the Forrester Parkway Extension proposed Glendale Road routeand asked that the Board consider other options for this road extension. Ms. Jones said that she has to travel only 2. 8miles to the by-pass but she is not I favor of this proposed road. Ron Farr, 236 Glendale Road, spoke in opposition to theForrester Parkway Extension proposed Glendale Road route citing concerns regarding reduced property value, increasedtraffic and children' s safety within the neighborhood. Jodie Crosby, 240 Glendale Road, spoke in opposition to theForrester Parkway Extension proposed Glendale Road route citing concerns that her yard is at the lowest points which isnot level with the road. Barry Farrow, 178 Glendale Road, spoke in opposition to the Forrester Parkway Extensionproposed Glendale Road route citing concerns for speeding, increased traffic, access to his driveway while backing up aboat. Paul Dover, 218 Glendale Road, spoke in opposition to the Forrester Parkway Extension proposed Glendale Roadroute cited concerns for the safety of children including the 12 school buses that travel this area. Janice Wood, 166Glendale Road, spoke in opposition to the Forrester Parkway Extension proposed Glendale Road route and cited concernfor garbage thrown in her yard, possible reduction in property value, and concern about the increase in traffic. Ms. Woodsaid she was disappointed in the Board for what they were proposing. Chuck Mendenhall, spoke in opposition to theForrester Parkway Extension proposed Glendale Road route citing concern for construction of a road through aneighborhood and wetlands based on a study by students from Georgia Tech. Jim Bacon, 433 Warwick, GA, owner in theOakland Group, spoke in favor of the Forrester Parkway Extension regardless of which route is chosen. Mr. Baconexplained that he, former Chairman Ed Duffy, and former County Administrator Alan Ours all travelled to Charlotte, N.C.to visit Core Properties that later developed a Master Plan for a Lee County large development that would have includedLife Style Centers, such as Target, and Bath & Beyond. This development group cited this proposed east west roadconstruction route as the most important progress for economic development. Mr. Bacon recommended the Board meet

with this group again once a route has been determined. Ricky Spence, 282 Kinchafoonee Creek Road, spoke in favor ofthe Forrester Parkway Extension proposed Glendale Road route citing this route was developed by EMC Engineering andBob Alexander, former Lee County Planning Director. Lee County had professional engineers look at least seven differentroutes. Fascine Middleton, who owns 3 properties along Creekside Drive including 111, 168, 170, spoke in opposition tothe Forrester Parkway Extension proposed Glendale Road route citing safety of the residents, Bobby Hinman, GlendaleRoad, spoke in opposition to the Forrester Parkway Extension proposed Glendale Road route citing safety of the childrenin the neighborhood, and concerns regarding flooding due to the construction of the proposed bridge. James Holton,owns property north of Jay McAfee, spoke in opposition to the Forrester Parkway Extension proposed Glendale Roadroute and asked the Board to consider the environmental impact of this road construction and conservation of his familyfarm which has been in his family for 180 years. Heidi Roe, 130 Maggie Court, spoke in opposition to the ForresterParkway Extension proposed Glendale Road route citing the noise level of the current rumble strips that are installedacross Highway 19 on Forrester Parkway. With no further comments Chairman Muggridge closed the public hearing.

B) Z14-004 ZONING APPLICATION, LARRY DORSEY, APPLICANT, has submitted an application to rezone a

2.5 acre tract of property in Land Lot 137 of the 1st District and being on the west side of Philema Road 2014. 85feet south of the intersection of Philema Road and the north Land Lot line of Land Lot 137. Property is currentlyzoned C- 1 Neighborhood business and application is made to rezone to R-3 Mixed Use Single FamilyResidential for the purposes of placing a manufactured home for residential use on the currently vacant land.Property is further identified as being 916 Philema Road South, Leesburg, Georgia. The Planning Commissionconducted a public hearing on April 15, 2014 and recommended approval. Regional Commission ( RC) staffrecommends approval.

Property is currently zoned R-1 Single Family Residential and application is made torezone to C- 2 General Business for the purposes of developing retail or office space and storage. The PlanningCommission conducted a public hearing on April 15, 2014 and recommended denial of the proposed C- 2 zoning;and recommended approval of rezoning property to C- 1 Neighborhood Business. Regional Commission ( RC)recommends denial of C- 2 zoning due to permitted uses being overly broad and the inclusion of commercialstorage buildings not being suitable near area homes; and approval of C- 1 zoning to prevent commercial storagebuildings from being built in close proximity to residential homes. A) Consideration to award bid to Flint Equipment for a five ( 5) year lease/ purchase of a Motorgrader at a monthlylease payment of$1,222.00; and Front End Wheel Loader at a monthly payment of$1, 473.00.County Manager Rabun explained that staff committee reviewed all bids and recommended awarding the bid to FlintEquipment for a five year lease of a MotorgraderJD 670G at a monthly lease payment of $1, 222.00 and a Front EndWheel loader-JD624K at a monthly payment of$ 1, 473.00.

B) Consideration to award bid to Yancey for the lease/ purchase of a Wheeled Excavator at a monthly lease paymentof$1, 650. 64; and Track Excavator at a monthly lease payment of$1,143. 20.County Manager Rabun explained that staff committee reviewed all bids and recommended awarding the bid to Yancey forthe lease/ purchase of a Wheeled Excavator-CAT M318D at a monthly lease payment of$ 1, 650.64; and Track Excavator-CAT 316EL at a monthly lease payment of$ 1, 143.20.

C) Consideration to accept high bid of$20,000 from Yancey for the sale of a 1984 Caterpillar scraper/ pan that hasbeen previously declared surplus.County Manager Rabun explained that staff committee reviewed all bids and recommended awarding the bid to Yancey for

D) Consideration to declare vehicles surplus property. ACTION ITEMCounty Manager Rabun recommended the Board take action on declaring the 1999 Ford Crown Victoria Vehicle 211, 028miles, 2000 Ford Crown Victoria Vehicle 175,630 miles, 1999 Ford Crown Victoria Vehicle 228,458 miles, 1985 Peterbuilt

Planning DepartmentE) Consideration to adopt a resolution granting final approval for Westwinds IV subdivision at Armena Road

SD13- 006) and accept 80 foot deed of right-of-way, easements, a 2 year maintenance bond and paved roads.Roads to be accepted are Station Drive (1664 ft/ 0. 31 mi length) and Depot Court( 974 ft/ 0. 18 mi length).

Matt Inman, Director of Planning, Zoning, and Engineering, explained that County Attorney Skipper had reviewed andconfirmed that all documents are up to legal standards. Chairman Muggridge asked about the quality of the roads. Mr.

Inman said that there were no problems during an inspection of roads during a rain event and in addition, Lee County hasa two year maintenance bond. Station Drive and Depot Court meet applicable GA DOT and Lee County roadconstruction specifications and standards. Soil- cement test performed by 1' l'L, Inc. also met required specifications. Mr.Inman recommended the Board accept the deeds of rights-of-way, easements, and roads, deed of dedication and the two-year maintenance bond included within Westwinds IV @ Armena Road Subdivision at their Voting meeting later thismonth.

F) Review of Planning Commission meeting minutes for April 15, 2014.The Board reviewed the Planning Commission meeting minutes for April 15, 2014.

ONSTITUTIONAL OFFICERS & GOVERNMENTAL BOARDS/ AUTHORITIES

A) Consideration to appoint one member to the Lee County Family& Children Services Board for a five year term.

The current term expires 6- 30- 16. Letters of interest from Charles Moore, and Ragan L. Fretwell.Chairman Muggridge explained that letters of interest were received from Charles Moore, and Ragan L. Fretwell forappointment to Lee County Family& Children Services Board for a five year term. This term expires June 30, 2016.

B) Consideration to appoint one member to the SOWEGA Regional Commission ( RC) for a one year term, expiringone year from appointment date. Letter of interest from Robert Ramsey.Chairman Muggridge explained that a letter of interest was received from Robert Ramsey for the SOWEGA RegionalCommission (RC) for a one year term, expiring one year from appointment date.

C) Consideration to appoint one member the SOWEGA Housing Task Force for a two year term. Current termexpiring 12- 31- 15. Letter of interest from Ragan L. Fretwell.Chairman Muggridge explained that a letter of interest was received from Ragan L. Fretwell for appointment to the

SOWEGA Housing Task Force for a two-year term with the term expiring December 31, 2015.

OUNTY MANAGER' S MATTERS

A) Consideration to adopt an updated Capital Improvements Element Annual Resolution and submit to the

Regional Commission to be transmitted to Department of Community Affairs. ACTION ITEMCounty Manager Rabun recommended the Board take action to adopt the updated Capital Improvements Element AnnualResolution and authorize staff to submit to the Regional Commission to be transmitted to the Department of CommunityAffairs.

Commissioner Singletary made a MOTION to adopt the final Capital Improvements Element Annual Resolution andsubmit to the Regional Commission to be transmitted to the Department of Community Affairs. Commissioner Roland

seconded the MOTION. The MOTION passed with unanimous vote Commissioner Frich voting yea.9

B) Approval of the Flexible Benefits Plan Document Amendment allowing for the rollover of unused funds in aParticipant' s Health Care Flexible Spending Account up to a maximum of $500.00 per individual

participant/ employee as allowable under the P.P.A.C.A., effective May 1, 2014County Manager Rabun explained that Admin America, Lee County' flexible spending account administrator, has providedan amended plan document for approval, in compliance with changes made to I.R.S. regulations under the Patient

Protection and Affordable Care Act that became effective May 1, 2014. This amendment allows for the rollover of a PlanParticipant' s unused funds at the end of the plan year, up to$ 500.00.

C) Acceptance of lowest and best bid to fabricate and install a set of steel stairs to provide access to the upstairs

west side entrance to the Department of Family & Children Services ( DFACS) building in Leesburg.Recommended bid is to S& S Concrete for$ 12,450.

County Manager Rabun recommended the Board take action to approve the bid for installation of exterior stairs for theDepartment of Family and Children, a county-owned building at 4th Street in Leesburg. Acting Director Jamie Swain hasbeen provided copies of the bids and depending on the DFACS Board may be able to share in this purchase for thesecond store stairs.

Commissioner Singletary made a MOTION to award the bid to S& S Concrete for $12,450 for the installation of DFACSstairs. Commissioner Frich seconded the MOTION. The MOTION passed with unanimously with CommissionerRoland voting yea.

OMMISSIONER'S MATTERS

A) Discussion of installing an 8" x 10" engraved brass plaque near the bell location in front of the T. Page Tharpbuilding in honor of Mr. Bill Cannon.Commissioner Roland recommended the Board approve the purchase and installation of an engraved brass plaque for theschool bell located in front of the T. Page Tharp Government Building in honor of Mr. Bill Cannon. Commissioner

Roland said that he had discussed this issue with Mrs. Opal Cannon and she understood that when the bell was donated to

the county by her family that a plaque would be installed on this bell. County Manager Rabun explained that the estimatefor purchase of the 8" x 10" plaque was $ 210.00. Chairman Muggridge recommended expanding that presentation plaque

to incorporate language regarding the larger issues of foundation of freedom with education and faith.

EPARTMENTAL MATTERS

A) Discussion of the FY 2014/ 2015 proposed budget.

Budget Chairman Frich opened the budget meeting for discussion of the FY 2014-2015 proposed budget.The Board discussed increased medical cost for employees and the J. Smith Lanier budget estimate projection.The current amount budgeted per employee is $ 12, 000. The Board also discussed the tobacco surcharge.

The Board discussed EMS ambulance fee billings $ 587, 835 with actual year to date collection of$ 371, 958. A

Request for Proposal for EMS billing services has been bid out. The Board discussed options of an incentivefor higher level collections of non-payment clients, the track record of the billing company with collections, and

auditing the company billing codes for possible incorrect codes. The FY-2014-2015 ambulance fee revenue is

currently budgeted at $ 521, 400. The Board discussed the importance to meet the criteria for reimbursement.Medicare and Medicaid set the rates for ambulance fee reimbursement. The prior billing contract paid $15. 00per claim and the current contract has no base fee and pays 7%.Budget Chairman Frich requested a year to date report from the billing company.

The Board discussed SPLOST IV projects and requested the amount of funds left in this account and theproject list. The Board also discussed SPLOST V funding for road projects including Westover Road, Ragan,Lane, and Thomas. The Board discussed LMIG funds as additional funds for upcoming road projects.

The Board discussed the $ 43, 000 of unclaimed funds held by Superior Court from the previous Superior Court12

Clerk. County Attorney Skipper is currently reviewing and will provide court procedures to obtain these fundsfor use on county projects County Manager Rabun reported.

The Board discussed the Volunteer Firefighter pilot program for the Redbone Station. Bobby Watkins, InterimPublic Safety Director, explained that it takes two volunteers to obtain credit for one firefighter. The Board

discussed options for providing $ 25. 00 monthly state retirement, turn-out gear, pager, and training

requirements. Mr. Watkins agreed to bring back a complete list of costs and requirements for this pilotprogram. Commissioner Roland suggested the Board consider implementing a non-transport fee for medicalresponses. Chairman Muggridge questioned why the county is reimbursed for ambulance fees but not fire feesfor fire responses. Mr. Watkins explained that it is often difficult to determine who should be charged such asan act of arson or car accidents that insurance companies do not accept cost claims from fire departments..

Doug Coffins, County Extension Service Director, requested $ 1, 300 be reinstated in his budget for matchingfunds for the purchase of computer equipment. Mr. Collins explained that the state would pay one-half for thereplacement of computers. Chairman Muggridge questioned Mr. Collins on a wellness program provided bythe Extension Service and possibly have the county pay one- half for this position. County Manager Rabun

explained that the RFP for providing Wellness will be due June 10, 2014 and the Extension Service could bidon this contract. would not recommend another model. The Board discussed the 12% State Retirement paid

by the county through a contractual obligation with County Extension. In addition, Mr. Collins discussed clubmeetings, staffing numbers, student participation, vehicles, farmers market, and percentage of time dividedamong farmers, homeowners and 4-H students.

The Board discussed the county' s Defined Benefit ( DB) funding amount for the county retirement program.Ms. Jones said that the county has funded the DB Plan between the required amount and recommendedamount. Chairman Muggridge commented that he did not want the county to underfund the employee

retirement program. The Board requested the funding report for the DB Plan.

The Board discussed the Parks and Recreation program and the built in overtime for the staff. The Board

discussed options but all agreed that the current staffing model is not sustainable.

The Board also discussed the structure of E911 and Sheriffs office overtime schedule.

NNOUNCEMENTS

A) The next regularly scheduled County Commission Meeting is Tuesday, May 27, 2014 @ 6:00p.m. in the OpalCannon Auditorium.

B) County offices will be closed Monday, May26, 2014 in observance of Memorial Day.

Regarding the rezoning from a commercial zone to a R- 3 zone, and based on the rezoningcriteria in Section 70-690 of the Lee County Zoning Ordinance, staff finds:

1. Will the zoning proposal pent* a use that is suitable in view of the use, development andzoning ofadjacent and nearby property?

RC staff was not provided any information regarding the length of time the applicants parcel

has been vacant as currently zoned so it is unclear if the current zoning has had any effect.

5, Will the zoning proposal result in a use which will or could cause an excessive orburdensome use ofexisting streets, transportation facilities, utilities, schools, policeprotection, fire protection, public health facilities, or emergency medical services?This factor ins broad in scope. The planning con urussiaar most weigh die public benefits of the existing zoning restriction against

the private burden of the restriction to the applicant. In considering the public benefit of the restriction, the planningcommission void look at several vanillin. How does the existing zoning restriction affect the community' s schools? Thecommunity' s tax base? Population density? Traffic? Storm water detention and control? Aesthetic concerns? None of thesevariables alone is determinative.]

The proposed zoning will have little to no impact on county services and facilities.

AMENDMENT TO THE LEE COUNTY BOARD OF COMMISSIONERSFLEXIBLE BENEFITS PLAN

Pursuant to Section 10. 1 of the Lee County Board of Commissioners Flexible Benefits PlanDocument, said Plan Document is hereby amended as described herein. It is the intention of the

Plan Sponsor that such Amendment shall allow for the rollover of unused funds in the Health Care

Flexible Spending Accounts of Plan Participants at the end of each Plan Year as authorized by IRSNotice 2013- 71 and to eliminate the Post Plan Year Extension Period previously applicable to suchaccounts. It is the intention of the Plan Sponsor to maintain the Post Plan Year Extension Periodfor unused funds in the Dependent Care Flexible Spending Accounts of Plan Participants. To the

extent any terms or conditions of this Amendment are inconsistent with the rules or regulations laterpromulgated by the U.S. Treasury Department or the Internal Revenue Service, such terms andconditions shall be void.

ARTICLE I

DEFINITIONS

The definition of " Post Plan Year Extension Period" currently found in ARTICLE I of the PlanDocument shall be modified to read as follows:

Post Plan Year Extension Period" means the period of 75 days immediately following aPlan Year during which Participants may incur expenses and be reimbursed from theirDependent Care Flexible Spending Arrangement from the Plan year that ended immediatelypreceding the extension period.

The following definition shall be added to ARTICLE I of the Plan Document:

Rollover Amount" means the amount of a Participant' s Health Care Flexible Spending thatis not forfeited at the end of a Plan Year but instead is credited to the Participant' s Health

Care Flexible Spending Account for the subsequent Plan Year, subject to Section 6.7.

ARTICLE V

PARTICIPANT ELECTIONS

Section 5. 2 of the Plan Document shall be amended to read as follows:

5. 2 SUBSEQUENT ANNUAL ELECTIONS

During the Election Period prior to each subsequent Plan Year, each Eligible Employeeshall be given the opportunity to elect, through a Salary Redirection Agreement to beprovided by the Administrator, which Benefits options the Participant wishes to purchase.Any such election shall be effective for Benefit expenses incurred during the Plan Year( andany applicable Post Plan Year Extension Period) which follows the end of the ElectionPeriod. With regard to subsequent annual elections, the following options shall apply:

a) An Eligible Employee who failed to initially elect to participate may elect Benefitsunder the Plan during the Election Period;

b) During the Election Period, a Participant may terminate his participation in the Planor change Benefit elections under the Plan;

c) Subject to the provisions of Section 5.4, an Employee who elects not to participate

for the Plan Year following an Election Period will have to wait until the nextElection Period before again electing to participate in the Plan.

Section 5. 3 of the Plan Document shall be amended to read as follows:

5. 3 FAILURE TO ELECT

Any Participant enrolled in the Insurance Premium Payment Arrangement who fails tocomplete a Salary Redirection Agreement pursuant to Section 5.2 by the end of the ElectionPeriod for the subsequent Plan Year shall be deemed to have elected to continue

participation in the Plan for the subsequent Plan Year for the purposes of paying theEmployee' s share of premiums for any Employer-sponsored Insurance Benefits which thatEmployee is covered under as of the first day of the subsequent Plan Year. Any Participantfailing to complete a Salary Redirection Agreement pursuant to Section 5. 2 by the end ofthe Election Period shall be deemed to have elected not to participate in the coverages

referred to in Section 4.2 or Section 4.3 for the subsequent Plan Year except that if the

Participant has a Rollover Amount from a prior Plan Year, the Participant shall be deemed

to have elected to participate in the coverage referred to in Section 4.2 but only to the extentof the individual' s Rollover Amount.

ARTICLE VI

HEALTH CARE FLEXIBLE SPENDING ARRANGEMENT

Section 6.7 of the Plan Document shall be amended to read as follows:

6.7 ROLLOVERS AND FORFEITURES

The lesser of $500.00 or the amount in a Participant' s Health Care Flexible SpendingAccount as of the end of any Plan Year ( and after the processing of claims for such PlanYear pursuant to Section 6. 11 hereof) shall be credited to the Participant' s Health Care

Flexible Spending Account for the subsequent Plan Year. The amount described in this

paragraph is the Rollover Amount.

The amount in a Participant's Health Care Flexible Spending Account in excess of$500.00as of the end of any Plan Year ( and after the processing of claims for such Plan Yearpursuant to Section 6. 11 hereof) shall be forfeited and deposited into the Employer's benefitplan surplus. In such event, the Participant shall have no further claim to such amount for

any reason.

Section 6.8 of the Plan Document shall be amended to read as follows:

6.8 LIMITATION ON PARTICIPANT' S ALLOCATION

Notwithstanding any provision contained in this Health Care Flexible SpendingArrangement to the contrary, no more than$ 2,500.00 may be contributed by a Participant toa Participant's Health Care Flexible Spending Account in or on account of any Plan Year.The Employer reserves the right to change the maximum amount that may be allocated toa Participant' s Health Care Flexible Spending Account prior to the beginning of any PlanYear. Any such limitation shall be applied in a uniform and nondiscriminatory manner toall Participants in the Plan. The limitation found in this paragraph shall not restrict nor be

affected by the amount of any Employer non-elective contribution to a Participant' sHealth Care Flexible Spending Account or to the amount of any Rollover to aParticipant' s Health Care Flexible Spending Account as may be authorized bySection 6.7.

Section 6. 11 of the Plan Document shall be amended to read as follows:

6. 11 HEALTH CARE FLEXIBLE SPENDING ARRANGEMENT CLAIMS

a) All Medical Expenses incurred by an individual while a Participant in the LeeCounty Board of Commissioners Flexible Benefits Plan and covered by this HealthCare Flexible Spending Arrangement shall be reimbursed, even though the

submission of a claim for such expenses may occur after Participation hereunderceases, subject to paragraph ( c) of this Section 6. 11 and provided that the Medical

Expenses were incurred during the applicable Plan Year. A former Participant maysubmit claims for unreimbursed medical expenses incurred prior to the date uponwhich the individual ceased to be a Participant.

b) The Plan shall reimburse, at the times set forth in this Section 6. 11, each eligible

Participant for all allowable Medical Expenses, up to a maximum of the amountdesignated by the Participant for the Health Care Flexible Spending Account for thePlan Year plus the amount of any non-elective Employer contribution plus theRollover Amount described in Section 6.7, which have been incurred by theParticipant and/ or his Spouse or Dependents, in excess of any payments or otherreimbursements under any health care plan which may be sponsored by theEmployer, any governmental agency or any other plan covering a Participant and/orhis Spouse or Dependents. Furthermore, reimbursements shall be made available to

the Participant throughout the year without regard to the level of flexible benefit plan

dollars, which have been allocated to the Participant' s Health Care Flexible SpendingAccount at any given point in time.

c) Claims for the reimbursement of Medical Expenses incurred in any Plan Year shallbe paid as soon after a claim has been filed as is administratively practicable;provided however, that if a Participant fails to submit a claim within the 90 dayperiod immediately following the end of the Plan Year, those Medical Expenseclaims shall be considered for reimbursement only at the discretion of the

Administrator.

d) Reimbursement payments under this Plan shall be made directly to the Participant.The application for payment or reimbursement shall be made to the Administrator( or

the Administrator' s designee) on an acceptable form within a reasonable amount of

time of incurring Medical Expense. Medical Expenses shall be deemed to have beenincurred when the service is provided, not when the service is paid for. The

application shall include the name of the eligible Employee, Spouse or Dependent on

whose behalf the Medical Expense was incurred, the date incurred, a brief

description of the Medical Expense and a statement that the Medical Expense has not

been reimbursed or is not reimbursable by a health insurance plan or otherwise, and,that if reimbursed from the Participant's Health Care Flexible Spending Account, willnot be claimed as a tax deduction. The Administrator shall retain a file of all such

applications.

ARTICLE VIII

ERISA PROVISIONS

Section 8.2 of the Plan Document shall be amended to read as follows:

8. 2 APPLICATION OF BENEFIT PLAN SURPLUS

Any forfeited amounts credited to the benefit plan surplus by virtue of the failure of aParticipant to incur a qualified expense or seek reimbursement in a timely manner may, butneed not be, separately accounted for after the close of the Plan Year (or after such furthertime specified herein for the filing of claims) in which such forfeitures arose. Except as

authorized by Section 6.7 of this Plan, such amounts shall not be carried over to reimburse aParticipant for expenses incurred during a subsequent Plan Year ( except for expensesincurred during the Post Plan Year Extension Period) for the same or any other Benefitavailable under the Plan; nor shall amounts forfeited by a particular Participant be madeavailable to such Participant in any other form or manner. Amounts in the benefit plan

surplus may, but need not, be used to defray any administrative costs and experience losses.

ARTICLE XI

CONTINUATION COVERAGE UNDER COBRA

Section 11. 6 of the Plan Document shall be amended to read as follows:

11. 6 DURATION OF CONTINUATION COVERAGE

Except as otherwise provided in this Plan, Continuation Coverage shall extend for the

remainder of the Plan Year in which the Qualifying Event occurs.

11. 8 PARTCIPANT' S OPTION FOR PRE-TAX TREATMENT OF PREMIUMS

Upon the occurrence of a Qualifying Event, if an employee and the employee' s spouse andall of the employee' s eligible dependents decline Continuation of Coverage in the Health

This summary describes a change to the Lee County Board of Commissioners Flexible BenefitsPlan. The change described below will go into effect as ofMay 1, 2014.

ADDITION OF A NEW ROLLOVER PROVISION

At the end of the current Plan Year, up to $ 500 of unused funds in your Health Care Flexible

Spending Account may be rolled over into the subsequent Plan Year. This is a change from the

prior rules governing the Plan which was recently authorized by the IRS.

After the end of the Plan Year, you may submit expenses for reimbursement prior to the claimsfiling deadline of April 30. Any eligible expenses properly submitted prior to the claims filingdeadline will be paid prior to the amount ofyour rollover being finalized.

Lee County staff received a request for final approval for Westwinds IV ® Armena Road

Subdivision. All construction is complete and approved. All legal work has been received andhas been approved by the County Attorney. Staff has reviewed and approved the final platadministratively.

Station Drive( 1664 ft/0. 31 mi) and Depot Court( 974 ft/0. 18 mi) have been inspected during mysite visit and they meet applicable GA DOT and Lee County road construction specifications andstandards. We have received a 2- year maintenance bond that is in place through May 27, 2016.The soil-cement test performed by TTL, Inc. shows that roadway base course meets the requiredspecifications.

Attached is a plat of Westwinds N Q Armen Road Subdivision, the Certificate ofTitle, RightOfWay Deed, Deed ofDedication, the two-year Maintenance Bond, the Soil-Cement Cores TestResults, and the approval email from Jimmy Skipper.

RECOMMENDATION:

Staff recommends that the Lee County Board of Commissioners accept the deeds of rights-of-way, easements, and roads, deed of dedication, and the two-year maintenance bond includedwithin Westwinds N® Armena Road Subdivision.

RC Staff examined the subject property according to the applicable provisions of Lee County'sZoning Ordinance listed as follows: Article XII Section 70-382,( C-2, Permitted Uses).

Regarding the rezoning from a residential zone to a C-2 zone, and based on the rezoning criteriain Section 70-690 of the Lee County Zoning Ordinance, staff finds:

The proposed zoning is out of scale with the needs of Lee County. Furthermore, there is alreadyplenty of commercial establishments located on Grand Island Dr. contributing to traffic on whatappears to be a predominantly residential street.

14. Is it impossible to find adequate sites for the proposed use in districts permitting such useand already appropriately zoned?

WHAT IS THE PROPOSED USE?!

15. Would there be an ecological or potution impact resulting from the proposed zoning it isgranted?

The environmental impact would be very minimal if developed according to applicablestate and federal regulations.

NATION: RC staff recommend denying the request to rezone the property in

question. RC staff believe that any commercial zoning would be inappropriate at this locationand furthermore the applicant has failed to divulge what use they intend to put here. Thiswould open up the property to any number of uses if rezoned that would be allowed by rightthat probably would not be very desirable at this location.

Sometime between Friday, April 25, 2014 and Monday, April 28, 2014 a transformer was tripped by a squirrel, which sent a surge to the phonesystem and completely destroyed all the electronics, hardware and programming. Starting Monday, April 28, 2014 we had Southern Telecomreplacing, repairing and reprogramming the outdated phone system. I have included the bill for the work up to date in the amount of

Public Hearing and additional information:

Planning staff has reviewed the concerns noted by citizens during the public comment session aspart of the May 12, 2014 Board of Commissioners meeting. The primary issues discussed duringthis meeting were related to safety of pedestrians, loss of property value, storm drainage andhaving to back into the busy street. In order to address these issues staff has refined plans toinclude sidewalk/ bike lanes, curb and gutter, street resurfacing and turnaround pads to be

installed along the Glendale Road section. These improvements will provide greatly increasedsafety for pedestrians and will not require the homeowners to back into Glendale Road. Providingthe curb and gutter and upgraded storm drainage will be a visual upgrade to the existing ditchesand aging infrastructure currently present which will provide better drainage as well as an upgradedcurb appeal which will be a boost to property values along this section. Please see the attacheddrive details for more information on these proposed improvements.

The Glendale Road option is the preferred route for the Forrester Parkway Extension. While thereare environmental issues, right of way concerns and budget constraints that will have to beresolved during the design and construction phases this route provides the best route for theForrester Parkway extension. Any route selected will have similar concerns but the Glendale optionprovides the best balance between the safest and most direct route and mitigation to the impact ofthe landowners adjacent to the proposed route.

Project Description: Forrester Parkway& Westover Road Extension:

The project area lies in the southwest portion of Lee County between the Oakland Development tothe West and the end of the existing Glendale Road at its eastern end. The primary objective ofForrester Parkway Extension Project is to provide an east west arterial for traffic between US 19 andUS 82, a total length of approximately five miles. The proposed roadway will provide a ten mileconnection between Philema Road ( SR 91) and US 82( SR 520) when completed. The WestoverRoad Extension Phase II will extend the current Westover Road project from Fussell Road one mile

to the north to the intersection with Forrester Parkway. The roadway will be designed to make

current and future needs of commuting traffic and provide for transportation needs for futuredevelopment in the area.

There must be a balance between the most direct route between the two ends of the project and amitigation of impact of the disturbance to the environment and adjacent landowners as the projectwill be constructed in areas that include the Kinchafoonee Creek Watershed, developed residentialareas, and agricultural uses.

Forrester Parkway Extension Project is approved as a priority through the Dougherty Area RegionalTransportation Study( DARTS) 2035 Long Range Transportation Plan. Forrester Parkway is also inthe Lee County 2026 Comprehensive Plan and will be funded by SPLOST VI funding. This will be atwo- lane facility with posted speed limits from 35 mph to 55 mph. The estimated traffic volumesaccording to the DARTS Study, is 4,000 vehicles per day by 2035. The project is proposed to have aright-a- way of 120 feet on Forrester Parkway and 100 feet on Westover Road.

From the Georgia Tech Student's presentation- Section 4.0 Conclusion:

Southern Solutions found that overall the Forrester Parkway extension with Glendale option was

the best fit for the Lee County east-west connector. This decision was made not only based onempirical data and arbitrary figures, (note: refers to items such as economic development for whichan exact number cannot be assigned) but also out of logical reasoning. The main upsides to theGlendale option is the interconnectivity and the future economic development that the routeprovides. Glendale Road sits in the middle of Lee County' s only two options for East-West traveland therefore offers the best flow throughout the county. This route is bookended by two potentialcommercial development sites, which will produce an economic benefit. On the east side of

Glendale is a shopping center anchored by a Publix. Just east of this shopping center on Glendale isa parcel projected to become another commercial/ business center. On the west side of theproposed connector is another proposed development, which has provoked a lot of retail interest.The route will also provide an ideal residential development along the Kinchafoonee Creek.

Staff Recommendation:

After reviewing all the available data from the DARTS study, meeting with numerous land ownersand making multiple site visits to the properties adjacent to the proposed roadway, the aboveoption is recommended for approval as our preferred option to date. As stated in the DARTS

Roadway Corridor Study" There must be a balance between the most direct route between the twoends of the project and a mitigation of the impact of the disturbance to the environment andadjacent landowners as the project will be constructed in areas that include the Kinchafoonee Creekwatershed, developed residential areas and agricultural uses." Any route selected will have toresolve a challenge including environmental, right of way acquisition and budget constraints butthis route provides Lee County with the safest and most direct route for its future growth andtransportation needs.

The next step after route approval is to select an engineering consultant to begin preliminary designwhich must be completed prior to the acquisition of the right of way. It is recommended that this

project be designed and constructed beginning at the western limits and proceed to the east as theproject becomes more complex from an environmental, cost and right of way acquisition as theproject approaches the Kinchafoonee River.

Staff recommends approval of the Glendale Road Route for the Forrester Parkway Extension.
