The purpose of this guide is to give builders, designers and architects a quick reference fonnat to use whendeveloping plans to be submitted to the Architectural Review Committee (ARC) of Har-Ber Meadows.

Driveways Common Design: 2.2.4 (Page 10)

• Maximum 18' wide with 2 car garage.

• Maximum 26' wide with 3 car garage.

• Comer lot drive and garage must connect to alley nearest theinterior property line as allowed by setbacks.

Driveways Accessing Streets 2.2.4b' (Page 10)

• Driveway must cross front setback in a straight line that isperpendicular (90 degrees) to the curb.

• Drive shall be 12' wide at the curb.

• 2 car garage drive shall be a maximum of 18' across the garageentry.

• 3 car garage drive shall be a maximum of 26' across the garageentry.

• Driveway shall be a minimum of 2' from the side property line.

• Driveway shall be a minimum of 3' from the side of the structure.

• Driveway shall be a minimum of 26' deep perpendicular (90degrees) to the garage entry.

• Shared drives must be approved by the ARC.

• Lots with side-by-side driveways should be minimized.

• Lots with side-by-side driveways must have a 3' high evergreenhedge from the sidewalk to the front setback line.

• In many cases chases need to be placed under the drive for utilities.

Building Plans & Elevations

Submit a scaled drawing showing the following details:

• Floor plan with major dimension ( 1/8' or 1/4" scale).

• Exterior Elevations- All sides (1/4" scale)Include: Roof pitches, chimney cap design, exterior materials and

address plaque location.

• Exterior material and color board.

Review the guidelines section 2.3 page 13 to 20 for more detailed information.

ARCHITECTURAL REVIEW COMMIITEEAPPLICATION FORM

The Architectural Review Committee (ARC) for Har-Ber Meadows requires that all newconstruction plans be approved prior to the commencement of construction. In order toallo* for the timely and accurate review of these plans, the ARC has requested that allapplicants complete the following form and provide the required information. A list ofthe minimUm requirements is listed on this application. The ARC will not reviewincomplete applications. Please allow a minimum oftwo weeks for the review process.

To all Residential Builders

Effective December 1, 1998

These are the square footage requirements for all single family dwellings in theproject. Consult the Development Company or your Realtor ifyou need furtherclarification.

Minimum Square Footage. No living area shall be less than the minimum squarefootage as set forth below. Living area includes finished and habitable space exclusive ofporches and garages.

a) Standard Lots: Blocks 1-2-3A-4-17-18-19-20-21-23-25-27-29, theminimum square footage is 1800. All other Standard Lots will have aminimum square footage of 1500.

b) Estate Lots: the minimum square footage is 2700 for one story and 3000for two story homes.

c) Village Home Lots: the minimum square footage is 1300.d) Patio Lots: the minimum square footage is 1200.

1.0 INTRODUCTION

These Design Guidelines outline design goals,design criteria, and the design review processfor Har-Ber Meadows. All builders andowners are encouraged to read this documentthoroughly.

1.1 ObjectiveslPurpose

The purpose of the Design Guidelines is toensure that the development of Har-BerMeadows conforms to the design intent of theHar-Ber Meadows Master Plan prepared by thedeveloper, Har-Ber Meado,,'s DevelopmentCompany and approved by the City ofSpringdale as a Planned Unit Development. Tothat end, the primary objectives of these designguidelines are:

1. To establish design criteria that ,,'illprotect and enhance the integrity of allcomponents of the Har-Ber l\feado\\'scommunity.

2. To create an efficient, orderly, andstreamlined process for design review andapproval of each development proposal forthe Har-Ber Meado\vs community.

3. To encourage design that will achieve aharmonious relationship among buildingsand sites at each stage of development.

4. To provide an attractive environment forall ages and incomes of people living, work­ing, shopping, and seeking recreational pur­suits in the Har-Ber Meado\vs community.

This document is presented as a minimum set ofdevelopment guidelines and standards for theHar-Ber Meadows community. The intendeduse is to provide a framework to illustrate anddefine design objectives for a unified,hannonious setting for the diverse enterprisesand styles inherent in a multi-use, nlulti­housing type land development.

These guidelines are supplemental to theProtective Covenants and are to be used inarchitectural review of builder, developer, orhomeo\vner plans. Non-compliance \vith theseguidelines is justification for disapproval ofsubmitted plans. These guidelines are also foruse as standards for future compliances tomaintain the integrity ofthe comnlunity, as wellas the preservation and enhancenlent of proper­ty values.

1.2 General Description & DesignIntent

Har-Ber Meadows is being developed as aplanned community possessing values andcharacteristics associated \vith the traditionalplanning principles of villages developed in thelate 19th and early 20th centuries. The intent ofHar-Ber Meadows is to create a community forall age groups and a variety of income. levels,to create a broad mix ofland uses and a varietyof housing types. Like the traditional villagemodel, Har-Ber Meadows emphasizes theimportance ofstreet life and pedestrian activity,open space and recreation.

Housing, buildings, and site elements areintended to exhibit historical references typicalof the region. The design intent is meant totake this historical vernacular and translate itinto modem plans and elevations. Architecturalstyles of Har-Ber Meadows may borrow fromthe historic models of existing and oldercommunities.

The focus is on creating walkable neigh­borhoods with a mix ofuses and common openspace areas that encourage social interaction.The 400+ acres of Har-Ber Meadows is anideal community size to encourage walkingbetween various land uses. A desirable walkingdistance usually means an area that may bepotentially covered within minutes or with aradius of no more than one-half mile.Sidewalks and pathway systems with generouswidths, well-defined public spaces likeFounders Park, Crumpacker Park, and DancingRabbit Park, and attractive, highly characteristicbuildings that flank the streets are intended toencourage residents to walk rather than drive totheir various destinations. Founders Park, thecivic and retail core, the conlmunity recreationcenter, and the elementary school all lie withina comfortable walking distance from 75% ofthe homes within Har-Ber Meadows. Homesare required to be located on "build-to lines"rather than setbacks which reinforce an intimatestreetscape and emphasize a safer and friendlierpedestrian environment. Porches are permitteda lesser setback from the street as a means ofencouraging builders to construct more homeswith porches. Some alleys have been providedso that garages will not be dominant objects onthe all of the streetscape and much ofthe dailytraffic and services (Le., trash pick-up) may belocated off the streets.

One of the most significant features within theHar-Ber Meadows comnlunity is the aI110untof land-less than one fifth of the site--devotedto common areas. Planned amenities includedare nearly twenty acres of lakes and more than3/4 miles of improved naturalistic and sceniccreeks and drainageways; a conununityrecreation ·center with swimming pool,pathways, and lake overlooks; a civic core withinfonnation center, church, day care,cOlllmunity building, offices, and senior carefacility; landscaped parks and playgrounds; and,a well-conceived and well-designed retailcenter. The retail center will provide, at aminimum, conveniences for the community ofHar-Ber Meadows. Design guidelines for thecommercial components will be contained inanother set of guidelines.

The Community of Har-Ber Meado,vs hasbeen designed to promote "street scenes" thatare aesthetically pleasing in character andreflect the feeling of a neighborhood. Thepurpose of these guidelines is to identify thoseelements of each section that ,vill influence theneighbor-hood appearance and street character.

The builder/o,vner is to develop and nlaintainindividual lots in a nlanner prescribed by theDeclaration of Covenants, Conditions, andRestrictions and by these design guidelines.Compliance with building setback lines, lotlayouts, driveways, sidewalks, garages, fences,grading and drainage, etc. are required of thebuilder/owner, including connections toutilities.

1.3 Disclaimers

The Design Guidelines are intended to describea general level of conformance fordevelopment and are to be used for planningpurposes only. The design guidelines and theprocedures set forth herein may be modified orwaived from time to time by the ArchitecturalReview Committee and do not replace the needfor conformance to any applicable federal, state,or local obligations, nor do they create anindependent jurisdictional district.

Compliance with this document does notprovide exemption from required state, countyor local approval procedures. All structuremust conform to any state or local buildingcodes, zoning ordinances, or othergovernmental regulations to ensure the healthand safety ofits occupants. Ifany provisions ofthese Design Guidelines are more restrictivethan the other applicable local codes, theprovisions of these Design Guidelines shal·lapply.

The ARC is understood to assume noresponsibility for structural integrity nor foradequate code compliance of mechanical andelectrical design by approval of the submittedplans.

2.1 Introduction

The following standards address site planningcriteria, architecture, and landscapingrequirements that are common to all sectionswithin Har-Ber Meadows. Specific standardsfor each lot type are identified within thesections that follow. The lots are classifiedaccording to their size. The three classificationsof lot types are: Village, 37' \vide or less;Standard, 75'-149' wide; and, Estate,minimum area of29,000 square feet. Within theStandard Lot section, five separate lot typesare identified with some variation in designstandards for each.

2.2 Site Planning Criteria

All sidewalk construction is to meet or exceedCity of Springdale standards. Sidewalks mustbe located one foot from the property line. Thislocation may not be varied unless approved bythe ARC. Though little if any are anticipated,gentle radii instead of abrupt curves and anglesare required for transitions and around existingtrees.

Best efforts shall be made to match sidewalkelevations with the existing manhole and valvebox elevations. If adjustment of the heights arerequired, builder shall notify the developer (24hours) prior to sidewalk constructiop.

2.2.3 Walkways

Walkways should be a complementarycomponent of the site architecture and anextension of the sidewalk system and shouldnot compete visually with the house and/orlandscape.

2.2.1 Composite Building Sites

For all sections, any owner of one or moreadjoining lots may consolidate those lots or aportion of the adjoining lot into ~~e sinole­family residence building site, with ~he~rivilege of placing or constructingImprovements on the composite site. ExpressARC approval is required for consolidatedbuilding sites. Setback lines shall be measuredfrom the resulting side property lines ratherthan the lot lines shown on the recorded plat. Inall instances, improvements on consolidatedbuilding sites must be approved by the ARC.The maximum unit size may be increasedproportionately to the additional square footage(land area) obtained by consolidating lots.

2.2.2 Sidewalks

Sidewalks are to be constructed by the builderwithin public street rights-of-way frontage and

2.2.4 Driveways

2.2.4a Construction

Builders are required to build the driveway intothe street right-of-way. Concrete driveways areto be a nominal 4" thick. Expansion jointsbetween the curb and drive\vay are required.Curb modifications for driveways must be inaccordance with the City ofSpringdale Code.

The use of stamped and colored concrete· 'Interlocking pavers, brick pavers and brickborders are pennitted. Color, pattern anddesign will require the approval of the ARCprior to construction. .

Driveways should not be constructed over inletsor manholes. In instances \vhere this n1ay beunavoidable, compliance with Countyregulations, that may require inlet adjustmentand/or upgrade, may be necessary.

When a driveway intersects with a street oralley, the radius at this intersection must be S'.Diagonal intersections are pennitted only onalleys.

2.2.4b Drive\\'ays Accessing Streets

Driveways must cross the building setback areain a straight line and approximately 90 degrees

Driveways serving two-car garages accessedfrom the street shall be twelve (12') in width atthe curb cut and no greater than eighteen feet(18') at the garage. The driveway may beincreased in width to twenty-six feet (26') at thegarage for three-car detached garages located atthe rear of the lot (Note: Two-car and three-car,side-by-side, front loaded attached garages arenot pennitted).

In no instance maya drive\vay be pennitted toabut the foundation of a house. The space isnecessary so that plantings may be installedbetween the driveway and the house to screenthe foundation. A minimum three foot (3')planting strip is required between the house andthe driveway. Driveways must be setback aminimum of two (2') from any interior side lotline. Two adjacent lots with side-by-sidedriveways should be n1inimized. There areinstances where this condition can not beavoided. For instances where side-by-sidedriveways occur, a three foot (3') highevergreen hedge should extend from the side­walk to the front setback line between the twod~veways. As a guideline, side-by-sidednveways will be limited to not more than oneoccurrence for each side of the street per block.

2.2.4c Drive,vays Accessing Alleys

All lots adjoining an alley must have drivewayaccess to the alley. The width of the drivewaymust be a maximum of eighteen feet (18') fortwo-car garages and a maximum of twenty-six

feet (26') for three car garages. For comer lots,driveways and garages must be placed near theproperty line farthest from the street when a lotsides onto a street.

2.2.5 Garage Placement

2.2.5a General

A street scene with the emphasis on residencesand the pedestrian environment instead ofgarage doors and driveways is the community'sdesign intent. Detached garages or attachedgarages accessing the alley are required. Anattached side-loaded garage in the front of thehouse is not allowed. Side loaded attachedgarages on the rear of the house that face a sidestreet are not allowed.

2.2.6 Alleys and Alley Treatment

Alleys will have a thirty foot (30') right-of-\vayand twelve feet (12') of pavement located sixfeet (6') on either side of centerline. Alleyshave one way circulation except for short deadend runs which access one, two, or three lots. Afourteen foot (14') utility easement wiII belocated between the edge of pavement of thealleyway and five feet (5') beyond the alleyright-of-way line within the rear yard of eachadjacent lot. Six foot (6') privacy fences arepermitted along the rear property lines ofalleylots, and free access to all power transformersfor Ozarks Electric Cooperative Corp. isrequired. Each transformer requires a minimumthree foot (3') clearance from a fence, aminimum of eight feet (8') from any buildingwall and fifteen feet (15') from any buildingwall opening such as a window or a door.Meters and trash are not permitted to beexposed to the alley. All meters which are

located above grade and exposed to the alleymust be screened with landscaping. Lightingfor each garage nlust be located above thecenter of the garage door. Address plaques ongarages are optional. All downspouts ongarages must be directed towards the alley. Noparking wi~~ be permitted on alleys.

2.2.7 Fences

2.2.7a General

Fencing is allowed. Individuality of fencing isencouraged. The fences must meet the standardsaddressed within this section.

Fences may only be constructed of \vood orvinyl, wrought iron, tubular steel or maso~.All wood fences are to be constructed \vlthredwood, cedar or treated southern yellow pine.All fence designs must be approvea by theARC. All fences nlust be installed usingquality materials and standard c~~st:ucti~n

techniques. All fencing must be maIntaIned Ingood condition.

Wrought iron or tubular steel fencingnlust beprimere.d and painted a semi-gloss black, whiteor forest green only. Panels bolted instead ofwelded to posts are preferred for easiermaintenance. Set all fence posts in concretefootings. Steel or wrought iron fencing can beattached to brick columns which match thebrick being used on the residence. No materials(Le., screening, wire mesh) shall be at~ached tosteel or wrought iron or wood fences. When asteel or wrought iron fence meets a wood fence,the metal fence may not be attached to the woodfence. The metal fence is to be terminated witha 3" post adjacent to the wood post.

Wherever a hedge is planted between asidewalk and a fence exposed to a street orcommon area, the height of the hedge may notexceed three feet (3'). The intent is to allowsome visibility of the fence from all angles.

The preferred approach to transition gradechanges with fencing is to stair-step the fencedown the slope and level with the horizon. Eachfence panel must not be "stepped" or stagge~edgreater than six inches (6") above or below theadjacent fence panel. For steeper slopes, smallerfence panels will be required. Wrought iron orsteel fences may not parallel down the slope.

Wood or wrought iron fencing \vith diagonal orhorizontal pales or pickets are strictlyprohibited. Chain link fencing is strictlyprohibited.

2.2.7b Heights

Fences located in the front yards are limited toa height of three feet (3'). Fences located alongthe rear property line and the side property linesfrom a point located ten feet from the frontbuilding wall must be a nlinimunl of four foot(4') in height. Six foot (6') fences may bepermitted by ARC approval only. The"finished" side of the fence, if one side is afinished side, must always be the side facing thestreet. Six foot (6') and eight foot (8') heightfencing is permitted in limited areas(seeSection 4.14b) and with express ARC approval.

2.2.7c Setbacks

When a fence is located in the front yard, afence setback of one foot (1 ') to two feet (2')from the sidewalk is pennitted along frontproperty lines between the sidewalk and thefence. A minimum setback of ten feet (10')

from the front elevation of the house is requiredfor four foot (4') to six foot (6') high fences, bu'in no instance shall mechanical equipment sudas air conditioner units and heat punlps beallowed to be seen from the street or publicview. When a fence has not been employed,mechanical equipment nlust be screened withevergreen landscaping.

For alley lots, a six foot fence may be locatedalong the rear property line with ARC approval.The property line is located a distance of ninefeet (9') from the edge ofpavement.

2.2.7d Pedestrian Gates

Three foot (3') wide gates are permitted andmust be an integral part of the fence design.One single sided three foot (3') hinged gateshall be installed in the most appropriate sideyard facing the front street. Gates may not belocated along the side yard of a corner lot.Front-facing double gates are not pemlittedDouble gates are not pemlitted on comer sideyards or rear and side property lines adjacent toa lake or common area.

2.2.7e Drive,vay Gates

Driveway gates are limited to \vrought irononly. Driveway gates must be constructed tothe same minimum standards as identified inSection 2.2.8a, Fences.

2.2.8 Front Yard Retaining 'Valls

A prevalent site element found within many ofthe historic and newer neighborhoods ofnorthwest Arkansas is a front yard retainingwall located along the front, and sometimesside, property line. The grades from sidewalk

to front porch are oftentimes too steep for anormal lawn or walkways, so in order tocompensate for the abrupt grade change, aretaining wall must be constructed. Followingare guidelines for the construction of front andside yard retaining walls when exposed to thestreet or public view.

Timber, exposed concrete, and concrete blockretaining walls are not permitted. These wallsmust be confined to rear yards only. The onlyacceptable materials are natural, indigenousstone, brick to match the residence, or otherstone/masonry which must first be approved bythe ARC.

Both wet and dry wall construction arepermitted although wet \\'alls are preferred.Wet veneer walls (stone covering concreteblock) are permitted. Coping is encouraged,but not required. All \valls must be maintained.When mortar is used on a stone \vall, the jointsmay be either deeply raked to give the effect ofa dry wall or the mortared joints may be morenoticeable.

2.2.9 Pools, Spas and Decks,

Portable or permanent above ground swimmingpools are prohibited. Smaller prefabricated,installed above the ground, spas or hot tubs areacceptable. Above ground spas or hot tubs,visible from public view or from other lots mustbe skirted, decked, screened or landscaped tohide all plumbing, heaters, pumps, filters, etc.

Swimming pool appurtenances such as rockwaterfalls and sliding boards must not begreater than four feet (4') in height. Skimmernets, long handle brushes, pool chemicals,

filters, pumps, heaters, plun1bing, etc. n1ust ncbe visible from public view or the street.

Pool walls and decks shall not encroach onutility easements.

Safety fences surrounding pools and spas arerequired and must comply ~'ith therequirements as specified in the 1991 Edition ofSwimming Pool Code of the Southern BuildingCode as required by the City of Springdale.Fencing must not be higher than four feet (4').Six foot (6') fencing may be approved by ARCapproval only. Safety fencing around pools n1aynot be privacy fencing. See Section 2.28 forrequirements.

2.2.10 Trash Receptacles

Rear-Aile,'.The construction of trash receptacle enclosuresis encouraged on all rear-alley homes. Suchenclosures will enhance and presette theappearance of the alley-ways. Enclosurc:s mayonly be constructed ofwood, vinyl, or m·~onry.All \\'ooden enclosures are to be constructedwith redwood, cedar, or treated southem pine.All enclosure designs must be approved by theARC. All enclosures must be installed usingquality materials and standard constructiontechniques. (See discussion of methods ofconstruction 2.2.7 Fences, 2.2.7a General).

No" Rear-Alley.Residents of shared or single driveway homesare encouraged to contact Sumay Services, Inc.(751-7024) to make arrangements for themonthly rental or purchase of their mobile trashreceptacles. The receptacles provide not onlyconvenience to the homeowner, but will alsoafford a uniform street-scene on trash pick-updays.

2.3 Architecture

2.3.1 General

Har-Ber Meadows' various sections aredesigned to promote "street scenes" that areaesthetically pleasing in character and reflectthe feeling of a neighborhood. Developing a"street scene" requires builders to coordin~te

their architectural designs, as well· aslandscaping styles, in a manner that displaysstreet and neighborhood individuality whilemaintaining a certain level of continuitythroughout the development.

The purpose of this section is to establish basicdesign criteria for the construction ofresidencesand other structures within Har-Ber Meadows.Emphasis is on quality material, design, andconstruction in order to promote well-craftedresidences within the various communities.The house footprint and the roof form shouldwork together to provide variety and interestwhen viewed from the street and across thelakes and common areas. These guidelinesallow for diversity in design and shouldproduce a climate of individuality, whileinsuring the architectural integrity of thecommunity as a whole.

2.3.2 Massing and Plan Criteria

Varied arrangements on the site result in moreinteresting street scenes. More pleasingarrangements are achieved with a variety ofarticulated plans which break the rectangularbox into interesting three-dimensional shapeswith courtyard-like spaces in and around eachhouse.

Houses on comer lots should be artiCulated.Special treatment could occur on comers ofhouses. Several examples include but are notlimited to the following: bay window, gable,porch, steps and entrance, etc. facing the streetcomer.

Where a "U"-shaped plan or an "L"- shapedplan has a short and long side, the short sideshould be toward the comer. Highlyunarticulated walls, particularly walls with alimited number of\vindows or corbels, are notpermitted on homes facing the side street oncomer lots.

2.3.3 Exterior Elevations

All houses should include some variation oftheridge line. Priority should be given to thosesides of the house \vhich are visible fronl streetsand walkways. The most articulated elevationsshould be those which are in public view,including the side of the house which faces theside street on a comer lot and the side facing alake or common area. However, it should beassumed that the houses will be seen from allangles and that there will be a continuity ofmaterials and details on all elevations. Comerlots will never be pennitted to have t\\'O-storyhouses with unarticulated surfaces facing theside street. All aesthetic considerations aresubject to approval by the ARC.

2.3.4 Elevation Repetition

Location of house designs should be carefullyreviewed to avoid excessive repetition in thestreet scene. The intenfis to avoid the negative"look-alike" or "cookie cutter" effect of

frequent repetition, but still allow sufficientlatitude in satisfying market demand. The ARCreserves the right to reject an elevation that doesnot enhance the overall street scene. Thefollowing guidelines for floor plan andelevation repetition will apply for all homesexcept the Village Homes.

• Six (6) full lots must be skipped whenbuilding the same plan, sax:neelevation, on the sanle side of thestreet or on both sides of the streetBrick, stone, siding, and trim colormust be different.

• Three (3) lots must be skipped whenbuilding the same plan, differentelevation, on the same side of thestreet. Brick, stone, siding, and trimcolor must be different.

• Two (2) lots must be skipped \vhenbuilding the Sanle plan, differentelevation, on both sides of the street.Brick, stone, siding, and trim colormust be different.

• Identical uses in brick type and colorand siding color is strictly prohibitedon homes which are adjacent to oneanother except for Village Homes.

2.3.5 Exterior Materials

Materials should be used with restraint inregard to both color and diversity of materialtypes. The intent is to create a continuity ofmaterials throughout the neighborhood. Thenumber of primary materials on the exteriorwill be limited to three (3), not including roofshingles and wood trim. The followingmaterials are acceptable:

2.3.5a Exterior 'Valls

BRICK. Earth tone colors. Bricks shall meetstandard specifications established by TheBrick Institute of America. In the event thatbrick is utilized on the front facade, the l'>rickmust be utilized on all sides of the houseexposed to front streets, side streets, comnlonareas and lakes. Gables and cantileveredoverhangs on the public sides are not requiredto utilize brick. All subnlitted plans nlustindicate precise areas where brick is .utilized.

STONE. Only types of stone that areindigenous to the region will be allowed.Stone may only be permitted as a wainscoat,foundation, or accent material. Concretesimulation stone products which closely minlicindigenous stone products \vill be accepted.The use of any type of stone on the ex\~rior ofa residence must be approved by the cOFitteeto ensure architectural compatibility ~ith theneighborhood.

STUCCO. The use of stucco \vill be permittedas both the primary as well as thef,accentexterior material.

MORTAR JOINTS. "Slunlp" joints will notbe allowed. Mortar color shall be selected tocompliment stone or brick color.

WOOD SIDING (non-man-17zade). Prior toconstruction, each builder must submit a list ofwood siding and trim colors, including thecombinations proposed, to the ARC forapproval. Horizontal application will only bepermitted.

VINYL SIDING. Vinyl siding is permitted ifproperly detailed. Vinyl siding may be used asthe primary exterior material. Wolverine and

Heartland siding are preferred, but others willbe considered. Primed paintable shutters areavailable from other sources. Decorativemillwork is required above all windows anddoors on elevations which face the street. Anyvinyl siding product or trim detail that does notmaintain the appearance of traditional wooddetailing is not acceptable.

OTHER SIDING. Concrete siding is permittedin horizontal applications only. Concrete sidingmay only be used as an accent or trim and notas the primary building material.

TRIM. All wood trim shall be smooth, highquality finish-grade stock, stained or painted asapproved by the Committee. The use ofMDO(Medium Density Overlay) panel siding isallowed.

PRIVACY WALLS. Privacy walls as anintegral component of building architecture,i.e., adjacent to a bathroom or master bedroom,must match dwelling unit materials and shall beno more than six feet (6') in height.

Samples of all finished materials and colorsmust be submitted by the builders to the ARCfor approval.

Wood, vinyl, or concrete siding on a gable endis permitted. On gable ends ofhomes on comerlots or lots located on a lake or common area,brick should extend into the gable if structurallypossible. A brick facade with wood siding onthe gable should be avoided at these locations.Gable ends of a uniform material tend to bemore architectural than those which change atthe eave line.

2.3.5b Exterior Paint

The proposed palette for all exterior colors nlustbe submitted to and approved by theCommittee. The exterior colors for eachresidence shall be selected to compliment,coordinate or harnl0nize with the colors ofbuilding materials which are used in theirnatural state, such as brick, stone, copper, etc.The palette of exterior colors on \vood sidingfor the walls of the dwelling unit wheneverbrick, stone, copper, etc. are not employed mustbe soft in hue. The trim or accent colors nlustcomplement the main color. Paints or stainsshould be linlited to three (3) complementarycolors per residence. Colors and colorcombinations must' be submitted to ARC forapproval. The type of paint shall be a durable100% acrylic exterior paint or enamel.

2.3.5c Roof Materials

The roofing in sections shall be of a pre­approved selection ofcolors for continuity andindividuality throughout the development.Roofing material color shall be subnlitted andapproved by the ARC. The minimumrequirements for roofing materials is identifiedwithin each section of these guidelines.

2.3.5d Windo,v Materials and Treatment

Wood, vinyl, or aluminum windows may beused. When aluminum windows are utilized,the finish shall complement the color and thearchitectural style of the house. No mill finishaluminum will be acceptable. No reflectiveglass or glazing will be allowed on any facadewhich is visible from a public street, lake orcommon area. The use of wrought ironornamentation on the exterior ofany window isprohibited without the prior app~oval of the

ARC. Use of double pane windows isencouraged but not required for energyconservation purposed. Sunscreens such asawnings, sunshades or shading devices, grillesor louvers will not be pennitted. Windowcoverings facing a street, lake, or common areamust compliment the color of the house.

Care should be given to the size, type andorganization of all windows. They sho!-l1dnever appear like surface "holes" cut into theside of the box. They should be architecturalfeatures and, wherever possible, grouped intorecessed areas or bordered by projections whichprovide a shadow pattern. Multiple-arched ortrendy windows are not pennitted.

Decorative millwork or decorative brickwork isrequired above all \vindows \vhich face a publicstreet. Primed and paintable shutters are highlyencouraged and will aid to create someindividuality among front and comer sideelevations. Shutters must be sized to the lengthof the window and their width must be equal tohalf the width of the window.

2.3.6 Entrances & Porches

Although some houses may have porches,deeply recessed entrances provide bothprotection from the elements and a sense ofindividuality on the percentage ofhomes whereporches will not be employed. Individualentrance structures should be distinctivearchitectural features. They are best whenthere is a combination ofoverhanging roofs andsome change in the plan configuration. Aminimwn recess offour feet (4') is required forthese entryways when a porch is not employed.

The minimum porch depth is five feet (5').Eight feet (8') is preferred. The prefcrrcminimum length of a porch should not be )es~

than one third of the total front elevation of thehouse. Side porches when attached to andcontinuous with the front porch are pennitted.Side porch~s are preferred on comer lots.

Door surrounds must be proportionate to thedoor; door surrounds must not be out of scale.

The flooring .material of covered porches maybe made of brick, stained or painted wood, orconcrete. The flooring material of entrywaysmay be made of brick or concrete. Nounfinished wood is pennitted.

Steps may be composed ofbrick, cast concrete,stone, or 'stained or painted wood. Nounfinished wood is pennitted.

Columns on porches nlay be composed ofaluminum, fiberglass, wood, concrete (cast inplace or precast), linlestone, and fieldstone.Columns must be an integral part of the overallarchitecture. Highly detailed columns are notpennitted. Railings shall be made ofv.'ood orironwork. Single columns may not be less than6"x 6". Double columns may not be less thantwo 4"x 4" 'so

The ARC will permit residences to be locatedon the front porch setback line \vhen the lengthofthe front porch is a minimum of one third ofthe total front elevation of the house, regardlessof the location ofthe living area. Porches mustalso have a minimum depth of five feet (5').

2.3.7 Roof Forms and RoofOverhangs

Changes in roof geometry are best whenaccompanied by offsets in plan. Avoid flatroofs. Refer to the table located in thefollowing section for roofpitches. Porches andoverhangs may have a minimum slope of 3 in12 pitch. A combination ofroofpitches may beused if integrated to the design of the house.

Roof overhangs are both practical andattractive. They give a house character andsolar protection. Overhangs should be anintegral part of the building form and not thinplanes extended past the mass of the house.Dse over windows and porches to createshadow and over garages to reduce the impactofgarage doors.

Eave condition overhangs are suggested andshall be 24" and rake condition overhangs shallbe a minimum of 12-18". No flush rakeconditions are allowed. Exposing the ends ofrafters may be used in certain conditions ifcharacteristic of the architectural style. Fascias,when incorporated into the design, must be aminimum 1" x 6 ". Closed or boxed-in soffitconditions are acceptable depending on thecharacteristics of the architectural style.

2.3.7a Roof Pitches

2.3.7b Rain Gutters and Drains

Where runoff occurs affecting pedestrianentrances and \valkways, the installation of raingutters and drains is recommended. Drain pipestied into the rain gutter do\vnspout must bescreened from public view either by suitablematerial or by planted shrubs or ground cover.Elsewhere, or in areas not seen by the public,the use ofa splash block or hidden drain pipe ortile is required. Color shape and location mustbe compatible with the character of the houseand must be approved by the ARC. Paintedaluminum or copper is recomnlended. Vinyl isnot pennitted. Galvanized aluminum must bepainted to match the trim.

2.3.7c Dormers

Dormers must have gable, shed, hip, or archedroofs. No flat or steep gable roofs arepermitted.

2.3.8 Addresses

Address signage shall be treated as anarchitectural feature to the front elevation ofthehouse. All houses shall be identified with pre­cast concrete plaques for homes constructed of

masonry. A home constructed of siding mayhave a wood or fiberglass plaque with a naturalwhite finish. The address plaque must belocated near the front door.

Approximate plaque size is to be 9" (vertically)x 15" (horizontally) or. Numbers are to be 4"high. Plaque background is to be natural whitefinish. Bold type face is the preferred numeralstyle.

2.3.9 Chimneys

Every residence must incorporate a minimum ofone fireplace. In order to use the chimney as arepetitive design element throughout thecommunity, the chimney structure should beexpressed on the exterior of each residence inone of the following manners:

Chimneys can be used to establish anornamental or thematic direction. They may bebuiltout of masonry, wood or concrete hardi­plank. The minimum plan dimensions for anexposed mass is 24It x 24" and a larger fonn ispreferred. The use of prefabricated fireplaceunits allows a wide design latitude for wood­clad or masonry chimneys. If placed on anexterior front or side wall, the chimney must beclad in masonry to match the primary buildingmaterial. Chimneys located along rearelevations (not exposed to public view) orinterior chimneys may be clad in siding tomatch the siding being utilized elsewhere on thehouse.

In the event of gas fireplaces, direct vents inplace of chimneys are allowed, provided thevents are located along the rear slope or rear

half of the roof and painted to matchshingles.

The height of the chimney should beproportion to the roof line and adhere to fi: ~:.

codes. Broad, massive chimneys on theexterior of homes will be encouraged andnarrow, spindly shapes will be discouraged.

Exposed metal flues are not allowed. They maybe used only when clad with materialcomplementary to the.house, such as masonry.

All sides of a chimney shall be constructed ofthe same material.

2.3.10 Rooftop Elements

All stack vents and attic ventilators and directvents in place of chimneys (for gas fireplaces)shall be located on the rear slopes orirear halffor certain roof fornl conditions of roofs andmounted perpendicular to the ground plate. Ininstances where metal roofing is employed(follo\ving ARC approval), roof accl~ssories

may be made of the same metal. All exposedmetal roof accessories, stack vents, roofflashing, attic ventilators, etc. shall be paintedto match the color of the roofing material color.

The location and design of all skylights andsolar collectors shall be approved by the ARC.No solar collectors shall be allowed on any roofslope visible from a public street, l~e, orcommon area.

Exposed radio/television antennae greater thanfour feet in height, large satellite dishes, andradio towers are not acceptable. When feasible,antennae or satellite dishes should be concealed

within the roof attic space. Small satellitedishes and short radio antennae "may bepermitted with ARC approval. Small satellitedishes, generally 18" in diameter, may belocated behind garages at ground level andscreened with evergreen shrubs or in an obscurearea of the rear lot not affording visibility toneighbors, the street, alleys or common areas.When radio antennae, generally less than fourfeet (4'), and small satellite dishes are loca~ed

on a rooftop, they must be contained on the rearhalf of the roof and may not extend above theridgeline ofthe house. No satellite dishes, radioor television antennae will be permitted in anyyard located on a lake or common area.

Rooftop or window HVAC equipment is notpermitted under any circumstances.

2.3.11 Garages

2.3.11a General

The traditional solution is to detach the garagefrom the house proper, allo\ving the house tostand on its own and reflect the relationships ofthe interior spaces to the street. For shelter, thegarage may be connected to the house with acovered walk, breezeway or arbor.

All garage doors should be ofmetal design andof a color which complements the adjacentwall. No wood or particle board doors arepermitted. All garage doors are to be paneledmetal. Glass fenestration is permitted. Noreflective film or foil is permitted on windows.Murals on garage doors are not permitted.

Treatment of detail on garage doors should beconsistent with the overall character of ththouse. Carports are prohibited.

The roofpitch on garages should match the roofpitch on the house. The roof should slopetoward the driveway or the alley for all one­story garages in order to de-elnphasize thegarage door. The roof on the garage should becompatible in scale to and never exceed theheight of the house, particularly \vhen secondstory garages are constructed.

2.3.11b Attached Garages

Attached garages are linlited to lots which backonto common areas or lakes or allo\ved ininstances when located on the rear of-the honle.Attached garages on alley lots are pemlittedwhen accessed from the alley. Front-loadedattached garages are not permitted. Side­loaded, tum in garages in front of the livingarea ofa house are not permitted.

The highest roofs of the house should not occurover the garage due to the added visualemphasis. Treatment ofdetail on garage doorsshould be consistent with the overall characterof the house. This may be accomplished withone or t\vo well placed windows along the topof the garage door and by breaking up the nlass\vith paneled construction.

2.3.11c Two-Story Garages (LivingQuarters Above)

Garages with living areas located on a secondstory will be allowed on all sections exceptVillage Homes, any lot adjacent to Jones Roador Har-Ber Avenue, or on any lot where adetached garage is not already permitted, Le.,adjacent to a lake or common area. Garages

with living quarters will not be pennitted onlots with one story residences.

Two-story garages will be limited to attic­structure living areas only (often called seniorcitizen living quarters, servant's quarters, orsecond story living quarters). Full eight to ninefoot (8-9') plates are not pennitted.

For nvo-story garages located on alleys, anadditional parking space is required. Theadditional space must be contained in a three­car garage or 8.S' x 19' parking pad.

2.3.12 Porte Cocheres

Porte cocheres (the roofed structure extendingfrom the side of a home over the adjacentdriveway) are pennitted with ARC approval butmust meet the sid~ yard setback requirementsof a residence and not the side yard setbackrequirements ofa garage. Porte cocheres mustbe an integral part of the house. Columns mustdepict the same articulation as other significantdesign elements on the front of the house. Theroofline ofthe porte cochere must complementthe roofline of the remainder of the house.

2.3.13 Accessory Buildings

Tool sheds, storage sheds, garden sheds, andpotting sheds are pennitted. Children'splayhouses are pennitted. Greenhouses arepennitted with ARC approval. Metal andfiberglass buildings are not pennitted. All plansfor accessory buildings must be approved bythe ARC. All accessory buildings must notinfringe on building setback lines and utilityeasements.

2.4 Landscape

2.4.1 General

The builder is responsible for the landscapingof all areas on hislher property and the portionof the street right-of-way between the property

. line and the street curb except where otherwiseindicated. Street trees are required to be plantedby the builder except for certain streets whIchwill be the responsibility of the developer (referto the exhibits within this section for type andamount of trees per lot). Plantings other thangrass, groundcover, and low growingornamentals between the street curb and thepaved sidewalk are not pennitted in order topreserve adequate sight lines for motorists.Installation of all required minimumlandscaping must occur prior to occupancy ofthe residence. Installation of landscaping,including materials and \vorkmanship, mustcomply with current industry standards.

Refer to the Appendix for requirenlents for treeprotection, landscape maintenance, grading,foundations, and sediment control, irrigationand the plant palette.

2.4.2 Streetscape Design Intent

The landscape treatment for each section ofHar-Ber Meadows should have its own themeand individual character, but yet be consistentwith other neighborhoods to maintain an overallcontinuity throughout the community. Througha comprehensive program of right-of-waylandscaping, a sense of continuity can befostered within the community. Landscapedetails such as common street trees can

reinforce the desired community image in eachof the neighborhoods or specific streets.

The perceived image of the commWlity can begreatly enhanced through the use of lowberms, screening, landscaping, and otherimprovements along the perimeter rights-of­way. In addition, landscaping can enhance thesafety of roadways and pedestrian areas byguiding the circulation of cars and improvingthe safety of the people on foot or bicycle.

Entry points are intended. to set the initialcharacter of the development through theplacement and selection of monuments,signage, textured pavements, and landscaping.Each entrance shall have a sinlilar image toestablish community identity.

2.4.3 Street Tree Requirements

Trees are to be machine dug \vith a minimumtwo inch (2") caliper measured twelve inches(12") from the base ofthe tree. The trees withinthe Estate Lot section must be a minimunl ofthree inch (3") caliper. The developer for Har­Ber Meadows will plant street trees within theright-of-way ofstreets identified below:

streets adjacent to the lots which may front onthese streets. Each street tree must be plantedbetween the sidewalk and the street curb.

2.4.4 Lighting

The builder/owner is to install and maintainlighting on individual lots in a manner to notcause distraction, nuisance or to be unsigh~ly.

Light sources should not conflict with the sightlines of pedestrians or motorists in a mannerwhich endangers their safety and welfare. Lightsources must not "spill over" into neighboringyards. Light sources must be visible.

Exterior residential lighting can convey a Wam1,

inviting atmosphere. Care is to be taken inplacing fixtures, selection of fixtures and typesof light source. Exterior illumination ofarchitectural features such as columns, entriesand porches, chimneys and landscape featuresare encouraged.

Lights should be directed to illuminate housenumber graphics. Translucent address signsilluminated from behind are not permitted.

Ground lighting or decorative fixtures must beofhigh quality materials and workmanship andbe in scale and style with the residence. Exceptfor direct burial light fixtures, only castaluminum, brass, copper, or crafted cedar andoak are allowed. Plastic lighting fixtures arenot permitted. Power supply transformers andcable may not be exposed. All wiring forexterior lighting should be underground.

Free standing decorative fixtures and lamppostsare acceptable but must be approved by theARC. Pathway lighting and landscape lightingis encouraged. Such lighting must be

inconspicuous. Sodiwn vapor lights, "except forsubdivision street lights, are prohibited.Mercury vapor security lights, when the fixtureis visible from public view or fronl other lots, isprohibited. Mercury vapor lights, when usedfor special landscape lighting effect (hung intrees as up or down lights) is permitted \\'ithARC approval.

Colored lenses on low voltage lights, coloredlight bulbs, fluorescent and neon lighting arenot pemlitted.

Incandescent, low voltage incandescent, metalhalide, quartz and natural gas lights areacceptable.

2.4.5 Residence Landscaping

Planting bed edging is not required,;but isencouraged for maintenance purposes and todefine the shape ofplanting beds. Loose brick,plastic, concrete scallop and corrugatedaluminum, wire wickets, vertical tinlbers,railroad ties, etc., are prohibited. Acc~ptable

edging is Ryerson steel, brick set in morlar, andlandscape timbers (2" by 4",2" by 6", 4" by 4",and 4" by 6") set vertically in grade. Horizontallandscape timbers may only be used in theevent of retaining walls in place of grading;but, may never be used in the front ·or side yardsvisible from the street.

Planting beds may be curvilinear or geometricwith the shrubs massed in tiers, smaller shrubs,perennials, and ground cover in the front andlarger shrubs in the rear of the bed. Groupingsof shrubs of the same species provide asubstantiallook. Curvilinear beds should havesmooth, flowing curves and/or true radii.

Landscaping along the front sidewalk when afence has been located there is stronglyencouraged. Landscaping along the sideproperty lines is pennitted with or without afence.

Mulch all planting beds with three inch (3")shredded pine bark or equal at time oflandscape installation. Wood chips are notpennitted. No gravel or rock of any size orcolor is pennitted for use or substitution forshrubs, ground cover, mulch or grass lawns.Specimen boulders 12" in diameter or greaterare pennitted in Earth tone colors only. Brightcolors are not pennitted.

3.1 Site Planning Criteria

3.1.1 General

The Village Homes within Har-Ber Meadowsare identified as those homes with a minimum30' and maximum 37' lot width, accessed fromthe rear by alleyways, and located across fromFounders Park. The design guidelines forVillage Home Lots are addressed within thissection.

3.1.2 Building Setbacks

Encroachment upon established setback lineswith residential .structures, garages, andaccessory buildings is prohibited. Balconies,eaves, bay \vindov;s, fireplaces, overhangs,and cantilevered second floor space mayextend into these setback areas, except forinstances where the setback is also a utilityeasement. Maximum overhang allowed is 2'­0" (two feet).

This side yard \\'ill bedefined as the space between two homeswhich shall be utilized for the benefit of theowner of the "dominant" side yard--alsoreferred to as the lot o\vner \"ith \vindo\\'s onthe ground floor shared side yard. The \vidthof the useable yard shall ahvays be amininlum of ten feet (five feet for the"dominant" side yard plus five feet for the"servient" side yard). The "servient" lot owneris the lot o\vner \vith no windo\vs on theground floor of the shared side yard. HOIneson comer lots shall have their ten foot useableside yards adjacent to the side street. Each lotowner must abide by the regulations identifiedin the "Village Honle Lot Side YardEasement" section of the Covenants,Conditions. and Restrictions for Har-BerMeadows.

3.1.3b Privacy Wall

Each house on the Village Home Lot must bedesigned and constructed to incorporate a sixto eight foot (6-8') height privacy wall ofmasonry construction extending from the sidewall of one Village Home to the side wall ofthe adjacent Village Home and perpendicularto both walls. A three foot (3') wide gate mustbe installed to pennit access to the side yard.

No structure maybe installed on the side yard easement whichcan be seen above the height of the privacywall except for landscaping.

The gate shall be constructed to the standardsas identified in Section 2.2.7; however, theARC may permit gates which afford greaterprivacy or gates which deviate from thisstandard on a case-by-case basis. The mostappropriate distance from the front elevationof each Village Home will be determined bythe floor plan. The wall must match thematerials used on the adjacent house.

3.1.3c Other Improvements

3.1.4 Lot Coverage and Unit Size

Lot coverage is identified by buildings,driveways, patios, walkways, and otherstructures. For the purpose of calculating lotcoverage, pools, spas, and wood decks are notconsidered structures. A limit on lot coverageis necessary in order to preserve an adequateamount of open space and landscaped areasthroughout the development, as well asmaintain the desired character of individualneighborhoods. Lot coverage shall not exceedthe percentage identified below.

3.1.7 Driveways Accessing Alleys

All lots adjoining an alley must have drivewayaccess to the alley. The width of the drivewaymust be a maximum of eighteen feet (18') fortwo-car garages.

4.1.4b Screen Fencing

Due to potential for negative impact ofadjacentland uses, certain lots will be pem1itted toconstruct privacy or screen fencing on rear, and,in some instances, side property lines. Theselots are identified in this section.

An eight-foot (8') high privacy fence will bepennitted only along the rear property line ofalllots abutting the commercially zoned landlocated adjacent to Har-Ber Meadows .and nota part of Har-Ber Meadows. Eight-foot highprivacy fencing is limited to the rear and sideyards of the following locations:

4.2 Architecture

4.2.1 Garages

Attached garages are limited to lots which ba~k

onto common areas or lakes or allowed Ininstances when located on the rear of the home.Detached garages may be permitted in the rearof a lot which borders a common area \vhensetback an adequate distance from the rearproperty line. The ARC will revi.ew requestsfor detached garages on lots bordenng commonareas on a case-by-case basis. Front-loadedattached garages are not permitted. Side­loaded, tum-in garages in front of the livingarea are not pennitted.

Eight foot (8') fencing must be installed withthe finished side facing Har-Ber Meadowsresidential development (finished side faces theinterior of the lots). Six-foot (6') fencing mustbe installed with alternating panels and exposedrails along lot lines to provide a unifonn,attractive fence to each abutting property.

4.1.4c Fencing along Lake Lots

Wood screen fencing along rear property linesor side property lines of lots adjacent to a lakeare not permitted. Wrought iron fencing ispermitted along rear property lines adjacent toa lake and must extend from the rear comers aminimum of twenty-four feet (24') along bothside property lines. The wrought iron fencemust be four feet (4') in height. Six foot (6')fencing is permitted with express ARCapproval.

The highest roofs ofthe house should not occurover the garage due to the added visualemphasis. Garage doors should not donlinatethe facade. Treatment ofdetail 011 garage doorsshould be consistent with the overalldharacterof the house. This may be accomplished withone or two well placed \vindows along the topofthe garage door and by breaking up the nlasswith paneled construction.

4.2.2 Porte Cocheres

5.1 Site Planning Criteria

5.1.1 General

The Estate Home Lots are those lots with aminimum area of29,000 square feet and locatedwest of proposed 56th Street, north of FrancisFair Park South and east of Francis Fair ParkNorth. The character of this neighborhood isessentially larger lots, deeper expanses of frontlawns, and greater setbacks between residences.More than half of the perimeter of this well­defined neighborhood is edged with parkland.

The Community ofHar-Ber Meadows has beendesigned to promote "street scenes" that areaesthetically pleasing in character and reflectthe feeling of a neighborhood. The purpose ofthis section is to identify those elements thatwill influence the overall neighborhoodappearance and street character.

Lots adjacent to common areas are to bedeveloped to derive full potential ofopen spaceand views. Likewise, the residences andgrounds should be equally pleasing whenviewed from these areas as \velI. Designconsideration for buildings, site layout, fencing,and landscaping should be addressed topreserve and enhance vie\vs for all residentsthat view these areas.

The builder/o\vner is to develop and maintainindividual lots in a manner prescribed by thepeclaration of Covenants. Conditions andRestrictions and by these design guidelines andstandards. Compliance with building setbacklines, lot layouts, driveways, sidewalks,garages, fences, grading and drainage, etc. arerequired of the builder/owner, includingconnections to utilities.

5.1.5c Garage Placement, Common Area Lot

In order to establish the character of theneighborhood and preserve the integrity of theopen space amenities, certain restrictions mustapply. 5.2.1c Two-Story Garages(Living Quarters Above)

Detached garages with living areas located on asecond story will be allo\ved. Two-storygarages will be limited to attic-structure livingareas only (often called senior citizen livingquarters, servant's quarters, or second storyliving quarters). Full eight to nine foot (8-9')plates are not permitted. Each second storyliving quarter may not exceed four hundredsquare feet (400 s.r.) of space excluding thestairwell. Second story living quarters will bepennitted on lots which abut 56th Street as longas they are setback a minimum of twenty-fivefeet (25') from the street and landscapedbetween the street and garage.

6.1 General

Specific requirements and guidelines forgraphics is intended to limit the number ofsigns, to present an image of quality and tosquelch the propensity of competing buildersto "outdo" each other in attracting homebuyers with signage.

Through an organized system of signag.e,adequate direction to builder products will beachieved and the developer will be able topresent Har-Ber Meadows as a quality, masterplanned community.

7.1 General

The official submittal of plans andspecifications to the ARC is to provide areview process for confonnance to guidelinesand standards, adopted by the ARC. The endresult is to impart a visual character and asense of conununity through controlledarchitecture, landscaping, and other designelements identified these guidelines.

All new construction, subsequentconstruction, remodeling \vith exteriorexposure, expansion, and demolition ofstructures must be reviewed and approved bythe ARC prior to commencement of any on­site building or construction activity. Theapproval process can be facilitated ifcompleteand high quality submittal documentation isprovided to the ARC. The ARC reserves theright to alter the review process in order toensure an adequate review ofall submissionswhile accommodating the needs of buildersand property owners.

The design for residences nlust be approved inwriting by the ARC before construction of aresidence can begin. The ARC is committedto a high level of design quality within ourcommunities by reviewing residential designand plotting submissions and working withour builders to achieve this goal. Compliancewith these guidelines is paramount, but theARC will review requests from builders andhomeowners· for modifications from theseguidelines on a case-by-case basis.

Each submittal shall consist of two (2) sets ofBlueline prints and supplementaryspecifications and two (2) copies (photocopies acceptable) ofthe lot plan. Preferred lotplan scales are 1"=20' and 1/6"=1 '-0". Onlycomplete submittals will be reviewed.

The Builder will have complete responsibilityfor compliance with all governing codes andordinances. .

A landscape plan will not be required with thesubmittal documents, unless the builderwishes a review by the ARC. However, eachbuilder is expected to comply with theminimum standards for landscaping containedwithin these guidelines.

7.3 Timing

The ARC shall review and approve in writing,each submittal or recommend revisions tothose aspects of the plans that are inconsistentwith the builder guidelines.

8.1 Plant Palette

The following is a list of plant materialconsidered to be appropriate for Har-BerMeadows. Other plant material may be used,but priority should be given to plants from thispalette. The use ofgolden euonymus, becauseofgrowth characteristics and susceptibility todisease, is discouraged. Yucca, cactus, andbamboo are not in character with the plantpalette and are discouraged and may be maybe rejected. Silver Maple, Acer saccharinurnis not permitted due to its shallow rootgrowth. Mulberry trees are not permitted duein large part to their rapid invasive suckergrowth habit. Malus species should beconfined to rear yards, particularly rear yardsadjacent to common areas and lakes. Thisrequirement is meant to enhance the potentialfor wildlife in these areas. Canadian Hemlockis not permitted because once they catchspider mites, they are difficult to rid and havea tendency to spread to other CanadianHemlocks. Magnolias are a stronglyencouraged ornamental tree (see Plant List).

8.2 Landscape Maintenance

Each yard shall be maintained in a neat, cleanand orderly condition by the builder/ownerprior to and after the sale ofsuch residence.

All landscaping is required to be maintainedin a healthy and attractive appearance. Propermaintenance includes:

The builder/owner shall be responsible forindividual site development and maintenanceincluding the area within the public streetright-of-way (between the back of the streetcurb and property lines). The builder/ownerof corner lots shall be responsible for theright-of-way for both streets.

A. Tree protection fencing 'should be'placed around drip line of trees "prevent storing of nlachineryequipment which can cause so,compaction and mechanical damage.No materials or equipment of any sortmay enter or be stored within thefen'ced protection area, or dripline ofthe tree; potentially toxic nlaterialssuch as solvents, paints, gasoline, oil,etc. shall not be poured on the groundnear the dripline of.the trees.

C. Soil should not be excavated, spread,spoiled or otherwise disposed ofwithindrip line of trees.

E. Trenching or boring near protectedtrees should be avoided if at allpossible. When necessary, care shouldbe taken to avoid damaging the tree'sroot system by hand trenching.

D. Trash fires shall.not be pennitted.

B. Excessive pedestrian traffic should notoccur within drip line of trees. Careshould be taken when working in thevicinity of trees in order to preventdamage to trunks, branches, andfoliage.

8.3 Tree Protection/Preservation

The foilowing procedures are recommended toinsure the survival and good health of treesexisting on site. The builder shall use thefollowing guidelines to preserve trees on site:

a developed lot. Where keeping utilitylines from within tree canopies is notpossible, care should be taken toprotect root system as much aspossible.

H. In close areas, where fencing to dripline is not possible, protect trunk bystrapping (not nailing) a continuousshield ofwood, 2" x 4" x 5', around thetrunk and lay plywood on ground indrip line of tree to prevent compactionof soil by trucks or machinery, etc. isevident. No nails, bolts, ropes or guywires shall be attached to any trees.

I. Prune trees using horizontally acceptedmethods to compensate for any loss ofroot system.

J. Removal of any tree "'ith a caliper of8" or more measured 12" from thebase of the tree shall reguireapproval of the ARC.

Where tree clusters are preserved, buildershall also preserve understory if possible.This helps maintain conditions aroundexisting root systems.

8.4 Grading, Foundations &Sediment Control

8.4.1 Grading

Berms are to be graded in gentle, undulating.naturalistic fonns, not straight or steep slopes.Berms should undulate in width as well asheight where area pennits. Continuous straightline, constant height berms are not pennitted.Benns should appear naturalistic in form.

Swales are to be graded shallow, but wide toslow runoff. Avoid steep cuts for naturallook.

Steep slopes of 2.5:1 or more should bebroken with retaining walls or steps.Terracing of lawns is encouraged only whenthe grades are too steep.

A minimum lawn slope of one per cent (1 %)is preferred but under certain circumstances,lawn slopes ofone half (~%) to one percent(1 %) may be allowed.

It will be the responsibility of each builder toprovide adequate drainage for each honle.Builders.shall respect the overall grading planwhen developing a lot or group of lots.

Caution should be used in establishing thefoundation elevation so that adequate drainagefrom the back yard around to the front is notimpaired by drive\vays or slabs that areconstructed too high.

8.4.2 Foundations

A fonn survey should be undertaken to ensurethat building setback lines have not beenviolated prior to foundation construction.Foundations shall comply with local BuildingCode requirements.

Eighteen to twenty-four inches (18"-24")between grade and finish floor elevation isrequired on all homes. Regional architecturalexpression should be implemented in order todetermine the streetscape character. The use ofmasonry or stone as a wainscoatlfoundation is

required. Exposed concrete pours or exposedconcrete block foundations are not permitted.

8.4.3 Sediment Control

In order to maintain clean streets and preventsiltation or stornl se\\'ers and drainagecharmels, all projects in Har-Ber Meadows arereQuired to practice sediment control duringconstruction. As soon as earthworkcommences, sediment control methods shallbe installed in such a way as to filter all stonnwater run-off from the tract into the publicstreet. The sediment control system shallremain in place and in good repair untilconstruction is complete. landscaping isinstalled. and lawns are established.

Builders shall confonn to all, regulatoryagencies' rules, regulating standards, andcriteria governing sediment control includingthe Arkansas Department ofPollution Controland Ecology.Builders shall respect the overall sit~ gradingplan when developing a lot or group of lots.

When construction is to begin adja~ent to acompleted property, the contractor is requiredto put up a solid black silt fence along theentire property line separating the proposedconstruc-tion site from the completedproperty. This fence should be maintained bythe builder during construction and everyeffort should be made to keep anyconstruction debris from going over the fenceonto the adjacent completed property.

8.4.4 Site Maintenance DuringConstruction

There are no dump sites within the Har-BerMeadows development. All material shall be

removed from the premises dufconstruction and conlpletion of construct:Each builder will be required to maintaiIdumpster adjacent to each residence or groLof residences under construction. Thi~

dumpster should be emptied periodicallywhen construction debris reaches the rinl ofthe dumpster. Each Friday, all constructionsites are to be cleaned so as to facilitate apleasing enviromnent tohomeo\vners andprospective buyers and to eliminate anyhazards. Construction materials shall be keptout of the street rights-of-way at all times. Allpark sites used by the construction cre\vs shallbe free from trash. All streets and alleys are tobe free from dirt, debris, and spilled concrete.

Each builder/owner shall also be responsiblefor street cleaning and trash pickup on theadjoining .lots and areas where homes arebeing constructed.

8.5 Irrigation

Installation ofan irrigation system by builderis encouraged but is not mandatory.

Sprinkler heads should be located toeffectively water areas intended withminimum overthrow onto pavement, walks,etc., and to effect 100% overlap insuringeffective and even coverage.
