EXECUTIVE SUMMARY

The Council has clear ambitions for the economic growth of North East Lincolnshire as set out in its Economic Strategy and Local Plan. Sustainable transport is integral to this and the use of private vehicles is one option which is part of the transport mix. This report and the appended documents presents an approach to the policy and provision for both on-street parking and the Council’s pay and display car parks, that aims to meet the needs of businesses, residents and visitors to the borough. REASONS FOR DECISION The periodic review of off-street parking permits, tariffs and charges ensures the charging regimes are fiscally prudent and supportive of wider economic factors.

1. BACKGROUND Following a comprehensive consultation and engagement exercise, Cabinet adopted a new Parking Strategy on 20 December 2017. Part of the action plan that followed was to undertake a review of parking permits, tariffs and charging, including the supply and pricing of spaces for disabled users.

2. PROPOSAL

2.1 ENGIE has reviewed the pricing and supply of off-street publicly available car parking in the borough. The appended reports notably include, amongst other matters, the following key points:

Charging tariffs at each individual car park have been reviewed to reflect local use and circumstances. A small price increase in certain locations could support investment in transport in the area, including improvements to the parking assets of the Council, as part of an integrated strategy that supports the economic growth of the borough.

Some targeted promotion and marketing would support revenue generation at specific car parks which are currently underutilised at certain times.

The opportunity to support short term provision for free parking as a potential to aid retail spend, when and where appropriate.

A review of the pricing for permits to provide a transparent, consistent and equitable pricing structure.

The review of parking provision for disabled users in off-street car parks.

The management of the conditions relating to requests for:-

concessionary parking permits

free parking arrangements

parking waivers 2.2 There has been extensive appraisal of all car parks with a view to supporting

the financial position of the car parks and transportation infrastructure together with supporting the local economy.

3. RISKS AND OPPORTUNITIES

3.1 There are opportunities to increase car park usage on underutilised car parks by the introduction of new competitive tariffs, which could generate an increase in car park revenue.

3.2 There is a risk that by reducing parking charges across the board, there would be a significant loss in pay and display revenue. The car parks recommended for reduced charges are those which are currently underutilised.

3.3 With the majority of customers using shorter stay tariffs rather than an all-day tariff, the removal of the all-day tariff on selected car parks together with a small increase in tariff in the more highly utilised car parks could increase revenues from parking. This could be utilised to support further investment in transportation in the area or it could be reinvested in the parking assets of the council. The optimal use of each car park could also increase, leading to capacity being reached on a more regular basis.

3.4 There is flexibility to offer limited free parking and reduced price short stay parking, when and where appropriate, to support retail spend. However there is also a need to cover operational costs, so this must be balanced against any small increases elsewhere.

4. OTHER OPTIONS CONSIDERED 4.1 There are many different options the Council could lawfully follow in the

management of its off-street car parks. What has been presented by ENGIE represents its best advice on the most appropriate way forward, following substantial consultation and engagement when the Parking Strategy was being developed and also, during the preparation of the attached documents.

4.2 The Council could require different options to be developed and investigated

but as mentioned above, the current recommendations are the result of in depth engagement and analysis.

4.3 The Council could elect to do nothing and keep the current charging regimes

in place. This is unlikely to align to the Council’s priorities and could lead to car parks not being managed effectively.

5. REPUTATION AND COMMUNICATIONS CONSIDERATIONS

5.1 Amending car parking and tariffs has the potential to bring about challenge. However, the review has been based on a holistic approach of looking at all off-street car parks across the borough with the key outcome being that the Council’s car parks are managed in a responsible manner and in a way that supports economic activity.

6. FINANCIAL CONSIDERATIONS

6.1 Any financial surpluses as a result of revenue from designated parking places and penalty charges must be used for the purposes set out in section 55 of the Road Traffic Regulation Act 1984 (as amended).

6.2 It is not anticipated that the proposals will bring about any material enhancement of income in the short term but longer term, should usage and revenues increase, any surplus would be invested as per 6.1 above.

7. CONSULTATION WITH SCRUTINY

7.1 There has been consultation with the Economy Scrutiny Panel (11 September 2018) on the recommendations and supporting procedural documents. The Panel recommended that tariffs be reviewed on an annual basis and this is one of the recommendations of this report.

8. FINANCIAL IMPLICATIONS

8.1 The report shows that with no change in demand the recommended tariff changes would achieve additional income of £44k.

8.2 It is, however, difficult to accurately assess the impact on demand and thus

income levels from tariff changes. The proposed annual review will though allow a regular assessment of the impact of tariff changes and provide an opportunity to further amend them when they are not meeting their objectives.

9. LEGAL IMPLICATIONS

9.1 There are no immediate legal implications arising from the proposed

recommendations that are not covered in the body of the above report. 9.2 Constitutionally the Director for Economy and Growth has responsibility for all

Council functions in connection with car park management. It would be prudent that any regular review of tariffs and permit prices be undertaken in consultation with the Portfolio Holder for Environment, Transport and Energy.

10.1 There are no direct HR implications arising from the contents of this report. 11. WARD IMPLICATIONS

Aim This document outlines the procedures relating to any requests for the renewal of existing concessionary parking permits and also for any new requests which may be received, as well as outlining some of the conditions surrounding the concession. These procedures aim meet a number of the high level outcomes that the council and its partners aspire to achieve to ensure prosperity and wellbeing for the residents of North East Lincolnshire:

3. Displacement – Existing Arrangements In instances where individuals or businesses have already been given access to a concession due to the restriction of access to or the removal of parking provision the council through its partner ENGIE will invoke the following conditions:

Permits will be valid for a period of 12 months commencing on 1st April of that year and expiring on 31st March the following year.

Applications must be made to Parking Services for the concession on an annual basis by way of an application form and payment.

An administration fee of £15.00 per permit will be required in order for Parking Services to process the application.

As part of this application process the applicant may be contacted by an Officer of the local Transport Team in order to create a Personal Travel Plan. This will help to introduce the applicant to other sustainable travel options in keeping with those outlined in the Local Transport Plan (LTP) and in turn may reduce the requirement for a concessionary permit moving forward.

ENGIE’s Parking Services will be responsible for processing any applications received and issuing the permits. The number of concessionary permits allocated and the location where these are valid for use will be determined by the Parking Services pending review of any application submitted.

Permits are non-transferrable and cannot be reallocated to another applicant.

Permits will be issued electronically by way of an E-permit. This will be assigned to the applicants vehicle registration mark specified upon application. Therefore, should the applicant change their vehicle they must notify Parking Services allowing at least two working days (Monday to Friday excluding Bank Holidays) for the E-permit to be amended.

4. Displacement – New Requests For any new requests made for concessionary parking arrangements caused by the restriction of access to or the removal or parking provision, the council and its partner ENGIE will consider the following:

Was the loss of parking provision a direct result of the actions of the council?

Does the request originate from someone who was entitled to park there in the first place?

What are the financial implications of providing a concession?

What are the alternative transport methods in that location?

How many individuals have been affected?

How many parking spaces have been lost?

Where is the nearest alternative provision?

Once a concession has been approved, the location of the concession, any payment required and any limit imposed on the number of applicants will be communicated to the applicant and an application pack will be sent out. Upon receipt of the application, the council and its partner ENGIE will invoke similar conditions to those used for existing requests.

5. Concessionary Permits – Charities

Both existing and future applications for concessionary parking permits received from charities will be subject to the same conditions as those applying due to displacement with the following additional condition:

Concessionary permits will only be issued to organisations who can demonstrate they are a registered charity.

6. Temporary Concession / Free Parking Requests - Events Occasionally requests are made to the Service Area and/or Council to temporarily waive or reduce the parking charges in one or more of the council’s Pay and Display car parks in support of an event (for example, the provision of free parking for volunteers at a charity fundraising event). Requests may be received from a variety of sources

including community groups, charities, social enterprises and businesses. A request could be to waive or reduce charges for; specified vehicles, a specified number of bays or section of a car park, a whole car park or multiple car parks. Before approving a request the following must be considered:

What are the financial implications?

What is the impact on parking availability for other car park users?

Will it have a negative impact on adjacent businesses?

Will it have a negative impact on the Council’s reputation?

Each request will be considered on a case by case basis and no decisions made will set a precedent for any requests received thereafter. The council reserves the right to refuse a request. As these requests are generally received by ENGIE, where a request does not pose any foreseeable risk to the council, ENGIE may approve and administer a request. Where a request has not been identified through the Event Safety Advisory Group (ESAG) process, event organisers should, as an alternative, forward their request to [email protected] typically allowing 30 working days prior to the date of the event. Should a request be for a large volume of vehicles/bays, involve an entire car park or multiple car parks the request may then be referred to the council for approval and thus this may take in excess of the 30 working days to process. Generally requests of this nature are for larger events planned over a longer period of time so organisers are urged to make their request at the earliest opportunity to avoid disappointment. Parking Services do not have the facility to temporarily reserve bays and therefore cannot guarantee a parking space. As such, the majority of requests received will be managed by way of temporary permits. Depending on the circumstances of the request these may be issued electronically to predefined vehicles or in a hard copy format to be circulated by an event organiser. Applicants will therefore be advised that whilst permits have been issued the use of the car park is on a first come, first serve basis and guidance may be given on peak times in order to minimise the probability of disappointment. For events where there is a requirement to reserve bays or a section of a car park and it is imperative that this happens to enable the event to proceed, Parking Services will refer the request to ENGIE’s Highways and Transport Operations department in order for them to facilitate this and the procedure for Traffic Cone Hire will be followed (see ‘Appendix A’). The hiring of cones carries a charge which will be relayed to the event organiser. Upon receipt of their payment the request will be confirmed.

1. Introduction and Context The Economy Scrutiny panel held on 14 November 2017 was asked to consider the draft Parking Strategy. At Cabinet held on 20 December 2017 it was recommended that in consultation with the Portfolio Holder for Energy and Environment, the Director of Economy and Growth prepares a plan of further actions relating to the draft parking strategy. This report presents a series of recommendations to the parking charges and provision for the council’s off-street car parks. Parking charges in the North East Lincolnshire Council’s off-street car parks have remained unchanged since 2012. At present, all off-street, pay and display car parks are split into two zones in both Grimsby and Cleethorpes. Zone one car parks are more centrally located for accessing the town centres and are charged at a slightly higher tariff than zone two. Appendix one and two provide a listing of all current car park charges. After a detailed review of each car park the zonal charging will be removed and all recommended charges will vary between parking facilities depending upon local economic conditions. Commuter parking in Grimsby and Cleethorpes is catered for through season tickets, business and council parking permits. The usage of the daily £5 tariff in the town centre is low. Statistics identify that an average of 8.26 per cent of customers park all day. When considering free parking, consideration must be made that there is no such thing as free parking. The costs for developing, improving, maintaining and enforcing car parks still have to be met from parking income.

2. Parking Charges

Sufficient off-street parking should be provided in town centres, dedicated to short and long stay parking to accommodate appropriate demand situations. Long stay parking should be directed, where practical, to off-street locations on the edge of the town centre or in designated central locations. The price of long stay parking (i.e. 4 or more hours) should be proportionally higher than that of short stay. Therefore the pricing policy is used as a demand management tool aimed at altering the habits of commuters to the commercial centres without jeopardising the viability of these areas by discouraging shoppers. Short-term parking is aimed at providing a service for consumers. However, space is often limited by long-term parking by retail workers and business users. The use of parking charges to influence travel habits should be linked to Local Transport Plan (LTP) aspirations to encourage mode shift for example, to encourage greater use of public transportation, cycling or walking, to reduce congestion and environmental impact. A small increase in parking charges would support any investment in the parking assets of the council, alongside the promotion of the parking facilities to attract customers and try and influence the parking trends. A more flexible fee structure in some locations could increase both utilisation and pay and display revenue. There is flexibility to offer limited free parking in Grimsby town centre and reduced price short stay parking in Cleethorpes, when and where appropriate, to support retail spend. However, there is also a need to cover operational costs, so this must also be balanced against any small increases elsewhere. The car parks recommended for reduced charges are all currently underutilised. With the majority of customers using shorter stay tariffs, rather than an all-day tariff, the removal of the all-day tariff on selected car parks could increase car park usage and could be reflected by a more efficient and productive return for each car parking bay. The optimal use of each car park could also increase, leading to capacity being reached on a more regular basis. It should also be noted that reducing selected town centre off-street parking charges, could potentially reduce the levels of on-street parking, as well as making the off-street car parks a more attractive option for drivers, reducing congestion from on-street parking in nearby residential streets.

Grimsby Town Centre Car Parks

Abbey Walk Multi-Story Car Park – Grimsby During weekdays this car park is utilised mostly by permit holders. Overall the demand for parking here by pay and display customers is very low.

This car park has 386 standard parking spaces, 19 disabled spaces and 22 parent and child spaces.

A new lift has recently been installed in Abbey Walk car park, replacement CCTV has also being fitted and all of the ticket machines have been replaced with new machines which can take payment by card.

Recommendations

It is expected that some targeted promotion and marketing of the facilities on offer at Abbey Walk may be beneficial in terms of revenue generation, especially at weekends where the car park is essentially empty on a Saturday and closed on a Sunday.

1. It is recommended that the weekday tariff for Abbey Walk be moved to a slightly lower hourly rate tariff alongside a new competitive tariff at the weekends. The first hour would be free, up to two hours 50p, and over two hours £2.50.

2. The car park currently closes at 7pm during weekdays, 6pm on a Saturday and is closed on a Sunday. It is recommended that the opening hours are revisited to make them more flexible to provide for;

Secure overnight parking for travel purposes as pre-payment facilities are available for parking for the next day up to seven days in advance;

Secure evening and overnight parking when attending wedding receptions at the Town Hall, Grimsby;

Promote the option of pre-paying for the next day’s parking if partaking in drinking that evening, endorsing the Safer Road Humber campaign http://morning-after.org.uk/

3. Introduce targeted promotion through social media, and directional signage is necessary to encourage usage.

Burgess Street Car Park – Grimsby This is a low demand car park.

This car park is unmarked but has approximately 60 standard spaces.

During the last financial year a total of 68% of customers purchased a ticket for more than 4 hours.

With an appropriate pricing strategy, this has the potential to be developed into a more attractive car park. It could be better utilised to support businesses in Grimsby Town Centre or provide long stay parking for workers, freeing up capacity for short stay shoppers in other town centre car parks. The access to the town centre is a distance away across busy roads. Consequently, it is underutilised with customers choosing a nearby private car park in preference to this car park. Improvements are programmed to be made to the condition of this car park to make it more attractive to customers. Works will include, resurfacing, implementation of lined bays, improved lighting, clear signage and a new ticket machine. Recommendations

4. This car park is already set at the lowest tariff. It is recommended that a new competitive tariff be introduced whereby the first hour would be free, up to two hours 50p, and over two hours £2.50, alongside a new option to purchase a discounted weekly ticket of £10.00, at the ticket machine. This would offer both some incentive for employees in the area and also shoppers to choose this car park.

5. Introduce targeted promotion through social media, and directional signage is necessary to encourage usage.

Civic Offices Plaza (forecourt) – Cleethorpes The current North East Lincolnshire Council Off-Street Parking Places Order (amended 2013) states that staff permits may be used here. However, this has never been enforced as such. Vehicles are utilising this parking area all day and preventing genuine visitors to the Civic Offices being able to park. Vehicles are also double and triple parking and blocking access. There needs to be a balance between both staff parking and visitor parking. Recommendations

1. It is recommended that the forecourt should be brought into scope for enforcement as a ‘staff permit’ only car park, Monday to Friday.

2. In addition to preserve spaces for visitors the introduction of four signed visitor bays allowing a free two hour short stay is recommended (where staff permits are not permitted for use).

Cleethorpes Town Hall Car Park – Cleethorpes The Cleethorpes Town Hall car park is a staff permit only car park except for weekends and bank holidays when it is then a free car park. Wedding guests wishing to use the car park on a Saturday are directed to Wardall Street car park, as the Cleethorpes Town Hall car park is currently free and entirely full to capacity. There is potential opportunity for implementing charging on this car park or introducing a restriction on the length of stay. This recommendation can only be considered alongside the introduction of an on street resident parking scheme to avoid potential displacement of vehicles over a weekend parking on street. Encouraging visitors to use Grant Street Car Park would provide some relief to town centre traffic and the environmental impact this has. It would also create increased footfall for the Station Quarter, which would help encourage business investment. This car park has a low demand during November to February but demand rises throughout the remainder of the year and peaks during August.

The car park is split into two sections with the car park holding 65 standard parking spaces, six disabled spaces and one motorcycle space. The HGV section has 14 spaces.

During the last financial year a total of 42per cent of customers

purchased a ticket for over four hours.

Recommendations

1. It is being explored as to whether consideration can be given for the HGV section of this car park to be relocated to an alternative location. If the HGV section of this car park was reconfigured for motor vehicle parking, this would accommodate more motor vehicles in a prime parking location. In turn this would increase revenue for the council as from May to September the utilisation of the car section is 80 per cent, for the same period utilisation of the HGV section is only 30 per cent.

2. It is recommended that the tariff for HGV parking be increased from £3 to £6 for 24 hours. HGVs are currently using this car park on an evening as a lorry park, for a free overnight stopover.

The Leisure Centre currently issues 1870 permits to members of the centre for use in this car park.

There is a long standing arrangement that was included in the SLM contract and which transferred to Lincs Inspire, to provide free parking for the Leisure Centre users. The car park was originally built to serve the Leisure Centre alone but this later changed to also enable it to be used as a Pay and Display car park. Leisure Centre users continue to park for free through the issue of hard copy permits to members by the Leisure Centre and by issuing refunds to the customer in the Leisure Centre for any parking charges that have been paid by users. These refunds are subsequently refunded to Lincs Inspire on a monthly basis. Recommendations

Marine Walk Car Park – Cleethorpes This car park is currently free of charge and consequently is very well used. It looks directly out to the sea and it is an ideal location to park and walk into the resort. It is also adjacent to the end of the Cleethorpes Light Railway where you can board alight the steam train at this car park. Bays need to be marked out to maximise space, as on a busy day vehicles can be parked haphazardly thus not making the best use of the space available. This car park could potentially accommodate 52 standard bays on the tarmac car park. Signage has recently been erected to warn that a Penalty Charge Notice (PCN) may be served, to try and prevent Motorhomes from misusing this car

During the last financial year a total of 38 per cent of customers purchased a ticket for 1 hour.

Recommendations 1. These car parks are already set at the lowest tariff. With the exception of

Wellington Terrace it is recommended that a new competitive tariff be

introduced whereby the first hour would be free, up to two hours 50p, and

over two hours £2.50, alongside a new option to purchase a discounted

weekly ticket of £10.00, at the ticket machine for all car parks. This would

offer both some incentive for employees in the area and also shoppers.

2. The discounted season ticket which is currently available to neighbouring

business to Orwell Street car park at £225.70 to be removed and replaced

with a savers annual season ticket priced at £250.00 available for all

above car parks.

Waltham Road Car Park, Scartho & Church Lane Car Park, Humberston There has been interest from Ward Councillors to change both Church Lane car park and Waltham Road car parks, to limit the duration for free parking, due to vehicles belonging to employees and commuters parking in these locations all day.

Recommendations

1. It is recommended that the free tariff is retained with the introduction of a maximum short stay of 4 hours.

For this restriction to be effectively managed operationally then the most practical way to manage this is to install a pay & display machine for a customer to obtain a free ticket for 4 hours.

3. Season Tickets and Permits The council offer a wide variation of permits to suit different requirements. Season tickets provide a significant saving and excellent value for money over the cost of regular all day parking charges. They can be used on selected car parks. From both the council and ENGIE’s perspective, the current inconsistencies that have developed over a number of years in managing differing types of off street parking permits has proved to be increasingly problematical for staff. It is also time consuming and extremely difficult to justify.

The cost of an annual parking permit varies from free of charge to £663.83, with no real justification for the range of charges, leading to some questions about equity. Many of the permit prices and conditions of use relate to historical agreements which are now outdated and, in some areas, contribute towards significant pressure on car parking availability. Permits are not valid in some car parks where there is spare capacity. There is a concern for the growing impact of low-cost or free of charge permits, in parking spaces in high demand, high profile locations. Recommendations

1. It is recommended that the price of a new single use annual season

ticket is introduced at a cost of £450 from a selection of designated car

parks. In order to mitigate a potential loss of income it is recommended

that single use season tickets are not valid on both Abbey Walk and

Duchess Street car parks.

2. It is recommended that the current general use annual season ticket is increased from £663.83 to £670.00.

3. Together with the above option for season tickets it is recommended that a savers annual season ticket at a cost of £250.00 is also introduced for the following car parks; Burgess Street, Orwell Street, Wellington Terrace, Garibaldi Street and Grant Street car parks.

4. It is recommended that season tickets are no longer valid in Cartergate car park, which is under the most pressure in terms of available capacity.

5. It is recommended that season tickets are now permitted in all car parks with the exception of Garden Street, Market Hall Roof, Cartergate, St. Peter’s Avenue, and the Leisure Centre. Alongside a restriction that they cannot be used in the short stay bays in Wardall Street car park and only on the first floor and above in Abbey Walk car park.

6. Alongside new standardised permit prices it is recommended that the current monthly and six monthly options are removed, and to only have the new annual prices.

7. It is recommended that all discounted permits be phased out as and

when new Orders come into being for individual, or sets of, car parks.

These are limited in number and would mean that residents and

businesses can choose between any new adopted permits as per the

recommendations above.

8. Businesses on the North and Central Promenade car parks can also

make a request to reserve a parking bay by making an additional

payment of £200.00. Any vehicle occupying a reserved bay would also

require a business permit. This was implemented in 2009 to assist

traders, to allow more flexibility when re-stocking or returning from

another business during the working day etc. This was promoted at

one reserved bay per business, for one vehicle, with no flexibility to

increase the number of bays per business. There are certain

businesses that now hold several reserved bays.

9. It is recommended that any future requests for the installation of a

reserved bay on the Central and North Promenade are limited to one

bay per business, due to the capacity available.

1. The table below demonstrates a financial forecast by replacing the current business permits sold in Cleethorpes at £102.13 and substituting with a single use car park permit of £450.00.

2. Detailed financial analysis has been carried out on each car park for the revenue received in 2017/18 and what the potential income would change to with the recommended tariffs if sales remained the same (see table 2).

We cannot forecast the outcome of increased sales for promotional tariffs implemented.

We would estimate that short stay sales would increase in locations where the long stay option is removed as turnover would increase.

The long stay option recommended for removal from a selection of shoppers car parks would potentially still be received via alternative council long stay car parks.

3. Within Cleethorpes the council has a supply of 1560 chargeable

parking spaces in its off-street car parks. In high season the demand exceeds the supply. A small rise in parking charges on the highly utilised car parks accompanied by certain changes to terms and conditions of use and the marketing of underutilised car parks should see a potential increase in revenue.

4. It is recommended that any new tariffs implemented are financially reviewed annually.

5. Options for travelling into the borough by train need to be explored with advertising and marketing for Grimsby and Cleethorpes in other authorities.

A comparison of the charges set by other nearby authorities is given in Appendix 3.

1. Background

A parking waiver, also known as a dispensation, allows temporary parking where parking restrictions normally apply.

Typically this involves allowing a vehicle a temporary exemption to On-Street restrictions such as a single yellow line, double yellow line or a limited waiting bay. The authorisation of a parking waiver does not sanction dangerous parking, obstruction or footway parking.

The council receives requests for waivers for a variety of reasons. In most instances requests will be made in order to conduct building, maintenance or repair works where close proximity to the site is essential. On occasion the council also receives requests from formal and informal carers in order to park in proximity to a patient’s place of residence.

2. Aim This document outlines the procedures relating to On-Street Waivers and the circumstances under which they are issued. These procedures support a number of the high level outcomes that the council and its partners aspire to achieve, ensuring prosperity and wellbeing for the residents of North East Lincolnshire:

3. Trade Waivers A Trade Waiver may be issued to a vehicle:

Completing building, maintenance or repair works and close proximity to the site is essential.

Essential to broadcasting operations.

The council may also, at its discretion, issue a Trade Waiver to a vehicle in circumstances where the request does not meet the above criteria but it is deemed to be essential.

A £15.00 administration charge per application applies. There will be no additional charge for applications made for a single day although an additional £5.00 charge will be incurred for each additional day applied for.

Whilst the majority of waivers are issued as a temporary solution there may be instances in which a waiver may be issued over an extended period. For example, the waiver is required regularly in order to carry out a scheduled task and it could be considered unreasonable to complete an application or pay an administrative charge on each occasion. In these exceptional circumstances the daily charge may also be deemed excessive due to the duration of the waiver issued. The council’s partner ENGIE may therefore waive the daily charge at their discretion.

Trade Waivers are issued to a specified vehicle for the date and location stated on the application. Alternative dates and locations may be offered to the applicant should those on the application be deemed unsuitable.

Completing the application does not guarantee a waiver. Waivers will be assessed on a case by case basis. The council’s partner, ENGIE, reserves the right to decline an application. ENGIE will not honour requests made out of convenience or where there is suitable unrestricted parking nearby. Should the application be to allow loading or unloading, if this can be achieved without parking in contravention and then the vehicle be moved to a more suitable location a waiver may not be deemed appropriate.

If a location falls within a parking place that is subject to a Residential Parking Scheme a waiver may be granted. However, depending on the duration of the work the applicant may be referred to the Residential Parking Permit application form in order to apply for visitor’s permits as an alternative measure. When conducting work in such locations visitor permits may be obtained by either the resident or the tradesperson. Applicants should consider their options carefully before making a payment and also be certain of what they are applying for as supporting eligibility documents may be required. Waiver Conditions and Enforcement

Parking Services require at least two working days (Monday to Friday, excluding Bank Holidays) to process a request for a waiver. This is required to ensure the waiver details can be passed to the parking enforcement department to avoid incorrect Penalty Charge Notices being issued.

The majority of waivers will be issued electronically. The Civil Enforcement Officers will be able to view the details of any electronic waivers issued on their hand held computers.

Once a waiver has been issued the following conditions apply:

If the vehicle in receipt of the waiver is parked; in the wrong location, on a type of restriction other than that agreed or on a date on which the waiver is not valid, the vehicle may be subject to the issue of a Penalty Charge Notice.

At any time, such as during an emergency a Police Officer, PCSO or Civil Enforcement Officer may withdraw a waiver, and should a request to move the vehicle be refused a Penalty Charge Notice may be issued.

While the waiver is in use, the Council does not accept liability for any damage, loss or accident caused to or by the vehicle. It is the responsibility of the applicant to ensure that the vehicle is parked in a safe manner, ensuring safety to the public at all times.

5. Waiver Requests - Car Parks Whilst Trade Waivers are generally only applicable if there is a requirement to temporarily park in a location, subject to an on-street restriction in order to carry out work. There are instances when there is an exception to this rule and it is necessary that vehicles, machinery or materials occupy one or more bays within a public car park. Whilst an administration charge of £15.00 will still apply in order to process the application, the £5.00 for each additional day will instead be replaced by a charge that is calculated based on the number of bays used multiplied by the relevant parking tariff applicable in that car park for the full duration that each bay is occupied. Suspensions / Reservations

Requests are on occasion received to suspend on and off street parking bays. Simply, these are requests to temporarily reserve a parking place, no charges are being suspended and any restrictions may be suspended by way of a parking waiver. At the time of issuing this procedure there are no on-street locations where there is a requirement to pay and display. Any request for bays in an off-street location where pay and display is applicable will be offset by the relevant charge being applied to the user of the bays. Parking Services do not have the facility to temporarily reserve bays. Any request received to reserve bays will be referred to the Highways and Transport Operations department and the Traffic Cone Hire procedure will be followed. Parking Services must approve the reservation of bays before referred on to the Highways and Transport team. In most cases Parking Services will urge the requestor to arrive at the location outside of peak times. This allows the requester an opportunity to get as close as possible to the location they wish to access. Due to the procedural timescales involved with the reservation of bays the applicant may be advised to reschedule the work if the request does not allow 30 working days

prior to works starting. The hiring of cones carries a charge which will be applied to the applicant. Upon receipt of payment the request will be confirmed. The council reserves the right to apply a temporary suspension of restrictions where it is unlikely that due to the volume this could easily be achieved by waivers or permits. For example, for the purpose of facilitating a large community event or redevelopment project.

7. Carer’s Permits Occasionally carers may need to park in a location subject to parking restrictions in order to administer care. This is more common in areas with a high population density as these areas are often highly restricted in terms of parking availability. Whilst this is acknowledged, in North East Lincolnshire there is sufficient unrestricted parking available in most cases and it is therefore not currently deemed appropriate to introduce a Borough wide Carers’ Waiver. This is underpinned by the current approach on Civil Parking Enforcement whereby if a vehicle is being used in conjunction with a medical emergency and as a result of parking on restrictions a PCN was issued, this may be cancelled after consideration of the evidence available. However, those engaged in routine care visits would still need to park in accordance with the restrictions. Consideration has been given to the types of restrictions and the circumstances under which requests are commonly received in order to establish if there are any restrictions that require an alternative approach. As a result of this, Residential Parking Zones have been identified as these may span over an entire street or multiple streets and it may be unreasonable to prohibit those administering care from parking within a zone. Residents who reside within a residential parking zone may require a high level of care within their home. This could range from an informal arrangement with a family member to frequent visits from a health professional. Whilst historically there has been a provision for Carer’s Permits in Residential Parking Zones, it was previously on the resident to apply. As such, many carers could not easily gain access to the permit scheme. Moving forward applications will be accepted from the Care Provider in order to increase accessibility. Further to this, it will help Parking Services better understand the permit requirement such as whether the provider uses multiple vehicles or requires access to multiple zones. The price for a Residential Parking Zone Carer’s Permit where the carer is the applicant will remain free of charge. As with the application process for Trade Waivers, Parking Services have a duty to establish an individual’s needs prior to issuing a permit and evidence may be required. In some instances it may not be essential that the vehicle be parked in proximity to the residence in order to administer care. As such, the Carer may demonstrate the requirement for a permit by way of a letter from a care organisation, Doctor or social service provider on headed paper detailing the address visited and brief details as to the circumstances why a permit is deemed necessary.

Once the circumstances have been considered and an application has been approved the appropriate permit will then be issued. Any decisions made hold no precedent and the circumstances will be annually reviewed upon application. The council reserves the right to refuse a permit application should we deem a permit is not necessary under the circumstances.
