MWBE Requirements

• Contract subject to State Revolving Fund M/WBE Program.

o 20% Minority/Women owned Business Enterprise Utilization Goal required.

• Prime contractor must utilize M/WBE subcontractors certified with the NYS Empire

State Development directory - https://ny.newnycontracts.com/cer

o Vetting firms strongly recommended (OSHA, Tax liens, Debarment)

o Prime contractors certified with ESD as an M/WBE can be used to self perform work towards fulfilling the M/WBE participation goal.

• Provide EPA-6100-4 form in bid packet.

• Develop Utilization Plan (UP) & Update UP during contract term. Goals in an

approved Utilization Plan will be valid for the life of the contract.

• Conduct Good Faith Efforts &/or provide Waiver Request

CM EHS Requirements

✓ Manage residual risks identified in design Prevention through

Design process (SOP 044) and regularly track in Enterprise

Management System E-Builder or Risk Register.

✓ Provide qualified trained EHS staff to meet contract requirements

and implement BEDC EHS Management System. Properly staff

project to meet/fulfill contract requirements.

✓ Ensure CM and Contractor personnel have received BEDC EHS

Standards Orientation training (Annually).

✓ Prepare and submit an EHS Management Plan (in accordance with

SOP 047).

✓ Review and comment on Contractor EHS submittals (i.e. EHASP,

JHAs, Construction Work Plans, Monthly Reports).

✓ Review and manage all EHS Annual Reports (EPCRA, Hazardous

Waste, Confined Space, etc).

✓ Manage and comply with all environmental permits and registrations

CM EHS Requirements

✓ Facilitate weekly EHS meetings with EHSRs/Contractor

Management staff to discuss upcoming construction activity and

ensure Contractor is addressing EHS risks and hazards of the work.

✓ Perform daily inspections of the Contractor’s work areas and

document non-compliance (document inspections through EHSDRs

on E-Builder).

✓ Track and monitor EHSRs’ daily performance and whether EHS

issues are being adequately addressed on a timely basis;

communicate performance issues to AM and RM.

✓ Prepare monthly trending analysis of Contractor EHS performance

to identify non-conformance trends, develop corrective actions, and

utilize for Contractor’s 6 mos EHS evaluations.

✓ Prepare Contractor and EHS staff evaluations, ensure they are

scheduled and conducted within required time frames in accordance

with Contractor Selection and Management Policy and SOP 230.

CM EHS Requirements

✓ Notify DEP of all incidents, “near misses”, hazard identifications, and

observations using E-Builder per SOP 315. Development of

Lessons Learned when requested by DEP.

✓ Review Contractor incident reports and participate in meetings to

identify root causes/contributing factors. Ensure corrective actions

are implemented by Contractor.

✓ Oversee emergency response planning and drills for the site in

coordination with DEP’s Operating Bureaus (if applicable).

✓ Submit EHS Monthly Reports, Metrics per SOP 107, and have a

working knowledge of all EHS SOPs.

✓ Conduct EHS “1910” Inspections throughout the project in

accordance with SOP 119; ensure CM staff is trained on OSHA

1910 General Industry requirements.

✓ Preparation and participation in BEDC EHS MS Audits and OEHS

EHS Assessments.
