Military Applicants, with Proper Forms, Move to Front of Line for Contractor License Processing

The Contractors State License Board (CSLB) salutes U.S. military personnel for their service and offers expedited application processing by specially trained staff to veterans seeking to become licensed contractors. Unfortunately, not all veterans applying for California contractor licenses are able to take advantage of this opportunity because they do not submit the forms required for this service.

CSLB has noted an upswing in the number of license applications submitted by veterans that do not include the mandatory DD214 form confirming their release and honorable discharge from duty. Since January 2016, CSLB has received 316 applications that were marked as “veteran” but did not include proper documentation. Veteran identification cards are not accepted as proof of service.

Without a DD214 or other acceptable forms, CSLB cannot grant expedited status to otherwise-deserving veterans, and their applications are processed along with all others that CSLB receives on a first-come, first-served basis.

By including the appropriate documents with an application, CSLB staff will provide priority service that includes:

Expedited application processing; Access to CSLB Licensing staff specially trained to evaluate transferable military

training and experience to meet minimum licensing requirements; and Evaluation of college transcripts to help verify acceptable educational credit (in addition

to military training and experience).

Governor Signs Bill to Allow Vets to Apply Military Experience

Besides the aforementioned assistance for veterans, we also previously reported, and wish to remind you, that the Governor signed into law this legislative session SB 1348 (Cannella) which will require the CSLB to apply a veteran’s military experience and training towards licensure requirements. The new law, which takes effect on January 1, 2017, will also require the CSLB to post information on their Internet Web site about the ability of veteran applicants to apply their military experience and training towards licensure requirements.

44 California counties to share $34.9 million to fight workers’ compensation fraud The grants, funded through employer assessments, support law enforcement efforts in investigating and prosecuting workers’ compensation fraud.

SIGNED BILLS

AB 1244 Workers’ compensation The Administrative Director of the Division of Workers' Compensation is to promptly suspend any physician, practitioner, or provider from participating in the workers' compensation system if as a physician, practitioner, or provider the individual or entity meets specified criteria, including if that individual has been convicted of any felony or misdemeanor involving fraud or abuse of the Medi-Cal program, Medicare program, or workers' compensation system, if that individual's license, certificate, or approval to provide health care has been surrendered or revoked, or if that individual or entity has been suspended, due to fraud or abuse, from participation in the Medicare or Medicaid programs.

AB 1926 Public works: prevailing wage: apprentices Amends Labor Code section 1777.5 to require contractors who request the dispatch of an apprentice to work on a public works project and require the apprentice to "fill out an application or undergo testing, training, an examination, or other preemployment process as a condition of employment" to pay the apprentice for the time spent on that activity, including travel to and from the activity, at the apprentice's applicable prevailing wage rate.

An apprentice does not have to be paid for time spent on preemployment activities if the apprentice is required to take, and fails, a preemployment drug or alcohol test. The bill provides an exemption for contrary collective bargaining agreement provisions and takes effect January 1, 2017.

AB 1934 Planning and zoning: development bonuses: mixed-use projects When an applicant for approval of a commercial development has entered into an agreement for partnered housing with an affordable housing developer to contribute affordable housing through a joint project or 2 separate projects encompassing affordable housing, until January 1, 2022, require a city, county, or city and county to grant to the commercial developer a development bonus, as specified.

AB 2180 Land use: development project review Current law requires approval or disapproval within 90 days from the date of certification if at least 49% of the units within a development project are affordable to very low or low-income households. Current law also requires approval or disapproval within 60 days from the date of the adoption of a negative declaration, or the determination by the lead agency that the project is exempt from the California Environmental Quality Act. This bill will nowrequire approval or disapproval within 120 days from the date of certification of an environmental impact report when the development project consists of either residential units only or mixed use development in which the nonresidential uses are less than 50% of the total square footage of the development, among other conditions.

SB 1167 Employment safety: indoor workers: heat regulations Require the Division of Occupational Safety and Health to propose to the Occupational Safety and Health Standards Board for the board's review and adoption, a heat illness and injury prevention standard applicable to workers working in indoor places of employment. The bill would specify that this requirement does not prohibit the division from proposing, or the standards board from adopting, a standard that limits the application of high heat provisions to certain industry sectors.

AB 326 Public works: prevailing wage rates: wage and penalty assessments Current law provides that there is no liability for liquidated damages if a contractor, subcontractor, or surety deposits the full amount of the assessment or notice, including penalties, with the Department of Industrial Relations to hold in escrow pending administrative or judicial review. This bill would require the department to release the funds deposited in escrow plus interest earned to those persons and entities within 30 days following either the conclusion of all administrative and judicial review or upon the department receiving written notice from the Labor Commissioner or his or her designee of a settlement or other final disposition of an assessment issued, as specified, or from the authorized representative of the awarding body of a settlement or other final disposition of a notice issued, as specified.

SB 954 Public works: prevailing wage: per diem wages Current law requires the Director of Industrial Relations to determine the general prevailing rate of per diem wages for work of a similar character in the locality in which the public work is to be performed, and the general prevailing rate of per diem wages for holiday and overtime work. This bill would require per diem wages to include industry advancement and collective bargaining agreements administrative fees if the payments are made pursuant to a collective bargaining agreement to which the employer is obligated.

AB 2535 Itemized wage statement Amends Labor Code 226 and clarifies that employees who are exempt from the payment of minimum wage and overtime are not required to have their hours tracked and logged on an itemized wage statement.

EMPLOYMENT LAW

December 01, 2016 Federal overtime rule The Final Rule focuses primarily on updating the salary and compensation levels needed for Executive, Administrative and Professional workers to be exempt. Specifically, the Final Rule:

1. Sets the standard salary level at the 40th percentile of earnings of full-time salaried workers in the lowest-wage Census Region, currently the South ($913 per week; $47,476 annually for a full-year worker);

2. Sets the total annual compensation requirement for highly compensated employees (HCE) subject to a minimal duties test to the annual equivalent of the 90th percentile of full-time salaried workers nationally ($134,004); and

3. Establishes a mechanism for automatically updating the salary and compensation levels every three years to maintain the levels at the above percentiles and to ensure that they continue to provide useful and effective tests for exemption.

January 01, 2017 Minimum wage Businesses with 26 or more employees must pay a minimum wage of $10.50 per hour, with the rate reaching $15 per hour in 2022. Small businesses with 25 or fewer employees are not required to begin the scheduled increase until 2018.

March 01, 2017 “All-gender” toilet facilities All single-user toilet facilities in any business establishment, place of public accommodation or government agency must be identified as “all-gender” toilet facilities. AB 1732 authorizes inspectors or other local officials responsible for code enforcement to inspect for compliance.

A contractor wants to ‘add’ a concrete change to his business plan. But the numbers won’t compute! To ‘dba’ or not ‘dba’, that is the question. Another important lesson for any contractors who decide to ‘surrender’ the corporation without discovering ‘loose ends’ after walking away…

Q:  I currently have a Sole Proprietor General Building (“B”) license that’s been Inactive for about three years now.  I want to add the “C-8” (Concrete) classification to my license in order to obtain a separate Concrete license for a Partnership that I am starting with my business associate.

My attorney said I may be able to Waive the Trade exam based on my General Building license if I can show that concrete has been a significant portion of my work for five out of the last seven years.  What does the CSLB consider acceptable documentation to prove my concrete experience?

A:   Your attorney is referring to B&P Code Section 7065.3, which allows for a Waiver of the Trade exam when adding a classification to your license if you meet the requirements.  As your attorney stated, one of the requirements is the classification needs to be closely related to your current classification and it must have been a significant portion of the work you performed for five out of the last seven years.  Since your license has been inactive for three years now, there is no way for you to document using your General Building license for performing Concrete work as required.

Q:  We have a Corporate license and we are going to be filing for a Limited Liability Company (LLC) license.  I know when we originally filed for our Corporation, the CSLB would not allow us to have a Corporate ending on our “dba” (doing business as) name, such as “Inc.” or “Incorporated”.  Is that the same for LLC’s?  As in, can we use “ABC Construction LLC dba XYZ Construction LLC?

A:   If there is no “dba” on the name with the Secretary of State (as in your case), you can choose to use “LLC” as part of your “doing business as” name, however the CSLB will require that you provide a filed Fictitious Name Statement.

Q:  Your company helped me set up my Corporation back in 2003.  We haven’t done business in California for years and I need to close up the corporation.  I noticed that it’s suspended by FTB (Franchise Tax Board).  What is the process to shut it down at this point?

A:  Before you can close/surrender your corporation, you will first need to get it back in Good Standing with the Secretary of State.  You will need to contact the Franchise Tax Board to find out the reason for the Suspension, however it is likely that your company needs to either file back tax returns, pay taxes owed, or both.  Contact my office if you need assistance with this.  We are here in Sacramento and can visit the FTB on your behalf to determine what’s needed and file the appropriate items to lift the Suspension.  Once the Suspension is lifted, you can file to surrender the corporation.

Safety Tip of the WeekWORKING AROUND CRANES

EXPERIENCE CAN BE THE WORST TEACHER

Experience teaches us a lot about working around cranes. But often the lessons are costly. For example: A laborer carrying a bag of cement walked between a crawler crane and a building column. The crane swung round and fatally crushed him between the counterweight and the column. On another job, a workman was leaning on the crane frame, talking with one of his buddies. The load came in contact with a live power line and he was electrocuted. Today, we'll discuss things we should and should not do when working around this equipment.

STAY OUT FROM UNDER

It's a smart move on your part to stay out from under suspended hooks and loads. There's always a chance that during a lift, the load could shift and fall. It may be a slim chance because of the good rigging techniques we use. But once is all it takes to cause a serious injury or a fatality. Also stay clear of swinging loads. That big "I" beam can squash you like a bug if you get in the way.

YOU'RE NOT SAFE WHEN NOT SEEN

Remember, too, that the crane operator may not see you. He's concentrating on moving his crane into position or swinging his load. Think of the swing area of the crane as "no- man's land." And stay out. The crane will have no sympathy if you get in the way. And it won't come out second best. I'll guarantee that.

OTHER DANGERS

Have you ever heard of a P.L.P.? It stands for Public Leaning Post. And a lot of people think that's what the crane is. They're asking for a shocking experience if the load or boom touches a live wire. So don't lean on the crane. Stay clear. It's too bad the workman we talked about earlier didn't take this advice. He'd still be around today. Of course, with all the overhead work going on, we always should wear our hard hats. Concrete slopped out of a lifted bucket can crack an unprotected skull. I don't understand why some persons never use the stairs or personnel hoists. They insist on "riding the hook." And they're asking for trouble when they do. It's one of the most dangerous means of transportation around.

USE EXTRA CARE AROUND CRANES

The crane is a fantastic piece of equipment. It saves us an enormous amount of work. But like anything else that's big and powerful, it can be dangerous. That's why I've taken the time to stress that you be extra careful when working around cranes.
