StateZigures showGaryteachershadanaveragesalaryof$52,433last schoolyear,about$5,000morethanthestatewideaverage.The district struggleswithdiscipline problems andoneof thestate's highestpovertyrates whilealso having someof the lowestscores onstandardizedtests amongIndiana's schools. Thedistrict also has hadsmall increases instatefundingas the estimatednumberofpupilsforthisschoolyearisdownfromsome22,000adecadeago.

“It has been illegal. My proposalsimplygives alaw that already exists, teeth,”commentedScott Those teethwouldhavebitingconsequencesforboththeMichiganEducationAssociationandteachersbydoingthreethings:

TherulingonFridaybyDaneCountyCircuitCourtJudgeJuanColasstemsfromachallengebyunionsrepresentingMadisonschoolteachersandMilwaukeecityemployees.Itwasunclearwhat immediateimpacthisrulingwouldhave.Colasruledthateliminatingcollectivebargainingrights forcityemployees includingteachersviolatedtheworkers' right tofreespeech, associationandequalprotection.Healsoruledthatthelaw'srequirementthatMilwaukeecityworkersmakepensioncontributionsviolatedahome-ruleprovisioninthestateconstitution.

Severalprovisions "singleout andrestricting therightsof thoseemployeeswhochooseunionmembershipandrepresentation"isviolationoftheirfreespeechandassociationrights,Colasfound.

JohnMatthews, executive director for the union that represents about 5,000 Madison school district teachers, said the ruling"certainlyhasmadepeoplefeelempoweredagaininsteadoffeelingoppressedandpushedaside."

"Ithinkweareonprettysolidgroundtowithstandanyappealsandanyattemptsbythefarrighttodoawaywithunionmembers'rights,"Matthewssaid,addingthattheagreementbetweenMadisonteachersandthedistrictexpiresinJune2013.

Wisconsin'sRepublican-ledlegislatureapprovedthesweepingchangestopublicsectorunionpowerslastyearinsessionscalledtoZixastatebudgetdeZicit,sparkingmassiveunion-backedprotestsandeffortstorecallWalker.

WalkereasilysurvivedarecallelectioninJuneandhasbecomeachampionforZiscalconservatives.

The law,whichGov.Walkerpassed,forcedmoststateworkers,includingteachers,topaymoreforhealthinsuranceandpensions,limitedtheir pay raises,made payment of uniondues voluntary andforcedunions tobere-certiZiedeveryyear. Numerous legalchallengeshavebeenpursued.

ChicagoteacherswillresumewalkingpicketlinesonMondayaftertheirunion’sdelegatesdelayed a decision on whether to suspend their week-old strike. A proposed contractincludes revisedjobsecuritymeasuresandrevampedteacherevaluations.Abreakdownoftheissuesonthetable:

TEACHER EVALUATIONS: The union is particularly concerned about a newteacher evaluationsystem whereChicago’s schoolleadersareproposingthatstudentperformanceonstandardizedtests count toward25percent ofateacher’sassessment,growingto40percent inZiveyears.Teacherssaythatdoesnottakeintoaccountexternalfactorsthataffectperformance,includingpoverty,violenceandhomelessness.Theyargueitcouldresultin6,000teacherslosingtheirjobswithintwoyears.

"Evaluateusonwhatwedo,notthelivesofourchildrenwedonotcontrol,"ChicagoTeachersUnionPresidentKarenLewissaidinannouncing thestrike. Twenty-four states nowrequire teacher evaluations basedon somemeasureofstudent growth, according to ananalysis bytheNationalCouncilonTeacherQuality,aresearchandpolicygroup.PublicschooldistrictsinTennesseeandWashington,D.C.,recentlyimplementednew teacher evaluations tyingoutcomes tomerit raises, whileColorado andNewYork aredeep in theprocess ofdevelopinganevaluationsystem,thecouncilnoted.

JOBSECURITY:Worriedthathundredsofschoolscouldbeclosedinthenextfewyears, theunionhaspushedforapolicytorecalllaid-offteacherswhenjobsopenupanywhereinthedistrict.Thedistrictsaysthatcouldtakeawayprincipals’legalright tohiretheteachers they want. Instead, it has said that if a school closes, teachers would have the Zirst right to jobs that match theirqualiZicationsat the schools that absorb the childrenfromtheclosedschool.Thedistrict alsosays itwill guaranteeinterviews totenured,highlyratedteacherswhoarelaidoff.Itsaysitwill‘‘aimto’’Zill50percentofvacancieswithdisplacedteachers.

SALARYandBENEFITS:Theschooldistricthasoffereda7percentraiseoverthreeyearswiththeoptionofa3percentraiseinthefourthyear.Theproposedcontract alsopreservesraisesbasedonyearsofservice.TheaverageChicago teacher salary is$76,000,accordingto theschooldistrict. Someteachers areupset that the contractdoesnot restorea4percent raisepromisedinthelastcontractbutcanceledbyMayorRahmEmanuel.Teachersalsocouldnolongerbepaidforsickorpersonaldaystheydon’ttake.
