WHEREAS, in 1975 the California Regional Water Quality Control Board,Cen1ral Valley Region (hereafter Regional Board) adopted the Watcr QuaJity ControlPlan fOr the Saaamento Riv~ and San Joaquin Riv~ Basins (Basin Plan), which hasIbeen ~~cd occasionally. and

WHEREAS, the Federal Clean Water Act (CWA) Section 303 requires theRegional BOard to develop water quality objectives which are sufficient to protectbeneficial uses designated for each water body found within its region; ~d

WHEREAS, the proposed amendment will revise Chapter n "Beneficial Uses" ofthe Basin Plan to .further describe the process of designating beneficial uses; Chapter IV"Impl~~~on" to rmnove the inaccurate description oftbe federal antidegradationpolicy, update the water quality limited segments section, include new State Water~ource Control Board (State Board) policies; and all chapters to update outdatedreferenc"es to regulations; and .

WHEREAS, the proposed amendment is consistent with State Board ~sohitionNo. 68-16 (Stmemmt of Policy with Respect to Maintaining High Quality of Waters inCalifomia), the State's "Antidegadation Policy," in that the changes to water .qualityobjectives (i) considerm aximum benefits to the people of the state, (ii) will notumeasonably affect present and anticipated beneficial use of waters, and (ill) will notresult in watm' quality less than that pIescnoed in policies. Likewise, the ~~dm~t isc.onA~ with the federal Antidegradation Policy (Title 40 Code of Federal Regulations(40 CPR) Section 131.12); and

WHEREAS, the regulatory action proposed meets the "Necessity" standard of the,Anmm;&trativeProcedmes Act, Govcmm~t Code, section 11353. subdivision (b); and

WHEREAS. the basin p1anning process has'b~ certified as "ftmctionallyequivalent.' to the California Bn,-,iIomnental Quality Act requirements for preparing~vjronmenta1 documents as specified in Title 23 CaIifomia Code of Regulations (23 .

CCR.) Section 3782 and is. theref~. exempt:from those requircmcnts (Public ResourcesCode. Section 21000 et seq.); aDd

WHEREAS, Regional Board sta:fIhas prepared a draft am~dment md a staffreport dated May 2002; and .

WHEREAS. the Notice of Filing and m1viro:!1!!l~!al checklist indicates that theAmendmmlt results in no potmltial for advcrse effect. either iDdiVidually or cumulatively.on wildlife; and

WHEREAS. the draft @In~dment. stafireport. WHEREAS, the Regional Board held a public hearing on 19 July 2002, for thepurpose of receiving testimony on the draft Basin Plan amendment. Notice of the publichearing was sent to all interested persons and published in accordance with Ca1ifomiaWater Code, section 13244; and .
