Arguments heard on the point of sentence.It is submitted by the convict that he belongs to a poor family and a lenient

view may be taken while sentencing him. Considering the fact that convict is 55 years old, poor and is sole bread earner,

a lenient view is taken in his favour. Accordingly, convict is sentenced to imprisonment for period already undergone in J/C from 18.10.2013 to 19.10.2013 for offence U/s 174 A IPC.

In the present case, complainant Dhanwanti Devi has expired. His DVR is on record. Other witnesses are formal in nature no purpose will be served by examining them. Hence PE stands closed at the request of the Ld. APP. SA dispensed with as no incriminating evidence has come on record against the accused.

Arguments heard. Vide separate judgment on even date, accused Bhagwati Prasad is acquitted for
