Melinda Hester reported that the 79th

Legislature, 3rd called Special Sessionpassed HB 1, which amended the TexasEducation Code, Section 38.015, Self-Administration of Prescription Asthma orAnaphylaxis Medicine by Students.

Beginning with the 2006-07 school year,students with asthma and students who areat risk for developing anaphylaxis are entitledto carry and self administer their prescriptionasthma or anaphylaxis medications while atschool or a school event, provided thestudent can demonstrate they are skilled inself-administering their own prescriptionmedications to their physician or other healthcare provider and the school nurse, if one isavailable.

sponsoring the model legislation around thecountry. This type of legislation exists in (14states including Texas) California, Montana,North Carolina, South Carolina, Washington,Connecticut, Wisconsin, Kentucky, Oregon,Hawaii, Utah and Virginia. Texasimplemented this legislation (HB 984) lastyear. Texas schools and school nurses justcompleted their first year implementing thislegislation. Legislation has been introduced inRhode Island, Indiana, Oklahoma, NewJersey, West Virginia, Michigan,Pennsylvania and again in Tennessee.ANA, NASN and AFT are concerned aboutthe legislation, because many states arerequiring the RN to delegate, which is aviolation of states NPAs, should the RNdetermine the unlicensed person is notqualified or competent. Additionally, they areconcerned that precedent is being set forother types of chronic diseases to follow suit,i.e. asthma and epilepsy.A consensus among these organizations isthe safety of students come first and effortsshould be directed at public policy andfunding that provides a full-time RN in eachschool building to manage all students,particularly those with chronic disease. Theopportunity exists, to teach Texas schoolnurses about the laws surroundingdelegation, thus assisting them to beconfident in the care of students withdiabetes by unlicensed personnel.

7.5. ProposedRule Reviews forChapters 211,GeneralProvisions; 213,Practice andProcedure; and219, AdvancedNurse PractitionerPrograms

Joy Sparks reported that Section 2001.039of the Texas Government Code requireseach agency to review each of its rulesevery four (4) years and consider whetherto re-adopt, re-adopt with amendments, orrepeal each rule. The reviews of chapter211 (General Provisions), chapter 213(Practice and Procedure), and chapter 219(Advanced Nurse Practitioner Program)were posted in the July 14, 2006, TexasRegister and are being done pursuant tothis statutory requirement. The Board willneed to assess whether the reason(s) fororiginally adopting these chapterscontinues to exist. Each section of thesechapters will be reevaluated to determinewhether it is obsolete, reflects current legaland policy considerations, reflects currentprocedures and practices of the Board,and/or whether it is in compliance with

The Board considered Staff’s proposedcriteria for the staff to use in proposingeligibility and disciplinary orders involvingindividuals with criminal conduct.

The Board voted to adopt the “DisciplinaryGuidelines for Criminal Conduct” to beused in Eligibility and Disciplinary Mattersand to place the guidelines on the websiteto guide candidates for licensure andlicensees under investigation with theaddition of a footnote that employmentwith a board order/sanction is at thediscretion of the employer/facility.

7. NEW BUSINESS 7.2. RevisedFrequently AskedQuestions onEmergencyMedical Treatmentand Labor Act(EMTALA)

The Board considered new FAQs on therole of the nurse regarding the EmergencyMedical Treatment and Labor Act(EMTALA), primarily as it relates toperformance of a medical screening examby a registered nurse.

The Board voted to approve new FAQs onthe Nurse’s Role with the EmergencyMedical Treatment & Labor Act (EMTALA):Performance of Medical Screening Examsand to permit Board legal counsel to makenon-substantive editorial changes ifdeemed necessary for purposes ofclarification.

7.6. Request forAdditional Chargesfrom the Board tothe AdvisoryCommittee forEducation

The Board considered staff’s request forthe Board to approve additional charges tothe Advisory Committee for Education(ACE) regarding distance education,simulation as a part of clinical learningexperiences, and limitations or a revisedprocess for re-submitting a proposal for anew nursing education program after theoriginal proposal is denied by the Board.
