A. ELIGIBILITY FOR PARTICIPATION:
1. Any person legally competent to enter into a contract will be eligible to
participate in auction.
2. In case of a group of persons, the name of all the persons making the bid must
be given with complete specification of shares alongwith all necessary
supporting documents. The person making the bid should submit a valid legal
Power of Attorney authorizing him to bid on behalf of other persons and also
copy of PAN card of the applicant.
3. In the case of bid on behalf of a Firm or Company or an Association etc., the
bidder shall furnish certified copy of Board Resolution/Authorization in favor of
the person making the bid along with the certified copy of Memorandum of
Association/Articles of Association of Company, Partnership Deed, HUF etc, as
the case may be and that the bidder has the Authority to bid and enter into an
agreement of sale of its behalf.
B. HOW TO PARTICIPATE:
Users are advised to go through links “Help for contractors” and “Information
about DSC” on https://eauction.gov.in
1. Pre-requisites:
a) Digital Signature: In case of online e-Auction/tendering, it is mandatory
to obtain a digital signature (minimum Class-II having signature and encryption
both) from Government of India certified issuing authority. If the digital
certificate issued to the authorized user of a firm is used for signing and
submitting a bid, it will be considered equivalent to a no objection certificate /
power of attorney / lawful authorization to that User. The firm has to authorize
a specific individual through an authorization certificate signed by all partners
to use the digital certificate as per Indian Information Technology Act 2000.
Unless the certificates are revoked, it will be assumed to represent adequate
authority of the user to bid on behalf of the firm in the department tenders as
per Information Technology Act 2000. The digital signature of this authorized
user will be binding on the firm.
b) Sign-up: The applicant will have to obtain user ID and password for the
Bid Process by registering on e-auction portal i.e. https://eauction.gov.in (by
clicking “online bidder enrolment” link). On successful creation of user ID, user

will have to login and map its digital signature (signing and verification both) to
proceed to successful login.
c) The desktop or Laptop of the user should have Firefox 46.0.1 and Java
Runtime Environment (JRE v8_update_151). Portal may not work properly if any
other version of Firefox or JRE is installed (even the newer version may not
work).
ii. Payment towards auction fee amounting to Rs.1000/- and Earnest Money
deposit will be required to be deposited for participation in e-auction through
offline mode either by RTGS/NEFT in favour of HSIIDC Limited in Vijay Bank,
Sector-11, Panchkula or Demand Draft payable at Panchkula and detail thereof
will need to be entered by the applicant on the auction portal within the
stipulated period.
iii. Applicant will be required to forward the documents as regard to detail of
payment made and eligibility documents through Post/Courier at Head Office of
the Corporation situated at C-13-14, Sector-6, Panchkula and same should reach
as per schedule detailed above.
iii. The envelope containing confirmation of payment of bid security (EMD), e-
auction fee and eligibility documents in reference to the usages in favour of
HSIIDC

C. RESERVE PRICE AND DETAIL OF THE SITES:

* Size of the sites is tentative and actual size will be as per demarcation or at the time of
physical possession.
The Corporation may without assigning any reason withdraw any or all the sites from auction at any stage. HSIIDC reserves the right to accept or reject any or all the bids or cancel/postpone the auction without assigning any reasons thereof.
** An applicant is eligible to participate in more than one site by depositing a single EMD
for the same size of the sites in a particular Estate and in case of being the highest bidder in more than 01 site, he/she would need to make payment for all such sites as per clause ‘D’. In case of failure, EMD so deposited shall stands forfeited.
Note: 1. Kindly amend the EMD amount in case it is shown more than the amount as per brochure details. Such amount need to be edited by the applicant to the appropriate value as per choice of site by the applicant before making any payment.
2. Auction fee is Rs.1000/-per e-Auction. Kindly amend the Auction Fee amount in case it is shown more than the Rs.1000 per e-Auction Such amount need to be edited by the applicant to the appropriate value i.e. Rs.1000 per e-Auction.
D. PAYMENT TERMS:
1. The highest bidder shall be required to remit an amount equivalent to 10% of
his quoted bid amount by 5.00 PM on 11.10.2019 by way of online payment via
RTGS/NEFT as detailed in Annexure-II (after adjustment of EMD deposited by
the highest bidder). Kindly note that in case of being the highest bidder in more
than 01 site, he/she would need to make payment for all such sites. In case the
highest bidder fails to deposit the said amount as specified above, his/her bid
shall stand rejected and the EMD deposited by him/her for participation in the
auction shall stand forfeited to the Corporation.
2. In addition to the above said payment of 10% of the quoted bid amount, the
highest bidder shall be required to furnish the below mentioned documents:
i. Self-certified copy of PAN card and passport sized photo of applicant/authorized signatory.
ii. In the case of bid on behalf of a firm or company or an association etc., the bidder shall furnish the certified copies of Board

Resolution/Authorization in favour of the person making the bid along with the certified copy of Memorandum of Association/Articles of Association of Company, partnership Deed, HUF etc as the case may be and that the bidder has the authority to bid and enter into an agreement of sale of its behalf.
iii. The above said documents would be required to be sent by the successful bidder(s) either at the registered office or respective field office of the Corporation within a period of 7 days of close of auction and the Regular Letter of Allotment in favour of the bidders would be issued only after the Corporation receives the said documents to its satisfaction.
3. After acceptance of the bid, the successful bidder will further be required to
deposit another 15% of the quoted bid amount within 30 days of the date of
Regular Letter of Allotment by way of RTGS/NEFT/OTC/NET Banking with Bank
account as detailed in Annexure -II. This period is further extendable by 30
days after obtaining specific written approval from HSIIDC in which case
allottee will be required to deposit the 15% of the bid amount along with
interest @15% p.a. for the extended period, failing which the 10% amount
already deposited shall stand forfeited to the HSIIDC and the successful bidder
shall have no claim to it or for damages.
4. The allottee shall deposit additional 25% of the price of the unit within sixty
days from the date of issuance of allotment letter; in case of delay in
remittance of payment, delayed interest @15% p.a. shall be payable which shall
be compounded on the instalment dates towards balance 50% price of the plot;
5. Thereafter the balance 50% amount can be paid either in lumpsum without
interest within ninety days from the date of issuance of allotment letter
OR
In four equal half yearly instalments within two years from the date of issuance
of allotment letter, due on 30th June and 31st December each year. Interest
@12% p.a. (or as amended from time to time) on the balance amount shall be
payable along with the instalment, from the date of offer of possession. In case
the bidder/allottee chooses the option to make the payment in instalments, he
would be required to furnish four separate bank guarantees, each coterminous
with each instalment in favour of HSIIDC equivalent to the 50% of the Bid Price
and the period of the bank guarantee shall be more than the payment period of
the instalments. Any delay in payment shall carry delayed interest @ 15% per
annum, compounded half yearly on the amount in default for the defaulted
period.
6. In case the instalment is not paid within 6 months of the due date, the plot is
liable to be resumed.

7. In the event of default or breach or non-compliance of any of the terms and
conditions as indicated or for furnishing any wrong or incorrect information at
the time of auction, HSIIDC shall have the right to cancel the bid and forfeit
whole or any part of the amount paid.
8. The conditions for erection of building on the auctioned site shall be governed
by zoning plan of the site. The plans shall be got approved from the Director
Controlled Area-cum-MD, HSIIDC.
9. The EMD of un-successful bidders shall be refunded in their account as per
details provided by them at the time of payment of EMD.
10. The EMD of the highest/successful bidder shall be retained towards part sale
consideration.
11. The EMD shall not bear any interest.
E. PERIOD FOR PROJECT IMPLEMENTATION:
1. The allottee will have to complete the construction of covered area as per his
project report (the minimum covered area should be 25% of the total
permissible covered area), obtain occupation certificate & start operations
within 5 years from the date of offer of possession of the site, after getting the
plans approved from the competent authority.
2. However, in case the allottee fails to complete construction of 25% of the
permissible covered area within a period of 5 years from the date of offer of
possession of the site, the allottee shall be entitled to further extension in
permissible period of construction by three years, on year to year basis, on
payment of applicable extension fee.
3. That in case of non-completion of stipulated construction within the
available/extended period, the same shall be treated as violation of terms and
conditions of allotment and plot/site shall be liable for resumption.
F. EXTENSION FEE:
1. Extension fee shall be as per EMP-2015 as applicable to Institutional sites.
G. TRANSFER AND TRANSFER FEE
1. The transfer of site shall be governed as per provisions of Estate Management
Procedures-2015 of the Corporation as amended from time to time and
applicable to Institutional Sites.
H. RESUMPTION OF SITE:
1. In the event of non-payment of any amount due within the stipulated period or
on breach of any of the terms and conditions of allotment, it shall be lawful for

the HSIIDC to order resumption of plot/site.
2. Upon resumption of the site/built-up premises, the allottee would be entitled
to refund of the amount deposited towards the price of the site including
interest and penal interest, if any, deposited by the allottee on instalments,
without any interest by the Corporation, after deducting 10% of the price of the
site. In addition to the above, maintenance, water/sewer charges, in default, if
any, shall also be deducted from the refundable amount. In cases where the
site is resumed along with the structure constructed thereon, the allottee shall
be at liberty to remove such structure from the site at his own cost within a
reasonable time of three months, failing which the Corporation may get the
cost of construction of the building assessed from approved Valuer/ Chartered
Engineer and pay this amount to the erstwhile allottee. In such cases, the re-
allotment price of the site will be inclusive of the amount so paid by the
Corporation to the erstwhile allottee.
3. An appeal against resumption of plot/site shall lie before the committee
headed by Secretary Industries, Haryana with Director Industries, Haryana and
Managing Director/Haryana Financial Corporation as the other members. The
appeal shall be filed in the office of Secretary Industries, Haryana, within 90
days of the resumption order.
I. SURRENDER OF SITE:
1. The provisions of surrender would be as per Estate Management Procedure (as
amended from time to time)/decision of Board of Directors of the Corporation
as applicable to Institutional sites.
J. OTHER TERMS & CONDITIONS:
1. The HSIIDC shall have the right to accept/reject any bid or withdraw any/all
sites from auction on the spot without assigning any reasons.
2. The land/building shall continue to vest in the HSIIDC until the entire
consideration money, together with interest and other amount, if any, due to
the HSIIDC on account of the allotment/sale of such land or building or both is
paid.
3. The allottee shall have the right to mortgage the plot in favour of banks/FIs
subject to the condition that the HSIIDC shall have first charge on the plot for
recovery of its dues and the charge of the bank/FI shall be second/sub-
servient. Further, the allottee shall get the deed of conveyance executed in its
favour before creating mortgage of the plot/shed. The mortgage to be created
by the allottee in favour of Bank/FI shall be without prejudice to the rights of

the Corporation in terms of the RLA/deed of conveyance in respect of the
plot/shed in question. In the event of auction of the property by the bank/FI
for recovery of its dues, the Bank/auction purchaser shall be required to clear
the dues of the Corporation in respect of the plot as the purchaser shall be
stepping into the shoes of the allottee. The auction purchaser shall utilize the
plot/premises for permissible activities only and in case the project was not
completed by the allottee, the auction purchaser shall be required to complete
his project within two years of re-allotment of plot in its favour, failing which
the provisions relating to grant of extension as provided in clause 16.4 (iii) of
Estate Management Procedure-2015 shall be applicable.
4. The allottee shall pay the maintenance charges as applicable in the estate.
5. On payment of 100% price of the site, the Deed of Conveyance in the prescribed
form and in such manner as may be directed by HSIIDC shall be executed. The
charges for registration and stamp duty will be paid by the allottee. Execution
of conveyance deed will be mandatory within a period as specified in EMP as
applicable after making full payment towards cost of site and clearance of all
other dues, if any.
6. Sites will have to be constructed as per zoning plan/approved plans and the
successful bidder/allottee shall not make any alterations/additions to the
structure erected on the site without prior/explicit written permission of
competent authority.
7. Offer will be received subject to the reserve price and to the right of the
Competent Authority, HSIIDC to accept the bid up-to or beyond such reserve
price. The HSIIDC may reject any bid/even the highest bid or withdraw any or
all the sites from auction without assigning any reason.
8. The site shall not be used for any purpose other than that for which it has been
allotted. No nuisance activity shall be carried out on site/building.
9. The site shall not be subdivided or fragmented under any circumstances.
10. HSIIDC will not be responsible for levelling the uneven sites.
11. Allotment of site will be done on ‘as is where is basis’.
12. Allottee shall have to pay all general and local taxes, rates or cesses imposed or
assessed on the said site and building by the competent authority including
applicable maintenance charges.
13. There has been increase of FAR from 100 to 150%. Allottee will be liable to pay
rates proportionately as and when decided/demanded by HSIIDC on account of
increase in FAR, in case of availing FAR from 101% to 150%.

14. Allottee will be liable to pay the amount, if any, found in arrears on account of
calculation mistake or any other account or otherwise without questioning the
period to which it may relate.
15. Allottee shall not make any alterations/additions to the structure erected on
the site without prior/explicit written permission of the competent authority.
16. The Government Polices and National Health Program like family welfare,
immunization etc. shall be implemented as per policy guidelines issued by
State/Central Government from time to time.
17. One representative each from Health Department, Haryana, HSIIDC and Distt.
Administration shall be taken in the Committee/Board, managing the
affairs/functioning of the Hospital.
18. The allotment shall be governed by the provisions of EMP-2015, as amended
from time to time Estate Management Procedure (as amended from time to
time)/decision of Board of Directors of the Corporation as applicable to
Hospital sites.
19. Board of Directors of the Corporation/State Govt. is authorized to
change/modify any of the condition (s) of the Estate Management Procedures
(EMP) applicable to such sites without any notice.
