Group that imposes an obligation on The Frank Whiddon Masonic Homes Group
to re-transfer the land to Council in the event that The Frank Whiddon Masonic
Homes Group proposes to sell the land to a third party (except with prior
approval of Council); and

1. That Council take immediate steps to augment the Bourke Weir Pool with water
from the 19A weir Pool, provided it is practicable and economically viable.
2. That Council lobby the current State Government and candidates for the seat of
Barwon in the upcoming state elections to commit to the construction of a
“regulator” as soon as possible at the site known as BU8 with is east of Bourke.
3. That Council, take all steps to ensure that, where possible, that no stranding of
water occurs in the Bourke Weir Pool, bumping and/or extraction.
4. That Council lobby all levels of Government to make a release of environmental
water to recharge the Bourke Weir
5. That Council look to the establishment of another bore to supplement Walkden’s
Bore as a matter of urgency.

i. call upon the NSW Government to fund the 12 months of this extra cost
rather than requiring Councils to find the funds at short notice when
budgets have already been allocated
ii. Explain how this sudden increase will impact Council services/the local
community.
iii. highlight that Councils were not warned of the increased cost until May
2019, despite the new laws being passed in November 2018
iv. explain that the poor planning and implementation of the increase is
inconsistent with the Government’s commitment to work in partnership
with the sector
v. Ask the Government to work with Local Governments to redesign the
implementation of the scheme to ensure it is fairer for Councils and
communities into the future.

Report: 127/2019 Bourke Levee Inspection

Background:
The Bourke levee is a ring levee which protects the town of Bourke against flood events. The
levee was constructed in approximately 1995 and received a major upgrade in 2009 as the result
of storm damage. Each year Council is required to undertake an inspection of the levee to
identify any defects and routine maintenance requirements
Current Situation
Council engaged a Civil Engineer to inspect and complete a report on the current condition of
the Bourke levee bank. The levee inspection was completed in April 2019 and was generally
found to be in good condition. The long dry period results in little in the way of scours or crab
holes.
The inspection identified defects obvious at the time and should not be taken as an exhaustive
list. Other defects are bound to exist should be looked for as part of routine maintenance patrol.
Defects Identified
Headwalls along the river back are tending to fall away - this will need to be
monitored
The stormwater outlet/pump station through the levee at Richard Street is of
considerable concern. - This priority was identified as a number 1 and requiring
immediate action.
Significant cracking has occurred west of the wharf – monitor for any movement - This
priority was identified as a number 1 and requiring immediate action.
Ants nest were found along the levee - these need to be poisoned. This priority was
identified as a number 2 and requiring action in the next three months.
Gates and fences restrict access to the levee and the resulting damage from vehicles –
damaged gates need to be replaced and closed. - This priority was identified as a
number 3, requiring action in the next six months
A survey undertaken in 2013 of the top of the levee has identified a number of sites
where the level is below design by, in order of, 100mm. This may have occurred due to
the settlement of the levee over time.
Most of the repairs required can be undertaken as part of Councils general maintenance
regime. The stormwater outlet/pump station through the levee at Richard Street is an urgent
priority and funding will need to be sourced to undertake the required works to ensure the
safety of the town in mid to high level flood events.

Financial
The estimated fund required to undertake the repair water to the Richard Street outlet/pump
station is $250,000. Council will need to seek funding to undertake the works, a scope of works
will also be required for the alterations needed.
All other works to be carried out from the Bourke levee maintenance annual budget
Recommendation:
1. That Council continue to seek funding to upgrade Stage Two (2) of the Richard Street
Pumping Station.
2. That Council note the report on the Bourke Levee.

Report: 129/2019 Town Street Trees

Background:
At the Ordinary Meeting of Council held on Monday, 27th May 2019, Report 106/2019 – A report
was provided on Town Street Trees including the impact of the droughts and the effect on the
town’s street trees that appear to be dying on the footpaths, parks and median strips around
Bourke. Some of these trees were fully grown, but have not survived the severe drought
conditions. An Arborist was engaged by Council to inspect and provide a report to Council on
the condition of the trees.
Council also had the Arborist inspect the seven (7) Queensland Fig trees in Mitchell Street and a
further report is provided in relation to the condition of these trees
Current Situation:
A report has been prepared from a qualified Arborist on over 70 street and park trees that
require urgent attention the report and photos are included at the end of this report. It is
recommended that most of the trees are removed as they are either dead or dying.
In additional to the above report the report on the seven (7) Queensland Fig trees in Mitchell
Street are recommended to be removed.
A visual assessment of 8 Fig Trees (Ficus Hillii) running along Mitchell Street please find the
following.
All 8 trees are showing detrimental decline due to recent drought. However, I feel there are
other contributing factors to the decline of these trees such as the amount of impact created to
the drip zone by means such as roadways, footpaths and also recent earthworks to rectify a
sewer problem. All these factors reduce the amount of moisture uptake from the feeder roots.
I do think the major factor is drought which has now created 2 trees to be completely dead and
6 other trees with at least 70% deadwood.

The trees that are showing signs of new shoots, however, are bearing epicormic regrowth. This
new growth (epicormic regrowth) is much faster and more weakly attached. These trees
unfortunately will never amount to any structural form or shape.
The trees in their current position also create a very unsafe environment. The deadwood on
these Ficus Hillii is very brittle and therefore if were to fail may impact on pedestrians and
passing vehicles.
My suggestion is for the removal of these trees as soon as possible, including grinding of
stumps to remove the trip hazards and replant with a more suitable species of trees that will
flourish within a small root zone area.
There are no replacement trees currently in stock to replace those to be removed.
Council staff will purchase suitable trees as identified in the Street Tree Master Plan to replace
any trees that require removal once water restrictions have been removed and an ongoing
supply of water is expected to be able be maintained. (Preferred street tree attached)
The removal of the trees will be undertaken by Council staff and/or a contractor depending on
the size and location of the trees.
Financial Implications
The 2018/2019 Operational Plan provides an allocation for tree removal and this will be utilised
to provide the funding for the removal of the trees.
Recommendation
1. That Council immediately engage a qualified Arborist to remove all dead street and park
trees due to the safety issues.
2. That the replacement of the trees be deferred until water supply for the town is a little more
certain.
3. That the replacement trees be selected from species as identified in the Street Tree
Masterplan.

Report: 130/2019 Bourke Local Strategic Planning Statement

Background
In March 2018, amendments to the Environmental Planning and Assessment Act 1979 (EP&A Act)
introduced new requirements for Councils to prepare and make Local Strategic Planning
Statements. Local Strategic Planning Statements (LSPS) will set out the 20-year vision for land
use in the local area, the special characteristics which contribute to local identity, shared
community values to be maintained and enhanced and how growth and change will be
managed into the future.
Councils will show how their vision gives effect to the regional or district plan, based on local
characteristics and opportunities, and the Council’s own priorities in the Community Strategic
Plan it prepares under Local Government Legislation.
Bourke Shire Council was chosen by the Western Region Department of Planning and
Environment to be the pilot Council to draft an LSPS. Council staff have worked with the
department staff on the drafting of the attached document.
Report
Local Strategic Planning Statements will be a pivotal tool for local strategic planning in NSW.
They will inform local statutory plans and development controls, and give effect to regional and
district plans. The LSPS can also identify where further strategic planning effort may be needed.
The statements will act as a unifying document. Drawing together and summarising planning
priorities identified through state, regional, district and local strategic work. They provide the
local context and local-scale expression of actions and priorities from these plans. In practice,
the statements will shape how the Local Environmental Plan (LEP) and Development Control
Plans (DCP) evolve over time.
The statements will be the primary resource to express the desired future for the LGA as a
whole and for specific areas. This will guide and indicate what significant changes are planned
for the LEP and DCP to deliver the vision. The LSPS will identify the need for further local
strategic planning effort such as precinct and master planning, local character statements, and
local housing and infrastructure strategies.
The LSPS will assist Councils in their consideration of infrastructure needs to support growth.
This will promote transparency and clarity by identifying upfront the strategic infrastructure
priorities for an area, which can then be delivered through a range of methods such as
government funding or planning agreements.
An LSPS will be a succinct and easy to understand document that will allow community
members to contribute to and understand the future direction of land use in their area. This

future direction should be framed in the LSPS as a 20-year vision for the LGA, which builds on
the 10-year vision in Council’s Community Strategic Plan. Importantly, it must be a planning
vision, emphasising strategic land use, transport and environmental planning, clearly
demonstrating how the area will change to meet the community’s needs in 20 years’ time. The
20-year vision may be derived from a community strategic visioning process conducted as part
of the Community Strategic Plan prepared under the Local Government Act 1993, or from a
separate engagement process.
Legislative Requirements
The Statement are to identify the planning priorities for an area and explain how these are to be
delivered and implemented. The legal requirements for an LSPS outlined in section 3.9 of the
EP&A Act include:
(a) Context - the basis for strategic planning in the area, having regard to economic, social
and environmental matters
(b) Planning Priorities - the planning priorities for the area that are consistent with any
strategic plan applying to the area and (subject to any such strategic plan) any applicable
community strategic plan under section 402 of the Local Government Act
(c) Actions - the actions required for achieving those planning priorities
(d) Implementation – the basis on which the Council is to monitor and report on
implementation of those actions.
Recommendation:
That Council adopt the draft Local Strategic Planning Statement (LSPS) and place on public
exhibition for comment.

GENERAL MANAGER’s Report
Background:
Much of the fooling report has been previously been presented to Council.
Tour De OROC was initiated back in 2013 to raise money for the Macquarie Homestay which
aims to provide cheaper accommodation for residents and their family members from the
OROC area who are required to stay in Dubbo to seek medical treatment to date almost
$400,000 of fundraising has been contributed to Macquarie Homestay.
With all of the hard work put in by so many people since the first event in 2013, the naming of
the first guesthouse at Macquarie Homestay after Tour de OROC was acknowledgement of the
significant contribution the event has made to the facility.
There have been a number of local residents who have utilised the facilities of Macquarie
Homestay and from all reports all have been impressed by the facility. Whilst located in Dubbo
it is very much a facility for the region.
I should note that I was approached to go on the coordinating committee for the 2019 Tour de
OROC and have agreed to do so.
As such I will need to declare a non- pecuniary interest in this matter.
Current Situation:
Plans are on the way for the bi-annual Toyota Tour de OROC to be held in 2019 with the
tentative dates for the ride being Monday, 7th October through to Saturday, 12th October 2019.
The Rotary Club of Dubbo South will once again be running the event this year with the
assistance of Councils, Rotary Clubs and individuals across the OROC footprint.
I have agreed to go on the organising Committee for this years’ ride, representing the Bourke
Community and already Bourke Rotary Club have agreed to assist in the coordination locally.
Bourke Shire Council has been a strong supporter of the event in previous years with former
Mayors Andrew Lewis and current Mayor Barry Hollman participating in sections of the ride.
Manager of Roads, Mark Gordon and John Bartley have both ridden in the event within the
shire in previous years

Organiser Mathew Dickerson points out that in its short existence, the Toyota Tour de OROC
has hit some significant milestones:-
Almost $400,000 of fundraising has been contributed to Macquarie Homestay;
Two Guinness World Records have been set;
Riders have individually pedalled over 3,200km across 18 days of riding;
Internationally renowned riders have ridden alongside committed amateurs, including:-
o Commonwealth Games dual gold medallist, Megan Dunn in 2013;
o Three time Tour de France Green Jersey winner, Robbie McEwen in 2015;
o Australia’s international Voice of Cycling, Matt Keenan in 2017
For those who don’t know about the Tour de OROC, it involves cyclists riding across the OROC
Region having to pay a fee to participate and hoping to attract sponsorship and support along
the way. Around 20-25 riders participated and they are accompanied by support crews. The
riders travel around 1200 kilometres depending on the exact route taken.
It is hoped to attract 30 riders this year and this will also involve a support crew or around 10
people making a total of 40 people.
Given the size of the OROC area and the distance between towns, the distance will vary as the
organisers try and include as many towns as possible. The Bourke community have been
amongst the highest, if not the highest, fund raisers over the past few years for TOUR de OROC
which is indicative of the generosity of this community.
Bourke Shire Council have previously agreed to assist in the coordination of the event, however,
at that time there was no request for a financial contribution.
It was hoped that Council may consider a financial contribution in 2019
Financial Implications
A fund raising function is planned for the night when the group will be in town with Luke Moon
the publican of the Port of Bourke Hotel providing the venue as well as a number of items to be
utilised in the fund raising activities.
In past years the accommodation has been partially donated and the remaining costs met from
the fund raising activities. Given the economic conditions it was proposed that the cost of the
accommodation be met jointly by Bourke Shire Council and Bourke Rotary club with Bourke
Rotary Club members also proposing to “billet” some of the participants.
Accommodation will be on a twin share basis and an evening meal and breakfast are to be
provided.
Bourke Rotary Club will also contribute to the cost and intend holding a Trivia Night to assist in
the fund raising efforts.
Recommendation:
That Council contribute a donation of $1250.00 towards the costs associated with the hosting of
the Tour De OROC riders and support crew in Bourke for the 2019 ride.

Background:
Western Division has two (2) Meetings During the year, the first being the Annual Conference
and the other the Mid-Term Meeting.
Current Situation:
The Mayor and I will be attending and this item is being raised as a reminder for any Councillor
who wishes to attend.
I understand that the Minister for Agriculture and Minister for Western New South Wales, the
Hon. Adam Marshall, MP will be in attendance.
With Minister Marshall’s area now including Councils which are outside the current footprint of
the Current Western Division Membership the opportunity may exist to be able to broaden the
membership base.
Financial Implications
The cost of travel to the meeting has been provided for in budgetary provisions.
Recommendation:
That other Members of Council who wish to attend are asked to advise the General Manager so
that appropriate arrangements can be made.
Back ground
A proposal has been put on the table regarding the potential upgrade Council Street Lighting
Network to change them to LED making them both more efficient and cost effective.
The upgrade proposal impacts on all Council in the old OROC footprint.
Current Situation
The matter has been considered by the Far North West Joint Organisation of Councils and a
copy of the Acting Chief Executive Officers Report is detailed below in italics.
Additionally Council staff have had preliminary discussions with Essential Energy regarding the
proposal.

The matter is quite complex with a number of options involved and the utilisation of a
consultant with the required background highly desirable if not essential.
Purpose:
To provide information to the Board of the Far North West Joint Organisation (FNWJO) in respect
of Street Lighting matters.
Background:
Energy and Management Services Pty Limited (EMS) have been progressing the issue of LED
upgrades to street lighting as part of a previous arrangement with OROC.
EMS have been requested to submit a proposal to cover additional work to date and a reasonable
estimate to complete the necessary business case in regard to upgrading street lighting to LEDs to
a point where the work could actually commence.
EMS may also be able to assist each Council in the creation and/or selling of Energy Savings
Certificates that will be generated by the upgrades.
The proposal covers both Far North West and Orana JO’s.
Report:
EMS has been actively engaging with Essential Energy (EE) and the Australian Energy Regulator
(AER) arguing the case of Western Councils for some months in respect of the following issues:
• Essential Energy’s current regulatory determination by the Australian Energy Regulator (AER)
for EE’s Public Lighting Tariff charges;
• Assessment of the bulk upgrade of existing Lighting technology to modern LED technology;
• Reviewing EE’s non-binding estimate for the bulk upgrade of Category P lighting to LED
technology.
• Assisting with direct discussions with EE about specific Council by Council issues.
Through this process, EMS have made significant progress on the above matters and identified
further opportunities for Councils to take control of their lighting decisions and in doing so, saving
money and improving service levels. Opportunities exist beyond bulk upgrade to LED technology.
Public Lighting is at a significant cross roads as obsolete technology is progressively being
replaced with modern high efficiency and intelligent ready LED technology.
It is considered imperative at this time that Councils are adequately informed as to their options
to allow the best decisions to be made for their communities.
As part of continuing this parcel of work, EMS would:-
• Summarise Essential Energy Offers and prepare a brief report suitable for submission to
individual Councils;
• Continue with direct discussions with Essential Energy about specific Council by Council issues;
• Verify Essential Energy costing and charges for Street Lighting by incorporating rates etc. in e21
EnergyPlus.

EMS has supplied a newsletter of current issues (attached to this report). Such issues are generally
common to all of the Councils which previously were members of the former OROC.
These issues will need addressing in the coming period if Public Lighting inventory is to be
optimised and full benefits are to be realised.
Essential Energy is proposing to reconvene the prior Street Lighting Consultative Committee or an
equivalent.
EMS is aware of the difficulties for member Councils to actively respond and participate in such
committees and attend remote meetings. In this regard it is proposed that EMS represent both
the Far North West and Orana JO member Councils in order to advocate on member Council’s
behalf, to pass on relevant information and to assist Councils as required.
Whilst the quantum of work involved for EMS is somewhat unknown, discussions with EMS have
suggested a provisional amount of $4500 for the Far North West JO and $9000 for the Orana JO
to undertake the required work in respect of the LED upgrade functions. This is considered most
fair and reasonable.
On the basis of member Councils progressing this matter, member Councils are requested to
complete the attached correspondence nominating EMS, and specifically a Mr Brian Glawson of
this firm, as its representative to the Essential Energy Street Lighting Consultative Committee.
Once this parcel of work is complete there is no obligation for any member Council to continue to
engage EMS for any future work and Council’s nomination can be revoked at any time.
As valued long-term customers of EMS, simple responses and advice that can be provided with
minimal effort will continue to be provided free of charge to JO member Councils.
This matter is to be discussed at a meeting of Far North West JO and Orana JO General
Managers to be held on 24 May 2019. I will bring forward to the Board Meeting any further
information emanating from such meeting.
Recommendation:
1. That Energy and Management Services Pty Limited be engaged to represent the Far North
West Joint Organisation on the Essential Energy Street Lighting Consultative Committee.
2. That a provisional funding amount of $4,500 be approved by the Board for Energy and
Management Services Pty Limited to continue work in respect of the required analysis/actions
regarding the upgrading of street lighting functions to LED for Far North West Joint
Organisation member Councils.
3. That each member Council proceed to complete the correspondence nominating Energy and
Management Services Pty Limited, and specifically a Mr Brian Glawson of this firm, as its
representative to the Essential Energy Street Lighting Consultative Committee.
4. That the newsletter supplied by Energy and Management Services in respect of LED street
lighting be noted

Financial Implications
The cost for the initial work is being met by the Far North West Joint Organisation of Councils.
Should Council wish to further progress the upgrade to LED there will be a cost involved and
the capital cost of the upgrade would need to be considered in light of the potential cost
savings and relevant payback period.
There is some work to be done before is in a position to make that assessment
Recommendation:
1. That Council note the report in relation to a proposed upgrade of the Street Lighting
network to LED.
2. That Council note the recommendations of the Far North West Joint Organisation of
Councils.
3. That Council note the General Manager’s action in engaging Mr. Brian Glawson of Energy
Management Services as its representative on the Essential Energy Street Lighting
Consultative Committee.
Background:
Bourke and North Bourke have been on water restrictions for nearly 10 months and since the
24th December 2018 had been on Level Three (3) restrictions which meant that water had been
restricted to hand held hoses.
The level of restriction progressed to Level Four (4) then to Level Five (5) which meant watering
via buckets only plus relatively strict conditions on the use of water for parks etc.
Current Situation:
With the weir pool being boosted by a flow from the Culgoa the level of restrictions was able to
be eased to Level Three (3) and last week once the weir pool topped three (3) metres the
restrictions went to Level Two (2) which means the ability to utilise sprinklers for one hour per
day plus the use of hand held hoses at other times.
This will enable people to be able to provide plants and trees which had been under stress with
a solid watering
Should the weir pool reach 3.5 metres the level of restrictions would then go to level one (1)
which provides the use of sprinklers for two (2) hours per day.
Council has indicated that it would remain on that level once the water tops the weir until water
reached the lower reaches of the river system.

Funds and changes on a monthly basis in accordance with cash flow requirements.
The market value of Council’s investments held as at 31st May 2019 is $19,272,347.44.
Investment income earned as at 30th April 2019 is $461,387.71.

The Investment portfolio decreased by $145,352.05 during the period.
The investment portfolio is invested in term deposits with the National Australia Bank. The
investment portfolio is regularly reviewed in order to maximise investment performance and
minimise risk.
The Government Guarantee on Investments up to $1 million dollars has now expired and the
new cap of $250,000 has replaced the scheme.

Background:
The following property located at 2-6 Adelaide Street, Bourke was owned by House and Land
Sales. This property was purchased through a sale for unpaid rates (713 Sale) that was held in
2010. Since the purchase no rates and charges have been paid to Council.
Current Situation
Council is now in receipt of a forfeiture gazette notification for Western Lands Lease 9532 for
non-payment of rent on this property. The property has now transfer to The State of NSW.
The total outstanding rates, charges and interest as at the 18th June 2019 is $22,103.86. Due to
the transfer to The State of NSW it is now necessary to write-off the outstanding debt. The
property is vacant land and is now non-rateable.
Financial impact
The total outstanding rates and charges includes general rates $1,604.66, charges $14,365.59,
interest $5,204.88 and legal cost $928.73 totalling $22,103.86.
The total write-off required for assessment 60-000000000-000 is $22,103.86 plus interest accrual
after the 18th June 2019.
Recommendation
That Council write off rates charges and interest to the value of $22,103.86 plus any additional
interest accrual for Assessment Number 00062-00000000-000 as this vacant land is now exempt
from paying rates.

Background:
The following property located at 15 Yanda Street, Bourke was owned by House and Land Sales.
This property was purchased through a sale for unpaid rates (713 Sale) that was held in 2010.
Since the purchase no rates and charges have been paid to Council.
Current Situation
Council has now received a forfeiture gazette notification for Western Lands Lease 12651 for
non-payment of rent on this property. The property has now transfer to The State of NSW.
The total outstanding rates, charges and interest as at the 18th June 2019 is $21,865.97. Due to
the transfer to The State of NSW it is now necessary to write-off the outstanding debt. The
property is vacant land and is now non-rateable.

The total outstanding rates and charges includes general rates $1,588.54, charges $14,248.66,
interest $5,100.04 and legal cost $928.73 totalling $21,865.97.
The total write-off required for assessment 01141-000000000-000 is $21,865.97 plus interest
accrual after the 18th June 2019.
Recommendation
That Council write off rates, charges and interest to the value of $21,865.97 plus any additional
interest accrual for Assessment Number 01141-00000000-000 as this vacant land is now exempt
from paying rates.

Report: 139/2019 Pecuniary Interest Returns

Background
The purpose of this report is to remind Councillors and designated persons of the necessity to
lodge Pecuniary Interest Returns.
A Councillor or designated person holding that position on 30th June in any year must complete
and lodge a Pecuniary Interest Return by 30th September in that year.
The returns can be inspected by members of the public and assist in ensuring transparency and
accountability in Local Government decision-making. The obligation upon Councillors and
others to lodge returns is as much a protection for them as it is to the community.

Report: 140/2019 Review of Capital Works Program 2018/19 and Reallocation of Funds

Background
A future review of the 2018/19 Capital Works program and operational funds has been
undertaken by the Management team. Detailed below are recommendations of projects and
operating funds to be revoted in accordance with the Local Government (General) Regulation
2005 (clause 211) to the Delivery Programme 2017/2021 and Operational Plan for 2019/2020.

Work continues on the upgrade to the display in building three (3) this upgrade will be
completed in the coming months and the revote is necessary due to the time taken to
finalise the details.
The air-conditioning systems within the Back ‘O Bourke Exhibition Centre buildings are
between 11 to 15 years old. Some of these units are due to be replaced and the vote of
$112,500 in the 2018/2019 estimates now needs to be carried forward to allow for
replacement of these units.
Due to the drought a number of tress have died, these trees are now unsafe and need to
be removed. The funds allocated in the 2018/2019 budget now need to be reallocated to
the 2019/2020 budget to undertake the works as detailed in the report
Financial Implication
There will be no additional financial burden on Councils estimates as the expenditure is
transferring unspent funds form the 2018/2019 budget to 2019/2020 budget.
Recommendation
That Council adopts the recommendation to amend the Capital Works projects and operating
costs planned for 2018/19 as detailed in the report and revote the expenditure to the Delivery
Programme 2017/2021 and Operational Plan for 2019/2020.

Report: 141/2019 Delivery Program 2017/2021 and Operation Plan 2019/2020 –
Schedule of Rates and Charges 2019/2020
Resolution of Making of Rates and Charges 2019/2020

Background
Council’s Draft Delivery Programme 2017/2021 and Operational Plan for 2019/2020 (Resolution
173/2019); and the making of Rates and Charges Levy for 2019 /2020 (Resolution 178/2019) were
adopted on the 27th May 2019. The Operational Plan for 2019/2020 included within the Revenue
Policy including the Schedule of Rates and Charges for 2019/2020.
Current Situation
A review of the revenue policy had identified that the Urban Drainage Charge within the
Schedule of Rates and Charges has a typographical error. This error has no financial
implications. The charge per assessments should read $167.00 not $164.00 as detailed in the
policy. The overall total within the report is correct. The amount within the fees and charges
document is also correct. A new resolution now needs to be adopted as the previous resolution
in May resolved to adopt the charge as $164.00 not $167.00.
Also in accordance with section 566(3) of the Act, the Minister for Local Government has
determined that the maximum rate of interest payable on overdue rates and charges for the
2019/20 rating year will be 7.5%. This information was provided to Council after the completion
and advertising of the Draft Delivery and Operation Plan, the interest rate payable on overdue
rates and charges included in the draft document was to be the maximum allowable as set by
the Office of Local Government.
Financial Implication
There is no identified financial costs associated with this report.
Recommendation
1. That Council adopt the maximum interest rate of 7.5% as determined by the Minister for
Local Government and that the maximum interest rate of 7.5% per annum, calculated daily,
be levied on overdue rates and charges for the financial year ending 30th June 2020.
2. User Charges/Annual Charges – Urban Drainage 2019/2020
WHEREAS the draft Operational Plan and Revenue Policy for the year 1/7/2019 to 30/6/2020
was prepared by Council in accordance with Local Government Act 1993 S402, S403, S404
and S405 and advertised in the Western Herald AND WHEREAS a period of 28 days since the
publication of that notice was given and during the period no objections have been received.

Report: 142/2019 Sale of 26 Oxley Street Bourke to Bourke Shire Council

Background
At the May 2019 Ordinary meeting of Council a report was provided in relation to the successful
grant for the purchase and fit out of 26 Oxley Street Bourke by Muda Aboriginal Corporation.
Bourke Shire Council will auspice the funds and work with Muda Aboriginal Corporation to carry
out the works as required in the Deed. As part of the Deed of Agreement Council will become
the owner of the building.
Current Situation
In order to finalise this transaction a resolution of Council is now required to agree to the
purchase of 26 Oxley Street Bourke at the agreed price of $275,000 excluding GST and to affix
the Council Seal to the Contract of Sale.
Financial Implication
The purchase of the building will be funded from the grant funding provided and the building
once the fit out is completed will be leased to Muda Aboriginal Corporation. The rent will be
designed to cover the operating cost and minor maintenance. There is not expected to be any
significant financial costs to Council
Recommendation
That Council accept the offer to purchase 26 Oxley Street Bourke at the agreed price of
$275,000 excluding GST and that Council Seal be affixed to the Contract of Sale and other
documentation relating to this transaction.

Purpose
To establish the principles that apply and Council’s approach to, disclosure of information and rights
of public access to documents.
Council is subject to NSW legislation regarding disclosure of information, in particular the Local
Government Act (LGA), the Government Information (Public Access) Act (GIPA Act) and the
Environmental Planning and Assessment Act (EP&A Act). It also is subject to the NSW Privacy and
Personal Information Protection Act (PPIPA) and Health Records Information Privacy Act (HRIPA) that
establish standards for information handling practices for personal and health information.
The Commonwealth Copyright Act 1968 may apply in some circumstances to limit the copying of
certain documents held by the Council.
2. Policy statement
Council is committed to:
Openness and transparency in the conduct of its public functions.
Proactive disclosure and dissemination of information about operations, plans and decisions
or information that will enhance quality of life and economic development of the community.
Provision of access to Council documents unless disclosure in a particular case would be
contrary to the public interest.
3. Principles
Council will promote disclosure and dissemination of information about operations, plans and
decisions, and information that promotes community advancement on its website wherever
practicable, and will facilitate public access through this and other appropriate mediums.
Documents required by law to be available for public inspection will be posted on the website, unless
internet access poses an unacceptable risk of interference with privacy through potential data
gathering and matching techniques or unless to do so would impose unreasonable additional costs
on Council.
Any person is entitled to have information about their place of residence suppressed from documents
available for inspection where disclosure would endanger personal safety, or removed from any
register available for public inspection in accordance with the PPIPA.
Other Council documents not posted on the website will be available for inspection unless disclosure
on balance is contrary to the public interest.
Copying of some documents may be restricted where the Copyright Act imposes limitations.
Council's Guidelines on Access to Information (attached) list the types of documents available
including public registers available for inspection.
The Guidelines also list the categories of documents not available because of legislative restrictions
or because disclosure is likely to be contrary to the public interest. Documents of this kind include
those that contain information about the personal affairs of other ratepayers, commercially sensitive

information, or information which if disclosed would have an adverse effect on Council’s law
enforcement or other functions, such as the identifying particulars of complainants.
Inspection of Council documents which are specified as Open Access Information as outlined in
Clause 18 of the GIPA Act, is free of charge, or on payment of reasonable copying charges. Fees for
Formal Applications are outlined in the attached Guidelines.
Broad requests for access to a large number of unspecified documents which, if processed, would
divert substantial Council resources from dealing with other requests, or from performing other
Council functions may be refused on the grounds that such a diversion of resources is contrary to
the public interest (Clause 60 GIPA Act).
Any member of the public may also lodge a formal application under the GIPA Act, which will be
dealt with in accordance with the Act’s provisions. Formal applications will not be required where
documents are otherwise available in accordance with this policy and associated guidelines.
Any individual also has a right to know what personal or health information Council holds about him
or her, to access that information in accordance with the provisions of the PPIPA and the HRIPA, and
to amend that information in certain circumstances.

BOURKE SHIRE COUNCIL
GUIDELINES ON INFORMATION ACCESS
(To be read in conjunction with Council’s Access to
Information Policy)
Introduction
These guidelines set out the documents and types of information that are available to members of
the public on a proactive basis, and those that will not generally be available for inspection and
copying. These guidelines relate not only to written information, or information held within another
format, such as within a computer system but also any information given out face to face, or via a
telephone or email.
Council is committed to proactive dissemination of information about the conduct of its public
functions and information that will assist community advancement.
Documents required to be available for public inspection as open access information will, where
practicable, be made available on Council’s website, unless to do so would impose unreasonable
additional costs on Council.
Council will deal with informal requests to inspect other documents in accordance with the GIPA Act
free of charge but charges may apply for photocopies, and for any additional services which go
beyond the provision of access to identified documents.
The rights of access under the GIPA Act are the specified documents listed in Schedule 5 Government
Information (Public Access) Regulation 2009 and to other documents held by the Council unless
disclosure is, on balance, contrary to the public interest.
While any application will be considered on its merits Council may refuse access where:
a) dealing with the application would require an unreasonable and substantial diversion of the
Council’s resources,
(b) the Council has already decided a previous application for the information concerned (or
information that is substantially the same as that information) made by the applicant and there
are no reasonable grounds for believing that the Council would make a different decision on the
application, (clause 60)
Any applications will be processed in accordance with the Act’s requirements and a decision made to
provide access to the documents, or not to provide access based on public interest considerations of
the GIPA Act. Charges for formal GIPA applications are set out in Council’s Schedule of Fees and
Charges.
An individual also has rights to access and amend the personal and health information held by
Council about him or her under the PPIPA and the HRIPA. Where information about an individual is
held in documents, files or systems that include information about other persons, any request should
be made under the GIPA Act which provides for consultation with any other affected parties prior to
the possible provision of access to information concerning their personal or business affairs.

Privacy Legislation and Access to Council Information and Documents
The privacy acts referred to above also apply to the collection, storage, use and disclosure of personal
and health information by Council. The acts set out principles for the handling of this type of
information.
Full details of the acts and Council’s obligations are set out in the Privacy Management Plan.
It is not a breach of the privacy principles to disclose personal or health information where this is in
accordance with the acts, (e.g. where disclosure is consistent with the purpose for which the
information was collected, or where the person was aware that particular information is usually
disclosed) or where another act or law requires, permits or contemplates disclosure.
Disclosure of documents required to be made available for public inspection by the GIPA Act, LGA,
the EP&A Act or any other act, of disclosure under the GIPA Act is not contrary to privacy legislation.
Where access to other documents is requested and a judgment needs to be made about whether
disclosure, on balance, is contrary to the public interest, privacy may be a consideration if personal
information about another person is involved. Relevant factors include the nature of the information,
and the degree to which disclosure involves significant privacy issues, and any public interest that
would be advanced by disclosure. Council may need to be able to explain considerations taken into
account in deciding to disclose personal information to someone other than the person concerned.

(2) This clause does not apply to so much of the information referred to in subclause (1) (a) as

Public Registers
In addition to registers mentioned above, Council maintains other registers which are required by
law to be available for public inspection.
Where the public register contains personal or health information, Council is required to ensure that
access by a member of the public is for a purpose consistent with the purpose for which the register
exists. The Local Government Code of Practice issued under the PPIPA permits Council to provide
access to such registers by way of inspection on Council premises and for the copying of an entry or
page in the register without regard to the purpose of the person who seeks access.
Council reserves the right to seek to satisfy itself about the purpose of access and to require a
statutory declaration from the person seeking access that personal information will only be used for
a specified lawful purpose.
In relation to the returns of interests of councillors, designated persons and delegates Council will
maintain a record of the names of persons who access these documents.
Council maintains some registers which are not available for public inspection. Particular entries in
these registers, for example from Council’s Rates Record and the Register of Impounded Items

required by the Impounding Act, are available to any person. In the case of an application for a
certificate of an entry in the Rates Record under Section 603 of the LGA, a charge is payable.
Access to Other Documents Held by the Council
Other Council documents are available for inspection under the GIPA Act unless disclosure is, on
balance, contrary to the public interest. Any application must be received in writing and will be
processed promptly and within the agreed timeframe.
The request should specify the documents sought, with a reference to any time or date limitations.
Any application will be considered on its merits and considered in the light of the obligation to make
documents available unless pubic interest considerations favour the withholding of the document(s).
Information and Documents Not Usually Available
Information about the name of a property owner is in the public domain through internet access to
the register maintained by the NSW Land and Property Information Service.
Council holds information about property ownership for the purpose of carrying out its functions.
Council policy is not to make available information about the name of a property owner except in
emergency circumstances or where the enquirer can establish a clear need to know. Council will not
supply bulk property data to third parties for the purposes of direct marketing.
Documents listed below will not usually be available because they are excluded from the right to
access by an express provision in the LGA, or Council has concluded that disclosure of such
documents, or documents containing information of the kind indicated would, in the usual case, be
contrary to the public interest.
Documents Not Available Because of Provisions in LGA
The following information will not be available:-
Papers submitted to Council for consideration in a closed session.
Documents containing information about personnel matters concerning particular individuals,
the personal hardship of any resident or rate payer, trade secrets or other sensitive commercial
information, or where disclosure would found an action for breach of confidence.
Documents that contain information, the release of which would constitute an offence against
an Act.
Other Documents Not Available
Documents or parts of documents which would reveal the identifying particulars of persons
who provide information to Council in connection with its law enforcement and regulatory

Documents concerning Council functions or operations where disclosure would have a
prejudicial effect on Council’s property or financial interests, or would otherwise have an
adverse effect on its regulatory functions, or its capacity to operate in an efficient and effective
manner.
Council working documents prepared or received in connection with its decision making
functions, prior to the making of a decision by Council, a committee of Council, or an officer
exercising delegated authority.
It should be noted that access through verbal advice as to the content of documents listed above is
also not available.
Large General Requests for Access to Documents
Broad, general requests for a large number of documents, for example all documents of a certain
kind, or documents held on a number of different Council files, or which otherwise require a
substantial allocation of Council resources, may be refused after consideration of the public interest
factors involved by Council’s Public Officer/ Right to Information Officer. The Officer may, in the light
of an assessment of the work involved in identifying, locating, collating and assessing a large number
of Council documents, conclude that access should be refused on the grounds that the substantial
diversion of Council resources necessary to deal with the application would, on balance, be contrary
to the public interest. The Public Officer/Right to Information Officer shall, in reaching such a decision
take into account the following:
an assessment of the work and time involved in responding to the application.
the extent to which the work involved in dealing with the request would result in Council
resources being diverted from dealing with other access requests, or from other important
functions.
the nature of the documents requested and any public interests to be advanced by disclosure
generally, or disclosure to the particular applicant. Council acknowledges there is a public
interest in disclosure of documents about Council operations and the exercise of its functions,
and in a particular applicant gaining access to documents where there is a strong and justifiable
right to know.
However the right to access documents free of charge to an individual also requires consideration of
the effect the processing of such an application may have on the rights of others, and on the efficient
and effective use of Council resources in the interests of all ratepayers.
Refusal of Access
Where access to documents is refused under the GIPA Act, Council will advise the applicant in writing
of the reasons for the decision. In the case of refusal on grounds that dealing with the request would
involve the substantial diversion of Council resources, the Public Officer/Right to Information Officer
will provide details to the applicant in writing, including an estimate of the time involved in responding
to the application and consideration of the other factors mentioned in these guidelines however
before doing so will give the applicant a reasonable opportunity to amend the application
Any applicant dissatisfied with Council’s handling of a request for documents under GIPA Act may
seek a review in accordance with Sections 82 - 88 of the GIPA Act and may also seek a review of
reviewable decisions through either the Information Commissioner or the NSW Civil and
Administrative Tribunal.

The Commonwealth Copyright Act 1968 takes precedence over State legislation. Therefore the right
to copy documents under the GIPA Act does not override the Copyright Act.
If Council commissions a report etc. from a consultant it will be under the terms of the contract
whether it can be copied. With regard to documents supplied with development applications,
Council’s development application form includes a statement whereby applicants give their
permission to allow documents included with a development application to be accessed under the
GIPA Act.

Water restrictions in Bourke and North Bourke have reverted from Level Five (5) to Level Three
(3).
This change was effective from 4.00pm, Monday, 27th May 2019.
The weir pool is now re-filling due to inflows from the Culgoa River. This inflow is good news for
Bourke and North Bourke’s town water supply and for stock and domestic users. It is still unclear
as to how much water will be received into the Bourke weir pool, but it is anticipated that it will
continue to slowly rise.
The use of fixed sprinklers continues to be prohibited.
Hand held hoses can, however, now be used for two (2) hours per day only at each property.
These restrictions apply to both filtered and raw water supplies.
The Flow into the Darling River and then into the Bourke Weir Pool was welcomed by the
Bourke Community with many people travelling to the boat ramp and weir to watch the water
breach the bank at that location and move further downstream for the first time in over nine (9)
months.
Whilst there are some photos mirroring the situation when the river was at record lows it
appears that there was no-one within the community who could personally recall the river being
so low and the ongoing water supply to Bourke under such critical threat.
As of Tuesday, 28th May 2019, the Darling River will have stopped flowing over the weir at
Bourke for 285 days, far exceeding the previous record created in 2006 of 200 days.
The recent rain that has resulted in the Culgoa flowing well and hopefully we may see this
record period come to an end very shortly.
A reminder that water restrictions are in place in Bourke and North Bourke and the exact level
of those restrictions will vary according to the inflow into the River.

There is a strong degree of optimism that more water from the Culgoa will flow into the Darling
River and make its way into the Bourke Weir Pool.
It is however, anticipated that the flows will be slow in coming.
The Environmental flow both Copeton and Glenlyon Dams is gradually makings its way down
stream and the water from Glenlyon which was released into the Mehi River has reached
Collarenebri.
The low river levels and dry river beds have combined to make it difficult to predict how far the
water will get but there is a strong degree of optimism that it will get to at least Brewarrina, and
hopefully beyond.
Once the water from the Environmental Flow reaches the Barwon, the opportunity will present
itself for a much more accurate prediction to take place.
The supply of water for domestic purposes may have improved in Bourke but, we are certainly a
long way from having desirable flows into the Barwon Darling System and a considerable
amount of rain will be required in the catchment if we are to achieve these much needed flows
The construction of the bores has given the town of Bourke increased security but those who
are relying on water for irrigation are still relying on the rain in the catchment becoming
available.
The drought conditions are wide spread and right across New South Wales. There are
communities experiencing significant hardship. Regionally, the low level of available water in
Burrendong Dam has triggered some concern for those communities reliant of water from this
source including Dubbo.
In a positive for the Far West of the State there is still a strong flow in sections of the Warrego
this has meant equally strong flows in the Darling at Louth and beyond.
Hopefully this water will get to Wilcannia and provide that community with the additional water
that they need.
Council adopted the 2019/2020 Operational Plan (Budget) at its Ordinary Meeting of Council
held on Monday, 27th May 2019.
Arrangements for this year’s Tour de OROC are progressing and the riders will enjoy an
overnight stay in Bourke on the 9th October 2019.
Bourke Shire Council and Bourke Rotary will combine to host the riders in Bourke and will be
responsible for dinner, bed and breakfast. There are a number of people from the Bourke

district who have already experienced the benefits of Macquarie Homestay which will be the
beneficiary of all funds raised by Tour de OROC.
A fund raiser will be held at the Port of Bourke Hotel will some great prizes to be auctioned. All
these items have been made available for the fund raising efforts by Luke Moon, Publican of the
Port of Bourke.
As an indication of the amount of coordination that goes into an event such as this, Chair of the
organising Committee, Mathew Dickerson has a weekly meeting of the committee in Dubbo
with members of the committee from outside Dubbo including myself joining via
teleconference. The meetings are to ensure the route including stopovers is determined,
required permissions obtained and matters such as catering and accommodation are organised.
On the 7th June, Mathew with be accompanied by committee members Ashley Wielinga and
Paul Loxley who will drive the route to ensure that everything is in place prior to the advertising
and promotion commencing.
Toyota have once again agreed to be the major sponsor of the event in association with Dubbo
City Toyota.
Council adopted a new Code of Meeting Practice at its meeting held on Monday, 27th May 2019
and it will become effective at the next meeting to be held in June 2019. Council has up until the
14th December 2019 to determine how it will meet its obligation to webcast the meetings, noting
of course that the placing of an audio recording of the meeting will satisfy the requirement.
Options to meet the requirement in relation to webcasting are currently being investigated.
A reminder that the final instalment of the 2018/2019 Rates and the last Water Charges are due
this Friday, 31st May 2019.
If you are having difficulties in meeting your obligations in relation to the payment of Rates and
Water Charges please contact Council’s Revenue Officer who may be able to discuss the
implementation of a payment plan.
I have been notified that the Unit Commander of the Bourke State Emergency Services (SES),
Steve Walsh has indicated to the NSW SES Commissioner of his intention to relinquish his role
as Unit Commander at Bourke effective as of 30th June 2019.
Steve has held the role for 22 years and has given great service to the community of Bourke
during that time and has earned the respect of those within the SES and other emergency
services. During this time his dedication and commitment and ability to work collaboratively with
these other agencies for the betterment of the town.

From a personal point of view I would like to thank Steve for his assistance and cooperation
during my tenure in Bourke where I also act as Chair of the Local Emergency Management
Committee. Steve was a great supporter and contributor to that committee and always made
himself available.
Much of the work undertaken by our volunteer organisations, including the SES and Rural Fire
Service, goes relatively unnoticed by the general public who only really see what those
organisation do when an emergency situation arises. However, each of the volunteers are
required to obtain accreditation, attending regular training sessions and participate in planned
exercises so that they are adequately prepared for those emergency situations.
While Steve will relinquish his leadership role he will retain active membership of the SES unit
and continue to support the Bourke community.
I attended a meeting of the General Managers of The Far North West Joint Organisation of
Councils and the Orana Joint Organisation of Councils at Warren last Friday to discuss issues of
mutual concern.
Many trees in and around Bourke suffered during the drought and unfortunately it would
appear that many have already died or are unlikely to survive; which is a clear demonstration on
just how severe the drought has been.
Council has had an arborist look at the street trees and also trees within the parks in town to try
and determine which ones will need to be removed and which ones have the potential to be
revived.
Unfortunately amongst those unlikely to survive are some very large trees.
Those street trees needing to be replaced will be replaced with trees identified in the Street
Trees Master Plan.
There have been a number of positive comments received in relation to the improved facilities
across the shire which have been funded by a combination of the Building Stronger
Communities Fund, the Drought Communities Extension Fund and by other grants obtained by
Council and of course Councils other revenue sources.
The revitalisation of Central Park continues as it becomes a focal point of recreation for the
community.
The new shade sails over the skate park will increase their ability to be used particularly during
the hot weather, the half -court basketball/netball court is receiving good use as are both the
exercise equipment and the playground equipment.

The new fence around the tennis court has made a huge difference and work will commence on
the refurbishment of the tennis club house in the near future.
The toilet complex for Central park should be in place by the end of June.
It is also proposed to undertake some work on the improvements to “Poets Corner” which
reflects a great deal of Bourke’s history.
There is an ongoing emphasis on the consolidating and improvement of council’s existing assets
including active and passive parks.
In addition to the Bourke Skate Park receiving new shade sails, the contractors have also visited
some of the villages and have erected shade sails over the playground equipment at Louth and
Enngonia.
While on parks, work will commence on the establishment of the amphitheatre at Darling Park
at the corner of Mitchell and Sturt Streets which is part of the CBD redevelopment and will
provide an ideal location for outside performances.
There will some disruption to pedestrian access around that area whilst the works are being
undertaken.
The 2019 Graffiti Removal Day is scheduled for Sunday, 27th October 2019. Bourke Shire will
again be working with Bourke Rotary Club in relation to the coordination of the day. The state
wide initiative has attracted a great deal of corporate sponsorship including the supply of graffiti
removal kits free of charge so that all that is needed is for the manpower. Individuals and
Organisation within the community are asked to consider assisting on the day.
The aim of Graffiti Removal Day is to highlight the problem of graffiti across NSW and
encourage people to volunteer to remove and prevent graffiti. Graffiti vandalism costs the NSW
Government and residents more than $300 million every year and it has to stop.
The results speak for themselves:–
• Since its inception in 2012, the number of GRD volunteers has increased from 597 to
over 1800 in 2017.
• In its first year, 100 sites were nominated. In 2017 volunteers removed graffiti from 428
nominated sites.
Over the past couple of years the participation in the day has been relatively low and it is hoped
that with adequate notice the opportunity may be available to get a much greater involvement.
So if you can mark the date of the Graffiti Removal Day down in your diary it would be a good
start.

While individuals are very welcome to attend and assist in the effort to remove this unwanted
form of vandalism the day also presents the opportunity for sporting groups to get together to
ensure that the facilities they utilise is free from graffiti.

The level in weir pool continues to rise as a result of inflows from the Culgoa River. It is still
unclear as to how much water that will be received into the Bourke weir pool but it is
anticipated that it will continue to slowly rise over the next couple of weeks.

The lack of water in the river has meant that the PV Jandra has been able to cruise and in fact
spent some time basically sitting on a sea of mud. The slightly increased water levels have seen
it being re-floated and once the level in the river reaches three (3) metres should be able to
again be utilised for charters.
The PV Jandra is one of our major tourist attractions and we have numerous enquiries
regarding its operation, and no doubt its inability to be utilised has impacted on the length of
stay by some visitors.
The tourist season although slow to start seems to have gained a bit of momentum over the
past couple of weeks. This is welcome news for those persons in the tourism industry, either
directly or indirectly.
Work on Stage 3 of the reconstruction and sealing of the Wanaaring Road is well advanced.
Stage three (3) involves the area around Wongareena Plains. In addition to the funding being
made available from the Fixing Country Roads Program, further funding has been provided

under the Regional Road Repair program and this will result in another six (6) kilometres being
sealed.
To assist in the provision of the water required to undertake the work, a new bore has been
drilled and equipped and this will also allow water to also be available for future projects within
the area.
The Wanaaring Airstrip has been subject to a reseal with the funding being provided by a
combination a grant from the Commonwealth Government under the Remote Airstrips Program
coupled with funding from Bourke Shire Council.
The provision of an all-weather airstrip at Wanaaring is extremely important in cases of medical
emergencies and it is good to see these works undertaken. Like Louth the Wanaaring Airstrip is
not only sealed but also equipped with lighting to enable access twenty fours (24) per day.
Members of the public who are planning to travel to Hungerford next week for the Bi- Annual
Hungerford Field day will have the opportunity to inspect recently sealed sections at
Youngerina and Naree.
Funding for the two (2) new sections was provided by a Drought Initiative of the New South
Wales Government.
Council grading contractors are currently working around the Louth area completing necessary
maintenance works and residents should see improved road surfaces in the area.
Stage one (1) of the construction of the levee shared path from the Wal Mitchell Wharf
Precinct to Rotary Park is under way and being completed by local contractors. This is the first
stage of the project that will eventually see the walk way link Bourke to North Bourke.
There were a lot of people in town last week for the Education Summit conducted by
Maranguka in association with both Department of Education and the Department of Premier
and Cabinet.
All reports in relation to the summit were extremely positive and it encouraging to see the
support provided by so many agencies to enhance the education and training opportunities in
Bourke.
The opportunity was taken following the summit to hold a meeting of the Governance Group of
the Bourke Aboriginal Employment Prosperity Strategy (BAEPS), which I Co-Chair with Mick
Williams representing Maranguka. Representatives of a number of other agencies who sit on the

Governance Group including the Department of Industry, Department of Education and the
New South Ombudsman’s Office were involved in the Summit and it made sense to meet whilst
they were in town.
There were a number of matters discussed and observations made and it was recognised that
sometimes as a community we don’t recognised and celebrate our successes.
In looking at the evaluation measures for BAEPS one of the measures considered was the
number of students who have completed Year 12 at Bourke and had either secured
employment or had decided to undertaken further education.
Principal of Bourke High School, Andrew Ryder noted that of the nineteen (19) students who
completed Year 12 at Bourke in 2018; all had been successful in gaining employment or were
continuing further study.
This is a great result and congratulations to all concerned and if this can be replicated in future
years it will be tremendous.

The Far North West Joint Organisation of Councils will hold an Extraordinary Meeting on Friday,
7th June 2019 in Dubbo to further progress the procurement process regarding the
establishment of an air service for the towns of Bourke, Cobar and Walgett/ Lightning Ridge.
The news of a potential air service for Bourke and the other towns was welcomed by a number
of delegates to the Educational Summit held last week with delegates indicating that the air
service would both substantially reduce travel times and make access to each of the towns
much easier.
To protect Greater Sydney’s Water Supply, the NSW Government has announced Level 1 Water
Restrictions which came into effect across Greater Sydney (Sydney, Blue Mountains and the
Illawarra) from 1st June 2019.

With the ongoing drought, there’s more pressure on Greater Sydney’s Water Resources. The
NSW Government has introduced early restrictions on outdoor water use to conserve water for
the future.
The fact that Australia’s largest city is on water restrictions serves to demonstrate just how dire
the situation is across the state.
Bourke has been fortunately able to revert to Level 3 restrictions and the chances on inflows into
the weir pool may see this further eased. However, the forecast for the winter apparently points
to a drier period and if rainfall is not received into the various catchments we could quite easily
see the stronger restrictions once again imposed.
The Hungerford Field days are on this weekend and I know the locals of Hungerford and District
put in a lot of work to make the day a success and it would be good to see good a big crowd in
attendance.
Functions such as these are important to build the community resilience and spirit and build up
the social fabric of these isolated communities and should be supported.
The Mayor Councillor Barry Hollman attended his first meeting of the New South Wales Country
Mayors Association held at Parliament House last Friday.
The New Minister for Local Government, the Hon. Shelley Hancock, MP was in attendance as
was the Minister for Health in NSW, the Hon. Brad Hazzard, MP.
Both Ministers gave feely of their time to answer questions.
In all 86 delegates from across New South Wales attended the meeting.
One of the issues raised at the meeting was the substantial increase in the Emergency Service
Levy and the lack of consultation with Councils regarding the increase and the fact that the
increase was announced after most Councils had prepared their 2019/2020 Operational Plans
(Budget).
There was strong support for the action undertaken by Local Government New South Wales in
opposing the increase and looking to defer its introduction.
As a member of the Board Regional Development Australia- Orana (RDA-Orana) I attended a
Planning and Budget meeting of the Board on Monday, 3rd June 2019. There were
presentations on the day from Jillian Kilby, Roger Fletcher and Phil Johnston from Narromine.
Destination Country & Outback were unable to attend but provided a presentation for the day.

I stayed in Dubbo on Monday night to attend a meeting on Tuesday of the Regional Cross
Sector Leadership Executive Group which brings together the heads of the various agencies and
Not for Profit and Philanthropic Organisations across the region. This meeting is to assist in
ensuring the group is effective in providing whole of government alignment, a solution focussed
approach and the ability to monitor outcomes in the Maranguka Justice Reinvestment Project in
Bourke.
Annette and I joined with a number of other locals in attending a dinner at the Bridge Inn
organised as part of an initiative of the Rural doctors Network called “go rural”
The “Go Rural“ initiative saw 20 students from various universities across NSW and Tasmania
who are studying in various medical related professions, travel across the state last week on a
road trip designed to encourage future health professionals to consider the benefits and
rewards of a rural health career.
The four (4) day ‘Go Rural’ road trip, incorporated practice visits, clinical activities, community
events, themed dinners, cultural events and historical exhibitions in towns including Tamworth,
Narrabri, Walgett, Bourke, Brewarrina and Dubbo.
Research published in the Medical Journal of Australia shows rural exposure during medical
training has been associated with an increased likelihood of medical students entering rural
practice after graduation.
Go Rural provided students with a taste of how rewarding careers in rural health can be and the
road trip was organised to give medical, nursing, midwifery and allied health students the
opportunity to see for themselves, the amazing opportunities that working rurally offers, both
professionally and socially.
With the difficulty being experienced in attracting and retaining Allied Health Professionals to
Western New South Wales the initiative in an excellent concept.
The dinner featured guest speakers Dr Robert Reed and Daniel Kelly an Aboriginal Health
practitioner both from Brewarrina speaking about their experience in Rural Health.
Bourke Shire has been a long term supporter of such initiatives.
Bourke is also fortunate to host a training and placement facility of the University of Sydney
which coordinates training and placement of students across a wide section of North West New
South Wales.
That facility is located with the grounds of the Bourke Hospital.
The Chairs and Executive Officers of all the Joint Organisations of Councils (JOs) across the State
met in Sydney last week to discuss the issues impacting on the formation and operation of the JO
network.

Bourke Shire Council is a member of the Far North West Joint Organisation of Councils
(FNWJOC) along with Walgett and Cobar Councils.
The FNWJOC has recently advertised for a part-time Chief Executive Officer who will take over
from Peter Vlatko who has been acting in that roll and has been assisted by Mark Riley who has
been acting in a Project Officer capacity.
The FNWJOC have been fortunate to secure funding for the initial operation and this has
provided for a good financial platform.
A reminder, that Bourke Public Library has a good range of material for all ages and interests
and also carries a range of DVDs which can be borrowed.
Representatives of Bourke Shire Council will meet with the Local Land Services late next week to

The level in weir pool continues to rise as a result of inflows from the Culgoa River and it is
anticipated that it will continue to slowly rise over the next couple of weeks.
The Culgoa is still flowing up near the border which is good news as this water will make its way
south.
As at Monday lunchtime the height of the river at Bourke was 2.95 metres which is a rise of over
a metre from its lowest level but still a metre away from topping the weir.
Level three (3) water restrictions are still in place.
The use of fixed sprinklers continues to be prohibited.
Hand held hoses can, however, now be used for two (2) hours per day only at each property.
These restrictions apply to both filtered and raw water supplies.
Once the water level increases to 3 metres the level of restrictions will be reviewed in
conjunction with forecast inflows and weather predictions.

As of Wednesday, 12th June 2019, the Darling River will have stopped flowing over the weir at
Bourke for 300 days or about 10 months. This period would have been well in excess of 12
months had it not being for the Environmental flow dubbed the Northern Connectivity Event
which was made available in the early 2018.
The Environmental flow from both Copeton and Glenlyon Dams is gradually making its way
towards Walgett.
The dry river beds continue to make it difficult to predict how far the water will get, but there is
a strong degree of optimism that it will get to at least Brewarrina, and we are hopeful that the
flow will reach Bourke.
If you are having difficulties in meeting your obligations in relation to the payment of rates and
charges please contact Council’s Revenue Officer who may be able to discuss the
implementation of a payment plan.
The Mayor and I attended the Extraordinary Meeting of The Far North West Joint Organisation
of Councils (FNWJO) held at Dubbo last Friday.
The meeting was convened to progress the procurement process for the provision of air
services to the far North West of the state.
The Board of FMWJO considered seven (7) options and has narrowed these options to a point
where the JO can now enter into specific contract negotiations.
Final contract negotiations will proceed with a view to a determination by the FNWJO in the
next three (3) weeks.
The NSW Government has provided significant funding to see the return of air services to the
far North West and the FNWJO is most appreciative of the Government’s commitment.
The trip to Dubbo for the Meeting of the FNWJO meant that I had three (3) days in Dubbo last
Week having also attended the Board Meeting of The Regional Development Australia on the
Monday and then the Cross Sector Leadership Group on the Tuesday.
While in Dubbo Annette and I caught up with former Bourke residents Fizza, Prakash and
Nabeera Khan who moved from Bourke to Dubbo and have now moved to Melbourne.

The Khans were back in Dubbo to participate in their Australian Citizenship ceremony which was
conducted on the Wednesday.
They are all now extremely proud Australian Citizens.
They asked to be remembered to their friends in Bourke.
The next of Bourke Shire Council will be held on the 24th June 2019 and will commence at
9.15am with the meeting to be proceeded by a Public Forum during which members of the
public are able to speak to items on the agenda.
Council has previously conducted a Public Forum at 10.00am each meeting day, however, with
the changes to the Code of Meeting Practice this opportunity will no longer be available with
presentations being limited to items on the agenda. However, anyone who wishes to raise a
matter can make an appointment to speak with the relevant Manager or if necessary the Mayor.
Whilst unable to be at Hungerford due to Meeting of the Far North West Joint Organisation of
Councils held in Dubbo I understand that the Field Day was a great success and that the
organising committee did a tremendous job in attracting exhibitors and providing
entertainment.
I had some good comments on the condition of the road which Council staff try and ensure is in
good condition for the crowds making their way to the Field Day.
Last Friday and Saturday Bourke Shire Council hosted the Deputy Premier of New South Wales,
the Hon. John Barilaro, MP and the State Treasurer, the Hon. Domenic Perrottet, MP.
On the Friday evening the Deputy Premier and Treasurer joined the Mayor and available
Councillors for dinner at Diggers on the Darling.
On Saturday Morning Council hosted a breakfast meeting and it was attended by Councillors
staff and members of the community. At this meeting the Deputy Premier and Treasurer
announced the allocation of $1.4 million in funding which will be primarily be used to provide an
upgrading of the displays and facilities at the Back O’ Bourke Exhibition Centre, whilst part of the
funding will be allocated to the restoration of the North Bourke Bridge, Poets Corner in Central
Park and also the other funding will provided to upgrade the boarding area for the PV Jandra
and Signage around town.
There was a Q&A sessions with both the Deputy Premier and Treasurer giving freely of their
time to answers a range of questions.
Following the Tourism Funding Announcement those in attendance were invited to join the
Premier and Treasurer at the Old North Bourke Packing Shed where they announced that the

2019/2020 State Budget would see the inclusion of $37.5 million for the improvement to the Wild
Dog Exclusion Fence that will see an additional 742 kilometres of fencing constructed.
The funding recognises the significant damage caused by wild dogs and the impact of the
economy of the farming sector.
Many of the community members present had a strong interest in Wild Dog Control and the
announcement was very welcome.
This huge funding announcement comes on top of the funding of $926,000 recently received
under the Communities Combating Pest and Weed Impacts during Drought Program to assist in
addressing the wild dog problem in the western area of the state.
Working with the Western Local Lands Services the Shires of Bourke, Brewarrina, Wentworth,
Cobar, Central Darling and Broken Hill City Council combined to lodge that successful
application which will be auspiced by Bourke Shire Council as the lead Council.
The Hon. David Littleproud, MP, Minister for Water Resources, Drought, Rural Finance Natural
Disaster and Emergency Management, visited Bourke on Tuesday along with our Local Member,
the Hon. Mark Coulton, MP, Member for Parkes, Minister for Regional Services, Decentralisation
and Local Government and Assistant Trade and Investment Minister.
The two (2) Ministers met with council and other, members of the Community around the issues
created by the ongoing drought.
The issue of Water is of paramount concern for the residents of this area and we have been
lucky enough to have had both the State and Federal Ministers for Water visit Bourke over the
past few weeks to hear the community concerns.
The new sails over the Skate Park certainly add to the colour and presentation of the area and
have received quite a bit of favourable comment. The whole Central Park precinct seems much
more vibrant and is being increasingly utilised.
There is still some work to be done on the Tennis Clubhouse and then the installation of the
new toilets. Once these works are finalised the area will be further improved.
Work in the Main Street continues to go well and I know that many members of the community
are looking forward to an increased flow in the river and an end of water restrictions which will
not only have a positive impact on the private gardens around town but also allow Council the
opportunity to be able to plant in the gardens plots that have been formed as part of the
redevelopment of the Main Street.

Organiser of the 2019 Tour de OROC Mathew Dickerson was accompanied by Ex- Bourke
resident Ashley Wielinga last Friday in travelling around much of the route to be covered by
this year’s event to ensure that the times and locations of stopovers and rest breaks was able to
be finalised. As I have previously mentioned there is a lot of planning that goes into the staging
of an event such as Tour de OROC.
The visit to Bourke by the Deputy Premier, the Hon. John Barilaro, MP and the Treasurer, the
Hon. Domenic Perrottet, MP was well covered by the Sydney media with a double page spread
appearing in the Saturday edition of the Daily Telegraph, coupled with the lead article in that
days Editorial.
In addition to the print media coverage a television crew also accompanied the two (2) NSW
Senior Cabinet Members on their trip to the Far North West area of the State.
In addition to Bourke they also visited both Lightning Ridge and Cobar.
A meeting of the Barwon Darling Surface Water Stakeholder Advisory Panel will be held this
Thursday 13th June 2019 at Diggers on the Darling. Bourke Shire is represented on the Panel
which meets regularly to discuss issues related to the Barwon Darling System. It brings together
a wide range of representation including Local Government the farming community and various
Government agencies.
Local Government New South Wales have been in consultation with the NSW Minister for
Regional Roads and Transport, the Hon. Paul Toole, MP, to see if he would allow LGNSW join
him in approving the members and terms of reference for his Road Classification Review.
The State Government have a commitment to this review, which will ask councils about which
local roads councils want to hand back to the State – and which they want to keep – as part of
the government’s promise to take back 15,000km of local roads to reduce cost-shifting impacts.
In his visit to Bourke last week The Deputy Premier also highlighted the fact that Government
intends to take back the 15,000 kilometres of road and from Bourke Shire Councils perspective
there could be some considerable change depending on which roads are selected.
Bourke Shire Council will be the first Council in Far West New South Wales and one (1) of the
first in Regional New South Wales to have prepared what is known as Local Strategic Planning
Statements (LSPS). Manager of Planning and Environment at Bourke Shire Council, Dwayne
Willoughby and Planning Assessment Officer, Carolyn Crain have been working closely with
New South Wales Department of Planning to formulate the document.

The new Minister for Local Government the Hon. Shelley Hancock, MP introduced Local
Government (Amendment) Bill 2019 last week that will provide some legislative changes for
Councils. Included in these changes will be amendments to:-
raise the threshold value for council tendering arrangements to $250,000
allow some functions to be shared or delegated by agreement to fellow councils, that
may be better resourced or have particular expertise
Extend the cut-off dates by which councils need to decide whether to outsource
administration of the 2020 local government elections to the Electoral Commission.
Congratulations to Maxine Mackay OAM whose award was announced in the 2019 Queen’s
Birthday Honours list earlier in the week.
Maxine has done a lot of work within the Bourke Community and in particularly with the
children of the town and it is great to see her work recognised.
Congratulations to Greg Moore who was the recipient of the Police Service Medal which was
also announced in the Queen’s Birthday Honours List.
Greg has made a tremendous contribution to Bourke and the Central North Police District.
The Bourke town water supply reverted to back to total river supply last week with the height in
the weir pool gradually increasing providing a surety of supply for the short term with the cooler
winter conditions reduced level of evaporation.
The bores and pipelines which have been constructed have provided a degree of confidence
that the water supply for the town of Bourke can be maintained should we be faced with the
severe shortages in the supply from the river system.
There is still some work to be undertaken to increase the capacity of the pipelines and this will
be undertaken as soon as practical.
The Council and the community is extremely grateful for the funding which has been made
available by the State Government to “drought proof” the town.
Bourke Shire Council has been advised that Round 4 of the Mobile Black Spot Program will see
180 new mobile base stations to address coverage issues in regional and remote Australia with
Telstra being responsible for the delivery of 131 of those sites.
Included in the new sites are Enngonia and Yantabulla (Naree Station) within Bourke Shire while
the township of Tilpa is also included.
It is hoped that the first of the stations will be constructed in the second half of this year.

Representatives of Downer EDI who will be undertaking the work will be discussing the issues
relating to the construction of the new towers from an approvals point of view with Council over
the next few weeks.
Council has lobbied hard for improvements to the mobile coverage and will continue to do so.
The erection of the proposed towers will be a positive step forward and very welcome by both
the residents of the areas and the travelling public.

Children’s Craft and Story Time this month had the theme of Mother’s Day, and we had 10
children attend.
Our junior craft afternoon sessions had nine (9) children attend this month.
We have started an afternoon coding club for children. Our first session had 4 children
attend.

Executive Summary
The Bourke Shire Councils Tourism and Events Manager’s Activity Report provides Council with
an updated status report for the month of May/June, relating to its tourism teams activities
through visual data including graphs and statistic to allow for the measurement of the team
progress and performance.
It comprises of an overview of the operations, major activities and achievements of Councils
tourism section and will provide a platform to allow for the detailed monitoring of critical data
for future analysis.
Back O’ Bourke Exhibition & Information Centre:
Bourke visitor numbers to the centre for May (3693) have held their position on last years’
figures and is a strong indicator that although the impacts of drought including the Jandra
not operating, media coverage of drought-stricken landscapes, visitors are still travelling to
Bourke and spending money. Sales at the Back O’ Bourke Centre are on trend with this as
sales have grown 4% in the last month.
The Crossley is operating 7 days a week. Maintenance is continuing.
Guided Tours at the Back O’ Bourke Centre have commenced. Visitors are greeted by our
local Tour Guide and accompanied throughout the Exhibition Centre where the 45-minute
tour provides information on the history of the building, explanations of exhibits,
information of the area and general matters of interest to the visitor. Interest is gaining
momentum with another five (5) bookings scheduled for the month. Receiving very positive
reviews.
613 tickets were sold for the Back O’ Bourke Exhibition Centre for the month of May.
Maintenance and minor repairs have commenced on the Jandra, these will be ongoing now
until the Jandra comes out at the end of the year for slipping.
Compliance for accreditation at the Back O’ Bourke Visitor Information & Exhibition Centre
has been met. Accreditation provides consumers and the industry with an assurance that
an AVIC is committed to quality business practice and professionalism. The primary focus is
to ensure that standards of service delivery meet and, where possible, exceed the visitor's
expectations.
There are another 10 coach group itineraries completed and booked in for the Back O’ Bourke
Information & Exhibition Centre. This includes the full creation and coordination of itineraries
by the staff.
