RECOMMENDATION: It is recommended that this report be noted.

GENERAL MANAGER’S OVERVIEW: The monthly report on the Performance Plan, will follow referenced against the Key Result Areas of Cairns Water. CAIRNS WATER 1. Sources of Revenue The total revenue of $25,769,333 exceeded the budgeted amount of $24,455,324,

a variance of approximately $1,314,009 (5.37%). The breakdown of sources of revenue is shown in the attached chart.

2. Expenditure by Type Total operating expenses of $18,137,676 is below the budgeted amount of

$18,441,840, a variance of $304,164 (1.65%). The variance is primarily due to less than anticipated expenditure. The types and composition of operating expenditures are presented in the attached chart.

3. Net Operating Profit The net operating surplus of $7,631,657 is over the budgeted amount of

$6,013,484. The increase is due to less than anticipated expenditure in materials and services, increase in contributions and increased performance in fees and charges.

WASTE SERVICES 1. Sources of Revenue The total revenue of $8,084,551 is below the budgeted amount of $8,474,911, a

variance of approximately $390,000 (4.61%). The variance is primarily due to under-performance of tipping fees. The breakdown of sources of revenue is shown in the attached chart.

2. Expenditure by Type Total operating expenses of $3,915,831 exceeded the budgeted amount of

$3,772,893 a variance of $142,938 (3.79%). The variance is primarily due to the re-current contribution made to Queensland Rail for waste removal in the Landfill area, which was not included in the budget. The types and composition of operating expenditures are presented in the attached chart.

3. Net Operating Profit The net operating surplus of $4,168,719 is below the budgeted amount of

$4,702,018. The variance of approximately $533,000 (11.34%) is due to the effect of the contribution made to Queensland Rail and under-performance of tipping fees.

KEY RESULT AREA – SERVICE DELIVERY WASTEWATER WASTEWATER DISTRIBUTION Graph 4 provides information on the nature of sewer reticulation blockages and overflows for the calendar year 2002. Infiltration/Inflow Reduction Programs Programmed high pressure sewer cleaning and CCTV work in Clifton Beach continued during December. A list of sewers requiring rehabilitation, identified under this inspection process, has been forwarded to Cairns Water’s Contracts Officer in order that tenders can be invited. The sewerage manholes repair work at Gordonvale to reduce infiltration continued during the period. Distribution Maintenance Pre-treatment of raw sewage utilising “Probac” entered its 16th month during December. Effluent testing has revealed that soluble sulphides and oil and grease levels within the raw sewage increased slightly in some catchments. This is due to higher summer temperatures and reduced infiltration due to the current dry weather. A 300mm gravity sewer in Aumuller Street was damaged during construction of a new water main during December. The break was promptly repaired and the effluent surcharge contained without any serious threat to the environment. The EPA was informed of this matter and a separate report has been issued. • Cairns Water attended (26) sewer blockages during the month of

December. WASTEWATER TREATMENT Sewage Treatment is an Environmentally Relevant Activity (ERA) under the Environmental Protection Act (1994) and therefore requires an Environmental Authority (licence) which is issued by the Environmental Protection Agency (EPA). The licence, which was issued on 25 June 1997 and last amended on November 2001, sets out specific performance criteria for each Wastewater Treatment Plant (WWTP). Performance graphs for each of the six (6) wastewater treatment plants are shown at Graph 5 – (a) to (f). Environmental Incidents: The following incidents have been reported as per the environmental management system: Marlin Coast Plant

• Nil Northern Plant

• Final effluent faecal coliform median exceedances occurred on the 4/12/02 and 23/02/02. Chlorine injection system failures were the cause of both exceedances. Modifications have since been performed on the injection systems and combined with improved daily maintenance management practices should prevent the occurrence of further exceedances.

Southern Plant

• Nil Edmonton Plant • Nil Gordonvale Plant

• Nil Babinda Plant

• Nil TRADE WASTE Operations within the Trade Waste Group were as usual for December 2002 with no exceptions to report. Graph 6 advises details of the grease trap, septic, holding tank and other wastes delivered to the northern and southern discharge points.

Graph 7 provides the cumulative discharge of leachate from the Portsmith landfill to the Southern Treatment Plant. Graph 8 details the progressive results of invoices and payments received. A further follow up will occur shortly with the overall trade waste system to be integrated into main system over the next months. Issues relating to reporting to the EPA up to date. KEY RESULT AREA – RISK MANAGEMENT, MANAGEMENT AND STRATEGIC PLANNING Workplace Health & Safety Issues Safety Issues for December 2002 • Contractors installing bird proofing on both clarifiers at the Northern Plant

were instructed to improve work procedures to comply with Cairns Water’s safety requirements.

• All wastewater staff have completed the latest induction into requirements of the “Construction – Workplace Health & Safety Procedures”.

• Site safety audits continued during December with findings to be reported and forwarded to relevant officers.

• Low voltage switchboard rescue training of staff continued during December.

• GHD are finalising a report on the required upgrade/standardisation of Sewerage pump station ventilation systems.

• The next Risk Watch Meeting is programmed for January. Risk Assessment – Loss Control • Modifications to sewerage pump station (H) in line with the Esplanade

development plans continued during December. Updated information on lost time due to injuries in the work place is unavailable this month. There have been no safety hazards reported during the period. Regular safety audits of all work sites by Cairns Water’s Workplace Health & Safety Officer are used as a means to identify and rectify unsafe working practices.

Confined Space Entry Cairns Water staff were required to access confined spaces at various sites throughout the City. A total of 13 confined space entry logs and permits were completed during December 2002. These logs are kept as records by Team Leaders. The net operating surplus of $7,631,657 is over the budgeted amount of $6,013,484. The increase is due to less than anticipated expenditure in materials and services, increase in contributions and increased performance in fees and charges.

For the Month Ended 27 December 2002

The total revenue of $25,769,333 exceeded the budgeted amount of $24,455,324, a variance of approximately $1,314,009 (5.37%). The breakdown of sources of revenue is shown in the attached chart.

Total operating expenses of $18,137,676 is below the budgeted amount of $18,441,840, a variance of $304,164 (1.65%). The variance is primarily due to less than anticipated expediture. The types and composition of operating expenditures are presented in the attached chart.

For the Month Ended 27 December 2002

The total revenue of $8,084,551 is below the budgeted amount of $8,474,911, a variance of approximately $390,000 (4.61%). The variance is primarily due to under-performance of tipping fees. The breakdown of sources of revenue is shown in the attached chart.

Total operating expenses of $3,915,831 exceeded the budgeted amount of $3,772,893, a variance of $142,938 (3.79%). The variance is primarily due to the re-current contribution made to Queensland Rail for the waster removal in the Landfill area, which was not included in the budget. The types and composition of operating expenditures are presented in the attached chart.

The net operating surplus of $4,168,719 is below the budgeted amount of $4,702,018. The variance of approximately $533,000 (11.34%) is due to the effect of the contribution made to Queensland Rail and under-performance of tipping fees.

INTRODUCTION: Under the adopted Integrated Environmental Management System, a monthly Environmental Management Report is to be prepared for consideration of Council.

REPORT: This report covers environmental exceedances that have been reported to the Environmental Protection Agency for December 2002. 1. Broken rising main in Aumuller Street (adjacent to Elphinstone Close) on 5

December 2002

Notification was received of a suspected broken 160 mm rising main, located at the above address, at 14:00 hours. Works being undertaken by Cairns City Council, disturbed the main. A pump station crew immediately identified the problem, shut down the station, and informed their superiors. The fault occurred within the drainage channel on the eastern aspect of Aumuller Street, and one pump cycle was released into the channel before isolation was accomplished. The volume of effluent released into the channel was realistically estimated between 50 and 100 litres. Equipment and materials located on site, were used to contain the effluent, which was removed via suction tanker. All effluent was removed successfully, and the repair was then completed by 15:40 hours. No leaks were detected when the pump station was re-commissioned, and no loss of fauna was detected.

2. Two Faecal Coliform Exceedances for 80th Percentile at the Northern Wastewater Treatment Plant on 4 and 23 December 2002

Changes have now been completed to the disinfection system of the Northern Treatment Facility. Disinfection is now carried out on a continuous cycle based on chlorine residual readings. Flow control has now been by-passed and the residual set point has been adjusted to 0.25ppm to allow for response of control equipment. It was noted that due to the nature of the controller, the variable speed drive would only run down to 13HZ, as there is always a minimum output to the drive. The results of recent analysis are shown below.

The result of 80000 CFU/100ml on 4 December was the result of experimentation with the chlorine delivery system. It is believed that results such as this should now be a rare occurrence.

CAIRNS WATER PERFORMANCE PLAN 2002/2003 DECEMBER QUARTER REPORT Brian Smyth:JEA : 1/58/13-05: #578302

RECOMMENDATION: It is recommended that the December 2002 Performance Plan be adopted. Under the Water Act 2000 and the Local Government Act 1993, Cairns Water is required to report to Council on the progress of the yearly Performance Plan. This report is the December Quarter Report for the Performance Plan 2002/2003. The Performance Plan for 2002/2003 was adopted at the time of adopting the budget for this year.

BUSINESS UNIT OBJECTIVES: These have not altered from the adopted plan.

NATURE AND SCOPE OF ACTIVITIES: These have not altered from the adopted plan.

COUNCIL’S RESPONSIBILITIES: Apart from internal service level agreements, this has remained unaltered from the adopted plan. Service Level Agreements between Cairns Water and other relevant Divisions/Branches of Council remain outstanding with Cairns Water working on finalisation with the relevant Divisions.

CAIRNS WATER’S GENERAL RESPONSIBILITIES: This relates to reporting, delegated authorities and purchasing and has not altered.

ENVIRONMENTAL MANAGEMENT: Cairns Water has complied with its requirements under its licence from the EPA and the Integrated Environmental Management System.

CATCHMENT MANAGEMENT: This has remained unaltered from the adopted Performance Plan. Full compliance has occurred.

ASSET MANAGEMENT: This has been complied with in accordance with the adopted Performance Plan.

CAPITAL WORKS PROGRAMME: Both the Water, Wastewater and Waste capital works programs are either on or ahead of schedule. Expenditure on Water, Wastewater and Waste capital works are reported monthly.

COMMUNITY SERVICE OBLIGATIONS: These are being met.

FINANCIAL POLICIES: Cairns Water is meeting all required financial policies in relation to taxation, accounting etc.

PRICING AND REVENUE COLLECTION: Cairns Water has complied with the intent and requirements of the adopted Performance Plan. Cairns Water has also provided its report to the Queensland Competition Authority as required under the legislation of the Authority.

KEY STRATEGIES: The program for the development of Key Strategies for Cairns Water for 2002/2003 is on target.

PERFORMANCE REPORTING: As required by the adopted Performance Plan Cairns Water has met the monthly reporting process.

SUMMARY: The first three (3) months of the new financial year for Cairns Water has seen a focus on outputs and control of inputs. This is reflected in the continued reasonable financial performance of the business. The Regional Waste Management Contract continues to be a drain on resources as key senior staff are absorbed into the process of gaining the best outcome for Council and the City. The greatest asset of Cairns Water, its staff, continue to embrace Cairns Water enthusiastically without losing the Cairns City Council frame of reference. WATER - SITUATION REPORT

COPPERLODE FALLS DAM - Currently sitting at 61% full. - Rates of discharge from the Dam are being maintained at the required

environmental flow in Freshwater Creek. - Under the current restriction regime, outflows from the Dam are being decreased

around noon each Monday and increased around noon each Friday to cater for the current demand patterns.

BEHANA CREEK - Currently discharging at the intake approximately 35 ML/day. - Extractions for potable water supply have been negotiated for the time being at

15 ML/day providing the environmental flow is being maintained at 20 ML/day.

RURAL SCHEMES: The rural schemes south of Aloomba are currently in a satisfactory condition with the exception of the Bartle Frere scheme. This scheme supplies water to the Bartle Frere and Woopen Creek area and is inter-connected with the Miriwinni scheme for emergency purposes. Council may be aware that Cairns Water has recently augmented the supply to the Woopen Creek area by upgrading one of the Russell River crossings. While this has provided security of supply, problems have arisen recently with pressure complaints. Tests undertaken to date do not indicate any static problems with the complaints being based on apparent or perceived significant irrigation usage.

In order to gain further information on flows and demands in the system, trial meters will be placed on known irrigators – banana farms and other orchard type uses – in order to determine usage patterns and peak demands. It is stressed that these meters are trial only and solely being installed for the purpose of data gathering. BARRON RIVER WATER RESOURCE PLAN Brian Smyth:KB : #576274: 24/1/5-15

REPORT The Department of Natural Resources and Mines has now released the Barron River Water Resource Plan. This Plan will now be in place until December 2012. The Water Resource Plan itself does not provide Council with the details within the Plan that allows officers to advise Council of the implications for the City. While, Departmental officers assure Council that the requested supply from the Barron River has been included, this is certainly not obvious from the Plan itself. The Department is yet to release “Explanatory Notes” and “Consultation Notes” that will assist with the interpretation of the Plan and its outcome for the City. These “Notes” will not be available until the end of January 2003. In the Summary Brochure prepared by the Department at the time of release of the Plan, the following is advised under the heading “Innovative Policy Key to Future Opportunities”

“In the world’s driest inhabited continent, we will never have enough water, so we must learn to make better use of the resources we have before contemplating further development.

Working with our limited water resources is the basis of the national water policy, signed by all Australian governments in 1995.

Under the agreement, Queensland is obliged to reform how it manages water resources and to plan carefully for future development and use. That is why catchment-wide water resource plans are being developed across the state.

The bottom line is about making us as self-sufficient as possible and giving water its true value as a precious resource. Rather than increasing the amount of water available by capturing more in dams, which are costly in both economic and environmental terms, the focus is on innovative and efficient ways to manage supplies and to strike a balance between community needs and river health.

A particular challenge involves encouraging water to be used at the greatest efficiency and for the best economic return.

In the past, subsidies have applied to the cost of building, operating and maintaining dams, water storages, pipelines and treatment plants. While the strategy supported rural economies, there was little emphasis on efficiency or economic sustainability.

Water prices are now based on recovering the cost of service provision and when new infrastructure is planned, it should be funded by end users.

Water trading, a key outcome of the water planning process that will give water users unprecedented business flexibility, will also encourage efficiency. It follows a pilot trial in the Mareeba Dimbulah Water Supply Scheme, which had more restrictions and administrative complexity than the system that will be allowed under the plan.

Through water trading, water allocations will become a secure, bankable asset. When widely available, trading will give irrigators a real incentive to reach higher efficiencies, because they will be free to sell any surpluses they create, or use them to increase their own productivity.

These changes are expected to make irrigators innovative and adaptable – trying their hand at growing new and different croops that become winners on emerging world markets.

This imaginative policy was engineered to ensure that we make the most of our water resources because it makes sense to find ways of generating the best dollar value for water by using it on the most suitable land to grow the highest paying crop. Building new water storages as a first resort is at odds with this strategy, especially when existing water allocations in the area allow room for growth. For the first time, the water reform measures being introduced also take into account the environmental health of rivers. Too much extraction of water in many areas is stressing river systems, causing poor water quality, the loss of productive land and damage to ecosystems.

Making sure there is enough flow to keep rivers healthy will help maintain biodiversity, reduce salinity, protect aquatic life in our waterways and reduce land degradation. By striking the right balance in this way, the health of rivers will also improve, so that they become places for us all to better enjoy.”

At the April 2002 Ordinary Meeting of Council, with respect to the draft Resource Plan and the proposed submission to the Department of Natural Resources and Mines, it was decided as follows by Council:

1. it supports the introduction of an additional storage to ensure the long term water needs of the Cairns Community are secure;

2. it cannot support the proposed extraction scenarios on the Barron River and

Freshwater Creek due to:

- significant additional capital and operating costs associated with treating the turbid Barron River water in high flow regime;

- the incompatibility of the proposed Freshwater Creek weir and intake with the Freshwater Creek Management Plan;

3. it seeks lease tenure over the Barron River site to ensure security of access; 4. it seeks an all Government approach to water quality within the Barron River

catchment to ensure water, at the point of extraction for Cairns, is contaminant free;

5. it does not support the inclusion of Freshwater Creek in the proposed

Resource Operations Plan until the Department of Natural Resources and Mines and Cairns Water confirm content.

From the Plan as prepared by the Government, comment is provided on the points above as follows:

1. The Barron River Water Resource Plan does not advocate any additional storage, but does allow a trigger mechanism where the Minister may consider a Plan amendment for the consideration of a storage.

2. Detailed comment on this cannot be provided until the “Explanatory Notes” are

available for review.

3. The Plan, as was to be expected, is silent on the issue of tenure. Cairns Water is still negotiating the issue of tenure with Queensland Parks and Wildlife Services.

4. The Plan, as was to be expected, is silent on the issue of catchment

management. Cairns Water is concerned about the quality of water it will have to treat when extraction occurs from the Barron River. This issue will still continue to be pushed by Cairns Water.

5. From reading of the Plan, it appears that Freshwater Creek will be included in

the proposed Resource Operations Plan. No further definitive comment on the Plan can be provided until the “Explanatory Notes” are released and reviewed. Brian Smyth GENERAL MANAGER CAIRNS WATER

COPPERLODE FALLS DAM SAFETY CONDITIONS IMPOSED UNDER WATER ACT 2000 Brian Smyth:KB : #576211: 1/58/13-07

BACKGROUND Since the adoption by the Queensland Parliament of the Water Act 2000, Cairns Water has been negotiating with the Department of Natural Resources and Mines on safety conditions which would apply to Copperlode Falls Dam. Under the Water Act 2000 the State Government must licence all referable dams.

REPORT Under the definitions contained in the Water Act 2000, Copperlode Falls Dam is a referable dam with a Category 2 Failure Impact Rating. This category is achieved because the population at risk at dam failure is in excess of 100. The Department of Natural Resources and Mines has now issued the Safety Conditions for Copperlode Falls Dam, which are attached for the information of Council. The Department has imposed conditions on the Dam relating to:

• Documentation • Incidents and Failures • Design and Construction • Dam Data Book • Standing Operating Procedures • Detailed Operating and Maintenance Manuals • Special Inspections • Annual Periodic Inspections • Comprehensive Inspections • Safety Review • Emergency Action Plans and Event Reports • Decommissioning.

The conditions as imposed are reasonable and in fact Cairns Water continues to meet these conditions on an annual basis. The level of inspection reporting is consistent with what is currently undertaken where Cairns Water utilises the services of specialist dam consultants to audit the performance and structural integrity of the dam. The Department has recently referenced the Cairns Water Dam Data Book for reference for all other referable dam owners who are yet to establish their own data book.

RECOMMENDATION: It is recommended that this report be noted.

INTRODUCTION: Council may be aware of an allocation of $250,000 in the 2002/2003 capital works budget of Cairns Water for the commencement of the construction of a 20 ML reservoir at Draper Road west of Gordonvale. The Draper Road reservoir is the first major reservoir to be constructed since Council adopted the Cairns Water Storage Strategic Plan in 2001/2002.

REPORT: Construction work will occur on land previously acquired and on a bench which has been prepared for a number of years – materials from the bench earthworks were used as capping material for the closed White Rock landfill. The contract for the construction of this 20 ML reservoir will be in a design and construct format to allow for industry economies to be obtained. Tenders are proposed to be invited on Saturday, 8 February 2003 with a report on tenders received proposed to be considered by Council at its March 2003 Ordinary meeting. NORTHERN WASTEWATER TREATMENT PLANT BIO-SOLIDS BELT FILTER PRESS Brian Smyth:JEA:24/20/23-01: #578324

RECOMMENDATION: It is recommended that this report be noted.

BACKGROUND: Council last considered this issue in March 2002 as a follow on from the adoption of the Planning Report for the Northern Wastewater Treatment Plant. This consideration dealt with the potential early calling of tenders for a new belt press as part of the augmentation of the Plant to cater for nutrient removal. Since March however certain other design issues were required to be finalised prior to consideration being given to the press.

REPORT: Detailed work has been undertaken on the options of a single press and gravity table versus dual presses and gravity tables. Each option considered had a design capacity to cater for anticipated bio-solids quantities in the year 2018. The existing belt filter press at the plant has reached the end of its useful life as was reported to Council in December as part of the asset audit of the Plant. OPTION 1 – SINGLE PRESS AND GRAVITY TABLE This option would require a new building to be constructed, as a single press to cater for 2018 bio-solids volumes could not be physically located into the existing facility. While this is a disadvantage, it does offer flexibility in the overall development of the plant. The existing building is located adjacent the oxidation ditch and operationally provides problems to the plant operators for the removal of the filtered bio-solid cake. Estimated cost of belt press $325,000 Estimated cost of new building $320,000

OPTION 2 – DUAL PRESSES AND GRAVITY TABLES This option was explored, in order to obtain redundancy in the overall bio-solids management, in the event that plant breakdown occurred. The equipment sought for this option was again sized to cater for 2018 bio-solids volumes under nutrient removal conditions. Equipment of the variety sought is specialised with specific gearing and drive assemblies. As a consequence the availability of spares in the case of breakdown is critical. Unfortunately, this option also requires the construction of a new building as two (2) smaller presses are of such a shape and design that they would not be accommodated in the existing building. Estimated cost of 2 No belt presses $520,000 Estimated cost of new building $410,000 While option 1 on an initial purchase price is advantageous over option 2, it has been necessary to undertake a risk assessment on the purchase of the single press in the case of breakdown. This assessment has identified specific spares which should be held as inventory to enable rapid replacement if required. While this represents a holding charge the obvious benefits in being able to repair the press quickly with available spares are significant. RECOMMENDATION: It is recommended that the requirements of the Department of Natural Resources and Mines in relation to land tenure for the Edmonton Wastewater Treatment Plant be accepted.

BACKGROUND: The Edmonton Wastewater Treatment Plant was originally constructed on a Reserve for Buildings (Explosive Magazine and Incidental Works). Since its formation, Cairns Water has been endeavouring to secure land tenure over the plant area from the Department of Natural Resources and Mines, in order to provide security to operations and plant expansion.

REPORT: The Department of Natural Resources and Mines has now made the following offer in order to secure tenure over the land: 1. Preparation and lodgement of a Survey Plan suitable for registration in the Land

Registry in terms of the Land Act 1994 to facilitate the following actions: • Excision of areas totalling abt 2.94 ha shown as Lot 2 on CNS02/063 from

Reserve for Buildings (Explosive Magazine and Incidental Works) – Queerah; • Amalgamate an area of abt 1 ha shown as Lot 3 on CNS02/063 from Lot 140

on NR3427 being USL with the above excised area, and reserve and set apart by gazette notice as Reserve for Local Government (Sewerage) purposes;

• Amalgamate the balance area (abt 1.83 ha) of Lot 140 on NR3427 shown as Lot 1 on CNS02/063 with Reserve for Buildings (Explosives Magazine and Incidental Works) – Queerah;

REPORT: Council recently has been advised of the emergent capital works that have been undertaken to address the water supply situation in the Southern area of the city. Provision was made during the October review for these works.

Provision has also been made in the December review for the detailed design and the commencement of construction of a major pump station on the Western Bypass Main. A reallocation of $150,000 was made to this project with the funds being provided from allocation that was made for the Rural Water Supply Upgrade works. It is expected that construction and procurement work associated with the pump station will commence towards the end of May 2003. Within the Wastewater program, provision has been made by reallocation of funds from other refurbishment activities to cover the critical items identified in the asset audit for the northern and southern wastewater treatment plants.

BACKGROUND: On 18 February 1999, R. J. Manning (Mr Manning) of 6 Egmont Close, Clifton Beach wrote to Council advising of a perceived error in his water bill. From accounts it appears that Mr Manning was billed $9.69 when he believed that he should have been charged $2.80. Mr Manning’s argument was that his charge should be at the budget rate within financial years. One 22 September 1999, the Council wrote to Mr Manning advising the charge of $2.80 would be waived. It appears that this charge (either $9.69 or $2.80) was not waived and as such Mr Manning has continued to lose discount and accrue interest on the lost discount.

CONSIDERATIONS: Statutory: N/A Policy: N/A Financial: Total of lost discount and interest accrued to date (Monday, 13 January 2003) is $738.62.

Since the time of writing of the letter, Mr Manning has continued to lose discount and accrue interest on such. RE: WATER RATES One of the conditions for allowing discount on rate charges is that all-outstanding rates and charges have been paid. It has been brought to my attention that an amount of $2.80 still remains as an outstanding water usage charge against the property. This is a result of the re-calculation of water charges by yourself as outlined in your letter received on the 18th February 1999. As you are aware, the method of charging for water usage for the 98/99 was revised to a full user pay system. The establishment of an access fee of $100 with all domestic water used charge at $0.51 per kiloliter is considered to be a more equitable and fairer method for all. For the purpose of water charging the “water year” is a term of approximately twelve months ending in the period April/May. As an accurate costing is not possible and given the small charge involved, the $2.80 will be waived in this instance with this amount been credit to the property. COMMERCIAL WATER CHARGES – ASSESSMENT 369298 Anthony Bird:24/1/1-25: # 578576

RECOMMENDATION: That the Bosanquets be informed that the charges as levied stand; and Cairns City Council investigates alternative charging mechanisms as part of its budget deliberations for 2003/2004 for those properties that have both residential and commercial aspects to their improvements.

INTRODUCTION: On 9 November 2002, Peter Bosanquet wrote to Cairns City Council requesting exemption from all commercial charges levied against his property. On 1 November 2002, P. G. And L. F. Bosanquet (the Bosanquets) were issued with a supplementary rates notice for the period 1 July 2002 to 31 December 2002. The supplementary notice was issued due to a change in the classification of Assessment 369298. This change was due to the addition of a nursery to the classfication. Discussion with the Bosanquets reveal that the nursery on the property is watered through bore water and not the potable water supply. Consumption patterns on the property would indicate that the potable water was only being used for domestic purposes. Table 1.0 is a snapshot of consumption patterns over the last three bill periods, being one year. Table 1.0

Where residential type improvement/s share a meter with commercial improvement/s and the Department of Natural Resources and Mines land use code for that assessment is commercial, water usage charges will be levied at the commercial rate and no greening contribution will apply.

In cases such as this it is policy to charge a residential and commercial access charge (two charges) and have all consumption recorded at the commercial rate. Financial: Recurrent: On a singular property basis, the financial implications of writing the commercial charge off is not great in nature. In this case it would be one access charge at $62.10 and consumption would be charged at $0.48 instead of $0.70. Social: N/A

Cairns City Council has adopted a policy where all properties that have residential and commercial improvements are charged residential and commercial access charges with all water consumed being charged at the commercial rate. It is not recommended changing this arrangement without further analysis into both the policy and financial implications associated with a change. Further analysis would provide number and types of properties affected and also allow modelling of any proposed changes on the Cairns Water and Cairns City Council budget.

REPORT: The November 2002 meeting of the Local Authority Waste Management Advisory Committee (LAWMAC) was held in Townsville on 29 November 2002. The only issue that needs to be raised is that of some assistance that could be available to Council under a recycling programme being initiated through the Environmental Protection Agency. This is being followed through at officer level to see if Council is eligible for any grant assistance. No other issues require specific deliberation by Council.

PRESENTATION - TOWARDS BEST PRACTICE RECYCLING and the NPC Mr Bryce Hines, Cr Bob Beynon, Mr Greg Merry and Mr Vin Naidoo attended the meeting to give a Workshop/Presentation on the Best Practice Recycling Policies and Procedures on a Local Govt level plus a status report on the current undertakings of the National Packaging Covenant. Cr Bob Beynon opened the presentation briefing on the role that the NPC plays in assessing the actual costing of recycling. Cr Beynon congratulated LAWMAC and its member shires on the positive work towards voluntary recycling on a regional/rural basis. Mr Bryce Hines addressed the meeting advising that the objective of the presentation was to give a broad strategic rundown on how the Best Practice Recycling Policy and Procedure Guidelines work on a local government level. Mr Hynes gave a brief overview of the Project Guidelines in place to assist councils in establishing the best practice kerbside recycling and drop-off centres most appropriate to individual shire communities.

Mr Greg Merry addressed the meeting advising of the most asked questions regarding recycling as: • Benefits of recycling and is it worthwhile? • Viability and profitability? • What support funding is available? The Best Practice Guidelines consider Queensland’s dispersed population, tyranny of distance, viability and sustainability, affordability of a recycling service. Mr Merry advised of the availability of a “Towards Best Practice” information kit to provide background information on recycling in Queensland and considers the benefits of recycling and the issues of enhancing sustainability. The information kit systematically guides councils through the process involving councils in the service level decisions whilst encouraging community consultation and industry involvement and development. LAWMAC members were advised of the opportunities available to local government authorities to access the available funds subject to councils adopting a range of systems supported by Waste Education Strategy Programs. In Summary, the Guidelines and Incentives Scheme is to be launched Friday, 29th November 2002 by Townsville Mayor, Cr Tony Mooney. The key contacts for further information are Mr Peter Collins (EPA Brisbane) and Mr Bryce Hines (LGAQ Brisbane) with assistance accessible on an individual or regional basis with $$$ available. A brief question and discussion period followed with queries regarding the availability of Program information which Bryce confirmed was recorded on CD with some copies available at the meeting. Bryce also advised that he would also forward copies of the “Towards Best Practice Recycling in Queensland” CD information kit to all LAWMAC member councils. Mr Vin Naidoo addressed the meeting giving a brief background review on the current Statewide Sharps Management and Disposal Strategy Project, advised of the $100,000 funding available and circulated application forms for Council consideration and submission. FINANCIAL REPORT The Chair, Cr Dave Egan briefed members on the updated position regarding funding commitments for the Mobile Education Unit including a further $15,000 from the JRG and KRG. Cleanaway have also committed to $2,000 per year for 3 years and NQLGA have confirmed that all GST Input Tax Credits (approx $13,500 to date) will be credited to the LAWMAC / MEU account. Questions were raised regarding funding support from drumMuster with Cr Ron Hunt to follow up during the day’s meeting proceedings. It was resolved that the Financial Report as circulated with the Draft Agenda be adopted. Moved: Cr Greg Thomsen (Mackay) Seconded: Cr Ron Hunt (Cardwell) Carried. 13 – 0. MOBILE WASTE EDUCATION UNIT The “Kerby’s Coach” report as developed by Cr Ron Hunt and circulated in the Draft Agenda was noted with interest. It was proposed that the MEU commence its 2003 Itinerary from the southern section of the LAWMAC region taking in the southern member shires of Bowen, Sarina, Mirani, Proserpine, Nebo and Mackay before proceeding northward. The Chair announced his impending departure from the meeting to attend the launch of the Guidelines and Incentives Scheme by Townsville Mayor, Cr Tony Mooney and called for a consensus on the travel itinerary of the MEU in his absence for consideration upon his return to the meeting. Cr Greg Thomsen was appointed as Acting Chair in the interim and called for input and feedback regarding shire-based events and educational programs scheduled within individual council’s school curriculums. Following discussion it was resolved that the MEU be driven to the Mackay region during the first week of 2003 to commence an itinerary from the south of the LAWMAC region before proceeding northward taking in all member shires along the way. Following concerns regarding the input of incorrect show-dates into the existing draft travel itinerary members were requested to advise the secretary for notification of changes to be passed on to Paula Harrison (Envirocom Aust). Members moved the recommendation that that Paula Harrison (Envirocom Aust) be reminded of her commitment to LAWMAC in the development and circulation of a draft travel itinerary as agreed at a previous meeting. PRESENTATION – EPA WASTE WISE PROJECT Mr Peter Collins addressed the meeting giving a brief presentation the Waste Wise Project with a program overview of:

Plan 3. Measure of Success ( Measure against Performance Indicators of Action Plan

and report back to EPA on implementation) 4. Market Transformation (Lifecycle assessment of Waste Wise Program)

EPA provides support through its Waste Wise Team to facilitate with an information tool and resource kit available on the internet. Mr Collins advised of the $400,000 budget for Waste Wise this years and asked “Is LAWMAC interested in being part of the Waste Wise Project and help industry and local government profit by reducing waste?” Members indicated LAWMAC was interested and endorsed the Executive to work with Lindsay Delzoppo and Peter Collins in discussing the project further and called for councils to provide input and needs. It was resolved that the Executive of LAWMAC investigate further, call upon member councils for input and report back to the Committee on outcomes for discussion at the next general meeting. LAWMAC MEMBERSHIP & AFFILIATIONS The draft report as developed by Kylie Hughes (EPA) detailing the comments and issues on Best Practice Environmental and Economical Waste Management as raised by members at the September 2002 meeting was noted and received. Moved: Cr Judy Beatts (Hinchinbrook) Seconded: Cr Heather Keevers (Johnstone) Carried. 11 – 0 LAWMAC SUPPORTED PROJECTS Townsville City Council – Development of Accredited Waste Management Operator Course Mr Ian Kuhl gave a brief presentation refreshing on the current status of the project. Ian advised that Townsville City Council is now a Registered Training Organisation and will soon be in a position to provide formal training and qualification through the waste management course of elective and core modules. Nebo Shire Council – Community Education Project The Acting Chair, Cr Greg Thomsen tabled and read the Project Status Report as submitted by Cr Wendy Western.

WASTE MANAGEMENT ASSOCIATION of AUSTRALIA Members acknowledged with appreciation the WMAA support of the Mobile Waste Education Unit through active interest and promotion along with financial sponsorship of the project.

PRESENTATION – VISY RECYCLING Mr Frank Phillips gave a brief and informal verbal presentation on the current fact finding mission to resource MRF volumes for the Townsville/Thuringowa plant. General discussion followed with no questions raised.

PRESENTATION – WORMFARMING & VERMICULTURE - JSC Ms Kathryn Hall addressed the meeting giving a brief presentation and status report on the Johnstone Shire based “Guide to Household Vermiculture” project. The possibility of incorporating a vermiculture display into the MEU was proposed with members supporting consideration of the development of a design for a model plus an educational package.

PRESENTATION – BEVERAGE INDUSTRY ENVIRONMENTAL COUNCIL Mr Manny Manatakis addressed the meeting on the “Don’t Waste Australia – do the Right Thing” project and advised of a further $10,000 contribution for the MEU. LAWMAC members again extended their appreciation to BIEC and Manny for the continued support of the MEU. Manny advised of the need to measure the effectiveness of the MEU with a data monitoring mechanism developed along with documentation and records of an Attedance Register, Comments and Input and Media Coverage. Manny also commented on the Best Practice Guidelines and recommended that funding be applied within 6 months to provide a quick uptake on the scheme and allowing for budgets to be set accordingly through the establishment of a system enabling local government to fast-track this system.

General discussion followed regarding composite recycled material (eg. Tetra Packs) leading to a commitment by Mr Frank Phillips to write a brief on the product and submit to the JRG Chair, Mr Lyndsay Delzoppo for consideration. Cr Tom Gilmore proposed the concept of providing bags at Driver Reviver Stops, Fuel Stops etc for collecting recyclables during travels for consideration as a new project. Manny Manatakis and Cr Tom Gilmore to develop and review the concept.

WASTE TYRE MANAGEMENT The Acting Chair, Cr Greg Thomsen tabled a report by QCL on the proposed merger of Australian Cement and Queensland Cement. Following a review of Envirocycle and Encore Rubber, members agreed that there appears to be little if any progress on the disposal of waste tyres in Queensland. Members moved to accept the QCL Report but certainly not endorse it. Moved: Cr Ron Hunt (Cardwell) Seconded: Cr Heather Keevers (Johnstone) Carried. 12 – 0 Members resolved to forward a letter to QCL expressing extreme disappointment – LAWMAC Executive Committee to draft the letter and sumbit to the secretary for forwarding with copies issued to the Press and individual member councils. Moved: Mr Gary Ewart (Thuringowa) Seconded: Cr Ron Hunt (Cardwell) Carried. 12 – 0 Members resolved to forward a letter to Environment Australia questioning the lethargy on waste tyre levies reflecting on LAWMAC’s policy on tyres to landfill and the possibility of being forced to lift this ban. Mr Ian Kuhl to provide the draft wording to the Secretary. Moved: Mr Ian Kuhl (Townsville) Seconded: Mr Steve Elwell (Cairns) Carried. 12 – 0 Cr Dave Egan entered the meeting and resumed the role of Chair reporting on feedback by TyreCycle representative in possibly overcoming current blockage problems in using the tyre-rubber product in paving spraying. Cr Egan proposed that representatives from Boral, Pioneer and Sami should be invited to future meetings for their views. Following discussion members resolved that LAWMAC write to the EPA and relevant Federal Departments urging the EPA to initiate a joint project between EPA, MRD, and the relevant CRC, to research the re-use of waste tyres in road construction under Queensland conditions. Moved: Cr Tom Gilmore (Mareeba) Seconded: Cr Greg Thomsen (Mackay) Carried. 13 – 0 GENERAL BUSINESS Cr Ron Hunt addressed the meeting advising of the 15amp power supply installed on the MEU supported by a detailed document which will be clearly displayed in the Unit. Cr Heather Keevers addressed the meting raising concerns regarding the problems regarding over-usage and incorrect disposal of plastic shopping bags within the community. Mr Bryce Hines responded advising that the Federal Minister has established a Working Group to investigate the use of plastic bags. The issue is scheduled to be addressed through the NPC with the development of a recommendation for disposal of plastic bags and a Code of Practice for supermarkets. Bryce undertook to provide an update to LAWMAC members following outcomes.

Mr Doug Green addressed the meeting advising of the confirmation by drumMuster for financial support for the MEU to the value of $1,000. Cardwell Shire Council also called for the official outcome of the successful school in the naming of the MEU. Cr Egan undertook to review the entries and advise of the result on Monday 2nd December 2002 prior to closure of the school year. The meeting was advised that this meeting would be the last for Mr Gary Ewart (Thuringowa) for some time and extended their appreciation to Gary for his commitment and input to the Committee and also welcomed Mr John Biedenharn as Gary’s replacement. The Resumé and covering letter from Mr Fenn Hughes regarding the possibility of future employment within the Committee was tabled, noted and held over for further discussion and consideration at the next meeting. The Marketing Proposal for LAWMAC’s Interactive Waste Education Bus prepared by HOT CONCEPTS was tabled to be held over for consideration at the next meeting.

NEXT MEETING Following discussion it was noted that Nebo Shire Council does have the resources and facilities to host a general meeting of LAWMAC and should be considered. The next meeting was tentatively scheduled for a date between 3rd – 14th February 2003 in Townsville to coincide with the MRF launch. Townsville / Thuringowa members to determine the date and advise as soon as possible.

RECOMMENDATION: It is recommended that this report be noted.

REPORT Council may be aware that Cairns Water is developing a waste management strategy that incorporates and addresses the specific and inherent problems of the City of Lae in the Morobe Province of Papua New Guinea.

The project has now been operational for nearly twelve (12) months. Cairns Water staff have made (one) 1 visit to Lae – in February 2002 – to meet with the local business community and members of the National government. The visit also commenced the required data gathering process and reviewed the current practices of waste management in Lae.

In October 2002, Cairns Water hosted a visit from Lae of the project officer to familiarise that person with the current operations in Cairns and to train the officer as to the required data for the strategy. Subsequent to that visit, it was the responsibility of Lae City Council to collect and collate the necessary data for input into the strategy.

A return visit to Lae by the Waste Services Co-Ordinator, Steve Elwell, was planned for January 2003, however this has been postponed pending the supply of the required data and advice on recent security issues in the Province. At this stage this return trip will be made in February 2003.
