As with most discussions related to Covenant Enforcement we need to begin with the authority provided in both the Virginia Code Property Owner’s Association Act (POAA) and the Association’s governing docu-ments, (Covenants).

6 H F W L R Q � � � � � � � � R I � W K H � 32$$� ± A d o p t i o n a n d E n f o rc e m e n t o f R u l e s paragraph A reads in part�³«��7KH�ERDUG�RI�GLUHF-tors shall have the power to establish, adopt, and enforce rules and regulations with respect to use the common area and with respect to such other areas of responsibility assigned to the association by WKH�GHFODUDWLRQ«��´��3DUDJUDSK�%��VXE�SDUDJUDSK�LL�UHDGV�³DVVHVV�charges against any member for any violation of the declaration or rules and regulations for which the member or his family members, WHQDQWV��JXHVWV��RU�RWKHU�LQYLWHHV�DUH�UHVSRQVLEOH´�

Having established the authority of the Association through its directors to assess violation charges to the members through the POAA, we next examine the Association’s governing documents – the authority and process for effecting such charges. The Third $PHQGPHQW�E\�5HVWDWHPHQW�RI�WKH�'HFODUDWLRQ�RI�&RYHQDQWV�DQG�5HVWULFWLRQV��$UWLFOH�9,�)XQFWLRQV�RI�WKH�$VVRFLDWLRQ��6HFWLRQ����N��UHDGV�³7DNH�DQ\�DQG�DOO�DFWLRQV�QHFHVVDU\�WR�HQIRUFH�DOO�&RYHQDQWV�DQG�5HVWULFWLRQV´���7KH�5HVWDWHG�%\�/DZV��$UWLFOH�9,,,�&RPPLWWHHV��Section 2 provides the directors with the authority to establish com-mittees to conduct the business of the Association. On January 9, �����WKH�%RDUG�RI�'LUHFWRUV�HVWDEOLVKHG�WKH�FKDUWHU�RI�WKH�³+HDULQJ�3DQHO´��7KLV�FKDUWHU�SURYLGHV�WKDW�WKH�SDQHO�GHWHUPLQH�WKH�QDWXUH�DQG�H[WHQW�RI�WKH�YLRODWLRQV�RI�WKH�³FRYHQDQWV´�DQG�ZKHQ�QHFHVVDU\�determine appropriate charges for the violation. As with all com-mittees of the Association, the members are volunteers who serve at the pleasure of the Board of Directors.

5HIHUUDOV�WR�WKH�+HDULQJ�3DQHO�DUH�PDGH�E\�%&$�VWDII�IRU�WKRVH�properties substantially out of compliance and for which the staff has seen little or no improvements over a period of time. The RZQHU�RI�WKH�SURSHUW\�LV�QRWL¿HG�DW�OHDVW�WZR�ZHHNV�LQ�DGYDQFH�RI�the hearing, as to its time, place and the right to be represented by counsel, all in accordance with the POAA. Upon conclusion of the 3DQHO¶V�GHOLEHUDWLRQV�WKH�RZQHU�LV�QRWL¿HG�ZLWKLQ�VHYHQ�FDOHQGDU�GD\V�DV�WR�WKH�UHVXOWV�DQG�¿QGLQJV�RI�WKH�+HDULQJ�3DQHO���7KH�32$$�provides that charges may be $50 for a one-time occurrence, or up to $10 per day for a maximum of 90 days for an ongoing violation.

In many instances the mere notice of the intent to refer the case to the Hearing Panel is enough to have the owner contact the BCA and establish a timeline for bringing the property into compliance. 2WKHU�WLPHV�WKH�QRWL¿FDWLRQ�WKDW�WKH�+HDULQJ�3DQHO�KDV�WDNHQ�DFWLRQ�and the charges will begin results in the owner being responsive and moving toward compliance. However, for those instances where the full brunt of the charges still has not provided the desired result, the BCA may have to refer the case for legal action, asking our attorney to seek injunctive and compensatory relief through the &KHVWHU¿HOG�&RXQW\�&LUFXLW�&RXUW��3UHVHQWO\�WKH�%&$�KDV�VHYHQ�such actions pending.

Each week Property Management Director Al Raimo educates the community on timely information from his department. This week he shows the journey a covenant violation must take in order to be resolved. Sometimes there is frustration on the part of a complaintant to see a property brought into compliance, but there are legal avenues that must be persued and it all takes time.

Yard Sales, Lost Pets, Solicitation

It’s that time of year when the weather turns warm and people want to be outside – yard work, walking the trails, spring cleaning.

If you are planning a yard sale, looking for a lost pet or summer work, call the BCA.

The BCA has signs just for yard sales and lost and found pets. There is a deposit of $33, but it is fully refundable upon the return of your sign.

If you are a student, The Village Mill can help you look for clients for your babysitting services, lawn work or tutoring jobs – at no cost. Adults will pay to advertise their businesses, but at very reasonable prices.

3OHDVH�UHPHPEHU�WKDW�VLJQV�DUH�127�WR�EH�DW-tached to any road signs, stop signs or any street signs in the community. They will be removed and you may miss purchasers for your yardsale, or a call from someone who has seen your pet.
