The NEW CapitalGains Tax Rules

Nick Skelton, partner at Doncaster-basedCrozier Jones, Chartered CertifiedAccountants, outlines what businesses need toknow.

In his emergency Budget on 22 June 2010Chancellor George Osborne introduced a newrate of CGT with immediate effect. NickSkelton, partner at Doncaster-based CrozierJones, Chartered Certified Accountants,outlines what you need to know.

From 23 June 2010 there will be two main ratesof CGT, 18 per cent and 28 per cent, in place ofthe previous single rate of 18 per cent for allgains. The rate paid by individuals will dependupon the amount of their total taxable income.These new rates will not apply to those businessassets which qualify for entrepreneurs’ reliefwhich remain chargeable at 10%. The changewill therefore affect, for example, the sale ofsecond homes, buy-to-let rental properties,stock market investments and other short-term or speculative gains.

There has been no change to the annualexemption so no CGT is payable on the first£10,100 of chargeable gains.

You will be pleased to hear that gains madebefore 23 June 2010 will remain taxable at theold rates and that in working out the CGTpayable, taxpayers will be able to deduct lossesand the annual exemption in the waywhich minimises the tax due.

So, an example

In 2010/11 Mr Brown’s taxableincome, after all allowabledeductions and the personalallowance, is £27,400. The upperlimit of the income tax basic rate

band is £37,400. Mr Brown sells an asset in May2010 and realises a chargeable gain of £17,000.In November 2010 Mr Brown sells another asset,realising a chargeable gain of £25,100.

Mr Brown has no allowable losses to set againstthese gains, and the Annual Exempt Amount(“AEA”) for 2010/11 is £10,100. Neither of thegains qualifies for entrepreneurs’ relief.

Mr Brown’s taxable income is £10,000 less thanthe upper limit of the basic rate band (£37,400 -£27,400). Mr Brown sets the AEA against thelater gain (because part of that gain is liable totax at the higher CGT rate), leaving £15,000taxable (£25,100 – £10,100). The first £10,000 of the £15,000 is taxed at 18 per cent and theremaining £5,000 is taxed at 28 per cent. The £17,000 chargeable gain Mr Brown realisedin May 2010 before the change of rates on 23June 2010 is taxable at the old 18 per cent rate.

PEOPLE with mentalhealth issues arebeing helped to stay inwork and return totheir jobs successfullyby a Doncaster-wideNHS project.Better Workplace Better MentalHealth, run by NHS Doncasterand funded by the Big LotteryFund, works with businessesand GPs to improve emotionalwellbeing in the workplace andencourage people with stress,anxiety and depression backinto work.

The three-year programme,which was launched in October2008, helps businesses ensurethat their policies and practicesare positive about mentalhealth and wellbeing. Theproject also helps individualsexperiencing mild to moderatemental health problems returnto work or remain in their jobsduring treatment.

Employees take an average ofseven days a year off work forhealth reasons and it isestimated that mental healthproblems account for 40 percent of this figure.

Tackling mental health in theworkplace makes goodbusiness sense, improvingemployee commitment to workand staff performance,

reducing staff turnover andraising the organisation’sreputation and image.

Using a “needs assessmenttool” the Better WorkplaceBetter Mental Health teamworks with businesses toidentify specific areas that canbe improved so thatorganisations are able tooperate best practices aroundmental health.

The service can offer guidanceon training for mental healthawareness and help with returnto work plans for absentemployees.

The programme also worksclosely with GPs to encouragetheir patients back to work byengaging them in meaningfulactivities such as volunteering.

Jane Jefferson, Mental HealthProject Facilitator, said:

“We have had excellentfeedback from clients whohave said they are reallypleased that the type ofsupport and information weprovide is available to them.

Some had wanted to startvolunteering, for example,but did not know how to goabout it before this projectcame along. This type offeedback is extremelyencouraging and proves thatwe are inspiring andempowering people to makepositive changes in theirlives.

We have discovered that notevery employer can affordthe services of anoccupational healththerapist. It is theseemployers who perhaps willbenefit most from what theproject is offering.”

Better Workplace Better MentalHealth is part of the AltogetherBetter programme, whichincludes 16 projects that aimto improve the physical andmental well-being ofcommunities within theYorkshire and Humber region.

Most people believe thatinflation is the general rise in aset of prices of a basket ofgoods. The goods in thebasket being ones chosen bythe Office of NationalStatistics. But the rise in pricesis a consequence of inflationand not the cause.

The price rises occur becauseof the policies of Central Banksincreasing the money supply.As most business people arewell aware when the supply ofsomething is increased itsvalue reduces and it is thesame with money.

Some also believe that if theprice of oil increases then thisagain is the cause of inflation.But, if the price of oil hasincreased without an increasein the money supply then theprice of other products wouldhave to decrease tocompensate for the amount ofmoney used to purchase oil.

Then there would be noinflation. General price

increases can only occur whenthe money supply hasincreased.

Over recent years the Bank ofEngland have been given aninflation target of 2% perannum. If they were to meetthis target then the purchasingpower of someone’s savings, ifheld in cash, would fall by 18%in just 10 years. If inflationaveraged 4% per year then thevalue would fall by over 33%within 10 years. In the 1970’sinflation averaged 14% peryear and many who retired inthe late 1960’s, and receivingfixed incomes, saw the value oftheir income fall over 70% overthat decade.

In addition to the loss of realincome that can be caused byinflation, Individuals no longerreceive any Inflation(Indexation) Allowance whencalculating Capital Gains Tax(18% at the time of writing butthis is likely to increase afterthe emergency budget on the22 June 2010).

What this means is that in thefuture if an asset is disposed ofthat is subject to Capital Gainsthen Tax would be payable ongains that were purely down toinflation. The following exampleshows an individual whoinvests £1,000,000 for 10years.

The investment increases at10% compounded so that after10 years it is worth £2,593,742.However, inflation alsoaverages 10% per year so that£2,593,742 in year 10 onlypurchases the same amount ofgoods that £1,000,000 did 10years earlier. In effect no realgain has been made. This isnot how the tax man sees it, asa gain of £1,593,742 is taxedat 18% resulting in tax of£286,874 being due. Theinflation adjusted after taxvalue is £889,398 a fall of£110,602 or 11% purely downto the inflation tax. (Seediagram (A) opposite)

easing, £200 Billion within the last 18 months, inmy opinion it is highly likely this increase in themoney supply will soon begin to show up inincreased prices and it would be wise forinvestors to have strategies to counter theeffects of inflation.

The graph below illustrates the fall in thepurchasing power of the British £ over the last300 years. During the period it can be seen thatthe value of the £ has fallen quite rapidly sinceBritain went off the Gold Standard (when the £was convertible to Gold).

Since 1971 when President Nixon cancelled theconvertibility of US$ to Gold, most of the Worldscurrencies have had no backing of any tangibleassets. History does show that on the manyoccasions that un-backed paper money hasbeen used as a currency it has always ultimatelyreverted to its intrinsic value.

to take 300 Test wickets andmaking his debut for Yorkshireat only 17 he also had a goodsense of humour. Askedwhether he thought anyonewould surpass his 300 wicketachievement, his reply wastypically forthright: “If anyonebeats it, they’ll be bloodytired.”

It needs doingright, unfortunately many businesses are getting itwrong and creating accounts that contravenefacebook terms and conditions and run the riskof their account being closed losing all theircontent and established connections.

As a general rule of thumb, most annualmarketing budgets are usually set at around10% of annual turnover.

The 10% rule is well known in the industry andis applied if you consistently undertakemarketing activities.

If you haven’t marketed in a while or are justlaunching in business, the percentage willincrease to around 12-15% of turnover(projected turnover, if you’ve been trading forless than a year). If you’re launching a newproduct or campaign, the figures might notnecessarily be the same but you could use thesame formula as a good starting point.

The mistake most companies make is lettingmarketing activity die off. If you’re thinking thatI’m bound to say that as I’m in the marketingindustry, ask yourself this - do you find thecompanies that are most successful are usuallythe ones undertaking consistent marketingactivities?

Even if you’re very successful and are notlooking for any more clients, set your marketingspend slightly lower to around 7-9% of turnover.Most of that budget can be spent on marketingto existing customers and looking after them.

The bottom-line is that it’s unnecessary to over-complicate and over-analyse the subject ofmarketing or budgets. Setting a budget doeshelp, but it’s the message that makes thedifference. There’s no point spending even 50%of your turnover on marketing if the messageisn’t effective.

A recent survey conducted by weight-loss andweight-management specialists LighterLife, hasrevealed that more than a third of womencurrently on a diet are secret scoffers.

A massive 36 per cent – or SEVEN million - ofthe nation’s ladies watching their waistline arehiding food or eating it in the dark. Handbags,under the bed and clothes drawers emerged asthe favourite places to keep secret supplies.

But they’ll also gorge on naughty foods in thecar, walking down the street or even on asunbed. The research found one in six secretlyeats on a weekly basis, and one in 10 does soevery two or three days.

A desperate 53 per cent of girls have even feltthey would rather have food than sex, withchocolate, takeaways and desserts the topchoice to sway them away from the bedroom.

Vivienne Stewart, LighterLife Counsellor forDoncaster and Wickersley said:

It’s a time to enjoy all the hardwork you have been putting inover the past couple ofmonths.

As discussed in previousissues, the seasons are still alittle on the late side withgardens only just really comingout of a very late Spring.

June normally means that thelawns are slowing down a littleand you should be trying toleave a reasonable amount ofgrass on to stop your lawnfrom getting scorched from thesun. I would suggest cuttingmore frequently, at leastweekly, but setting the mowerquite high which will keep itlooking as green as it can be.Having said that, we have hada fairly wet start at thebeginning of June so the grassis still green and still growinglike stink!

Mid-Summer is usually thetime that perennials get a littlebit leggy and quite oftenrequire some extra support.Stake with old bamboo canes.Watch your eyes whenweeding or better still coverwith rubber cane protectors,small 500ml plastic bottles orlarge bits of blu-tack.

Any bits and bobs ofmaintenance should be limitedto a quick hoe round yourborders. Do it during a dry dayso you can cut the peskyweeds off in their prime. If youhoe on a regular basis you cancut the tops of the weedseedlings and they will bedead by the end of the day.Make sure you have a nicesharp hoe or you will justbruise the weeds rather thantake their heads off. Brutal buteffective.

Plants in pots require extrawater and nutrients at this timeof year. They rely solely onyour help to keep them going.Don’t expect that a quickshower will suffice. You needto water at least every day, ifnot twice a day if you havetime. Water early morning andlate evening to reduceevaporation.

Hanging Baskets are alsotroublesome! Apart frombanging your head on a regularbasis they also dry out muchfaster than pots on the ground.Try and mix in some waterretaining granules to retain asmuch moisture as possible andfollow the steps above forpots.

Tab Napping – a new typeof phishing!

I know it sounds like I havefinally flipped! What am I onabout?

For those who don’t alreadyknow ‘phishing’ emails attemptto acquire sensitive informationsuch as usernames,passwords and credit carddetails by masquerading as abank or a service provider.

These emails usually invite youto click on the link and logonto your account in order toavert some kind of made upsecurity breach. Fortunatelymost of us are now wise to thispractice and we know never toclick on the link as it will directus to a fake website designedto collect personal information.

Tab Napping is a new andalarming phenomenon, whichshows how phishing has nowdeveloped to a new level ofsophistication. It works byexploiting our inattention whenbrowsing with multiple tabs.

When multiple tabs are openand you are browsing the webon your current active tab, anyof the other inactive browsertabs could be replaced with afake web page. This web pagewill look exactly the same asthe page you opened originally,so you are unlikely to noticethat it has been replaced witha fake page designed to collectyour personal data.

Phishers now have thecapability to detect when a tabhas been left inactive for aperiod of time, allowing themto see which web pages youvisit regularly. This in turnreveals which bank you useand which email account youuse.

Tips on how to avoid TabNapping

Avoid leaving tabs open andunviewed, especially tabswhere you have to input yourlogin details on the page (egonline banking).Legitimate logon web pagessuch as banks always have aweb address that starts withhttps:// rather than just http://.

If you spot an unusual orsuspicious web address in oneof your tabs, simply close thetab, open a new one and re-enter the web address you arealready familiar with.Always log out of banking sitesimmediately you finish usingthem, and don’t open othertabs in the middle of a bankingtransaction.

This is not a busy time for the plumbing andheating fraternity. We, like the rest, are glued tothe events in South Africa probably with thesame bewildered look as everyone else.

Still there’s always 2014.

Anyway, whilst the great and good of plumbingand heating engineers wander around Europenoting the deficiencies of French and Spanishdrainage we that remain need to be giving somethought to any little bit’s we could be doing tomake our lives more pleasant.

How about that outside tap?

How about all those annoying drips on thebath and sink taps?

Whilst these are only little DIY tasks they will bemuch easier to do now than when the weatherhas turned.

Any little problems you have had last winter withyour heating or hot water systems are also bestsorted whilst you don’t need them.

Just a reminder about the renewabletechnologies we have looked at many times.Our new coalition friends have already pulled thefunding from the Low Carbon BuildingsProgramme. Times are hard and saving theenvironment can wait a while (maybe not!).

That being said both the Feed in Tariffs forelectrical generation which is available now andthe Renewable Heat Incentive due in April 2011are well worth considering.

You can expect a return of up to 12% on yourinvestment and payback periods of less than 11years. I don’t know of many other investmentscurrently giving that kind of return.

So when you are thinking about what to do withyour pension lump sum or that savings pot youhave tucked away earning a couple of percentyou might like to consider some of therenewable systems on offer. A utility bill freeretirement is a possibility.

And at the same time you will be doing your bitfor the environment (though this needs to paytoo!).

Do what you can – your grandchildren’s worldneeds you!
