Cannabis Ballot Measures• Measure N, a measure imposing a general tax on commercial

cannabis cultivation, manufacturing, and testing laboratory facilities.

1. Established an annual tax on commercial cannabis cultivation facilities in the amount of $15 per square foot of indoor area used to grow cannabis (“Canopy Space”). The City Council may increase this tax up to $25 per square foot of Canopy Space without further voter approval.

2. Established an annual tax on cannabis manufacturing and testing laboratory facilities in an amount equal to ten percent (10%) of the facility’s gross receipts.

• Measure O, a measure imposing a general tax on cannabis retail businesses.

3. Established an annual tax in an amount equal to ten percent (10%) of the cannabis retailer’s gross receipts. The City Council may increase this tax up to fifteen percent (15%) of the retailer’s gross receipts without further voter approval.

Allowed in Banning Industrial Zones (I):• Testing laboratory: A laboratory that offers or performs tests of

cannabis goods. • Manufacturing Level 1: For sites that manufacture cannabis

products using nonvolatile solvents, or no solvents. • Medium Indoor: An indoor cultivation site of between 10,001 and

22,000 square feet of total canopy.

deliveries throughout the state.

• The applications will be posted on the City website and available at the planning counter.

• All applications will be accepted by appointment only.– 951-922-3123

• During the appointment the application will be reviewed for completeness.

• All supporting documents and fees are required for acceptance.

• Incomplete applications will be reviewed and returned identifying items necessary for resubmittal.

• Appointments for Questions January 24, through February 15.

• Applications accepted 8 to 5, January 28, through February 22 by appointment only

• Applications will be processed from February 11 through February 22.

• Applicants will be notified by mail of their eligibility for the lottery by March 1st.

For Commercial Cannabis Businesses

• For cannabis cultivation, manufacturing, and testing laboratory facilities only, the City Manager in consultation with the Chief of Police will issue or deny a cannabis regulatory permit within 45 days of receipt of a completed application.

• By March 1, 2019, all applicants with accepted applications will be notified of lottery eligibility

• Any applicant determined ineligible may file an appeal with the Community Development Department between March 4 and March 8.

• Any appeals will be heard during the week of March 11 thru March 15.

• If no appeals - the public lottery will be held on March 13, 2019.

• If any appeals are submitted, the public lottery will be held on March 19, 2019 (or as determined by the City Manager)

The Lottery(For Retail Businesses Only)

• The lottery will be conducted as follows:– Each eligible applicant will receive a lottery ball, with a unique number.– The lottery balls, in the lottery machine shall be pulled at random until all balls

are pulled. – The first three applicants balls that are pulled will be issued a cannabis

regulatory permit and will be eligible to apply for a cannabis conditional use permit (CUP).

– The remaining applicants will be placed on a waiting list in the order their ball is pulled.

– If any of the first three applicants withdraws or is denied a CUP within 1 year, the first applicant on the waiting list will be contacted for reevaluation and issuance of the regulatory permit.

– The process will continue, in order, until three cannabis conditional use permits have been issued.

Conditional Use Permit• To apply for a Conditional Use Permit, use the City of Banning

Uniform Application and check the box, Cannabis Conditional Use Permit.

– On the City of Banning Web Site and at City Hall.

• Fill out the application and provide the additional information required.

– Additional information requirements are included on the attachments.• Chapter 17.53 for Commercial Cannabis Businesses.• Chapter 17.54 for Retail Cannabis Businesses.

• Submit the application to the Community Development Department with a check for $10,000.

• Cannabis CUP requires approval from both the Planning Commission and City Council.

• The process takes approximately 4-8 months, determined by completeness of the submittal package.
