1. Ask the applicant whether they are a Citizen.
If no, the question below pops up.
2. If applicant not a citizen, ask if they are a Lawful Permanent Resident.
3. If yes, ask the applicant what doc they have to prove this status - if No, skip to 3 – No below.
NOTE! Get a signed Attestation,
except if referral/brief advice by
telephone ONLY.
No documentation needed unless
reason to doubt citizenship.
If yes, proceed through the interview.

a. The applicant may show an original, certified copy or photocopy that appear to be authentic. If the applicant has one of the documents, select that
document here, and make a copy of the document for the applicant's file.
b. If the applicant has one of the documents but it is not feasible for them to personally meet with CLS staff or physically transmit
documentation, ask the applicant to identify the document orally and note the information in the Notes field on the bottom of this page.
The applicant still should submit the documentation as soon as reasonably possible.
c. If CLS is only providing brief advice or consultation by telephone, CLS is not required to maintain copies of documents. But applicant
should orally declare their eligible noncitizen status and CLS must record this declaration.
d. Where the applicant requires emergency assistance, but states that they have this status, but do not have a document, select “If
document is unavailable…” from the dropdown.
e. You must have the applicant sign a Statement for Emergency Representation found in the CLS Citizen/Eligible Alien Determination to be
kept in the file.

3 – NO – if the applicant responds No to the LPR question, the question below will pop up.
4. If the applicant answers Yes to the question about filing for adjustment of status, the question below pops up. If no, see 4 – NO below.
a. Must provide this proof at the time of application, as with the other immigration documents, but with the exceptions described in the previous
section (number 3., a-e above).

a. If yes, ask the applicant what document they have to prove they are a refugee, etc. and select that option.

b. Follow the same instructions as 3., a-e above.

5 – No – if the applicant answers no to question 5. above, next the agricultural worker question pops up.
6. The agricultural worker question response should auto populate from the Prescreen where you’ve already asked the applicant whether they are an ag
worker.
a. If the answer was ‘Yes’, then ask the applicant what document they have to prove they are an ag worker (see below options). If no, go to 6 – No.

will be evidentiary support after a reasonable opportunity for further
investigation. In this case, CLS must obtain this evidence as soon as possible.”

7-No – If no to question 7. above, the question (8.) below pops up.
8. If yes to the above question, ask what documents they have as proof (see below)and click next to that document. If No, see 8-No below.

Emergency Representation
Don’t forget the “Statement for Emergency Representation”. This is allowed
when the applicant/client needs emergency services, but is unable to produce
the required immigration documentation at the time of application. A signed
copy should be placed in the file.
