    REQUIREMENTS

    DEFINITIONS Motorboat Any vessel propelled by any orm o mechanical power, gas,

    electric and diesel, including an electric trolling motor. Personal Watercra A class o inboard vessel less than 16 eet in

    length that uses an internal combustion engine powering a jet pump asits primary source o motive propulsion and is designed to be operatedby a person sitting, standing or kneeling on the vessel rather than in theconventional manner o boat operation.

    Sailboard A suroard-type vessel with no reeboard and using a ree-sailsystem with a swivel-mounted mast not secured to a hull by guys or stays.

    Vessel Every description o watercra, other than a seaplane on the

    water, used or capable o being used as a means o transportation onwater. Starboard Te right side o a vessel. Port Te le side o a vessel. Bow Te ront o a vessel. Stern Te rear o a vessel. Leeward Downwind. No Wake Speed Speed at which a vessel does not produce a wake, not

    to exceed 5 mph.

    WHO MAY OPERATE A MOTORBOATAnyone operating a motorboat or personal watercra in Nebraska, born aerDec. 31, 1985, must be at least 14 years o age and they must have successullycompleted the Nebraska boating saety course and are in possession o a validcerticate card. (See Boater Education, page 6)

    REGISTRATIONLength o Registration Nebraska motorboat registrations are issued orthree-year periods, expiring on Dec. 31 o the third year. No motorboat may beoperated aer Dec. 31 without the registration being renewed.

    Where to Get a New Registration Registrations may be obtained only rom thecounty treasurer in the boaters county o residence.

    Where to Renew a Registration Registrations may be renewed atOutdoorNebraska.org/boating or at county treasurer oces.

    Duplicate A duplicate certicate will be issued by the county treasurer on prooo loss or a $5 replacement ee and $4 issuing ee.

    Proo o Registration Te registration certicate must be available or lawenorcement inspection at any time.

    What Must Be Registered All vessels powered by any mechanical device (gas,electric and diesel) capable o propelling the vessel over any public or privatewaters o Nebraska (including the Missouri River and Lewis and Clark Lake) must

    be registered.

    Exceptions: vessels not powered by machinery at any time motorboats registered in another state and housed in Nebraska less than

    60 consecutive days vessels owned by any government or political subdivision

    racing type motorboats when competing in state approved races andduring trial runs 48 hours beore or 48 hours aer competition vessels documented by U.S. Coast Guard

    address shall, within 15 days, notiy Game and Parks o the new address.

    Destruction or Abandonment Te owner shall notiy the Game and Parkso the destruction or abandonment o any vessel within 15 days, which willterminate the registration.

    NUMBERINGPlacement and Display Te assigned numbers designated on the registration

    shall be placed on each side o the orward hal o the vessel, reading le to rightin one horizontal plane.

    Numbering shall start with the validation sticker, ollowed by the twocapital block letters NB, then three digits in a numerical group, then a2-inch space, and nally two or three capital block letters.

    Letters and numbers will be block gures at least 3 inches in height, ocontrasting color and visible or 100 eet.

    Purchase o the letters and numbers, except the validation sticker and theattachment to the motorboat, are the responsibility o the owner.

    No numbers and letters other than the registration numbers, letters andvalidation stickers shall be displayed on any mechanically powered boaton either side o the orward hal o the vessel.

    Purchasers o Previously Owned Boats All registrations are nontranserable.Even i the motorboat you recently purchased is displaying a current validationsticker, you must register this motorboat in your name within 30 days ooperation on the waters o this state.

    Dealer Numbers A person engaged in the manuacture or sale o boats canobtain registrations or use in testing or demonstrating motorboats by paymento $46, plus a $4 issuing ee or each registration needed. Dealer numbers will beaxed temporarily in the prescribed position on the boat.

    TITLEWho Must Obtain a Title All rst time owners o newly acquired motorized

    vessels must obtain a title rom the county clerk in the county where the ownerresides beore the county treasurer will issue or renew a registration. A boat mustbe titled beore it may be sold. All boats made beore 1972 are exempt rom titling,but not rom registration.

    Hull Identication Number Federal law requires all boats manuacturedaer Nov. 1, 1972, including homemade boats, display a 12 character HullIdentication Number (HIN).

    Te character o each HIN must be at least a quarter inch high andlocated to the starboard outboard side o the transom within 2 inches othe top o the transom, gunwale or hull/deck joint, whichever is lowest.

    I a motorboat has no HIN and is newer than a 1972, a new one will need

    to be obtained rom the Nebraska Department o Motor Vehicles (DMV)beore a title and registration can be issued. Applications or HIN areavailable rom the DMV or county treasurer.

    Any person who operates a motorboat that requires a certicate o titlewithout having that title shall be guilty o a Class III misdemeanor.

    Any person who operates a motorboat that requires a HIN without thatnumber shall be guilty o a Class III misdemeanor.

    BOATER EDUCATIONRequirement Boater education is open to anyone, but anyone born aer Dec.31, 1985, who operates a motorboat or personal watercra in Nebraska must havesuccessully completed the Nebraska boating saety course.

    Options Boaters have two options to ulll the boater educationrequirement:

    Attend a six-hour Nebraska boating saety course with a proctored exam. Request class materials or home study, then attend a three-hour

    Nebraska boating saety course review with a proctored exam.

    EQUIPMENTFire Extinguisher Any inboard/outboard or inboard motorboat that has aclosed compartment, closed living spaces or permanently installed uel tanksmust have a re extinguisher according to the ollowing guidelines:

    Classes 1 and 2 one U.S. Coast Guard-approved type B-I re extinguisher Class 3 two U.S. Coast Guard-approved B-I or one B-II re extinguisher Class 4 three U.S. Coast Guard-approved B-I or one B-I and one B-II

    re extinguishers All airboats must carry the number o re extinguishers according to

    their classication. (See page 4 or classication o vessels.)

    NOE: Fire extinguishers are not required or outboard motorboats less than 26eet in length o open construction that do not carry passengers or hire.

    Oars Every vessel, except personal watercra, sailboards or similar devices and

    classes 3 or 4 motorboats, shall carry an oar or paddle.

    Bailing Bucket Every vessel, except personal watercra, sailboards or similardevices, shall be equipped with a bailing bucket, ecient bilge pump or sponge.

    Muer Exhaust o all internal combustion engines used on motorboats shallbe eectively mued in a reasonable manner. It shall be unlawul to operate

    any motorboat in such a manner as to exceed a noise level o 96 decibels whenmeasured at 100 eet when the motorboat is on plane.

    Whistle or Bell Every vessel o classes 1, 2, 3, and 4 shall have an ecientwhistle or other mechanical sound producing device. Every mechanicallypowered boat o Class 4 shall be equipped with an ecient bell.

    Flame Arrestor Every motorboat, with an inboard motor using gasoline, shall

    have the carburetor equipped with an ecient fame arrestor or similar device.Tese devices shall meet U.S. Coast Guard approval.

    Ventilation Every motorboat, except those o open construction, using volatileliquid uel shall have a prescribed venting system or bilges and the uel tankcompartment.

    LIGHTINGAll vessels in use rom sunset to sunrise, shall display lights as specied. No otherlights may be used, except a spotlight or dicult navigation.

    Every white light prescribed shall be visible at a distance o at least 2 miles Every colored light prescribed shall be visible at a distance o at least 1

    mile, showing green to starboard and red to port and screened to show

    rom dead ahead to 22.5 degrees rearward on the respective side. All mechanically powered sailboats shall display the lights required or

    that class o mechanically powered boat. All motorboats and sailboats shall carry a lantern or fashlight or

    emergencies. All anchored vessels shall display the 360 degree white light, except while

    anchored in a docking or anchorage area.

    FLOTATION DEVICESEvery vessel o any description, except sailboards, must carry one U.S. CoastGuard approved ype I, II, III or V fotation device o suitable size or each personon board. Every vessel, except sailboards, personal watercra, canoes, and kayaks,in addition to the required wearable lie preservers also shall carry one U.S. CoastGuard-approved ype IV throwable device.

    ypes o Devices:

    ype I Ofshore Lie Jacket Tis is designed to turn aperson who is unconscious in the water to a vertical or slightlybackward position.

    ype II Near Shore Buoyant Vest Tis is designed to turn aperson who is unconscious in the water to a vertical or slightlybackward position.

    ype III Flotation Aid Tis is designed to keep a personwho is conscious in the water in a vertical or slightly backwardposition. It has less turning ability than ype II and is designedor water activities, such as skiing.

    ype IV Trowable Device Tis is designed to bethrown to a person in the water.

    ype V Special Use Device Tis is designed only orspecic activities. Check label or limits o use. Varietiesinclude board sailing vests, deck suits, work vests, hybridpersonal fotation devices, and others.

    SAFETY

    DIVERS FLAGTe divers fag must be displayed in Nebraska whenever diving orunderwater-powered spear shing to give air warning to boaterso a diver in the area.

    Also:Scuba divers are reminded to display the divers fag and staywithin 150 eet o their fag.Divers may not dive within 200 eet o the outer limits o anydesignated swimming area, boat mooring, docking, or launching area.Boaters must maintain a distance o 150 eet rom a divers fag,

    except law enorcement boats, rescue boats and boats engaged inthe diving operations.

    ORANGE FLAGWhenever a water skier/tuber, suroarder or any person engagedin a similar activity or associated equipment, is down in the waterthe operator or observer o the tow boat must display a hunterorange fag o a size not less than 12 inches square or at least 144

    square inches. Tis fag must be visible 360 degrees.

    REPORTING ACCIDENTS It shall be the duty o the operator o a vessel involved in a collision,

    accident or other casualty to give his name, address and the identicationo his vessel in writing to any person injured and to the owner o anyproperty damaged.

    Te operator o every vessel involved in a boating accident is requiredto le a written report whenever a boating accident results in loss o lie,disappearance o a person, loss o consciousness, medical treatment,disability or more than 24 hours, or property damage in excess o $500.Reports in death, disappearance and injury cases must be made within

    48 hours; reports o other cases are required within ve days. Writtenreports shall be submitted to the Game and Parks. Report orms may bedownloaded at OutdoorNebraska.org.

    Te owner o a vessel shall be liable or any injury or damage caused bythe negligent operation o any powered vessel. Te owner shall not beliable i the vessel is being used without the consent o the owner unlessthe operator is a member o his immediate amily.

    UNSAFE VESSELS No overloaded vessels shall be operated on Nebraska waters. All vessels

    when loaded must retain at least one hal o the total depth o the boatabove the water when measured at the center o the vessel and must meetthe requirement o the manuacturers capacity plate.

    I any conservation ocer or other law enorcement ocial o Nebraskasees a vessel being operated without the proper equipment or with anyother unsae condition, he or she may direct the operator to correct thesituation immediately or return to mooring until the hazard is corrected.

    RIGHT OF WAYAudible Signals When two vessels are approaching each other head on ornearly so, each operator shall swing the bow o his motorboat to the starboard topass. Each operator shall give one short blast o the whistle and indicate his courseby swinging the bow o his motorboat substantially to starboard. Unnecessarysounding o whistles, horns, bells, or other sound producing devices is prohibited.

    Maneuvering and Warning Signals: Overtaking on the starboard side 1 short* blast Overtaking on the port side 2 short blasts Backing up 3 short blasts Danger 5 or more short blasts

    * A short blast is approximately one second.

    NAVIGATION RULESVessel trac shall be governed by the ollowing rules:

    When passing rom rear pass to other vessels port. When passing head on pass port to port. When passing at right angles vessel at right has right o way. Manually propelled vessels have the right o way over all other vessels. Sailboats have the right o way over all motor driven vessels. Motorboats, when meeting or overtaking sailboats, shall always pass on

    the leeward side. Any vessel backing rom a landing has the right o way over incoming

    vessels.

    UNLAWFUL PRACTICESIt is unlawul to:

    operate or give permission or the operation o a vessel that is notequipped as required. exceed the speeds posted or charted in any specic zone or area. Speed

    always must be reasonable and proper in consideration o the conditionsprevailing at that time and place.

    travel at speeds exceeding 5 mph/no excessive wake limit in or within 30yards o any vessel, harbor, marina, landing pier, shing pier, anchorage,or bathing beach.

    operate a personal watercra between sunset and sunrise. operate any vessel within any area marked o or set aside as prohibited. swim or bathe in any marinas or within 20 yards o launching, mooring

    or docking areas. tie o any vessel or attach one to any buoy, marker or navigational aid on

    any waters in this state. place or leave, in any public waters, any vessel not sae or operation.

    allow any child under 13 years o age aboard any vessel when not wearinga U.S. Coast Guard approved lie preserver, o suitable size, except whenhunting waterowl in an anchored boat. Te operator shall be heldresponsible or compliance.

    operate a personal watercra without wearing a lanyard type enginecuto switch.

    operate or be a passenger on a personal watercra without wearing aCoast Guard approved lie jacket, regardless o age.

    jump a wake with a motorized vessel within 50 yards o another cra. jump the wake o any boat that is towing a skier, tuber, wakeboarder, etc. or any boat operator, including personal watercra, under 16 years o age

    to tow a skier, tuber, wakeboarder, etc.

    BOATING UNDER THE INFLUENCEIt is unlawul to operate a motorboat with a blood alcohol content o .08 percentor greater. Doing so constitutes Boating Under the Infuence (BUI), which carriesa penalty o up to $1,000 ne, up to six months in jail and the loss o boatingprivileges or six months. Reusal to submit to a chemical blood alcohol test willresult in the same penalties as BUI.

    OTHER INFORMATION

    RENTALSOwners o motorboats or rent shall keep a record o the name and address opersons renting vessels designated or permitted by him to be propelled by anymechanical device. Te record, including boat identication number, departuredate and time and expected time o return, shall be preserved or at least sixmonths. Rental motorboats shall include all equipment prescribed by law orthat class o boat. It shall be unlawul or any motorboat livery to lease to anyoneunder the age o 18 years.

    SANITATIONEvery vessel with an installed toilet must have an operable U.S. Coast Guardcertied marine sanitation device (MSD) ype I, II or III.

    Also:

    I equipped with a Y valve, the valve must be secured by a padlock,nonreleasable wire tie or removal o the handle, so the valve cant beused either accidentally or intentionally without the owner/operatorsknowledge.

    No wastes or container o such wastes shall be placed, le or dischargedinto or near any waters o this state.

    WATER SKIINGObserver All vessels, when pulling a person on skis, suroards or similardevices and not equipped with a wide-angle rear view mirror, must have aresponsible person age 12 or older as an observer in the vessel with the operator.

    Liesaving Devices It is unlawul or any boat operator to tow or assist any

    person on skis, suroards or similar devices or or any skier to manipulatewater skis or similar devices unless the skier is wearing a lie jacket that is ingood condition and U.S. Coast Guard approved. Te exception is during state-authorized regattas and similar ski and water shows. All lines, when not in use,must be stowed aboard the towing vessel.

    Skiing Hours It is unlawul to tow or assist a person on water skis, aquaplane

    or similar device rom the period o one-hal hour aer sunset to one-hal hourbeore sunrise unless in duly authorized competition.

    REGATTAS AND RACES Game and Parks authorization must be obtained or all regattas,

    motorboat or other boat races, marine parades, tournaments orexhibitions on any waters o this state. Also:

    Te person in charge o such event shall obtain permission by ling an

    application with Game and Parks at least 30 days beore the event. Teapplication should indicate the date, time and location o the event.

    For events to be held on navigable waters, it is necessary to give at least 30days notice as permission must be cleared with the U.S. Coast Guard.

    Motorboats competing in special events may use cutouts during a periodnot to exceed 48 hours immediately preceding such regatta or race and aperiod not to exceed 48 hours immediately ollowing such event.

    Motorboats do not have to carry bells, whistles or re extinguishers whileracing. Forms may be downloaded rom OutdoorNebraska.org.

    AQUATIC NUISANCE SPECIESAquatic nuisance species (ANS) are dicult to control once they becomeestablished. ANS are moved to new areas as unwanted hitchhikers on boats andtrailers, on personal watercra or on sporting equipment. Tere are a ew simple

    actions to prevent ANS rom spreading. Inspect your boat, trailer and equipment and remove visible aquatic

    plants, animals and mud beore leaving the water access. Drain water rom your boat, motor, bilge, live wells, and bait containers

    beore leaving the water access. Report new sightings to Game and Parks. Dispose o unwanted bait and other animals or aquatic plants in the trash.

    Spray, rinse or dry boats and recreational equipment to remove or killspecies that were not visible when leaving a body o water and beoretransporting to another body o water.

    Consult Game and Parks beore trying to control an invasive species.

    BOATING WATERS

    OPEN WATERSLakes designated as open waters are open to all boats, subject to restrictions.

    Also: It always shall be unlawul or any operator to exceed the speed posted or

    charted in any specic zone or area. Speed always must be reasonable and proper in consideration o the

    conditions prevailing at the time and place. Speeds in excess o 5 mph are illegal at all times in or within 30 yards o

    any vessel, harbor marina, landing pier, shing pier, anchorage or bathingbeach.

    All U.S. Fish and Wildlie Service Waterowl Production Areas aredesignated as open waters, with a 5 mph/no wake restriction. No airboatsare allowed.
