Accessory Structures An accessory structure is a building or structure that is incidental or accessory to the main use or building located on the same property. This can include sheds, garage, pool houses etc. There are different requirement that need to be reviewed prior to any building permit being issued. Listed below are some general requirements for accessory structures in residential zones however refer to the Town Zoning By-law 1999-52 for additional information
1. Requirements for structures that do not require a Building Permits
• Structure is no greater than 10 sq meters (108 square feet) • Does not have plumbing within the structure • Maximum building height is 5.5 meters (18’-0” to the top peak of roof) • Minimum set back of 1.0 meters (3’-4”) is required from interior lot lines • Refer to attached sketches
Construction Requirements:
• Not regulated by the Ontario Building Code • Must comply with all municipal by-laws • Building cannot be located on an easement • Existing rear yard draining must be maintained • Ensure that all rain water does not shed on to neighbouring properties
2. Requirements for structures that require a Building Permit
• Structure is greater than 10 sq meters (108 square feet) • Contains any type of plumbing within the structure • Maximum building height is 5.5 meters (18’-0” to the top peak of roof) • Minimum set back of 1.0 meters (3’-4”) is required from interior lot lines • Structure cannot exceed the size of the main dwelling • Refer to the following page for additional information for zoning
Construction Requirements:
• A ratwall type foundation may be used for this type of structure. Structure
cannot be larger than 55 sq meters (592 square feet) and it cannot support any type of masonry.
• Full foundation depth must be used if supporting masonry and the structure is greater than 55 sq meters (592 square feet)
• Buildings cannot be located on an easement • Existing rear yard draining must be maintained • Ensure that all rain water does not shed on to neighbouring properties • Refer to attached sketches from foundation types

3. How large of a structure can I build on my property? The size of structure that can be built on any particular property is dependent on several factors.
• Zoning • Size of property • Size of existing residence • Size of all existing structures on the property
The zoning of a property will determine the maximum limit of lot coverage. There are several zoning designation within the Town of Amherstburg. Please confirm the zoning of your property prior to any application submission. Each zoning will have different permitted lot coverage’s. Refer to the Zoning Bylaw. This guide does not include Agricultural and Industrial zones. For example R1 zoning has a maximum lot coverage of 35% for all structures including the dwelling unit and any other structures on the property. There is an additional requirement that the size of the accessory structure cannot exceed the size of the main dwelling. The maximum allowable size of structure can be up to 10% of the lot size however cannot exceed 1076SF. With the R1A zoning the requirement for 1076 SF is exempted and the total lot coverage is 30% and maximum lot coverage of 10% for accessory structures. When calculating the size of structure you must meet the follow conditions:
• Does the area of main house and any structure on my property equal or less than 35% of my lot size? (The percentage of coverage depends on the zoning of your property)
• Is my proposed structure less than the size of the main dwelling? • Is the proposed structure less than 10% of the lot area and not larger than 1076 SF.
(The 1076 SF may be exempted depending on the zoning of your property) The following page is a calculation sheet to help you determine the size of structure that can be constructed on your property.

What is required to obtain a building permit for an Accessory Structure?
Along with your completed application form you will be required to submit two full sets of construction drawings completed by a certified designer. All drawings shall be a minimum scale as indicated. The following drawings are required.
• Site plan (sample attached) Drawing must include location of property lines, existing structures including dimensions, septic system location in proximity to the new struct
• Foundation plan (1/4” = 1’-0”) • Floor plans (1/4” = 1’-0”) sample attached • Elevations (1/4” = 1’-0”) sample attached • Sections and details (1/2” = 1’-0”) sample attached
Along with the drawings listed above, other approvals may be required for your particular project. The following are some approvals that may be required upon submitting your application prior to issuance of a building permit.
• ERCA • Septic Sewage System Approval • Ministry of Transportation • Committee of Adjustment • Minor Variance • Site plan agreement • County road approval • County road construction / Entrance permit
Refer to sample drawings within this package. What is the cost of a building permit? The following is a sample list of possible fees for a 24’ x 24’ accessory structure. Standard Fee for accessory structures $ 150.00 Indemnity Fee $ 50.00 Indemnity/Application Fee Deposit $ 500.00 The Indemnity/Application Fee Deposit is required upon application submission and will be refunded following the final inspection of the building and permit is completed and cleared. How long does it take to get my permit and when can I start? Building permits are usually issued within 10 business day of a complete application being submitted. Applications that are incomplete because of missing or incorrect information will be delayed. No work can commence until the permit has been issued and all fees have been paid. What inspections are required and how are they scheduled? Requesting inspections is the responsibility of the homeowner or the contractor of the project. Inspections must be booked at least 24 hours in advance. Each major phase of construction must be inspected to make certain the work conforms to the Ontario Building Code. Listed below are the mandatory inspections that are required.
Inspection Requirements
The following schedule outlines the required inspections for building projects. It is the builder’s responsibility to request inspections and confirm that all work has been approved. Permit drawings must be on site at time of inspection. Any work covered before inspections are made, must be uncovered by the applicant for proper inspection. Inspections will be available between the hours of 10:00 am to 12:00 pm and 1:00 pm to 3:30 pm. Inspection request must be made 24 hours in advance at 519-736-5408.
1. Footing inspection (before concrete is poured).
2. Underground plumbing inspection (water test or air test)
3. In-floor heating inspection
4. Rough plumbing inspection (water test or air test)
5. Water Line inspection (air test required)
6. Rough framing inspection (Provide roof truss drawings and engineered floor truss drawing layouts)
7. Insulation & air/vapour barrier inspection.
8. Final building, plumbing & heating / Occupancy Permits (prior to occupancy)

Decks and Fences Deck Requirements:
• Maximum 10% lot coverage • No building permit is required if the deck is less than 24” above finish grade level.
However must comply with municipal by-laws and the Ontario Building Code • Building permits are required if the deck is 24” or greater above finish grade level. • Building permits are required for any roof structure constructed as part of the deck • Minimum 1.5m (5’-0”) side yard if deck is off of the house • Minimum 6.0m *(19’-8”) rear yard if deck is off the house • Minimum 1.0m (3’-4”) side yard (accessory to a pool)
Fence Requirements:
• No permits required however must comply with municipal by-laws • Minimum height for swimming pool fences is 4’-0” • No greater than 6’-6”” high including all lattice work • Fences in front yard beyond front portion of the building can be a maximum height of
3’-0” & reduced to 2’-0” high within sight triangles (corner lots) Verify with Building Dept. • Must be on your property • Town will not be involved in any civil disputes
