RACCOMANDAZIONI PER LA SCELTA, LO STOCCAGGIO, L’USO E LA MANUTENZIONE DEI TUBI FLESSIBILI IN GOMMARECCOMENDATION REGARDING CHOICE, STORING, USE AND MAINTENANCE OF RUBBER HOSES

1. CRITERI DI SCELTAPer scegliere un tubo idoneo all'uso previsto è necessariodeterminare almeno i seguenti parametri fondamentali:

1.1 Pressione - depressioneDeve essere determinato il valore della pressione massima diesercizio o depressione in servizio. E' da considerare che, nelcaso di brusche variazioni di pressione o addirittura di picchisuperiori alla pressione massima di esercizio, sarà pregiudicatala normale durata del tubo.

1.2 Compatibilità dei prodotti trasportatiVanno definite la natura, la designazione, la concentrazione, latemperatura e la forma (liquida, gassosa, solida). In caso diprodotti solidi da trasportare è necessario indicare lagranulometria, la densità, la portata del prodotto solidotrasportato, la natura, la velocità e la portata del fluido portante.

1.3 AmbienteE' necessario conoscere il luogo d'uso, la temperaturaambiente, il grado igrometrico e l’eventuale esposizione agliagenti atmosferici. Condizioni ambientali particolari quali le luciultraviolette, l'ozono, l'acqua salata, gli agenti chimici ed altri elementi aggressivi possono provocare una precocedegradazione del tubo.

1.4 Sollecitazioni meccanicheDeve essere stabilito il raggio minimo di curvatura in serviziononché eventuali sollecitazioni a trazione, torsione, flessione,vibrazioni, compressione, schiacciamento e carichi longitudinalio trasversali.

1.5 Abrasione della coperturaAnche se i tubi sono già progettati per garantire una buona resistenza all'abrasione, è bene ricorrere ad una protezione ulteriore quando nell'impianto si possono verificaredanneggiamenti a causa di urti, corrosioni e strisciamenti.

1.6 Posizione di lavoroIndicare se il tubo in esercizio è posto al suolo, in sospensioneo in immersione.

1.7 Raccordatura utilizzata o previstaVa determinata per:- i raccordi e le flange: il tipo, la dimensione, la natura dellafilettatura, la norma di riferimento ed il tipo di applicazione;- i codoli: il diametro interno ed esterno e la lunghezza diaccoppiamento;- le staffe: il tipo e le dimensioni.Per garantire un buon funzionamento deve essere assicurata lacompatibilità tra il tubo ed il tipo di raccordatura. Il tuboassemblato deve comunque garantire la pressione di servizioindicata dal costruttore.

1.8 Regolamentazione tecnicaSi dovrà sempre tenere conto delle norme e delleregolamentazioni tecniche esistenti a livello nazionale, europeoed internazionale. In caso di tubazioni per impieghi di tipoparticolare è bene definire con il produttore un capitolatospecifico.

1.9 MarcaturaI produttori provvedono a riportare sulla copertura del tubo, adintervalli regolari, una serie di informazioni atte a definire ilcampo di impiego. In caso di difficoltà di interpretazione oquando le informazioni non sono ritenute sufficienti, gli utentisono invitati a rivolgersi al produttore.

1. CHOICE CRITERIAIn order to choose a hose suitable for a specific use it isnecessary to determine at least the following basic points:

1.1 Pressure - suctionIt is necessary to determine the maximum working pressure orsuction values. It should be taken into consideration that thenormal life of the hose will be prejudiced in the case of asudden pressure variation or pressure peaks exceeding themaximum allowed.

1.2 Compatibility of conveyed substancesThe nature, designation, concentration, temperature and state( liquid, solid, gaseous) must be determined. In the case of solidsubstances conveyed, it is necessary to indicate granulometry,density, quantity of the solid substance conveyed as well asthe nature, speed and flow of the fluid carrying it.

1.3 EnvironmentIt is necessary to know the place of usage, ambient temperature,hygrometric conditions and exposure to atmospheric agents.Specific environment conditions such as ultraviolet rays, ozone,sea water, chemical agents and other aggressive elements couldcause early degeneration of the hose.

1.4 Mechanical stressThe minimum bend radius must be established as well as anystress related to traction, torsion, bending, vibration, compression,deflection and longitudinal or transversal loads.

1.5 Cover abrasionEven though the hoses are manufactured to guarantee goodresistance to abrasion, it is advisable to use further protectionwhen damage to the hose may be caused by shock, corrosionand dragging.

1.6 Working positionIndicate if the hose is either placed on the ground, suspendedor immersed.

1.7 Used or foreseen couplingsThis must be selected according to:- coupling and flanges: type, dimension, type of thread,standard references and kind of application;- ruffles: internal and external diameter and coupling length;- brackets: type and dimension.

In order to guarantee good performance the compatibilitybetween the hose and type of coupling must be ensured. Theassembly must guarantee the working pressure suggested bythe manufacturer.

1.8 Technical standardsNational, European and International technical standards andrules must always be adhered to. In the case of hoses forpeculiar purposes it is advisable to establish proper specificationwith the manufacturer.

1.9 MarkingManufacturers must mark hoses at regular intervals with theinformation necessary for the proper use of the product. Whenthe interpretation is not clear or the informations areinsufficient, users should apply to the manufacturer.

Questi cambiamenti,che avvengono normalmente nel tempo in relazione al tipo digomma impiegato, possono essere accelerati da singoli fattori o da una combinazione degli stessi. Anche i materiali di rinforzo possono essere condizionati negativamente da un immagazzinaggio inadeguato. Le seguenti prescrizionienunciano un insieme di precauzioni per ridurre al minimo ildeterioramento degli articoli stoccati.

2.1 Durata di stoccaggioLa durata di stoccaggio deve essere ridotta il più possibileattraverso una rotazione programmata del magazzino.Quando non è possibile evitare uno stoccaggio di lunga durata è necessario che l'utilizzatore, effettui un controlloapprofondito del tubo prima della sua entrata in servizio.

2.2 Temperatura ed umiditàLa temperatura ottimale per l'immagazzinaggio di tubi flessibili in gomma varia da 10°C a 25°C. Essi non devono essere sottoposti a temperature superiori a 40°C o inferiori a0°C. Quando la temperatura è inferiore a -15°C è necessarioadottare precauzioni per la loro movimentazione. I tubi nondevono essere immagazzinati né vicino a fonti di calore né incondizioni di alta o bassa umidità. L'umidità relativa non devepreferibilmente superare il 65%.

2.3. LuceI tubi devono essere immagazzinati in locali bui, evitando inparticolare la luce solare diretta o una illuminazione artificialeintensa. Se i locali di stoccaggio hanno finestre o aperturevetrate, queste devono essere schermate.

2.4. Ossigeno ed ozonoI tubi devono essere protetti dall'aria attraverso idonei imballio immagazzinati in contenitori chiusi. Poiché l'ozono esercitauna particolare azione aggressiva su tutti i prodotti in gomma,i magazzini di stoccaggio non devono contenere materialicapaci di produrne come il materiale elettrico ad alta tensione, i motori elettrici o altri materiali in grado di provocare scintille o archi elettrici.

2.5 Contatto con altri materialiI tubi non devono essere messi a contatto con solventi, carburanti, oli grassi, composti chimici volatili, acidi, disinfettanti e liquidi organici in genere. Inoltre, il contattodiretto con alcuni metalli (per esempio manganese, ferro,rame e sue leghe) ed i loro composti esercitano effetti dannosi su alcuni tipi di gomme. Va altresì evitato il contattocon cloruro di polivinile (PVC) e con legname o tessuto impregnati di creosoto.

2.6 Fonti di caloreDevono essere rispettati i limiti di temperatura definiti al punto2.2. Quando ciò non è possibile, è necessario frapporre unaprotezione termica.

2.7 Campo elettrico o magneticoNei locali di stoccaggio devono essere escluse variazioni dicampo elettrico o magnetico, le quali possono provocare correnti nei raccordi metallici, riscaldandoli. Simili campi possono essere creati da linee ad alta tensione o da generatori ad alta frequenza.

2. RECOMMENDATION FOR CORRECT STORAGERubber is subject, by nature, to change in physical properties.These changes, which normally occur over the course of time,according to the kind of rubber used, can be accelerated by one particular factor or by a combination of these.Reinforcement materials are also adversely affected by unsuitable conditions of storage. The following recommendations give some precautions to betaken to ensure the minimum deterioration to stored articles.

2.1 Storage lifeStorage time should be reduced to the minimum throughprogrammed rotation. When it is not possible to avoid longterm storage, it is necessary that the user carries out acomplete check of the hose before its use.

2.2 Temperature and humidityThe best temperature for the storage of rubber hoses variesfrom 10 to 25 degrees centigrade. Hoses should not be storedat temperature above 40°C or below 0°C. When thetemperature is below -15°C it is necessary to take precautionswhen handling. Hoses should not be stored neither nearsources of heat nor in conditions of high or low humidity. A humidity level of a maximum of 65% is recommended.

2.3 LightHoses must be stored in dark places, avoiding direct sun lightor strong artificial light. Should store rooms have windows orglass openings, these must be screened.

2.4 Oxygen and ozoneHoses should be protected from circulating air by suitablepacking or by storage in air-tight containers. As ozone has aparticularly aggressive action on all rubber products, the warehouses must not contain material producing ozone likedevices under high electrical tension, electric engines or othermaterials provoking sparks or electric arcs.

2.5 Contact with other materialsHoses should not come into contact with solvents, fuels, oils,greases, volatile chemical mixtures, acids, disinfectants andother organic liquids in general. Furthermore direct contact withsome metals (for example manganese, iron, copper and itsalloys) and relative mixture exercise harmful effects on sometypes of rubber. Contact with PVC and creosote impregnatedtimber or fabrics should be avoided.

2.6 Heat sourcesThe temperature limits given in point 2.2 must be respected.When this is impossible, it is necessary to use a thermic shield.

2.7 Electric or magnetic fieldVariation in electric or magnetic fields must be eliminated inwarehouses as these could provoke currents in metal coupling,heating them. Similar fields could be caused by high-tensioncables or high frequency generators.

2.8 Condizione di stoccaggioI tubi devono essere immagazzinati senza sollecitazioni, allungamenti, compressioni, o deformazioni eccessive evitando il contatto con oggetti spigolosi o taglienti. Verranno immagazzinati preferibilmente in appositi scaffali o superficiasciutte. I tubi confezionati in rotolo, devono essere immagazzinati orizzontalmente evitando l'accatastamento.Quando ciò non è possibile, l'altezza delle pile deve esseretale da evitare deformazioni permanenti agli articoli posizionati in basso. Il diametro interno di avvolgimento delrotolo, in fase di stoccaggio deve essere tale da non pregiudicare le prestazioni del prodotto stesso. In particolaretale diametro non deve essere inferiore ai valori prescritti dalcostruttore. E' consigliabile evitare di collocare i rotoli su asteo ganci. E' inoltre consigliabile immagazzinare orizzontalmen-te, senza curvarli, i tubi che vengono consegnati diritti.

2.9 Roditori ed insettiI tubi devono essere preservati dall'eventuale attacco di roditori ed insetti. In caso di tali rischi dovranno essere predisposte adeguate protezioni.

2.10 Marcatura degli articoli imballatiE' opportuno che il tubo sia sempre chiaramente identificabi-le, anche se imballato.

2.11 Ritiro dal magazzinoPrima della consegna si deve controllare che i tubi siano integri e corrispondano all'uso previsto. Nel caso di uno stoccaggio prolungato e quando i raccordi non sono aggraffati, mandrinati o vulcanizzati, è necessario controllare labuona chiusura dei collari di serraggio.

2.12 Ritorno in magazzinoI tubi che sono stati utilizzati, devono essere svuotati da tutte le sostanze trasportate prestando un'attenzione particolare quando sono stati trasportati prodotti chimici,esplosivi, infiammabili, abrasivi o corrosivi. E' consigliabile,dopo la pulizia, verificare il buono stato e la possibilità di riutilizzazione.

3. NORME E MODALITÀ D’USODopo aver selezionato il tipo di tubo, l'utilizzatore deve tenereconto dei seguenti criteri di montaggio:

3.1 Controlli pre montaggioPrima del montaggio occorre esaminare attentamente il tubocontrollando tutte le sue caratteristiche per verificare la conformità alle specifiche: tipo, diametro e lunghezza. E' inoltre opportuno effettuare un controllo visivo accertando-si che non vi siano ostruzioni del diametro, tagli, coperturedanneggiate o altri difetti palesi.

3.2 MovimentazioneI tubi devono essere movimentati con precauzione evitandourti, trascinamenti su superfici abrasive, schiacciamenti e non devono essere tirati con forza quando sono attorcigliati o piegati. I tubi di peso elevato, che vengono abitualmente consegnati in posizione orizzontale, devono essere sostenuti,durante il trasporto, su speciali supporti per il trasporto. Se siimpiegano cavalletti di legno, gli stessi non devono essere trattati con iniezioni di creosoto o verniciati con sostanze chepossono avere effetti dannosi.

2.8 Storage conditionsHoses must be stored in a relaxed condition free fromtension, compression or other deformation and contact withobjects that could pierce or cut must be avoided. It ispreferable to store hoses on special shelves or on drysurfaces. Coiled hoses must be stored horizontally avoidingpiling. When this is not possible the height of the piles mustbe such to avoid permanent deformation of hoses storedunderneath. The inside diameter of the coil, during the storage, must besuch as not to compromise the performances of theproducts. In particular, this diameter must not have value lessthan those indicated by the manufacturer. It is advisable toavoid storing coiled hoses on poles or hooks. Furthermore itis advisable to store hoses to be delivered straight,horizontally, without bending.

2.9 Rodents and insectsHoses must be protected from rodents and insects. When sucha risk is probable adeguate precautions must be taken.

2.10 Marking or packaged itemsIt is advisable that hoses are always easy to identify even ifpacked.

2.11 Exit from storagePrior to delivery hoses must be checked for integrity and mustcorrespond to the required use. After long storage if couplingsare not clipped, swaged or built-in, it is necessary to checkthat locking collars are tight.

2.12 Return to storageHoses that have been used must be free from all substancesprior to storage. Particular attention must be paid whenchemical, explosive, inflammable, abrasive and corrosivesubstances have been conveyed. After cleaning, the hose mustbe checked for integrity.

3. NORMS AND METHOD OF USEAfter having chosen the type of hose, the users must keep inmind the following hose installation criteria:

3.1 Pre-assembly checksPrior to installation it is necessary to check carefully thecharacteristics of the hose so to verify that type, diameter andlength conform with the required specifications. Moreover avisual check must be effected to make sure that there are noobstructions, cuts, damaged cover or any other evidentimperfections.

3.2 HandlingHoses must be moved with care avoiding knocks, draggingover abrasive surfaces and compression. Hoses must not bepulled violently when twisted or knotted. Heavy hoses,normally delivered in a straight line, must be laid on specialsupports for transport. Should wood supports be used thesemust not be treated with creosote or painted with substanceswhich could damage the rubber.

3.3 Pressione e prove di tenutaNon si deve mai superare la pressione di servizio indicata dalcostruttore. 3.5 Prodotti trasportatiI tubi devono essere utilizzati per trasportare esclusivamentequei prodotti per i quali sono stati progettati. In caso di dubbioè sempre consigliabile rivolgersi al produttore. Per quanto è possibile, i tubi devono essere vuotati al termine del periodo dilavoro. In caso di impieghi pericolosi è necessario adottare tuttele misure e le precauzioni possibili per limitare le conseguenze dieventuali scoppi accidentali di un tubo.

3.6 AmbienteI tubi devono essere utilizzati nelle condizioni ambientali per lequali sono stati progettati.

3.7 Raggi di curvaturaInstallazioni al di sotto del raggio minimo di curvatura riducono sensibilmente la vita del tubo. Inoltre è necessarioevitare le curvature in uscita dai raccordi.

3.8 TorsioneSalvo indicazioni diverse, i tubi non sono progettati per lavorare in torsione.

3.9 TrazioneGli sforzi di trazione devono essere compresi nei limiti specificati dal produttore. Nel caso di dubbi sulla idoneità deitubi a lavorare in trazione, è bene consultare preventivamenteil produttore.

3.10 VibrazioniLe vibrazioni sottopongono i tubi a sollecitazioni a fatica eriscaldamento che si concentrano in prossimità dei raccordi epossono provocare scoppi prematuri. E' sempre opportunoaccertarsi che i prodotti siano stati progettati per resistere adette sollecitazioni.

3.11 PiegatureAlcuni utenti usano interrompere il passaggio del liquido piegando completamente il tubo. Tale sistema, sconsigliatodai produttori, sottopone l'armatura ad uno sforzo particolareche può provocare scoppi prematuri.

3.12 Scelta e montaggio dei raccordiOltre a rispettare le raccomandazioni fornite dai produttori, èsempre necessario verificare la compatibilità tra la pressioned'uso dei raccordi e quella del tubo. I raccordi con diametrisovradimensionati creano sollecitazioni anomale che posso-no provocare la rottura dell'armatura del tubo, mentre quelli sottodimensionati presentano difficoltà di serraggio e rischidi fughe. Inoltre i raccordi non devono avere spigoli vivi oparti taglienti che possono danneggiare il tubo. Per infilare il raccordo si possono utilizzare acqua o acqua esapone evitando di impiegare prodotti contenenti olii o solventi, salvo per i tipi di tubi destinati a trasportarli. E' proibito ammorbidire il tubo percuotendolo con un martelloo oggetti similari. Per quanto riguarda i fissaggi e i collariesterni è necessario evitare:

3.3 Pressure and seal testThe working pressure generally indicated by manufacturermust be respected. After the installation, when air bubbleshave been eliminated, increase the pressure to test theassembly and check possible leaks. This test must be carriedout in a place free from danger.

3.4 TemperatureHoses must always be used within the temperature limitsgenerally indicated. In case of doubt apply to manufacturers.

3.5 Conveyed productsHoses must be used exclusively to convey substances forwhich they were manufactured. In case of doubt it is alwaysadvisable to contact the manufacturer. As far as possible,hoses must be empty after usage. Where any risks areinvolved, special precautions must be taken to avoid bursts.

3.6 EnvironmentHoses must be used exclusively in the environment conditionsfor which they were manufactured.

3.7 Bending radiusInstallation underneath the minimum bending radius reducesthe life of the hose considerably. Morover it is necessary toavoid bending at fitting ends.

3.8 TorsionHoses are not manufactured to work in torsion, except forspecific purposes.

3.9 TractionTraction must be within limits specified by the manufacturer. In case of doubts, it is advisable to get in touch withmanufacturers.

3.10 VibrationVibrations put hoses under stress from heat and fatigue aboveall near couplings and premature bursting may occur. It istherefore advisable to check that hoses have been manufacturedto resist to such a stress.

3.11 KinkingSome users tend to obstruct the flow of liquids by kinking thehose. This system is not advised by manufacturers becausethe reinforcement is subjected to eccessive stress and couldlead to bursting.

3.12 Choice and application of couplingsBesides meeting manufacturers instructions, it is alwaysnecessary to check the compatibility between the workingpressure of couplings and hoses. Couplings with too largediameters cause abnormal stress which can split the hosereinforcement, whilst too small dimensions can createclumping difficulties and leakage.Furthermore couplings must be free from sharp and cuttingedges which could damage the hose. Water or soap andwater can be used to fit couplings.To put on fittings, use water or water with soap but do notuse products containing oils or solvents except for thetype of hoses suitable to carry them. Softening hoses withmallet or similar tools is forbidden. As far as the fixing andthe external collars are concerned take care to avoid:

3.13 Proprietà elettricheLe proprietà elettriche dei tubi, raccordati e non, sono misuratefra i raccordi e/o alle estremità del tubo e sono espresse in ohm.I tubi sono divisi in tre gradi:

a) Continui (grado M) contengono cordicelle o eliche metalliche.resistenza < di 102 ohm.

b) Conduttivi o antistatici (grado W) contengono strati di gommao plastica conduttivi. Resistenza > di 103 ohm < di 106 ohm.

c) Isolanti o discontinui contengono strati di gomma o plasticaisolanti. Resistenza >106 ohm.

3.14 Installazioni permanentiI tubi installati tra due punti fissi devono essere sostenuti da unadeguato dispositivo di fissaggio che non ostacoli i movimenti normali del tubo sotto pressione (variazione di lunghezza, del diametro esterno, torsione, ecc.).

3.15 Installazioni mobiliQuando i tubi devono collegare pezzi o organi in movimento, ènecessario verificare che la lunghezza del tubo sia adeguata e che i movimenti non sottopongano il tubo ad urti, sfregamentie non provochino sollecitazioni anomale di curvatura, piegatura,trazione o torsione.

3.16 IdentificazioneQuando sono neccessarie marcature ulteriori, si possono utiliz-zare delle fascette di nastro autoadesivo. Quando è impossibileevitare l'utilizzo di vernici, consultare preventivamente il produt-tore del tubo per verificarne la compatibilità della copertura.

4. MANUTENZIONEAnche se la scelta, lo stoccaggio e l'installazione sono state eseguite correttamente, è necessario effettuare un regolare e corretto programma di manutenzione, la cui frequenza dovràessere determinata in funzione della severità dell'applicazione.Durante i controlli periodici è necessario prestare un'attenzio-ne particolare allo stato dei raccordi e alla comparsa delle seguenti anomalie, rilevabili a vista, che denotano uno stato didegrado del tubo:

- Screpolature, fenditure, abrasioni, scollamenti, strappi dellacopertura con zone dell'armatura lese o scoperte;- Deformazioni, bolle, rigonfiamenti localizzati sotto pressione;- Zone appiccicose o molli;- Perdite.

4.1 RiparazioniSi sconsigliano riparazioni sui tubi. Tuttavia, quando si ha undeterioramento di una estremità su un tubo sezionabile, e se lalunghezza rimasta integra lo consente, si può procedereall'eliminazione della zona difettosa.

4.2 PuliziaIn assenza di istruzioni da parte del produttore, la pulizia, senecessaria, deve essere effettuata con acqua e sapone evitandol'impiego di solventi (per esempio benzina, olii paraffinici, ecc.) osoluzioni detergenti. Non si devono impiegare strumenti abrasivi,appuntiti o taglienti (ad esempio spazzole metalliche).

3.13 Electrical propertiesElectrical properties of hoses and assemblies, are measuredbetween couplings and/or the end of the hose and areexpressed in ohm. The hoses are divided into three grades:

a) Continuous (M grade) they contain little ropes or wire helics.resistance < of 102 ohm.

b) Conductive or antistatic (W grade) they contain rubber orplastic conductive sheets. Resistance > 103 ohm < 106 ohm.

c) Insulating or discontinuous they contain rubber or plasticinsulating sheets. Resistance > 106 ohm.

3.14 Installation between two pointsThe hoses must be supported in a suitable way, so that thenormal movement of the hose under pressure (variations inlength, diameter, twisting, etc.) is allowed.

3.15 Mobile piecesWhen hoses link mobile pieces, it is necessary to check thatthe length of the hose is suitable and that the movement doesnot hurt or drag the hose and that abnormal stress, bending,traction or torsion do not occur.

3.16 IdentificationIf further markings are necessary, self-adhesive tapes may be used. When the use of paint is unavoidable, check thecompatibility of the cover with the manufacturer.

4. MAINTENANCEEven though choice, storage and installation have beencorrectly carried out, regular maintenance is necessary, thefrequency of which is determined according to the useinvolved. During regular checks, special attention must be paid tocouplings and to the appearance of the following irregularitieswhich show deterioration of the hose:

- Cracks, cuts, abrasions, unsticking, tears in cover revealingreinforcement;- Deformity, bubbles, local swalling under pressure;- Sticky or soft areas;- Leaks.

4.1 RepairsHose repairs are not advisable. However when deteriorationoccur at one end, and if the full length allows for such, the wornsection may be eliminated.

4.2 CleaningIf cleaning instructions are not supplied by the manufacturerclean, if necessary, with soap and water avoiding the use ofsolvents (petrol, paraffin, etc.) or detergents. Never useabrasive, sharp-pointed or cutting tools (wire brushes).

Any and all terms in the Customerpurchase orders, acknowledgments, confirmations or anyother business forms which vary, conflict with or add to orare in any way inconsistent with the terms provided beloware rejected by Cidat S.p.A. and shall not be part of anyagreement between the Customer and Cidat S.p.A., unlessspecifically agreed to in a writing document signed by CidatS.p.A. The terms provided below shall prevail over anyvarying, additional or conflicting terms in the Buyer’s forms.4.Prices. Unless otherwise stated, the selling prices for thegoods as well as offers shall be considered net amounts inEuro, VAT not inclueded. Cidat S.p.A. reserves the right tochange prices, discounts and payment conditions in forcewhen the contract is confirmed. However any modificationswill become effective after notification of these has beenissued and they will apply only to the part of the supply thathas not been completed. In such a case the Customer maycancel the contract for the part not completed within 1 (one)week of the issue of the notification.5.Delivery. Shipments shall be EXW according to theIncoterms 2000 (International Commercial Terms), unlessdifferently agreed upon in the contract. Shipping dates are tobe considered approximate and are based on prompt receiptby Cidat S.p.A. of all the necessary information from theCustomer. Cidat S.p.A. shall not be liable for any loss orexpense incurred by the Customer in the event that CidatS.p.A. fails to meet the specified delivery schedule(s) due tounforeseen circumstances. Claims for damage or loss of thegoods in transit must be filled by the Customer against theCarrier and they must be notified within 24 hours from thegoods receipt. In addition to this, claims should be reportedthrough an appropriate reserve written in the delivery note.6.Returns. Cidat S.p.A. will accept returns only upon prioragreements and at conditions to be defined between theparties. Agreements on returns must therefore be acceptedbefore the dispatch, by fax and/or by e-mail, explaining indetails the reasons of these returns and mentioning theoriginal number of the delivery note and/or of the invoice.Products must be returned undamaged and complete in alltheir original parts. Cidat S.p.A. reserves the right to decidethe amount to be reimbursed, after the materials check.7.Tolerances. Due to Cidat S.p.A. requirements, tolerancesof +/-10% of the confirmed quantities are always allowedand accepted.8.Payment. Payment shall be made within the agreed period,in the agreed currency at the address shown on the invoice.

CONDIZIONI GENERALI DI VENDITASALE STANDARD TERMS AND CONDITION

In caso di ritardato pagamento, al Cliente verrà addebitatoun interesse pari al tasso Euroribor maggiorato di 2 puntipercentuali (2%) sul saldo non pagato. Gli interessi decorro-no automaticamente dal giorno successivo della scadenzadel termine per il pagamento. Per nessuna ragione e pernessun titolo il Cliente potrà sospendere e/o differire il versa-mento del corrispettivo convenuto, neppure in caso di con-troversia e/o reclami ed eventuali vizi e/o difetti della mercefornita. Cidat S.p.A. si riserva il diritto di sospendere tutte leulteriori forniture, recuperare tutti i materiali non pagati (cherestano di proprietà della stessa fino al pagamento dell’inte-ro importo della fattura) e di richiedere il pagamento imme-diato di tutti i crediti in essere. Il Cliente inadempiente dovràsostenere l'onere di tutte le spese sostenute per il recuperodel credito.9.Modifica e cancellazione del contratto. Il Cliente nonpuò annullare o modificare un ordine senza preventiva auto-rizzazione scritta di Cidat S.p.A. e si assume la responsabi-lità per tutti i costi sostenuti a causa di tale modifica e/o can-cellazione. Cidat S.p.A. si riserva il diritto di sospendere il con-tratto se il Cliente è considerato finanziariamente rischioso.10.Forza Maggiore. Cidat S.p.A. non è responsabile perqualsiasi ritardo o mancata esecuzione del contratto percause di forza maggiore. Queste clausole (elencate solo atitolo esemplificativo e non esaustivo) includono, senza limi-tazione, incendi, inondazioni, terremoti, incidenti, atti delnemico pubblico, guerra, atti di terrorismo, sommosse, epi-demie, quarantene, controversie di lavoro, carenze di mano-dopera, interruzione del pubblico trasporto, impossibilità diottenere materie prime o macchinari, aumenti straordinarinei prezzi delle materie prime, embarghi, atti di governo.Cause di forza maggiore analoghe possono consentire alCliente il mancato ritiro della merce ordinata, comunicandodetto rischio con ragionevole preavviso a Cidat S.p.A.Tuttavia, il Cliente non è giustificato in caso di (a) merci spe-dite prima del ricevimento di tale comunicazione, oppure (b)quando le merci sono già in transito prima che si verifichi unacausa di forza maggiore.11.Garanzia. La garanzia per la durata di un anno si intendesubordinata al riscontrato difetto di fabbricazione del pro-dotto sulla base dell’insindacabile giudizio di Cidat S.p.A.,che a sua scelta potrà rimediare mediante la sostituzionedella merce difettosa, da effettuarsi nel più breve tempo pos-sibile, o mediante l’emissione di una nota di credito per l'im-porto della merce difettosa. Nessun altro costo aggiuntivopotrà essere a carico di Cidat S.p.A. Inoltre Cidat S.p.A. nonsarà in alcun caso responsabile per danni diretti, indiretti,incidentali o consequenziali. Non ci sono altre garanzie espli-cite o implicite al di là di quelle ivi menzionate. È al tempostesso esclusa qualsiasi forma di garanzia per vizi e/o difet-ti derivanti da componenti esterni (agenti chimici, fisici, elet-tromeccanici, atmosferici), ovvero da riparazioni, interventie/o sostituzioni eseguiti sul prodotto direttamente dal Clientee/o da terzi da questo incaricato senza l’autorizzazione diCidat S.p.A., da insufficiente manutenzione e da mancataosservanza delle istruzioni per lo stoccaggio, l’uso e lamanutenzione dei prodotti (disponibili per la consultazionesui cataloghi o nel sito www.cidat.it).12.Controversie. Le presenti condizioni generali di venditasono regolate dalla legge italiana. Per qualsiasi controversiagiudiziaria si elegge competente il Tribunale di Busto Arsizio. Le parti dichiarano di aver interamente letto ed approvato ipatti e le condizioni generali di vendita ai sensi e per gli effet-ti degli Art. 1341 e 1342 del C.C. ed in particolare quelleriportate ai punti 1), 2), 3), 4), 5), 6), 7), 8), 9), 10) Forza mag-giore, 11) Garanzia, 12) Foro per le controversie.

In the event of late payment, the Customer will incur aninterest charge of 2% above the Euroribor rate on the unpaidbalance. Interests shall occur automatically from thefollowing day of the overdue payment. For any reason, theCustomer may suspend and/or defer the payment, even inthe event of disputes and/or complaints and in the event ofany faults and/or defects of the goods supplied. Moreover,Cidat S.p.A. reserves the right to suspend all furtherdeliveries, to recover all unpaid materials (which remainproperty of Cidat S.p.A. until the payment receipt of theinvoice full amount) and to require an immediate paymenton all other claims. In addition, the defaulting Customer shallbear any and all dunning charges, collection charges,investigation and information charges incurred in connectionwith the collection of the outstanding balance.9.Contract modification and cancellation. The Customermay not cancel or modify any order without Cidat S.p.A. priorwritten consent and accepts responsibility for all the applicablecosts incurred by Cidat S.p.A. due to such cancellation ormodification. Cidat S.p.A. may suspend the contract if theCustomer is considered financially risky and unsafe.10.Force Majeure. Cidat S.p.A. shall not be responsible forany delay or failure to perform due to causes beyond itsreasonable control. These clauses (to be considered asexamples and not as exhaustive) shall include, withoutlimitation, fire, flood, earthquake, accident, acts of the publicenemy, war, acts of terrorism, riot, epidemic, quarantinerestrictions, labor dispute, labor shortages, interruption oftransportation, inability to secure raw materials or machinery,extraordinary increases in such raw materials prices,rationing or embargoes, acts of God, acts of Government.Similar causes shall excuse the Customer for failure to takegoods ordered, providing reasonable notice to Cidat S.p.A.of such contingency. However, the Customer shall not beexcused from the terms for (a) any goods shipped prior toreceipt of such notice; or (b) goods already in transit whenthe force majeure cause occurs.11.Warranty and claims. The warranty for a period equal to1 (one) year from the date of shipping from Cidat S.p.A. canbe executed once the goods delivered proved to bedefective or faulty at Cidat S.p.A. option by means ofreplacing the defective goods (when these are returned toCidat S.p.A. premises) with new goods of good quality thathave to be delivered as quickly as possible or of issuing thecredit note for the amount of the defective goods. No otherrelated extra costs will be borne by Cidat S.p.A. MoreoverCidat S.p.A. shall in no event be liable for direct, indirect,incidental or consequential damages. There are no otherwarranties either expressed or implied beyond those setherein. However this warranty does not cover any faultscaused by normal deterioration, accelerated deteriorationcaused by special physical, chemical or electromechanicalconditions, insufficient maintenance or incorrect repair,failure to follow the storage, user and operating instructions(available on Cidat S.p.A. catalogues or on the web sitewww.cidat.it) or any other faults arising as a result ofcircumstances over which Cidat S.p.A. has no control.12.Interpretation. The validity, performance of these standardterms and condition of sales shall be governed by the ItalianLaw. For any legal dispute that may arise the final adjudicatorof any such dispute is nominated to be the Tribunal of BustoArsizio and this shall apply even in cases where the salescontract may stipulate the residence of the client.The parties declare to have read and accepted the standardterms and condition of sales under and for the purposes ofArt. 1341 and Art. 1342 of the Italian Civil Code, especiallyfor clauses 1), 2), 3), 4), 5), 6), 7), 8), 9), 10) Force Majeure, 11)Warranty and claims, 12) Competent Court.
