We are delighted to introduce you to Enfield’s Traded Services to Schools 2018 – 2019 Brochure.

With the continual changes within the education sector and being conscious of the financial challenges facing schools and local authorities, we endeavour to deliver the very best value from our combined resources, and can offer a range of cost effective and responsive services to schools.

We have continued to review the systems being used with the aim of ensuring that these arrangements enable you to access our services in an efficient and effective way and meet our common goal of continuously raising standards and improve the life chances for the children and young people in Enfield.

Developments to the Enfield website and Schools Portal continue to advance to be able to provide you with all the information needed for your decision-making.

We are confident that our continued focus on seeking to improve our services and systems to support the delivery of these services will strengthen the relationships, effective partnerships and collaborations, which are already in place.

1. DEFINITIONS AND INTERPRETATIONS

1.1 In these terms and conditions the words and expressions below will be interpreted to have the meanings adjacent to them:-

1.1.1 "Agreement" means this agreement between the Education Institution and the Council comprising the agreement to purchase services, these general conditions, the individual service terms for each traded service as agreed with the Education Institution and schedules hereto;

1.1.2 "Agreement Period" means (subject to earlier termination in accordance with its terms or by operation of law) the duration of the Agreement as set out in Clause 5 and Schedule 2;

1.1.3 "Agreement Price" means the monies payable by the Education Institution to the Council for the provision of the Services as set out at Schedule 2;

1.1.4 "Confidential Information" means information, data and material of any nature which either Party may receive or obtain in connection with the Agreement (including any procurement process) and: (a) Which comprises Personal Data or Sensitive Personal Data (as both terms are defined in

the Data Protection Act 1998) and any subsequent legislation; (b) The release of which is likely to prejudice the commercial interests of the Council or the

Education Institution; or (c) Which is a trade secret;

1.1.5 “Contract Manager” means a person designated by the Education Institution from time to time as notified in writing to the Council to act as the authorised representative of the Education Institution for all purposes connected with the Agreement;

1.1.6 “Council” means The Mayor And Burgesses Of The London Borough Of Enfield of the London Borough of Enfield, Civic Centre, PO Box 60, Silver Street, Enfield, London EN1 3XA

1.1.7 Council Personal Data” means the personal data supplied by the Council to the Educational Institution and for the purposes of or in connection with this Agreement.

1.1.8 "Dispute Resolution Procedure" means the procedure set out in Clause 13;

1.1.9 “Party” means any party to the Agreement individually and “Parties” refers to all of the parties to the Agreement collectively. A Party shall include all permitted assigns of the Party in question. All persons who are not a Party to the Agreement are third parties;

1.1.10 "Personal Data" means personal data as defined by the Data Protection Act 1998 or any subsequent legislation;

1.1.11“Processing” shall have the meaning given to it under the Data Protection Act or any subsequent legislation but, for the purposes of this Agreement it shall include both manual and automatic processing. “Process” and “Processed” shall be interpreted accordingly

1.1.12"Service Manager” means a person designated as such by the Council from time to time as notified in writing to the Education Institution to act as the representative of the Council for all purposes connected with the Agreement, including any authorised representative of such person;

1.1.13 "Services" means the services provided by the Council to the Educational Institution set out in Schedule 2;

1.1.14 ‘Working Day’ means any day save for Saturday, Sunday and a public holiday in England;

1.2 In these terms and conditions, all references to any statute or statutory provision shall be deemed to include references to any statute or statutory provision which amends, extends, consolidates or replaces the same and shall include any orders, regulations, codes of practice, instruments or other subordinate legislation made thereunder and any clauses attaching thereto.

1.3 Any headings within these terms and conditions are for convenience only and shall not affect the meaning of these terms and conditions. Unless the contrary is stated references to Clauses and or Schedules shall mean the Clauses and or Schedules of these terms and conditions respectively.

1.4 Unless otherwise expressly defined in these terms and conditions, the words used in these terms and conditions shall bear their natural meaning.

1.5 In these general conditions, words importing any particular gender include all other genders.

1.6 In these general conditions, words importing the singular only shall include the plural and vice versa.

1.7 In these general conditions “staff” and “employees” shall have the same meaning.

1.8 Except where an express provision of these terms and conditions states to the contrary, all obligations of a Party under the terms of this Agreement are to be performed at this parties cost.

1.9 Schedule 2 to this Agreement may have its own definitions for the terms used therein. In such cases where any conflict arises between the definitions used in Schedule 2 and the definitions stated in clause 1.1, the definitions in Schedule 2 shall prevail.

1.10. In the event of and only to the extent of any conflict between the Schedule 1 general conditions and Schedule 2, the Schedule 1 general conditions shall take precedence.

2 APPOINTMENT

2.1 The Education Institution appoints the Council to provide the Services in accordance with the Services (as set out in Schedule 2) and all provisions of the Agreement.

2.2 The Council accepts the terms of appointment as provided in Clause 2.1 in consideration of the Agreement Price.

3. PERFORMANCE OF THE SERVICES

3.1 The Education Institution and the Council will co-operate with each other in good faith and will take all reasonable action as is necessary for the efficient transmission of information and instructions and to enable the Parties to fulfil their obligations under the Agreement.

3.2 Any request by either Party to amend the scope or execution of the Services shall be dealt with by the Parties in accordance with the Agreement.

3.3 The Education Institution will immediately notify the Service Manager of any actual or potential problems that affect or might affect the Council’s ability to provide the Services.

3.4 If the performance of the Services by the Council is delayed by reason of any act or default on the part of the Education Institution or by any other cause that the Council could not have reasonably foreseen or prevented and for which it was not responsible, the Council shall be allowed a reasonable extension of time for completion of the Services so affected.

3.5 For major failures in the delivery of the Services, including as a result of industrial action or damage to the kitchen or dining room, where remedial works may either not be possible or not required by the Education Institution, the Council may reduce the charges for those Services.

4. AGREEMENT PRICE AND PAYMENT

4.1 In consideration of the Council's due and proper performance of its obligations under the Agreement, the Council shall charge the Education Institution the Agreement Price in accordance with this Clause 4.

4.2 The Council shall raise invoices as set out in Schedule 2.

4.3 The Education Institution shall pay all valid invoices within 30 days of receipt by direct debit. If any sum under the Agreement is not paid by the Education Institution when due then the Council may claim interest on such overdue sum from the due date until payment is made in accordance with the

Late Payment of Commercial Debts (Interest) Act 1998 (as amended from time to time including by the Late Payment of Commercial Debts Regulations 2013).

4.4 The Council shall inform the Education Institution where VAT is due. For the avoidance of doubt VAT shall be due where the Education Institution is outside of the Council’s VAT registration and accounting arrangements, being academies, independent schools and establishments outside of the London Borough of Enfield.

4.5 The Agreement Price may be reviewed annually by the Council at the end of each financial year in accordance with Schedule 2.

5. AGREEMENT PERIOD

5.1 The Agreement is for a period as set out in Schedule 2 (subject to any earlier lawful termination).

5.2 The Parties may by agreement in writing, extend the Agreement Period the Party seeking to extend the Agreement shall give no less than 12 weeks’ notice before the end of the Agreement Period.

6. SERVICE MANAGER/CONTRACT MANAGER

6.1 Any notice, information or other communication given to or made by the Service Manager shall be deemed to have been given or made by the Council.

6.2 Any notice, information, or other communication given or made to the Contract Manager shall be deemed to have been given or made to the Education Institution.

6.3 Only the Service Manager shall be able to authorise additional, or amendments to Services.

7. DISCLOSURE AND BARRING SERVICE CHECKS

7.1 The Council shall:

To the extent that the Council’s staff, employees and/or persons carrying out the services under the Agreement on their behalf are engaged in a ‘regulated activity’ (as defined by the Safeguarding Vulnerable Groups Act 2006 (SVGA 2006), ensure that such individuals are subject to a valid enhanced disclosure check for regulated activity undertaken through the Disclosure and Barring Service and;

(a) Monitor the level and validity of the checks under this Clause 7 for each member of staff. (b) not employ or use the services of any person who is barred from, or whose previous conduct or

records indicate that he or she would not be suitable to carry out regulated activity (as defined by the SVGA 2006) or who may otherwise present a risk to children or vulnerable adults.

7.2 The Council warrants that at all times for the purposes of this Agreement it has no reason to believe that any person who is or will be employed or engaged by the Council in the provision of the Services is barred from the activity in accordance with the provisions of the SVGA 2006 and any regulations made thereunder, as amended from time to time.

7.3 The Council shall immediately notify the Educational Institution of any information that it reasonably requests to enable it to be satisfied that the obligations of this Clause 7 have been met.

7.4 The Council shall refer information about any person carrying out the Services to the DBS where it removes permission for such person to carry out the Services (or would have, if such person had not otherwise ceased to carry out the Services) because, in its opinion, such person has harmed or poses a risk of harm to children OR vulnerable adults.

8. HEALTH AND SAFETY

8.1 The Education Institution shall provide to the Council information about health and safety, fire and emergency procedures and shall provide access to all appropriate Education Institution policies.

8.2 The Council shall ensure that the Service is carried out in accordance with its Health and Safety Policy and all applicable legislation.

9. CONTRACT MANAGEMENT

9.1 The management of the Agreement shall be in accordance with the provisions of Schedule 2.

10. ASSIGNMENT & SUB-CONTRACTING

10.1 The Council may assign, novate or transfer the Agreement or any part of it.

10.2 The Educational Institution shall not assign, novate, transfer, sub-contract or in any other way dispose of any part of the Agreement without the Approval of the Council. The granting of any consent to sub-contract any part of the Agreement shall not relieve the Educational Institution of any obligation or duty attributable to it under the Agreement.

10.3 Within 14 days of any written request by the Council to the Educational Institution, the Educational Institution will execute one or more agreements substantially in the form specified in Schedule 3 by which the Council shall transfer all or such part as may be specified by the Council of its rights and obligations under this Agreement to one or more third parties to be nominated by the Council.

11. INSURANCE

11.1 Without prejudice to any rights or remedies of the Council (including the Council’s rights and indemnities pursuant to the Agreement) the Education Institution shall indemnify the Council and keep the Council indemnified in full against all actions direct, indirect or consequential liabilities, claims, demands, losses, charges, costs and expenses which the Council may suffer or incur as a result of or in connection with any damage to property or in respect of any injury (whether fatal or otherwise) to any person which may result directly or indirectly from any negligent or wrongful act or omission of the Education Institution or its obligations under the Agreement.

11.2 During the term of the Agreement the Education Institution shall have in force with a reputable insurer:- 11.2.1 Employers liability insurance for no less than £10,000,000 (ten million); public liability

insurance for no less than £5,000,000 (five million pounds); and professional indemnity insurance for no less than £1,000,000 (one million pounds).

12. VARIATION OF THE AGREEMENT

12.1 Any variation to the terms of the Agreement must be agreed by the Parties and recorded in writing.

13. DISPUTE RESOLUTION PROCEDURE

13.1 If a dispute arises between the Council and the Education Institution in relation to any matter, every effort will be made to resolve the issue at a local level. However, if this cannot be resolved by the Service Manager and the Contract Manager either of them may refer such dispute to the Dispute Resolution Procedure set out below.

13.2 In the first instance each of the Council and the Education Institution shall arrange for a more senior representative than those referred to in Clause 13.1 to meet solely in order to resolve the matter in dispute. Such meeting(s) shall take place within 21 days of the date of the commencement of the relevant dispute, shall be minuted and shall be chaired by the Council (but the chairman shall not have a casting vote). Such meeting(s) shall be conducted in such manner and at such venue (including a meeting conducted over the telephone) as to promote a consensual resolution of the dispute in question at the discretion of the chairman.

13.3 If the meeting(s) referred to in Clause 13.2 does not resolve the matter in question then the Parties will attempt to settle it by mediation in accordance with the Centre for Effective Dispute Resolution ("CEDR") Model Mediation Procedure or any other model mediation procedure as agreed by the Parties. To initiate mediation the Parties may give notice in writing (a "Mediation Notice") to the other requesting mediation of the dispute and shall send a copy thereof to CEDR or an equivalent mediation organisation as agreed by the Parties asking them to nominate a mediator. The mediation shall commence within 28 days of the Mediation Notice being served. Neither Party will terminate such mediation until each of them has made its opening presentation and the mediator has met each

of them separately for at least one hour. Thereafter paragraph 14 of the Model Mediation Procedure will apply (or the equivalent paragraph of any other model mediation procedure agreed by the Parties). Neither Party to the mediation will commence legal proceedings against the other until 30 days after such mediation of the dispute in question has failed to resolve the dispute. The Parties will co-operate with any person appointed as mediator providing him with such information and other assistance as the mediator shall require and will pay the costs, as the mediator shall determine or in the absence of such determination such costs will be shared equally.

14. TERMINATION 14.1 Both Parties reserve the right to terminate this Agreement on giving 3 months’ written notice to the

other. Not withstanding the above, where the Education Institution terminates this Agreement within the period of the Agreement, the Education Institution may be liable to meet any costs which the Council incurs as a result of such early termination. This will include outstanding capital depreciation and repayment on any investment made directly by the Council in the Education Institution (against an agreed service term documented in a formally binding letter of agreement between the Education Institution and the Council) and/ or the repayment of any removal fees for on-loan equipment.

14.2 Either Party may terminate this Agreement by serving written notice on the either Party if:

14.2.1 the other Party has not remedied a breach to the satisfaction of the Party claiming the breach within thirty (30) Working Days or such other longer period as may be agreed by the Parties; or

14.2.2 In the event of a material breach of this Agreement; or

14.2.3 In the event of a default of any duty of care or any fiduciary or statutory duty owed to the other Party; or

14.3 The Parties agree that that termination (in whole or in part) or expiry of the Agreement shall not affect either Party's obligations which the Agreement provides shall survive the termination or expiry of the Agreement or the continuance of the part or parts not terminated where the Agreement is terminated in part only.

14.4 Any termination (in whole or in part) of the Agreement will not prejudice the rights, obligations and duties of each Party arising prior to such termination taking effect.

15. PREVENTION OF BRIBERY AND CORRUPTION

15.1 Either Party shall be entitled to terminate the Agreement forthwith and to recover from the other Party the amount of any loss resulting from such termination for committing any offence under the Prevention of Corruption Acts 1889 to 1916 or the Bribery Act 2010 as amended or any associated legislation.

16. ARRANGEMENTS ON TERMINATION 16.1 The Council and the Education Institution agree that termination or expiry of the Agreement shall

not affect either Party's obligations which the Agreement provides shall survive the expiration or termination of the Agreement.

16.2 After termination or expiry all data, documents and records (whether stored electronically or otherwise) relating in whole or in part to the Services and all other items provided on loan or otherwise to the Education Institution by the Council shall be delivered by the Education Institution to the Council provided that the Education Institution shall be entitled to keep copies thereof to the extent that the information contained therein does not relate solely to the Services or to the extent that the Education Institution is required by law to maintain copies thereof or to the extent that the Education Institution was possessed of such data documents and records prior to the date of the Agreement.

16.3 The Education Institution shall retain all papers, files, records and vouchers relating to the provision of the Services as provided for under Clause 16.2 for the period of 6 years after the date of the termination of the Agreement and thereafter shall not destroy them but deliver them to the Council.

16.4 Where, in the opinion of the Council, the Transfer of Undertakings (Protection of Employment) Regulations 2006 (as amended) (“the Regulations”) is likely to apply on the termination or expiration of the Agreement the Council shall provide to the Education Institution accurate information relating to the employees who would be transferred under the same terms of employment under the Regulations, including in particular (but not limited to):

16.4.1 The number of employees who would be transferred, but with no obligation on the Council to specify their names;

16.4.2 in respect of each of those employees, their dates of birth, sex, salary, length of service, hours of work and rates, and any other factors affecting redundancy entitlement, any specific terms applicable to those employees individually and any outstanding claims arising from their employment;

16.4.3 the general terms and conditions applicable to those employees, including provisions, probationary periods, retirement age, periods of notice, current pay agreements and structures, special pay allowances, working hours, entitlement to annual leave, sick leave, maternity and special leave, injury benefit, redundancy rights, terms of mobility, any loan or leasing agreements, and any other relevant collective agreements, facility time arrangements and additional employment benefits.

16.5 The Education Institution shall take all necessary precautions to ensure that the information referred to in Clause 16.4 is given only to the replacement party to this Agreement who have qualified to offer for the future provision of Services. The Education Institution shall require that such replacement party to this Agreement shall treat that information in confidence, that they shall not communicate it except to such persons within their organisation and to such extent as may be necessary for the purpose of preparing a response to an invitation to offer issued by the Education Institution and that they shall not use it for any other purpose.

17. CONFIDENTIALITY

17.1 In respect of any Confidential Information it may receive from the other party (“the Discloser”) and subject always to the remainder of this Clause 17, each Party (“the Recipient”) undertakes to keep secret and strictly confidential and shall not disclose any such Confidential Information to any third party, without the Discloser’s prior written consent provided that:

17.1.1 The Recipient shall not be prevented from using any general knowledge, experience or skills which were in its possession prior to the commencement of the Agreement;

17.1.2 The provisions of this Clause 17 shall not apply to any Confidential Information which:- (a) Is in or enters the public domain other than by breach of the Agreement or other act or

omissions of the Recipient; (b) Is obtained by a third party who is lawfully authorised to disclose such information; or (c) Is authorised for release by the prior written consent of the Discloser; or (d) The disclosure of which is required to ensure the compliance of the Council with the

Freedom of Information Act 2000 (the “FOIA”). 17.2 Nothing in this Clause 17 shall prevent the Recipient from disclosing Confidential Information

where it is required to do so by judicial, administrative, governmental or regulatory process in connection with any action, suit, proceedings or claim or otherwise by applicable law .

17.3 The Parties acknowledge that both Parties are subject to the FOIA and acknowledge the respective Codes of Practice on the Discharge of Public Authorities' Functions (the “Codes of Practice”) and on the Management of Records (which are issued under section 45 and 46 of the FOIA respectively) and the Environmental Information Regulations 2004 as may be amended, updated or replaced from time to time (the “EIR”)

17.4 The Parties agrees that:

17.4.1 Without prejudice to the generality of Clause 17.2, the provisions of this Clause 17 are subject to the respective obligations and commitments of the Council under the FOIA, the Codes of Practice and EIR;

17.4.2 Subject to Clause 17.4.3, the decision on whether any exemption applies to a request for disclosure of recorded information is a decision solely for the Council;

17.4.3 The Parties shall co-operate with each other when a request has been made for information that relates to the Services and shall respond within five (5) Working Days of any request for assistance in determining how to respond to a request for disclosure.

17.5 The Parties shall and shall procure that its sub-contractors shall:

17.5.1 transfer any request for information, as defined under section 8 of the FOIA, or EIR (as appropriate) to the other Party as soon as practicable after receipt and in any event within five (5) Working Days of receiving a request for information;

17.5.2 provide the other Party with a copy of all information in its possession or power in the form that the other Party requires within five (5) Working Days (or such other period as the Council may specify) of the other Party requesting that Information; and

17.5.3 provide all necessary assistance as reasonably requested by the other Party to enable the other Party to respond to a request for information within the time for compliance set out in section 10 of the FOIA or EIR (as appropriate).

17.6 The Parties may consult with each other in relation to any request for disclosure of the Confidential Information in accordance with all applicable guidance.

17.7 This Clause 17 shall remain in force without limit in time in respect of Confidential Information which comprises Personal Data. Save as aforesaid and unless otherwise expressly set out in the Agreement, this Clause 17 shall remain in force for a period of 3 years after the termination or expiry of this Agreement.

18. DATA PROTECTION (subject to a review when General Data Protection Regulations come intoeffect in may 2018)

18.1 With respect to the Parties' rights and obligations under this Agreement, the Parties agree that the Council is the Data Controller and that the Educational Institution is the Data Processor in relation to Council Personal Data.

18.2 The Educational Institution shall comply with the Data Protection Act 1998 (the DPA) and any other applicable data protection legislation. In particular the Educational Institution agrees to comply with the obligations placed on the Council by the seventh data protection principle ("the Seventh Principle") set out in the DPA, namely:

18.2.1 To maintain technical and organisational security measures sufficient to comply at least with the obligations imposed on the Council by the Seventh Principle;

18.2.2 Only to Process Personal Data for and on behalf of the Council, in accordance with the instructions of the Council and for the purpose of performing its obligations under this Agreement and to ensure compliance with the DPA;

18.2.3 To allow the Council to audit the Educational Institution’s compliance with the requirements of this Clause 18 on reasonable notice and/or to provide the Council with evidence of its compliance with the obligations set out in this Clause 18.

18.3 The Educational Institution agrees to indemnify the Council and keep the Council indemnified against all claims and proceedings and all liability, loss, costs and expenses whatsoever incurred in connection therewith by the Council as a result of any claim made or brought by any individual or other legal person in respect of any loss, damage or distress caused to that individual or other legal person as a result of the Educational Institution’s unauthorised Processing, unlawful Processing, destruction of and/or damage to any Personal Data Processed by the Council, its employees or agents in the Educational Institution performance of the Agreement or as otherwise agreed between the Parties.

18.4 Both Parties agree to use all reasonable efforts to assist each other to comply with the DPA. For the avoidance of doubt, this includes (without limitation) the Educational Institution notifying the Council immediately upon becoming aware of a breach of this Clause 18 and the Educational Institution providing the Council with reasonable assistance in complying with subject access requests served on the Council under Section 7 of the DPA and the Educational Institution consulting with the Council prior to the disclosure by the Educational Institution of any Personal Data in relation to such requests.

18.5 The Educational Institution shall not cause or permit to be Processed and/or otherwise transferred outside of the European Economic Area any Council Personal Data without the Approval of the Council.

19. WARRANTY 19.1 The Education Institution warrants to the Council that it has all necessary corporate standing and

authorisation to enter into and be bound by the terms of the Agreement. Nothing in the Agreement shall create a relationship of agency or partnership or a joint venture as between the Education Institution and the Council and accordingly the Education Institution shall not be authorised to bind the Council.

20. GENERAL PROVISIONS 20.1 Save as required by law and/or the requirements of any relevant stock exchange, no publicity shall

be made by any of the Parties relating to any matter in connection with the Agreement without the prior written consent of the other Party.

20.2 Any decision, act or thing that the Council is required or authorised to take or do under the Agreement may be taken or done by any person authorised, either generally or specifically, by the Council to take or do that decision, act or thing, provided that upon receipt of a written request the Council shall inform the Education Institution of the name of any person so authorised.

20.3 Any provision of the Agreement which is held to be invalid or unenforceable in any jurisdiction shall be ineffective to the extent of such invalidity or unenforceability without invalidating or rendering unenforceable the remaining provisions hereof and any such invalidity or unenforceability in any jurisdiction shall not invalidate or render unenforceable such provisions in any other jurisdiction.

20.4 The failure by the Council or the Education Institution to insist upon the strict performance of any provision, term or condition of the Agreement or to exercise any right or remedy consequent upon the breach thereof shall not constitute a waiver of any such breach or any subsequent breach of such provision, term or condition.

20.5 Each Party shall bear its own expenses in relation to the preparation, execution and implementation of the Agreement including all costs legal fees and other expenses so incurred.

20.6 The Education Institution warrants represents and undertakes to the Council that there are no pending or threatened actions or proceedings before any court or administrative agency which would materially adversely affect the financial condition, business or operations of the Education Institution and that there are no material contracts existing to which the Education Institution is a party which prevent it from entering into the Agreement; and that the Education Institution has satisfied itself as to the nature and extent of the risks assumed by it under the Agreement and gathered all information necessary to perform its obligations under the Agreement and all other obligations assumed by it.

20.7 The rights and remedies provided in the Agreement are cumulative and not exclusive of any rights or remedies provided by the general law, or by any other contract or document. In this provision "general law" includes the law of a country other than England, and "right" includes any power, privilege, remedy, or proprietary or security interest.

21. PREVENTION OF BRIBERY AND CORRUPTION

21.1 Either Party shall be entitled to terminate the Agreement forthwith and to recover from the other Party the amount of any loss resulting from such termination for committing any offence under the

Prevention of Corruption Acts 1889 to 1916 or the Bribery Act 2010 or any associated legislation including but not limited to the Local Government Act 1972.

22. THIRD PARTY RIGHTS

22.1 The parties hereby declare that no term of the Agreement is intended by the parties to confer a benefit on any third party (as defined by the Contracts (Rights of Third Parties) Act 1999) nor is intended to be enforceable by any third party. The provisions of the said Act are hereby excluded.

23. LANGUAGE

23.1 English shall be the language of the Agreement and all documentation or information required or produced in the course of the Council's performance shall be in English.

24. NOTICES

24.1 Any notice to be given under the Agreement shall either be delivered by hand or by post or email. The address for service of each Party shall be its registered office or such other address as either Party may previously have notified to the other Party in writing. A notice shall be deemed to have been served: (a) if delivered by hand when left at the address for service of either Party; or (b) if sent by pre-paid first class post, at 9.00am on the second Working Day after posting; or (c) if sent by email at 9.00am on the next Working Day after sending.

24.2 For the avoidance of doubt clause 24.1 shall not apply to the service of legal proceedings.

26. GOVERNING LAW

26.1The construction, performance and validity of the Agreement shall be governed by English Law. The Parties submit to the exclusive jurisdiction of the Courts of England and Wales.

SCHEDULE 3 NOVATION AGREEMENT

THIS DEED IS MADE THE DAY OF 20

BETWEEN:

The Mayor and Burgesses of the London Borough of Enfield a local authority having its principal place of business at Civic Centre, PO Box 60, Silver Street, Enfield, Middlesex EN1 3XA (“the Authority”); and

[ ] an educational institute based at ] (the “Education Institution”); and

[ ] a company registered in England and Wales under number [ ] and having its registered office at [ ] (the “New Company”).

WHEREAS:

(A) The Authority has an agreement dated [ ] and referenced [insert contract number] with the Education Institution for the provision of [describe in brief the scope of Services] (the “Contract”).

(B) The Authority wishes to transfer [part of] its benefit and burden under the Contract to the New Company.

(C) The Education Institution and the New Company have agreed to such transfer upon the terms and conditions of this Deed.

2.2 The Education Institution releases and discharges the Authority from all demands and claims whatsoever in respect of the Contract and accepts the liability of the New Company in relation to the Contract in lieu of the liability of the Authority and agrees to be bound by the terms of the

2.4 The Authority transfers its rights and obligations under the Contract to the New Company.

The CLC provides Schools and Educational Establishments a full range of IT support services for all users – teaching staff, students including administration staff. We provide specialist IT Technical Support for both Curriculum and Admin Networks, supporting all Microsoft packages, Windows and Mac platforms, LGFL Support, MIS Support (Capita SIMS, ScholarPack and RM2 Integris). All our service packages are priced based on the size of school networks and number of users. We are now able to offer a selection of bolt on top up services that can be purchased and added to your selected plan.

CLC SLA options detailed below outlines your service plan and what will be included automatically within your selected support. You can be assured that all our team are fully qualified and education focused. The CLC prides itself in being able to provide jargon free solutions, we currently provide specialist support for over 10,000 users per term across a range of networks.

All our Technicians and Personnel are fully qualified and enhanced DB certified. All our staff are fully compliant with the Data Protection Act 1998 and fully conversant with Dfe policies and statutory requirements for child protection and health & safety. We are also fully conversant with the new GDPR regulations that come into effect in May 2018.

You can be assured that your data is protected, we confirm that no data is held by the CLC and we will never pass to any third party. Any access to school data is in accordance with our service agreement is secure.

CLC service agreements are available to purchase throughout the academic year with the added benefit of not being signed up to lengthy contracts, which means your pricing structure is based on your individual school requirements. We will always provide a high-quality service to regardless of your service option. Our Diamond service is a new offer exclusively designed for hub schools working together in partnership. We will mentor, support and propose any training that may be beneficial. This package provides a high level of service that will enhance all user’s knowledge base. Due to high demand The CLC have been requested by schools to offer CPD. This offer has been included automatically in our Technical Support Packages from 1st April 2018. Our new stand-alone service offer, is available to purchase from April 2018 No matter how good your computer systems are, or how fine-tuned your IT infrastructure is, if users are not confident or given new ideas to support learning then the technologies can’t be used to their full potential. By providing training to staff and children we offer an all-round continuous approach to moving schools forward with learning through technologies. Development of a new website or revamping your existing site does take time so we will be working closely with you and your nominated contact ensuring the layout, content and any media information is up to standard. Any delay in providing this vital content may affect the launch date. Throughout this process your input is important and vital to ensure a clean time line is achieved ready for use. The purchase price will be determined by your selection and associated costs.

Online Safety is a statutory requirement for all schools. The CLC can provide specialist training by our CEOP Ambassador Angela Poplar who has provided this service with over 12 years of experience working with schools and educational establishments and also within the Local Authority. The CLC offers a range of packages that can be purchased to suit your audience requirements. Teaching Staff, Governors, Pupils, Parents & Carers and SEN Staffing.

Education and training is the key to ensuring that children and young people stay safe online. We can provide a fit for purpose training/support sessions. Social Media is high on the list; children need to understand the importance of their digital foot print. Sessions will cover the impact of cyber bullying, gaming, social media, and mobile technologies. Sexting that is illegal and the implications of posting inappropriate images online and the impact this can have on families, with consistent relevant training and support these trends can be reduced and the harm that can be caused.

Parents, Grandparents and Carers must be also involved to combat this distressing trend. We will provide fully supported sessions that will encompass your school’s departmental policies including updated information on the latest trends.

The CLC offers up to date sessions. Ofsted inspection framework emphasises and focuses on safeguarding, including online safety. The CLC Technical Support and Educational service agreements are purchased under the agreed terms and conditions as provided within Traded Service Agreement. Please note that CLC Terms and Conditions will also be applied.

v The CLC reserves the right to change or amend any of its service options as described.

v The CLC on occasion may change your service day with reasonable notice and re schedule.

v The CLC may authorise fully vetted qualified contractors to complete specialist works agreed under the project management of CLC.

v Emergency call outs will be dealt with in priority allocation, excess exemption or charges are noted on your selected service plan.

v The CLC will endeavor to contact you 24hours in advance of any changes to our schedule or your service.

v CLC Technicians are required to use mobile phones in schools for service desk response.

v Technicians arrival/leave times including lunch break allocation is the responsibility of the CLC this includes any changes where necessary to complete our service provision. Additional hours or non-completed hours will be deducted or carried forward. This will be logged on your term IT service log. Hours owed by the CLC will be rolled over.

v Unused technical support purchased may be carried forward at the discretion of the CLC.

v The CLC are not responsible for the removal of redundant equipment, fixtures and or fittings during our project works undertaken, unless specified in your proposal.

v Any delay to commissioned works outside our control that could include Floods, Mains Power Failures, Adverse weather conditions that may impede our service delivery, additional charges may be applied at the discretion of the CLC for any replacement of services affected or additional hours required and may be chargeable for completion of said works. We are unable to take responsibility for any delays or additional costs involved that may be chargeable.

v 3rd party contracted works arranged by schools, the CLC cannot undertake any support required without pre-booking and liaising with our service desk in advance of said works. Supported attendance will be in addition and deducted from your service plan accordingly. We will not accept responsibility for works not being satisfactory completed.

v Health and Safety is paramount, if we deem that an area is unsuitable or may be unsuitable we will contact you and discuss any actions required on your behalf to ensure the safety of our workforce.

This service includes architects, building surveyors, mechanical and electrical services engineers, quantity surveyors, clerk of works and principal designer.

The Core Service includes:

• annual service contracts for mechanical and electrical services to ensure statutorycompliance, and assist with the efficient running of engineering plant and equipment.

• responsive maintenance service for day to day repairs, including the Careline and emergencycall-out service (24 hour / 365 days per year, operated from 8.00am to 5.00pm Monday toFriday and outside these hours through the Council’s partner, GDIT)

Additional services include:

• planned maintenance works for repair or refurbishment of buildings, mechanical orelectrical elements, funded through the schools budget

• projects – building adaptations and improvements for initiated changes to existingbuildings, or provision of new accommodation funded through the schools budget

• measured term contracts for responsive electrical and mechanical maintenance to includeboiler servicing, water monitoring, electrical testing and portable appliance testing. Thiscontract and the contract for Building Maintenance also includes a facility for procuringminor improvements priced through a discounted schedule of rates.

• A range of other contracts covering specialist maintenance servicing including lifts,fire alarms, security and CCTV, water risk assessments, and air conditioning.

Please note that whilst this SLA is offered on a “pay as you use” basis, the Core Service has to be taken in its entirety, consequently Responsive Maintenance is not available as a stand-alone service.

Early Years Social Inclusion

Early Years Social Inclusion (EYSI) is a multi-disciplinary team which is part of Enfield School Improvement Service. It supports schools in meeting the developmental needs of children facing difficulties in a range of areas including

• social, emotional and mental health (SEMH)• motor development• sensory processing• speech, language and communication (SLC)

The team is made up of colleagues from Health and Education and includes specialists in:

• nurture groups and attachment difficulties• Makaton and augmented communication• communicate in print and visual learning• multi-sensory and kinaesthetic learning• speech and language therapist• occupational therapist• physiotherapist

Much of our work is dedicated to early intervention, as well as enabling schools to meet the needs of children and young people who are at a delayed developmental stage. We work in a way which is flexible, responding to schools emerging priorities.

We support schools in the implementation of three evidence based, tried and tested interventions across Early Years and Key Stages 1, 2 and 3:

• Nurture Groups• Language and Social Skills groups (LASS)• Tiger Teams

In addition, bespoke training and support can be discussed and developed for use within schools.

Nurture Group Training, development and support: (up to 16 days, plus EP half day) £xx per year for LA Maintained Schools Nurture groups are a highly specialised, intensive and targeted Wave 3 SEMH intervention recognised widely by health teams as well as education. They form part of the local CCG offer and are named in Enfield’s Local Offer. Nurture group practice is based in the theories of attachment and child development, and enables many vulnerable learners to access the mainstream curriculum without the need of further intervention.

In line with Nurture Group Operational Policy and Procedure, Local Authority commissioned groups will need to consider and purchase the package outlined below in order to run their nurture group effectively. Description of Service

Enfield Education Welfare Service works in partnership with schools, agencies and families, offering a holistic approach to improving school attendance and maximising pupil’s opportunities to achieve and attain.

As well as performing our statutory responsibilities, we offer a traded service to academies and free schools. This covers direct work in schools, outreach work with families and associated follow up work. The amount of support provided is available at three levels:

Level one support includes: • school consultation,• outreach work with referred families• attendance clinics’ sending letters• liaison with other agencies.

Level two, in addition and includes:

• taking Team Around the Child (TAF) lead role for referred cases• attending professional, child protection and school inclusion meetings,• operating ‘coffee mornings’ for parents to raise importance of good attendance• contributing to school assemblies on attendance matters.

Level three, in addition, and includes:

• operating ‘Fast Track to Attendance’ advice and guidance on school policy and systems toaddress and improve attendance.

The Enfield Educational Psychology Service (EPS) is a specialist psychological service. The team is co-located and works closely with Enfield’s Specialist Multi-Disciplinary CAMHS as well as with other teams in Enfield

Enfield Council and other commissioners fund specific services from the EPS. This includes supporting the Council in delivery of its statutory duties and other core priority areas.

The Statutory Work of the EPS:

Schools and colleges can purchase further time from the Enfield EPS through a Service Level Agreement for non-statutory involvement. The full range of services available to purchase is detailed in the extended brochure. Below are some examples of the traded offer:

‘Consultation’ model of service delivery - a collective, joint problem solving approach which aims to develop a shared understanding and ownership of presenting issues that leads to improved outcomes. This model may include direct psychological assessment and/or intervention with the child or young person as well as separate consultations with parents and staff/partners.

This model is fully aligned with the SEND Code of Practice in supporting a graduated approach to the assessment and intervention of children and young people with SEND. It is usually the case that the EP will join an IEP review in the first instance.

Evidenced based or therapeutically informed interventions with individual or groups of children and/or parents which could include:

There is no cost difference for ad hoc purchases. Schools may wish to join together so that they gain the benefit of the discounted rates.

If the educational psychology involvement requires a written record, the time to do this activity needs to be factored into the time purchased. A full day is 6 hours which can be split up into half days to meet the needs of the school.

Schools need to request the number of days via the Traded Services Portal by 31.3.18, even if they are continuing with the same level of purchasing from the previous year.

Quality Assurance: • All EPs are registered with the Health Care Professions Council (HCPC) and have a duty to adhere

to the standards of conduct, performance and ethics, which includes keeping skills and knowledge up to date by attending service development days and regular CPD courses.

• All EPs receive regular supervision in groups and on an individual basis in order to monitor casework and quality assurance.

• Trainee educational psychologists who are enrolled on approved training courses work under thesupervision of qualified EPs within the team. We may also employ assistant psychologists to workunder supervision.

• All staff have an enhanced DBS.

• The service is compliant with data protection legislation.

• All staff annual leave entitlement and sickness is factored into the cost of the service.

• All staff attend regular team meetings to keep abreast with national and local developments.

• Enfield EPS participates in the British Psychological Society / Division of Child and EducationalPsychology ‘Quality Standards Framework’ to ensure quality and drive improvements through asupport/challenge peer review process.

Evaluation Evaluation of the EPS is through an on-line survey completed by the school following an episode of involvement. The outcomes of the survey are communicated in the annual report of the EPS, although the service routinely looks at the results so that the service is developed based on the feedback received. A children’s feedback survey has just being launched. We are continuing to review the way we work in collaboration with settings, schools and colleges and we welcome your feedback.

Direct work with children and families in the school / setting may include:

• assessment and short term therapeutic intervention (up to 6 meetings) to children, young peopleand their families. This may include undertaking an observation of a child in school.

• whole school or small group staff training (including support staff) focussing on understandingchildren and young people’s social, emotional and mental health needs.

• Staff consultation to discuss individual or groups of children, using structured approaches, e.g.Circle of Support, Reflecting Teams, Solution-focused problem solving, work discussion groups

• bespoke training and support for staff on topics related to children’s social, emotional and mentalhealth needs and their behavioural presentation. This could include topics like ADHD, depressionin childhood and adolescence, deliberate self-harm.

Outcomes of involvement could include:

• reduced exclusions and increased understanding of issues underlying the challenging behaviour.

• improved emotional well-being of the children and young people in your school.

• increased staff confidence, knowledge and skills in managing children’s emotional problems.

• reduced stigma around mental health throughout the organisation.

An annual evaluation is undertaken in partnership with schools and we are continually reviewing ways to evidence outcomes of the service.

This service delivers a high quality careers education, information, advice and guidance (CEIAG) to pupils, educational establishments and providers.

The service aims to:

• ensure careers advice contributes to pupils’ social mobility and economic prosperity• inspire pupils to succeed and make the right decisions at key transition points throughout

their education.• encourage and support pupils to set clear career goals, expectations and motivate them to

achieve examination results which reflect their full potential and meet their individual goals.• enhance pupils’ employability skills, economic resilience to maximise their personal and

career potential.• assist performance in OFSTED inspections and supports key impact measures such as the

Destination Measures.

Options of packages:

The Service has designed a range of CEIAG packages for which each educational establishment will have a bespoke package to meet the needs of their pupils and school, based on either the Core or Enhanced Package. Schools can access services in a variety of ways giving flexibility to ensuring the needs of the schools are met and delivery based on individual customised programmes.

The Core Package

• CEIAG delivery over two, three or four day’s service during term time to suit the operations ofthe school (any variation to this can be discussed with the Operation Managers).

The Enhanced Package

• in addition to the core package, an enhanced or bespoke package enables schools tocommit to a set number of additional days, at competitive rate that incorporate a wider varietyof options.

EMS works together with schools, academies and partner organisations to ensure that the Government’s vision for music education in England up to 2020 is met. The Government’s vision, as set out in the National Plan for Music Education, is to enable children (aged 5-18) from all backgrounds and every part of Enfield to have the opportunity to learn a musical instrument, to make music with others, to learn to sing and to have the opportunity to progress to the next level of excellence.

Enfield Norse (ENL) provides cleaning service to the London Borough of Enfield and schools within Enfield and adjoining boroughs. Enfield Norse is a Joint Venture (JV) company formed and owned by London Borough of Enfield and Norse Ltd.

The service provides schools, and colleges with work experience building links between businesses and education to deliver programmes for learners aged 14-19 years. Enfield Work Experience Team work alongside the Progression & Pathways Team to offer a range of high quality services aimed at brokering links between schools and employers/businesses that enables 14-19 year-old learners to benefit from an experience of the work environment. The team will support young people to be better prepared, especially at 17 and 19 for progression to further/higher education and employment.

The Enfield Work Experience Team works closely with other areas within the local authority to ensure the services offered are informed by discussions around the emerging employment growth sectors.

Description of Service

The Pupil Benefits Team determines entitlement of free school meals for children attending full time education. Parents are required to make an application which includes a request for the applicant’s national insurance number. Parents are not required to provide documentary evidence of the benefit they receive but must sign a declaration on the completed form. Enfield has access to a secure Eligibility Checking System that holds data from the Department for Work and Pensions, Home Office and HM Revenue and Customs.

On receipt of the completed application, the Pupil Benefits Team will use the DfE’s Eligibility Checking System to determine a family’s entitlement to free school meals.

If a family does not receive a qualifying benefit, the Pupil Benefits Team will confirm this with the parent and alert the school by secure file transfer detailing this. Once determined, families have a continuous entitlement to free school meals but are obliged to inform the school or Pupil Benefits Team of any change to their benefits. The Pupil Support Team will carry out termly checks on the Eligibility Checking System and will write to parents only if a negative return is received. Cancellation reports will be sent to schools by secure file transfer. For those who apply and are not entitled, parents will be advised of this.

The Team provides advice and guidance to schools and parents on the procedure on application and qualifying benefits. FSM entitlement reports are provided to all schools at the beginning of the year. However, entitlement reports can be provided on request at any time.

In order to manage these new requirements, there is a statutory requirement for each organisation to have a named independent Data Protection Officer (DPO) who will the legislative requirements are being met within the required timescales. The service on offer aims to support schools to fulfil the statutory DPO role as required by the GDPR. With this in mind, the provision of DPO (shared) as provided by the Local Authority includes: • act as conduit to Information Commissioner and Public • ensure that training is made available and that awareness is raised • inform, advise and issue recommendations on Data Privacy • monitoring compliance Initially, considerable compliance work is needed and for this reason the cost for Year 1 is high. The work that will be supported includes: • Assistance with creating required data catalogues, privacy impact assessments, privacy notices and

consent documents to comply with the new law. • Creation of documentation for Subject Access Requests and other enquiries. • Review of existing consents etc. to determine if they need to be renewed or are compliant with

Clerking Advice and Support

Depending on your level of buyback you will be able to access support for all Governing Body (or Board) and Committee meetings with the additional flexibility for the unexpected meetings e.g. exclusions and disciplinary meetings. You will also be able to access professional advice by contacting the service during office hours.

Our Clerks / Governance Advisors provide procedural advice as part of agenda preparation for Governing Body and or Committee meetings with the production of model agendas and dissemination of Governing Body minutes and related papers. As part of ongoing support, you will also receive regular information and educational updates in addition to support in producing and approval of Instruments of Government and model policies.

Clerks will attend meetings, take notes, give procedural advice and produce minutes of meetings within agreed timelines as set out in our Service Level Agreement.

The Governor Professional Learning and Development Programme

Through your buyback you will have unlimited access to all centrally held training sessions available for booking through GovernorHub and e-learning via Modern Governor (in association with the Learning Pool) – (Option to ‘opt out’ of e-learning available). The cost of this programme is displayed on the Schools’ Portal under the general heading of SIS Professional Development Programmes along with the other Professional Development Programmes SIS offers to schools.

The Insurance & Risk Management Team are committed to delivering an efficient, effective and high quality service that meets customer needs, corporate priorities and statutory requirements.

Period of Agreement

The agreement will run from 01 April 2014 to 31 March 2019* but remains subject to the usual annual insurance renewal process, unless otherwise varied or purchased during the period by agreement. * Following a tender exercise, the Council entered into a 5-year Long-Term Agreement with external insurers with

effect from 01 April 2014. This means the insurance arrangement, to include policy numbers, may remainunchanged until 31 March 2019. Any changes during the contract duration will be communicated to schoolsseparately.

Costs are recharged on the following basis.

Actual insurance premiums for the year are known when the annual insurance renewal and negotiation process is complete, usually just before the start of a new policy year (April). Internal Audit provides assurance to all levels of management about the adequacy and effectiveness of operations, compliance with laws and regulations, accuracy and reliability of management reporting, and the safeguarding of assets and other interests.

There are two services available:

1. Internal Audit review of the School’s internal control environment, by undertaking a range ofindependent reviews which evaluate the Schools’ internal control framework. The objective,independent review will cover a range of major systems within the School, to ensure compliance withpolicies and procedures and to ensure good financial practices are applied throughout.

Examples of processes that can be covered by the audit are:

Governance, to ensure that:• Roles and responsibilities of the Governing Body and sub-committees are clearly defined.• Governance meetings and minutes demonstrate discussion and decision making to ensure the

school meets all its statutory obligations and complies with the financial regulations. • A complete and up to date register of business interests of all governors, and staff with financial

responsibility, is maintained at the School.

Budget setting & Financial monitoring, to ensure that: • Good financial management exists, including the provision of regular budget reports, which are

reviewed by senior management and the Governing Body.

Expenditure, to ensure that: • Expenditure is legitimate, complies with relevant policies and procedures and is authorised

appropriately. • Governing Bodies have the opportunity to review expenditure in their school to determine that the

school’s resources are well spent and provide value for money.

Cash & Bank, to ensure that: • Bank balances are managed to ensure that the school does not become overdrawn.• There are appropriate controls in place for reimbursements to staff and the various types of

business / debit cards in operation at the school.• Appropriate separation of duties exists to reduce the risk of error and fraud.

Income, to ensure that: • Charges are levied in line with agreed scales and income is banked promptly and in full.• Accurate records of all income due or collected are maintained by the school.• Appropriate separation of duties exists to reduce the risk of error and fraud.

The service is provided by Enfield Council’s in house legal service which is responsible for providing legal advice to the Council in respect of the whole range of its functions. The service forms part of the Chief Executive’s Group (CEX), and the Director of Law and Governance reports directly to the Chief Executive. Legal Services adheres to the procedures as laid out in the Council’s Constitution.

VFM and Benchmarking

Legal Services collect benchmarking data to evidence efficient use of resources and demonstrate VFM where this is available.

The Service is available to participating schools and for a fixed sum. Works can be commissioned under the categories set out in the Trading Agreement above.

1.1 This SLA is set to run for the financial year 2018 -2019 and you will be charged for this period only with no carry-over of initial fees or hourly rate charges between other financial years

You will be charged an initial sum of £3885 for Secondary Schools, or £1040 for Primary and Special schools. During the year, any legal work will be offset against this initial figure using the hourly recharge figures set out in SLA.

If the amount recharged exceeds the initial sum, you will be recharged on a monthly basis based upon the hourly rates set out in the SLA.

The following costs are not covered by the Annual Fee:

• Barristers’ and other professional fees, including the cost of reports;

• Legal costs awarded against the School in any case or tribunal

The initial sum is not refundable and an invoice for this amount will be issued in November of the SLA year.

This summary of the Payroll Service will be supported by a detailed Service Level Agreement (SLA).

Description of Service

• calculation and payment of salaries, subsistence and expenses to all school employees inaccordance with national and local agreements.

• interpretation and implementation of pay awards, annual and six-monthly increments andother global changes, and the calculation of payment of arrears.

• periodic recalculation of hourly fractions to term time employees regarding changes toholiday entitlement.

Some pests such as insects and rodents pose a potential health hazard. They can infest and ruin foodstuffs and cause serious structural damage to buildings.

The Council’s Pest Control Team provide a professional and competitively priced service for the treatment of pests such as rats, mice, cockroaches, wasps, pharaohs’ ants and others.

Through a Service Level Agreement, we will proactively inspect your premises at appropriate intervals for signs of pests, undertake any treatment needed and offer advice and make recommendations to assist you in keeping your premises pest free.

Options of Packages

Each annual agreement (contract) is ‘bespoke’ dependant on the needs of the client. Please contact us for a free quote.

Benefits of using the Service:

The main benefit of having a pest control agreement is that your premises will be routinely checked proactively for signs of pests and treated as needed. However, if you see signs of pests between visits you can ring the Pest Control Team and we will attend at the earliest opportunity.

Premises preparing or serving food are required under Food Hygiene legislation to ensure that their premises and food is not exposed to the risk of contamination from pests. Premises that do not have pest control arrangement such as those that have developed serious pest infestations have been closed down under Food Hygiene legislation until the infestation is under control. This poses a reputational risk, risk of legal action, financial risk and severe operational difficulties.

The school swimming service assists schools in achieving the National Curriculum requirement for every child to be able to swim 25m competently and confidently using a number of strokes and be able to perform self-rescue in a water-based situation by the end of KS2.

The lessons are generally 30 minutes in duration for 15 weeks of the year and delivered by qualified instructors in the following Enfield pools: Albany, Arnos, Edmonton, Southbury and Southgate.

Description of Service

• The School Admission Appeals service is offered to all non-local authority maintained / voluntaryaided controlled schools. These schools are responsible for making arrangements for an IndependentPanel to hear a parent appeal against a decision not to admit their child to the school.

• Appeals are heard for either primary schools or secondary schools. They can be for children startingschool in September, or for children wishing to enter the school at any point throughout the academicyear.

• Appeal hearings follow a prescribed format of the admission authority or their representativepresenting their case, and then being asked questions, and then the parents/ carer presenting theircase and questions can be asked of them. The aim of the hearing is to hear all the evidence in a fair,but firm, manner and allow both parties an opportunity to state their case.

Benefits of using this Service The Council’s service operates well established procedures and practices for arranging School Admission appeals and has now planned hearing dates throughout the whole academic year which also helps to give schools as much advance notice as possible. The Council’s service has a proven track record of successfully arranging admission appeals within the requirements of the School Admission Appeals Code and has built up a large pool of experienced and trained independent panel members.

We provide a full service which covers matters such as contacting the parents and dealing with all queries and bookings relating to the hearing so we require little from the school aside from producing necessary paperwork and attending the hearing on the day. To underpin our role of supporting schools to raise achievement for all children and young people we offer four professional learning and development SLA packages. In addition, we offer bespoke school based professional development and consultancy for school improvement, please contact us for details.

We also provide a School Improvement Advisor Service Package to Enfield Primary Academies, Secondary, Special and Academy/Out Borough Primary (this service is without charge to Enfield LA Maintained Primaries as funded via DSG). Our packages for 2018-19 are:

1. The Professional Development Programme for Teachers, School Leaders including SBMs2. Teaching Assistants and School Support Staff Development Programme

3. The SEND/Inclusion Professional Learning and Development Programme4. Governor Professional Learning and Development Programme5. School Improvement Advisor Service Package for Secondary, Special & Academies

We are collaborating with the Teaching Schools Council and DfE regarding the new apprenticeship frameworks for the schools’ workforce to enable Enfield schools & academies to access their Apprenticeship Levy for TAs, school business management and teacher CPD. These arrangements will not be finalised by the DfE before summer 2018. We are a recognised provider of apprenticeships and will therefore supplement our SLAs once the DfE issues the necessary guidance. The apprenticeships we offer will be heavily subsidised for buyback schools & academies.

School Standards & Support Service Professional Learning and Development SLAs The Service offers a range of Professional Learning and Development opportunities which schools can purchase as Service Level Agreements (SLAs) also referred to as the “buy-back” arrangements.

The SSS Professional Learning and Development SLAs has four distinct elements all of which are available separately.

1. The Professional Development Programme for Teachers & School Leaders incl SBMsAccess to all the sessions and events listed in the Enfield Professional Learning Programme 2018-19 which will be published and made available to schools online by the end of the Spring Term, to include:

Information Regarding NQT Programmes and Appropriate Body Fees The NQT Development programme provides NQTs with an opportunity to:

• network across the borough and develop links with NQT colleagues in other schools.

• develop their knowledge of key issues in relation to education practice on a local andnational level.

• gain practical advice and skills to enable effective teaching and learning.

• reflect on and improve their classroom practice.

A team of experienced advisors and school based colleagues deliver and contribute to the NQT programme at both secondary and primary level. As well as access to the NQT Development Programme this SLA includes the NQT Appropriate Body fees for all your NQTs. For NQT Induction Quality Assurance purposes the SSS will observe a sample of NQTs in each setting and will also fulfil its obligations as outlined in the Induction Regulations specified in the Responsibilities of the Appropriate Body. The NQT Professional Development Programme is published as a separate document in the summer term each year and be viewed online via NQT Manager. The charges for the NQT Professional Development Programme are covered by this SSS SLA.

For schools opting not to purchase the SSS Professional Development for Teachers, School Leaders including SBMs SLA we offer the option to the purchase from us the statutory NQT Appropriate Body function.

The Appropriate Body has the essential quality assurance role within the Induction process and it is responsible for insuring that schools are aware of, and can meet, the requirements for NQT Induction as stipulated in the relevant DfE guidance. We also provide training and ongoing support to Induction tutors/coordinators and mentors via regular briefings.

The NQT Appropriate Body fees are charged per NQT per term and are only charged to those schools who opt not to purchase this SSS SLA.

Purchasing the 2018-19 Governor Professional Learning and Development Programme will give a school’s governors access to:

This service provides educational establishment’s access to a comprehensive health and safety support service, with a training programme that meets legislative requirements.

The service will be delivered by fully qualified officers who have detailed knowledge of Employment, Health & Safety law, the policies and procedures of a local authority, and will provide support on health and safety issues, safeguarding against exposure to risk of prosecution where suitable and sufficient support is not otherwise available. As part of the local authority dealing with schools, we are experienced in the application and requirements of legislation and how it can be effectively applied in this specific context. Community schools receive this service at no charge and do not need to indicate that they require this service. For academy, voluntary aided, or foundation schools, the standard service can be bought for an agreed fee with a separate additional arrangement for bespoke services and visits.

Asbestos Service- In addition to the Health and Safety service there is an option for our Asbestos Service that includes: surveying, monitoring, training, consultation; and provision of, and support with, Asbestos Management Plan and reports together with access to an online system holding records of your asbestos register and surveys.

The Service

Community and Voluntary Aided Schools

The two main elements are available separately:

a) Advice and Employment Documentation Service which provides online, telephone andface –to-face support covering for example:

• production of policies, procedures and guidelines

• advice and guidance on pay and conditions

• attendance at disciplinary, grievance and redundancy hearings

• processing advertisements

• necessary employment checks e.g. Asylum and Immigration Act, have been carriedout

• processing starters, changes to and terminations of service

b) Primary School Supply Pool

The service provides supply teachers and relief support staff. It deals with recruitment andselection to the Pool, completion of all relevant paperwork and any complaints or issuesarising as a result of deployment from the Pool.

Schools Personnel provide a number of centrally funded services including the NQT Pool.

Foundation schools

The service offers an advisory service including advice and guidance on pay and conditions, attendance at disciplinary, grievance and redundancy hearings.

Enfield Council offers a reliable local waste collection service with flexible contract terms, no hidden charges and a wide choice of bin sizes to suit all needs. We also offer a fully co-mingled recycling service.

Our waste service operates from Monday to Friday between the hours of 6am and 4pm. This service allows a minimum term time weekly collection and the cost of the service includes delivery of container and an annual waste transfer note.

Options of packages

Our service offers the following bins:

• 360 litres, 660 litres, 940 litres, and 1100 litres for general refuse term time collection

• 1280 litre bin for co-mingled recycling term time collection

This service is for Academies, Free Schools and other non-maintained schools Trade Union representatives have a statutory right to reasonable paid time off from employment to carry out trade union duties and to undertake trade union training. Historically funding for facilities time for trade unions representing school based employees at a local/branch level have been primarily funded through the Dedicated Schools Grant, however funding regulations state that non-maintained schools are not able to de-delegate monies back to Local Authority to administer Trade Union Facilities Time As such we facilitate a service through which academies, free schools and other non-maintained schools can ‘buy in’ to a pooled service that shares the costs of teaching and non-teaching Trade Union facilities time. The service provides an effective route for statutory and collective consultation and bargaining, a framework and structure for non-maintained schools to manage industrial relations and access to branch official from recognised unions, it includes: Consultation, negotiation and representation, for trade union members on matters connected with terms and conditions, including: • pay • hours of work • holidays and holiday pay • sick pay arrangements • pensions • equality and diversity • notice periods • the working environment • job evaluation • local agreements (e.g. Teaching Assistant /Nursery Nurse agreements) • Health and Safety Attendance and representation at meetings with and on behalf of union members in relation to: • grievances • disciplinary • attendance management • restructuring and/or redundancy • pay & grading appeals • TUPE transfers • Health and Safety and any other industrial relations issues where school-based employees have a statutory right to representation.

Alternative arrangements: Any non-maintained school not purchasing the service needs to ensure there are adequate arrangements in place for trade union facilities. The handling of any industrial relations matters will revert to a school based official or regional representatives and has the potential to lengthen the process. Schools will be responsible for making their own arrangements for covering work areas/tasks and costs associated with release of officials for representation or training.

Trade union representatives employed within the school will be entitled to undertake the full range of functions listed within this document and training from their respective union. It is estimated that a school based representative for a school not buying back would need cover for approximately 8 days of training per official.

Period of Agreement To manage provision time effectively the service agreement will need to be in operation for one full year and will require a minimum of six months’ notice of termination. The current Service Level Agreements operates from 1 April 2017 to 31 March 2020, unless otherwise varied or purchased during the period by agreement.
