STATE UNIVERSITY STUDENT AMBASSADORS 2

3 BY: Sarah Niederee, Jansen Penny and Jonathan Peuchen 4

5 WHEREAS, Mario Garcia III, a senior in family studies from Shawnee, KS and Paige Engle, a junior 6

in public relations from Overland Park, KS, have represented Kansas State University (K-7

State) and the K-State Alumni Association as the 2017 K-State Student Ambassadors. 8

9 WHEREAS, The Student Ambassador Program, established by the K-State Alumni Association in 10

1977, elects one male and one female student each year to represent the student body at 11

Alumni Association events throughout the state and at university activities; and 12

13 WHEREAS, Mario Garcia III and Paige Engle have visited with prospective students and alumni, 14

attended Student Alumni Board meetings and activities and assisted with programming 15

on campus such as the Alumni Fellows program and the All-University Homecoming 16

Committee during their year of service. 17

20 SECTION 1. Kansas State University Student Governing Association commends Mario Garcia and 21

Paige Engle for the time and effort that they have put forth to represent Kansas State 22

5 Soil Judging contest hosted by South Dakota State University in Redfield, South 9

WHEREAS, By placing in the top two teams, KSU qualified for the National Soil Judging competition 12

this spring in Tennessee; and 13

14 WHEREAS, Team members include Keren Duerksen, Jacob Reinecker, Chris Weber, Logan Evers, 15

Sarah Zerger, Tessa Zee, Tara Wilson, Peter Bergkamp, Megan Owens, Lucas Scott, and 16

the team is coached by Mickey Ransom, professor of agronomy, and assistant coaches 17

7 WHEREAS, Legislation passed by the student senate is not currently sent to any of the recipients 8

listed in the bill or resolution; 9

WHEREAS, Sending legislation to listed recipients is critical to sharing the opinions of students at 11

Kansas State University; 12

WHEREAS, Adding this responsibility to an officer’s duties ensures that it will be completed in the 14

future; and 15

WHEREAS, It is important for the governing documents of the Kansas State University Student 17

Governing Association to reflect the expectations and time commitments of its officers. 18

BE IT ENACTED THAT: 20

21 SECTION 1. Article V, Section 7 of the Kansas State University Student Governing Association 22

Constitution is hereby amended to read as follows: 23

507. Duties and Powers of the Speaker pro tempore of the Student Senate. 25

A. Assume the duties of the Speaker of the Student Senate upon the 26

Speaker’s absence or at Speaker’s request. 27

B. Coordinate the process of sending legislation passed by the Student 28

Senate. 29

C. B. Coordinate the open period speakers for the Student Senate. 30

D. C. Assist the Speaker of the Student Senate in the appointment of the 31

secretary, Parliamentarian, Intern Coordinator and chairpersons of the 32

standing committees. 33

E. D. Assist in the coordination of committee appointments. 34

F. E. Oversee the College Caucus system. 35

G. F. Chair such Standing Committees as may be provided in the By-Laws. 36

H. G. Plan and organize at least one diversity training session for KSU SGA. 37

I. H. Collect current data to analyze and interpret the demographic makeup of 38

Student Senate. 39

J. I. Organize activities to help in the orientation of newly elected Student 40

Senators. 41

K. J. Serve on the Faculty Affairs Committee of Faculty Senate. 42

BILL 17/18/21 INCREASE OF THE FINE 1 ARTS PRIVILEGE FEE 2 3 BY: Privilege Fee Committee 4 5 WHEREAS, The activities funded by the Fine Arts Privilege Fee add to the overall experience of 6

student life; 7 8 WHEREAS, The Kansas State University (KSU) student body and the KSU community have seen, 9

and continue to receive, many benefits from the current fine arts privilege fee; 10 11 WHEREAS, All fine arts departments were given an equal opportunity to present their request for 12

funding to the privilege fee committee for the fiscal years July 1, 2018 through June 30, 13 2019; July 1, 2019 through June 30, 2020; and July 1, 2020 through June 30, 2021; 14

15 WHEREAS, The College of Architecture, Planning and Design, McCain Auditorium, the Art 16

Department, The International Student Center and Fine Arts Student Organizations 17 requested and were granted continuances of their current funding level; 18

19 WHEREAS, The Music Department: Band and Orchestra Department, The Music Department: Choral 20

and Opera and the Ebony Theatre requested and were granted $1,250 increases for script 21 rental and royalty fees; 22

23 WHEREAS, Communication Studies, Theater and Dance requested an $8,000 increase for box office 24

costs and $1,250 increase for script rental and royalty fees, but was only granted an 25 increase for $1,250; 26

27 WHEREAS, The English Department requested a $600 increase, but was not granted said increase; 28 29 WHEREAS, All fine arts departments were discussed, debated and decided upon on an individual 30

basis; and 31 32 WHEREAS, The Privilege Fee Committee agreed to recommend to Student Senate the following 33

privilege fee agreement. 34 35 BE IT ENACTED THAT: 36

37 SECTION 1. The Kansas State University Student Governing Association (KSU SGA) approves the 38

following Privilege Fee Budget Agreement. This privilege fee budget agreement shall be 39 included in and/or replace the appropriate chapter of the KSU SGA Statutes. 40

41 Fine Arts Privilege Fee Agreement 42

43 This agreement made this 2

nd day of November 2017, between the Kansas State University Student 44

Governing Association (SGA), Kansas State University Fine Arts (DEPARTMENT). 45 46 1. The annual DEPARTMENT privilege fee budget (BUDGET) shall be funded for the 47

following amounts for the following fiscal years: $327,700.00 for Fiscal Year 19 (July 1, 48 2018 through June 30, 2019); $327,700.00 for Fiscal Year 20 (July 1, 2019 through June 49 30, 2020); and $327,700.00 for Fiscal Year 21 (July 1, 2020 through June 30, 2021). The 50 BUDGET will be reviewed prior to year Fiscal Year 22. 51

a. All Fine Arts Privilege Fees must be spent by the Department, as outlined in 54 Section 4. Departments cannot transfer these funds to any other account. 55

b. Student Fine Arts groups that are eligible for Fine Arts Student Organization 56 funding are those groups whose primary function is the arts. 57

58 3. The Fine Arts Student Reserve Account (NISAFASRSV) has a current balance of 59

approximately $88,000.00. The Fine Arts Student Reserve Account will be expended 60 annually over each of the next three fiscal years to the Fine Arts Student Organizations at 61 an amount of $10,000.00. 62

63 4. The DEPARTMENT shall allocate the funds from each year’s portion of the BUDGET 64

79 5. At the conclusion of each fiscal year all Department and Student Organizations remaining 80

shall revert back to the Fine Arts Student Reserve Account (NISAFASRSV). 81 82

6. Funding for McCain Auditorium is contingent on the agreement that: Student ticket 83 prices for McCain Auditorium events must continue to provide a discounted price of 50% 84 for all performances within the fiscal years 2019, 2020, and 2021. 85

86 7. This agreement supersedes any previous agreement made by KSU SGA with Fine Arts 87

regarding funding of budget and use of such funding. 88 89 8. Any breach of this agreement by the DEPARTMENT will result in automatic review by 90

KSU SGA and such review could result in decrease or termination of funding of the 91 BUDGET. The failure of KSU SGA to exercise any rights in any instance shall not 92 constitute a waiver of such rights in that instance or any other instance. 93

94 9. Within 60 days of the end of each fiscal year, the Chair of the DEPARTMENT shall 95

submit a written summary of the BUDGET expenditures to the Privilege Fee Chair for 96 review by the entire KSU SGA body. In addition to the BUDGET, the Chair of the 97 Department shall submit a Fine Arts Summary Report, as provided by Privilege Fee 98 Chair. Any Department that fails to submit a report, within the given time period, will not 99 receive any further Fine Arts monies until this report is submitted. 100

101 10. Departments are required to list all the following on all payment vouchers using KSU 102

SGA Fine Arts Funds: Event Name, Event Date, Event Location and type of event. 103 104 11. No construction or renovation of a building or facility at Kansas State University is 105

permitted with privilege fees unless the fee was established by a binding referendum vote 106

of the student body. (KSU SGA Constitution Article V Section 508.C and Article XI 107 Section 1105) 108

109 12. This agreement shall be governed by and subject to the laws of the State of Kansas. 110 111 13. By signing this agreement, the representative of the respective parties hereby represent 112

that each is duly authorized by his or her part to execute this document on behalf of such 113 party that the party agrees to be bound by the provisions of the agreement. 114

115 14. Bill 17/18/XX becomes effective upon execution of this agreement by the Privilege Fee 116

Chair; the Executive Director of the Center for Student Involvement; the Speaker of the 117 Student Senate; the Vice President of Student Life; the Student Body President; and 118 directors/chairs/department heads of agencies outlined in Section 4. 119

scholarships and grants offered by Kansas State University through university and federal 41

programs have increased by 156% (from $23,477,776 to $60,094,966); 42

WHEREAS, In the past 18 years (1999-2000 until 2016-2017), the total cost of attendance at Kansas 44

State University has outpaced additional scholarship and grant money available to 45

students; 46

47 WHEREAS, The Bureau of Labor Statistics’ consumer price index (CPI) increased by 44% (from 48

168.8 in January 2000 to 242.8 in January 2017); 49

WHEREAS, According to Census data, the average U.S. household income increased by 3% (from 51

$57,248 in 1998, to $59,039 in 2016); 52

WHEREAS, The consumer price index rising more rapidly that average U.S. household income 54

indicates a decreasing ability-to-pay for higher education; and 55

56 WHEREAS, The rising cost of tuition and the decreasing ability of students to pay is a contributory 57

factor to Kansas State University’s 8% enrollment decline in 3 years (from 24,766 58

students in Fall 2014 to 22,795 students in Fall 2017). 59

BE IT RESOLVED THAT: 61

62 SECTION 1. The Kansas State University Student Governing Association (KSU SGA) recommends 63

that University President Richard B. Myers makes centralized, needs-based scholarships 64

a priority in fundraising campaigns with the K-State Foundation. 65

SECTION 2. To recruit and retain students from an ever-diversifying Kansas high-school populous, 67

KSU SGA recommends that the college’s deans make funding for needs-based and first-68

generation scholarships a priority in their fundraising campaigns with the K-State 69

Foundation. 70

Publications Inc. shall be updated to Collegian Media Group. 15

Governing Association Statutes is hereby amended to read as follows: 20

5 WHEREAS, The Privilege Fee Committee reviewed the Collegian Media Group Audit for the Fiscal 6

Years 2014-2017 and listened to the presentation and proposal from the Collegian Media 7

Group for an increase; 8

WHEREAS, The Collegian Media Group publishes the Collegian newspaper, Royal Purple yearbook, 10

and Manhappenin’ magazine; 11

12

WHEREAS, The Collegian Media group asked for a $17,780 increase for FY19, $12,000 increase for 13

FY20 and $8,000 increase for FY21; 14

15

WHEREAS, The Collegian would like to focus more on providing better digital news media to 16

students without losing the monetary support they receive from local businesses 17

advertising on the print newspapers; 18

19

WHEREAS, The Collegian Media Group reported that they had over 200,000 page views in 20

Manhattan alone compared to only 3,000 paper copy pickups; 21

22

WHEREAS, The Collegian Media Group reported that a continuance would put considerable pressure 23

on expanding into digital; 24

25

WHEREAS, The Privilege Fee Committee believes that a continuance will still allow the Collegian 26

Media Group to shift resources toward digital production and away from printing 27

production; and 28

29

WHEREAS, The Privilege Fee Committee voted 9-0-0 to recommend to Student Senate the 30

following privilege fee agreement. 31

BE IT ENACTED THAT: 33

34 SECTION 1. This agreement made this 9

th day of November 2017, between the Kansas State 35

University Student Governing Association (SENATE), and Board of Directors of 36

Collegian Media Group (DEPARTMENT) 37

1. The annual DEPARTMENT privilege fee budget (BUDGET) shall be funded the 39

following amounts for the following Fiscal Years: $395,364 for Fiscal Year 19 (July 40

1, 2018, through June 30, 2019); $395,364 for Fiscal Year 20 (July 1, 2019, through 41

June 30, 2020); and $395,364 for Fiscal Year 21 (July 1, 2020, through June 30, 42

2021); and will be reviewed prior to Fiscal Year 22. 43

2. The following items shall be considered contractual items: 45

46

a. No student fee funds shall be used for the purchase of food or social 47

functions. 48

49

b. No student fee funds shall be used for the creation or printing of publications 50

which fall outside the mission of Collegian Media Group, to serve the entire 51

campus or its primary publications (e.g. the Royal Purple, Collegian, e-52

Collegian.) 53

3. Any breach of this agreement by the DEPARTMENT will result in automatic review 58

by Kansas State University Student Senate and such review could result in decrease 59

or termination of funding of the BUDGET. The failure of SENATE to exercise any 60

rights in any instance shall not constitute a waiver of such rights in that instance or 61

any other instance. 62

4. Within 60 days of the end of the fiscal year, the Director of the DEPARTMENT shall 64

submit a written summary of BUDGET expenditures to the Privilege Fee Chair for 65

review by the entire Senate Body. 66

5. No construction or renovation of a building or facility at KSU is permitted with 68

Privilege Fees unless the fee was established by a binding referendum vote of the 69

student body (KSU SGA Constitution Article V Section 508.C and Article XI Section 70

1105). 71

6. This agreement shall be governed by and subject to the laws of the State of Kansas. 73

7. By signing this agreement, the representatives of the respective parties hereby 75

represent that each is duly authorized by his or her party to execute this document on 76

behalf of such party and that the party agrees to be bound by the provisions of the 77

agreement. 78

1. Interpret the KSU SGA Constitution, By-Laws and legislation, upon written 34

request by the Student Body President, Speaker of the Student Senate, or by 35

presentation of a petition signed by a number of members of the student body 36

that shall be equal to, or greater than, five percent of the total votes cast in 37

the most recent KSU SGA general election for the KSU SGA President and 38

Vice President. This number shall be rounded up to the nearest whole 39

number, if necessary. 40

2. Try all bills of impeachment passed by Student Senate. 42

3. Hear appeals of decisions from the Housing and Dining Services Judicial 44

Boards, Ad Hoc Boards, KSU SGA Elections Review Committee, KSU SGA 45

Elections Commissioner and Student Review Board, with the authority to 46

modify or overturn the decisions of such persons or bodies. 47

16 WHEREAS, After evaluation of the current KSU SGA By-laws concerning the membership of the 17

Executive Committee, it is apparent that refinements are in order. 18

BE IT ENACTED THAT: 20

21 SECTION 1. Article IV, Section 9, Subsection F of the Kansas State University Student Governing 22

Association (KSU SGA) By-laws is hereby amended to read as follows: 23

F. University Allocations Standing Committee On-Campus Allocations Standing Committee 24 shall be in charge of making recommendation make recommendations regarding the 25 Student Activity Fee and the Fine Arts Fee. 26

1. University Allocations Standing Committee On-Campus Allocations Committee 28 shall consist of fifteen voting members and the Chair of University Allocations 29 Standing Committee Chair of On-Campus Allocations Standing Committee who 30 shall vote only to break a tie. A quorum of the committee shall be eight 31 members a majority of the committee members then selected and qualified, not 32 including the Chair of University Allocations Committee Chair of On-Campus 33 Allocations Standing Committee. 34

2. Membership 36

a. University Allocations Standing Committee Chair On-Campus 37 Allocations Standing Committee Chair, appointed by the Speaker of the 38 Student Senate in consultation with the Speaker pro tempore of the 39 Student Senate, who shall chair the committee. The appointment shall 40 be subject to the approval of Student Senate. 41

b. Nine Eight Student Senators, appointed by the Speaker of the Student 42 Senate in consultation with University Allocations Standing Committee 43 Chair On-Campus Allocations Standing Committee Chair. 44

C. The duties of the Treasurer shall include: 24

1. Set a date at the beginning of the term, following selection of the Speaker of 25 Student Senate, to meet with the Student Body President, Speaker of the Student 26 Senate, Attorney General, and at least one adviser of KSU SGA to set the 27 discretionary budget for the term. The group must be in unanimous agreement 28 on the budget before the next fiscal year. 29

2. Maintain the budget and give at least one report per semester to Student Senate, 30 Cabinet, and the Judicial Branch on the state of the SGA budget. 31

3. Communicating with the Office of Student Activities and Services Center for 32 Student Involvement Accountant, Privilege Fee Standing Committee Chair, 33 University Allocations Standing Committee Chair and College Allocations 34 Standing Committee Chair On-Campus Allocations Committee Chair and Travel 35 Allocations Committee Chair outside of Executive Committee Meetings to 36 maintain a running report of entities and organizations utilizing SGA Funding 37 and advise chairs when needed. 38
