Do California Employers Need to Worry About Federal Electronic Injury and Illness Reporting Requirements?California employers have many questions about whether the federal Occupational Safety and Health Administration’s (OSHA) electronic reporting requirements currently apply to them. The short answer is no — California employers don’t need to follow the federal requirements at this time.First, some background: In 2016, OSHA issued a final rule regarding the tracking and reporting of workplace injuries: Electronic submission — rather than paper submission — of injury and illness data, also known as the Log 300, will be required. Covered employers with 250 or more employees will be required to electronically submit the OSHA Form 300, 300A and 301. Certain smaller employers in industries with high rates of injuries and illnesses will be required to electronically submit the OSHA Form 300A.The federal electronic reporting requirements are phased in over a two-year period. Initial federal reporting requirements set for July 1 of this year were moved to December, and the current federal administration is also reviewing the final rule.So what does all of this mean for employers who are governed by California’s Division of Occupational Safety and Health, better known as Cal/OSHA?Federal OSHA has given states that operate their own safety and health programs, such as California, extra time to implement the new requirements. The federal compliance dates don’t apply to California employers.According to Cal/OSHA, California employers are not required to follow the new federal requirements and will not be required to do so until “substantially similar” state regulations go through the formal rulemaking, adoption and approval process.“California employers are not affected by the federal OSHA extension date because the new requirements have not yet been adopted or approved in California,” said Department of Industrial Relations Public Information Officer Frank Polizzi to the Cal-OSHA Reporter.Cal/OSHA drafted a proposed rulemaking package to conform to the revised federal OSHA regulations. The package is being reviewed internally before the formal rulemaking process and public comment period begins.Until Cal/OSHA implements the federal changes here in California, the federal rules will not be enforced. Employers should be on the lookout for California’s implementation of these federal rules.
California could ban gasoline cars In January, when the California Legislature reconvenes, Assemblyman Phil Ting, D-San Francisco, plans to introduce a bill that would ban new vehicles that run on gasoline or diesel after 2040.Automakers may not be too far behind.Last week, Ford said it would reduce spending on internal combustion engines by a third, as it introduces 13 new electric and hybrid models in the next five years. General Motors promised at least 20 new electric models by 2023; Executive Vice President Mark Reuss said GM “believes in an all-electric future.”Other manufacturers, from BMW to Volkswagen, also have announced substantial electric vehicle initiatives. Volvo has said it will end production of cars with internal combustion engines starting in 2019. Jaguar Land Rover cars will be available in electric or hybrid versions by 2020. And Palo Alto’s Tesla continues to pump out emissions-free vehicles, with its $35,000 Model 3 — the most affordable car in its lineup — just starting to reach customers.“There has been a paradigm shift,” said Daniel Sperling, a transportation expert at UC Davis.

• Obtain, maintain, and manage data, information, communications, and approvals required by project and company requirements between owner, architects, engineers, and contractors/subcontractors, or other project related entities.
• Analyze and evaluate proposals from subcontractors and quotes from vendors.• Ensure contractor, architect, engineer, and provider contractual requirements in areas of estimates, cost
specifications and valuations. Participate in negotiations when applicable and necessary.• Strong computer skills and familiarity with Microsoft Office Suite products, and experience with cost and
project related systems. Advanced capability in estimating programs such as Heavy Bid by HCSS.• Ability to represent Robinson & Moretti, Inc. in a professional manner at all times to ensure company quality,

Q: Quick question I was hoping you could answer/confirm for me: Are there any capital / financial requirements a contractor must satisfy (other than application fees) in order to qualify for a license? In other words, is the contractor required to provide any proof of financial stability or past financial records in order to qualify for the license? I suspect no, but was simply hoping to confirm. Thanks in advance.A: No, there is no financial requirement for Contrac-tors to qualify for a license.Q: If I file for a new corporate license with me being the sole corporate Officer/President, can I add some-one later?
A: Yes, you can always update the Officers on the license. If there is a change in Officers, you are re-quired to notify the CSLB within 90 days. Q: I’m going to be using your company to assist me with obtaining my General Building (“B”) license. I’m wondering if I should apply for additional licenses as well such as a framing license. I’m going to be building homes and I want to make sure I’m covered.A: You will be covered to build homes with the “B” (General Building) license. You will also be covered to do framing with your license. A General Building Contractor may take a prime contract or a subcontract for a Framing or Carpentry project. However, a Gen-eral Building Contractor cannot take a prime contract or a subcontract for any project involving trades other than Framing or Carpentry unless the contract requires at least two unrelated building trades or crafts other than those two, or unless they hold the appropriate classification, or subcontracts the work to an appropri-ately licensed specialty contractor. Q: I noticed on the Nevada Contractor’s License ap-
plication that one of the questions asks if our Officers are US citizens. Is that a requirement for a Nevada License? One of our Officers is a permanent resident of US, but he’s not a citizen.
A: No, US citizenship is not required to obtain a Ne-vada Contractors License. Just be sure he includes his INS card and Social Security Card when submitting the application.Q: My license expires at the end of the month and I have the renewal here ready to send. I want to change my business name. Can I just cross off the name they have on the renewal form and list the new name I want to use?A: No, you cannot use the renewal application to change your business name. You will need to com-plete an Application to change your business name.Q: When a corporate license is cancelled, is there a way to request a continuance of the license in order to finish contracts/work in progress?A: No. Only Sole ownership, Partnership, or Joint Venture entities may apply for a continuance. Cor-porations and Limited Liability Companies are not eligible for a continuance.

CHISPA Housing Management Maintenance Technician
CHMI is currently accepting applications for a Maintenance Technician to provide basic main-tenance and repairs at various apartment devel-
opments throughout Monterey County. Duties include: responding to service orders and requests for repairs, performing visual examina-tion and operational tests to determine need for repair work and perform a wide variety of re-
pairs involved in the upkeep of building, grounds and utilities. Repair duties may include repairs to plumbing fixtures such as sinks, toilets,

Safety Tip of the WeekDRINKING & DRUGS - NOT ON THE JOB
All of us know that certain drugs are illegal, and that drinking or drug use can lead to both physical and mental impairment, and also that state and federal laws prohibit or regulate the use of drugs and alcohol. Catchy phrases such as 'Drinking and driving don't mix', ‘Just say no to drugs', 'MADD, Mothers against drunk driving' and 'D.A.R.E. to keep kids away from drugs' serve as reminders and warnings of the dangers associated with drug abuse and the irresponsible use of alcohol. We also need to be concerned about those who use these substances on the job.
The nature of our work demands total concentration on what we are doing. One slip could cause a serious injury or even death -- and the victim could be you or a co-worker. Certainly the jobsite is no place for anyone using drugs or alcohol. Construction activities require employee alertness -to constant changes on the site and the ability to follow safe work practices to prevent accidents.
Experts suggest that 14% of workers use some type of substance on the job, and that 50% of those users try to sell drugs to other employees. Drug and alcohol users are more prone to have accidents, reduced productivity, increased tardiness and absenteeism, and poor quality work.
It is up to you to avoid becoming a statistic, and to make your workplace safe and productive. If you suspect that a co-worker is abusing alcohol and/or drugs, don't help them continue their habit, speak to your supervisor. Covering up a problem can lead to a potential incident and innocent workers could be hurt due to the impaired actions of a person who is a drug user or one who has a drinking problem. Many companies now offer an 'Employee Assistance Program' designed to help their employees 'kick the habit' --or your supervisor may refer them to programs in the community where they can get help and counseling.
