It is proposed by Robert Rowan Seconded by Ronald Marengere And resolved: That this Council authorizes an opening for the position of Director General & Secretary-Treasurer as described in the document submitted at the present meeting; That this Council authorizes that the position be posted in the Municipality and the following municipal web sites: UMQ, ADMQ and Quebec Municipal; That this Council authorizes to publish the ad in La Gatineau, The Low Down and Le Droit.


2010-02-039 VETO RESOLUTION 2010-01-014 - LEGAL FIRM CONSIDERING THAT; Prices from only two firms were received by councillors since their election in November of 2009, CONSIDERING THAT; The tender from the firm of Dutton-Rainville and the description of services seem to better suit the needs of the Municipality,

2010-02-041 WORKING HOURS OF THE GENERAL LABOURERS OF THE MUNICIPALITY CONSIDERING THAT; The outdoor municipal employees work without supervision between the hours of 4 pm and 5 pm, It is proposed by Denis Belair Seconded by Pamela Lachapelle And resolved: That this Council proceed to change the working hours of the outdoor Municipal employees to the following: 8:00 am to 12:00 pm &

12:30 pm to 4:30 pm These hours are to commence on February 15, 2010 with each of the employees to be advised in writing to this effect. Adopted by Councillors

2010-02-042 SICK LEAVE FOR ALL EMPLOYEES

It is proposed by Ronald Marengere Seconded by Robert Rowan

And resolved:

That this Council authorise eight (8) sick days to all Municipal Employees per year, but that three (3) days will be added as paid holidays between Christmas and New Years, which will mean the Municipal Office will be closed and no household waste pick-up will be carried out that week. However, someone will be on call for any emergency that should arise.



2010-02-043 COUNCIL MEETING, WASTE & RECYCLING PICK-UP CALENDAR – ANNUAL BULLETIN PRINTING CONSIDERING THAT; A Municipal Bulletin is sent out with the taxes every year, which includes a calendar of the scheduled council meetings and waste & recycling pick-up from March until February of the following year and that this calendar has proven to be very beneficial to the taxpayers of the Municipality;

CONSIDERING THAT; After a trial period, Council wishes to reinstate weekly household waste pick-up; It is proposed by Denis Belair Seconded by Ronald Marengere And resolved: That this Council authorises the printing of the Municipal calendar as presented with the dates of the regular council meetings, recycling, large article pick-ups and Community clean-up day and that the calendar also identify the weekly collection of household waste.

2010-02-044 PITNEY BOWES – STAMP MACHINE CONTRACT CONSIDERING THAT;

The contract for the Pitney Bowes stamp machine is due in March of 2010;

CONSIDERING THAT; The cost of the stamp machine is considered to be very high;

It is proposed by Denis Belair Seconded by Pamela Lachapelle And resolved: That this Council wishes to discontinue the contract with Pitney Bowes for the stamp machine and that the stamp machine be returned to Pitney Bowes at the end of the contract in March.



2010-02-045 SERVICE CANADA – SUMMER STUDENT GRANT CONSIDERING THAT; Service Canada offers a summer student grant project for which the application forms are available online from February 1 to 26, 2010; CONSIDERING THAT; The assessment phase is completed in April 2010 so the students may commence work as early as May 2010; CONSIDERING THAT; The Municipality requires students to help with regular seasonal maintenance as well as to gather information for the upcoming 150th Anniversary in 2012; It is proposed by Robert Bergeron Seconded by Ronald Marengere And resolved:

That this Council authorises the Director General by Interim Sandra Lacharity, to complete and submit the application for the summer student grant from Service Canada with a request of hiring two students for 2010.


2010-02-046 ADJUSTMENT OF SALARY – ASSISTANT DIRECTOR GENERAL CONSIDERING THAT; The Assistant Director General Secretary Treasurer does not carry the title or responsibility of Road Foreman; It is proposed by Denis Belair Seconded by Ronald Marengere And resolved: That the salary of the Assistant Director General Secretary Treasurer is lowered to $26.50 per hour commencing January 4, 2010 and that the road committee take on the responsibilities of the management of roads and road issues.

2010-02-049 HIRING OF A MUNICIPAL LAWYER CONSIDERING THAT; Prices from only two firms were received by councillors since their election in November of 2009, CONSIDERANT THAT This council has already assigned the 2007, 2008 and 2009 collection of non payment of taxes;

CONSIDERING THAT; The tender from the firm of Dutton-Rainville and the description of services seem to better suit the needs of the Municipality,

It is proposed by Pamela Lachapelle Seconded by Robert Rowan

And resolved: THAT, the firm of Dutton-Rainville Avocats be retained to

represent the interests of the Municipality of Kazabazua for the perception of the land taxes in arrears from the year 2010 at a rate of 10% including the properties up for taxes in arrears;

THAT the firm of Dutton-Rainville Avocats is also retained for the

telephone consultation service in the amount of $1,500 per year or $125.00 per month, plus taxes and expenses allowing the civil servants and the mayor to communicate with them for any information relating to the field of the municipal rights. This also includes the study and analyses of resolutions and draft by-laws;


THAT the firm of Dutton-Rainville Avocats is also retained for all

Council appointed current active files at a rate of $150.00 per hour as per details of the Offer of Services proposal received from the firm November 3 of 2009.

2010-02-050 HELP FOR MUNICIPAL OFFICE CONSIDERING THAT; It is the time of year when tax bill preparation is at hand and the Municipality is without a Director General; CONSIDERING THAT; A grant is available through Centre Jean Bosco de Maniwaki at a rate of 75% of the applicable wage for an office clerk; It is proposed by Denis Belair Seconded by Robert Rowan And resolved; That Council authorises the Assistant Director General and the Mayor Ota Hora to sign all applicable documents relating to the Centre Jean Bosco de Maniwaki grant for an office clerk, and that the contract be signed for a period of 22 weeks at 25 hours per week, in order to help maintain the regular schedule of taxes and general operation of the Municipal administration during the transition period of the hiring of a new Director General.


2010-02-051 FIRE DEPARTMENT RADIO TEST

CONSIDERING THAT; The current emergency communications system works very poorly in the area and requires the Municipality to pay a monthly rental fee; CONSIDERING THAT; There is a possible solution to this problem that would also include a communications system for the Municipality as well, but requires


a radio test on the tower located behind the Kazabazua Fire Hall by a professional communications firm; It is proposed by Pamela Lachapelle Seconded by Robert Bergeron And resolved:

That this Council authorise the radio test to be carried out on the tower located behind the Fire Hall at an expense of $1,500 in order to help find a solution for the emergency communications problem.


APSAM ROAD CONSTRUCTION/DITCHING COURSES

This subject is to be carried to the next regular meeting of Council in order to obtain more information on the availability of an English course or the availability of dates for other upcoming courses.

2010-02-052 REQUEST FOR SNOWPLOUGHING – PETRIN ROAD

It is proposed by Denis Belair Seconded by Ronald Marengere And resolved:

That Council wishes to hold on to this request to be re-evaluated for the new snowplough contract in 2010.


2010-02-053 PURCHASE OF A TANDEM TRAILER

It is proposed by Pamela Lachapelle Seconded by Denis Belair And resolved: That this Council authorises the purchase of a utility trailer for the road and sanitation department and that the trailer be either new at an approximate cost of $3,500 or the purchase of a used trailer


which would include a mechanical inspection and that the trailer purchased must be suitable with all members of council.


2010-02-054 SEPTIC EMPTYING 2010-2011 – AWARDING OF

CONTRACT CONSIDERING THAT; Four tenders were received by the Municipality for the 2010-2011 Septic Emptying contract, CONSIDERING THAT; The Sanitation and Environment Committee met and calculated the point system per contractor, as per the contract specifications for each of the tenders, It is proposed by Pamela Lachapelle Seconded by Denis Belair

And resolved:

That this Council award the 2010-2011 Septic Tank Emptying Contract to Cammionage David Tanner at a cost of $69.94 per regular tank emptying and the specified fees for all other types of emptying required as per the contract tender.


2010-02-055 BY-LAW SEPTIC COMPOST (BIO-SOLID) SPREADING – TERRITORY OF KAZABAZUA

BY LAW 2010-02-001

PROHIBITION OF BIOSOLID WASTE SPREADING ON THE TERRITORY OF THE MUNICIPALITY OF KAZABAZUA

CONSIDERING THAT; At a previous regular meeting of Council of the Municipality of Kazabazua, notice of motion was given by Councillor Ronald Marengere for the adoption of a by law to prohibit the spreading of Biosolid waste on the territory of the Municipality of Kazabazua; CONSIDERING THAT;


The information regarding the safe usage and/or spreading of biosolid materials (that being sewage waste, sewage compost, sludge etc.) is based upon studies commissioned by various organizations and companies; CONSIDERING THAT; These studies do not provide sufficient information nor is there enough evidence as to the long term impact of the use and/or spreading of biosolid materials (that being sewage waste, sewage compost, sludge etc.)

CONSIDERING THAT; The mandate of the Municipal Corporation of Kazabazua is to protect its citizens from potentially hazardous situations which could occur as a result of the use and/or spreading of biosolid materials (that being sewage waste, sewage compost, sludge etc,) on and within its territory; CONSIDERING THAT; The use and/or spreading of biosolid materials (that being sewage waste, sewage compost, sludge etc.) could have a negative impact on land values and potential and future expansion and community growth as well as viable use of the land on and within the Municipality’s territory; CONSIDERING THAT; The Superior Court of Quebec has set precedence through judgement #760-17-001371-064 October 1, 2009 (Ferme l’Evasion inc. C. Elgin (M du Canton D) allowing any municipality to install and enforce by law prohibiting the use and/or spreading of biosolid materials (that being sewage waste, sewage compost, sludge etc.) on and within its territory; IT IS PROPOSED BY; Ronald Marengere SECONDED BY; Denis Belair Opposed by; Pamela Lachapelle

AND RESOLVED THAT; The Municipality of Kazabazua does hereby prohibit the use and/or spreading of biosolid materials (that being sewage waste, sewage compost, sludge etc.) on the whole of its municipal lands and territories.

MRCVG – SEPTIC COMPOST AVAILABLE


The MRCVG has been approached by a developer in the Outaouais that wishes to use the septic compost that is available for approximately five years. A copy of our new by-law 2010-02-001 will be forwarded to the MRC.

2010-02-056 REQUEST FOR DOOR TO DOOR HOUSEHOLD WASTE PICK-UP – THIBAULT ROAD CONSIDERING THAT; Thibault Road is a private road, It is proposed by Ronald Marengere Seconded by Denis Belair And resolved: This Council authorises the garbage truck to go into Thibault Road for large article pick-up on the predetermined dates, but for now wishes to postpone the request for door to door pick-up for consideration at a later date.

The Municipality has recently received an offer from Garage Roger Johnson for free scrap removal for taxpayers within the Municipality of Kazabazua. The contact information will be printed on the Municipal bulletin

INFORMATION: The Municipality has received a request for a certificate of authorisation from the MRCVG – septic treatment plant to install a new system to improve the quality of the return water into the Kazabazua River. This new addition will allow for the gross reduction of fine particles and phosphates from what is currently being returned to the River. Environment Quebec has already authorised this new installation for improvement.


2010-02-057 SECOND ADOPTION OF THE REQUEST FOR ADDED USAGE S5 IN ZONE P107-A

Canada Province of Quebec Municipality of Kazabazua Project by-law number 01-01-10 Second project by-law for the modification of certain dispositions of the zoning by-law #201 number 78290. Whereas, the zoning by-law 201 has been in effect since the 17th of June 1992, following a certificate of conformity delivered by the MRC Vallee de la Gatineau; Whereas the council of the Municipality of Kazabazua expresses the desire to create a new use in zone P107A in order to add the S5 use;

Whereas the zone P107A includes the authorised usages as follows; C3, F9, I1, I2, I4; Whereas the Municipality wishes to authorise the usage S5 in zone P107A In this use, are the buildings, spaces and uses of a public service nature, which can be of some inconvenience for the surrounding vicinity and which require large spaces. Belonging to this use are the following;

- Domestic waste treatment site; - Waste water oxidation pools; - Salt storage bins; - Ministry of Transportation sites; - Industrial and domestic waste incinerators; - Dry material waste sites; - Treatment of septic mud sites;

Whereas the council of the municipality of Kazabazua wishes to authorize a new use inside zone P107A. Uses already authorized in zone P107A will remain authorized. CONSIDERING THAT; A notice of motion was given by Councillor Kevin Molyneaux at a regular meeting of council held January 12, 2010; (resolution 2010-01-023)


CONSIDERING THAT; A public consultation was held January 12, 2010 at 7:30 pm; For these reasons, It is proposed: Robert Rowan Seconded by : Denis Belair It is unanimously resolved to authorize the adoption of the second draft By-Law 01-01-10 modifying the zoning by-law 201.

It was ordered and ruled by the council of the Municipality of Kazabazua by this by-law as follows:

Article 1 : This by-law is entitled by-law No. 01-01-10 aimed at modifying zoning by-law 201. Article 2 : Whereas the Municipality has the intention of authorizing, the buildings, spaces and ground uses of a public nature, including services of a public nature which can be of some disadvantages for the vicinity and which require rather large spaces. Belonging to this use are the following;

- Domestic waste treatment site; - Waste water oxidation pools; - Salt storage bins; - Ministry of Transportation sites; - Industrial and domestic waste incinerators; - Dry material waste sites; - Treatment of septic mud sites;

Article 3 : The present by-law comes into effect conforming to the law.


2010-02-058 SECOND ADOPTION OF THE REQUEST FOR ADDED USAGE H1 IN ZONE C140


Canada Province of Quebec Municipality of Kazabazua Project by-law number 02-01-10

Second project by-law for the modification of certain dispositions of the zoning by-law #201 number 78290. Whereas, the zoning by-law 201 has been in effect since the 17th of June 1992, following a certificate of conformity delivered by the MRC Vallee de la Gatineau; Whereas the council of the Municipality of Kazabazua expresses the desire to create a new use in zone C140 in order to add the H1 use;

Whereas the zone C140 includes the authorised usages as follows; H1; Whereas the Municipality wishes to authorise the usage H1 in zone C140 In this use, are the spaces and uses of a forestry nature, but whose activities require special conditions of operating of resources in order to protect a particular site offering from the possibilities of interesting development in forest medium. Belonging to this use is the following;

The forest operations of which the methods of cut are made in conformity as follows;

- The total cut by band of a maximum width not exceeding 25 meters and a

maximum length of 275 meters provided that it is located has at least 50 meters of another surface of total cut carried out in the three years preceding the request by certificate of authorization, and this, on the property aimed by the request;

- The cut by perforated total of a surface not exceeding 3 hectares, Each surface of cut by perforation must be spaced from another cut by perforation carried out in the three years preceding the request by certificate of authorization, and this, on the property of request;

- The cut with limiting diameter with the threshold is authorized, the cut of all the forest essences of more than 10 centimetres in diameter.

- Cut of regeneration constituting an annual cut of trees chosen individually or by small groups to improve the situation of the forest grounds.

- The cuts of break or a weak part of the trees is annually cut down in order to support the principal settlement.


The additional buildings assigned to the forestry development such as the surfaces or storage, buildings being used for storage of the machinery and the tools necessary for the forest operations.

Whereas the council of the municipality of Kazabazua wishes to authorize a new use inside zone C140. Uses already authorized in zone C140 will remain authorized. CONSIDERING THAT; a notice of motion was given by Councillor Robert Bergeron at a regular meeting of council held January 12, 2010; (resolution 2010-01-024)

CONSIDERING THAT; a public consultation was held January 12, 2010 at 7 :30 pm; For these reasons,

It is proposed: Denis Belair Seconded by: Robert Bergeron It is unanimously resolved to authorize the adoption of the second draft By-Law 02-01-10 modifying the zoning by-law 201.

INFORMATION The Municipality has received a request from Kevin Murphy (ESSO) to obtain a certificate of authorisation for a liquor permit at his establishment.


2010-02-059 RELOCATION OF THE GABIE FAMILY ANCESTRIAL HOME CONSIDERING THAT; Mr. Howard Gabie needs to approach the Ministry of Agriculture, Fisheries and food of the Government of Québec and Commission de Protection du Territoire Agricole de Quebec, to obtain authorisation to relocate their ancestral house closer to the 105 route, situated on their land designated agricultural land, to permit them to access the highway;

CONSIDERING THAT; Mr. Howard Gabie and his son wants to repair and conserve this ancestral house; whereas the municipality of Kazabazua also plans to promote and preserve, as much as possible, all its historical / ancestral and touristic sites / houses; It is proposed by Robert Bergeron Seconded by Ronald Marengere And resolved;

That this council wishes to inform the Ministry of Agriculture, Fisheries and food of the Government of Québec as well as the Commission de Protection du Territoire Agricole de Quebec, that it supports M Howard Gabie in his endeavour to obtain authorisation to relocate, repair and conserve their old ancestral family house;


2010-02-060 OFFICIAL HIRING OF A LIBRARIAN/CLERK FOR THE MUNICIPAL LIBRARY CONSIDERING THAT; A posting and campaign was held through Emploi Quebec for a Librarian/Clerk,

CONSIDERING THAT; Interviews were carried out by Councillor Robert Bergeron and the Cultural and Social Committee, CONSIDERING THAT; A Librarian/Clerk was hired temporarily by the Director General by Interim,

It is proposed by Robert Rowan Seconded by Ronald Marengere


And resolved: That Ms. Tina Seguin is officially hired for the position of Librarian/Clerk, for a period of 30 weeks with the help of a grant by Emploi Quebec and that the Director General by Interim signs all applicable documents pertaining to this grant.

CONSIDERING THAT; The ministry of Municipal Affairs, Municipalities and regions of Quebec has submitted a governmental for devitalised municipalities and in this Municipal plan Kazabazua was declared a devitalised Municipality; CONSIDERING THAT; In January 2009 the Municipality established a revitalisation committee of Kazabazua in order to mandate and identify projects (such as the replacement of the Kazabazua rink and the creation of a sports arena); CONSIDERING THAT; By Municipal resolution 2009-08-150 funds have been reserved at the disposition of the Municipality for the projects established by priority with an initial amount of $4,000.00 set aside for the initial amount of $4,000.00 for the replacement of the Kazabazua rink and the creation of a sports arena; CONSIDERING THAT; Private partners of the Municipality are ready to contribute $9,500.00 (With an amount of $8,000.00 given by the Kazabazua Recreation Association (KRA) as a contribution); CONSIDERING THAT; The Ministry of Municipal Affairs and Regions of Quebec adopted the project (Replacement of the skating rink of Kazabazua and the creation of a sports arena) among the multiple planned projects, within the framework of the program of financial assistance Building Site Funds Canada Quebec Volet II. CONSIDERING THAT; The committee will return to the council to obtain final approval on the engagement of the specific funds of each project;

And resolved;

That this Council maintains the sum of $4,000 as its initial financial contribution portion of the Municipality; That the Council authorises the Revitalization Committee and its partners, the Recreation Association of Kazabazua, and Mr Robert Bergeron as agent for the municipality of Kazabazua and the Kazabazua Recreation Association to initiate the consultation processes, for the development of plans, in order to acquire estimates and all other procedures such as approaching various governmental agencies to negotiate and obtain the subsidies necessary to carry out the project,

That this council authorizes the presentation of the Replacement project of the skating rink of Kazabazua and the creation of a sporting arena, with the Ministry of Municipal Affairs, Municipalities and Regions of Quebec within the framework of the financial assistance program Building Site Funds Canada Quebec Volet II. That the Council authorises the Mayor Mr. Ota Hora to sign the agreement protocol with the Ministry of Municipal Affairs and all other partners such as the MRCVG for the realisation of this project Replacement project of the skating rink of Kazabazua and the creation of a sporting arena. That the Council and the Recreation Association of Kazabazua engage in paying their parts of the admissible costs of the project, as well as the costs of the exploitation and continuance of the project.


2010-02-062 HALL, CHALET AND LIBRARY RENTAL RATES CONSIDERING THAT; The Community Centre now has air conditioning and an added source of heat, CONSIDERING THAT; More activities and bigger events such as weddings are being held which raises the cost of cleaning and general up-keep,


CONSIDERING THAT; Other than a cleaning deposit, there is currently no charge to taxpayers for the use of the Hall, Chalet or Meeting room at the Library,

2010-02-063 REQUEST OF SUPPORT – UMQ - HAITI

CONSIDERING THAT; The Union des Municipalités de Quebec has requested financial aid support for Haiti,


CONSIDERING THAT; The financial aid requested is at a rate of twenty-five (25) cents per taxpayer, It is proposed by Pamela Lachapelle Seconded by Denis Belair And resolved: That this Council authorises a donation to the UMQ “Urgence Haiti” in the amount of $396.50 which represents twenty-five cents per taxpayer (1586) of the Municipality of Kazabazua as per the request. 2010-02-064 REQUEST FOR SUPPORT – MONTCERF-LYTTON - IMPLANTATION OF A MUNICIPAL COURT

It is proposed by Ronald Marengere Seconded by Robert Bergeron And resolved: This Council supports the Municipality of Montcerf-Lytton with its request for support to the MRC for the implantation of a Municipal Court in this territory and that a copy of this resolution be forwarded to the Municipality of Montcerf-Lytton as well as the MRCVG.


2010-02-065 REQUEST FOR SUPPORT – LIONS CLUB It is proposed by Denis Belair Seconded by Pamela Lachapelle And resolved: That this Council authorises a donation of $100 to the Low and District Lions Club in support of its annual Sweetheart Auction.



2010-02-066 REQUEST FOR SUPPORT – GATINEAU VALLEY SKATING CLUB – ANNUAL SKATING SHOW It is proposed by Denis Belair Seconded by Pamela Lachapelle And resolved: That this Council authorises the purchase of a ¾ page ad, in the 14th annual Ice Show program for the amount of $100 in support of the Gatineau Valley Skating Club.


2010-02-067 LA GATINEAU – SCHOOL BUS SAFETY AD It is proposed by Robert Bergeron Seconded by Ronald Marengere And resolved: That this Council wishes to purchase an ad space for a business card in the school bus safety issue of La Gatineau at a cost of $60 to help with public awareness of the safety and security of school children.
