When you go to the polls this year youre going to need ID A voter registration card does the trick but if you dont have that what do you need A law was passed limiting the kinds of identification you can use to vote but you dont have to worry about that yet Mr Smarty Pants will give you the low-down

Occasional contributor and respected defense attorney Kyle Hoelsher gives us an important lesson about freedom That we have some One outlined in the fourth amendment is the right to not be searched by the government without probable cause or a warrant

But I have nothing to hide

Good Neither do I but I consider it an insult to all who have given their lives defending the constitution of the United States to simply abandon my rights because Im nervous about saying No to someone in uniform And itrsquos not as easy as it sounds Youre saying ldquoNOrdquo to an authority figure that you have been trained from childhood to respect and trust Your heart races you feel afraid that yoursquore making yourself look guilty It isnrsquot easy but its important that you do it even if yoursquore certain you have nothing to hide

We talk a lot in this country about freedom Especially around elections The signers of the declaration of independence lived under a government that had the right to search wherever they liked with or without cause They signed that document knowing the odds were very much against them and the most likely outcome was theyd all be executed for treason That was real courage If you honor those great men at all it is your duty to demand your rights are respected even if it makes you feel a little uncomfortable

Officers of the law deserve our respect and admiration These are people who have decided to risk their lives every day in the service of the public

But no agent of the government has the right to demand for your blind obedience Freedom isnt about choosing coke over pepsi If you have a right and dont use it you just gave away your inheritance and maybe

your future too

It is unfortunate but human nature being what it is the rights guaranteed by the constitution have been in constant danger since before the ink dried So listen to Kyle

Dear Mr Smarty Pants

I am proud of the fact that I have not missed voting in a Presidential election since I turned 18 longer ago that I want to admit But I keep hearing that the voting laws have changed and some types of identification that used to work wonrsquot work anymore

I also hear people complaining about the new rules but I donrsquot understand what is wrong with having to show an identification when you vote It doesnrsquot seem like such a big deal to me I just want to make sure that I can vote when I go to the polls in November

Nancy you are leading Mr Smarty Pants into a bit of a political minefield here Our governor when he wasnrsquot busy running for President and forgetting which part of the federal government he was going to lop off with his third finger decided that passing a voter identification bill was so important he made it an emergency item and moved it way up to the top of the legislative calendar above solving that pesky deficit problem seceding from the United States and Mr Smarty Pantsrsquo personal favorite casino gambling

Texas came by its reputation for rigging elections honestly after the 1948 US Senate election in which Lyndon Johnson kicked the stuffing out of Governor Coke Stevenson by 200 votes statewide It has been alleged but never proven in a court of law that about that same number of voters cast ballots from beyond the grave in Box 13 down in Jim Wells County ndash in the order in which they were interred in the local cemetery and all with identical handwriting ndashdang What a coincidence

His hair would catch fire I know for a fact that voter fraud is real that it must be

stopped and that voter id is one way to prevent cheating at the ballot box and ensure integrity in the electoral system Texas Attorney General Greg Abbot told the Houston Chronicle

The best information at the time showed only 10 voter impersonation cases out of 2068 alleged election fraud cases since 2000 ndash or one out of every 15 million prospective voters Abbott told the Houston Chronicle that his office has prosecuted only about 50 cases of voter fraud in recent years Then the San Antonio Express-News reported that fewer than five ldquoillegal votingrdquo complaints involving voter impersonations were filed with the Texas Attorney Generalrsquos Office from the 2008 and 2010 general elections in which more than 13 million voters participated

Fewer than five A number between zero and four is it zero Even if it were four by Texas standards that ainrsquot even a little old popcorn fart of a voter fraud problem to paraphrase LBJ the aforementioned alleged ballot stuffer Mr Abbottrsquos assertion that his hair would catch fire if he didnrsquot do something quick to ldquoensure integrity in the electoral systemrdquo didnrsquot pass the stink test This was a solution looking for a problem So what was really going on

Mr Abbot is a Republican and most of those accused of voter fraud have been Democrats (insert punch line here) The fact is that a review of court records and interviews with prosecutors and defense lawyers showed that most of those charged by the Justice Department appear to have mistakenly filled out registration forms or misunderstood

eligibility rules the Democrats werenrsquot trying to cheat - they were just read the form wrong (Insert second punch line here)

In their verve to stop this epidemic of microscopic proportions the folks in Austin swatted a gnat with a sledgehammer and cranked out Senate Bill 14 which attempted to change the types of permissible identification for voting We provided a copy of the bill for your enjoyment

The B Bus to the DMVThis bill was signed into law in May of last year You

will notice that among other things while this new law would allow you to use your concealed handgun license to vote it would not allow you to use your college or university identification issued by a state owned institution If doesnrsquot specify whether you can carry your gun into a polling place but if you do you wonrsquot see any college kids who got there by showing the same ID they used to get hot rolls butter and milk

at the university mess Wersquoll leave you to figure out which partyrsquos voters this might effect the most

Senate Bill 14 pretty much says that unless you are a licensed driver a member of the military or you have a passport then you have to catch the B Bus down to the DMV for an odiferous day of line-standing in order to get yourself an id - and pay whatever fee may be required This is an ID that you are probably never going to use except to vote or you would have already had one

To the cynical and jaundiced eye it could be perceived that Senate Bill 14 was less a way of ldquoensuring integrity in the electoral systemrdquo than it was of weeding out voters who didnrsquot want to ride the B Bus to the DMV The US Department of Justice agreed You see Nancy Texas is one of nine states that must get any changes to their election laws cleared by the DOJ under the Voting Rights Act due to our rich history of discrimination

Assistant US Attorney General Thomas E Perez wrote in his letter to the Director of Elections ldquoAccording to the statersquos own data a Hispanic registered voter is at least 465 percent and potentially 1200 percent more likely than a non-Hispanic registered voter to lack this (new) identificationrdquo

No peckerwoods allowedThere were other more cynical parts of Senate Bill 14

involving ldquothird party registrationrdquo that would make it much more difficult to conduct voter registration drives in Texas which as of this writing have been struck down by the courts After all if we let people go out and register just anyone to vote well heck they might vote some peckerwood into office that we donrsquot like

So unless the courts sign off on Senate Bill 14 the same identification that got you into the last election will get you into this one Any government issued photo id ndash including a student id with a photo will work You can also use a utility bill or any other government issued paper with your name on it (but without a photo ndash like a birth certificate) but those may require you to sign an affidavit and your vote wonrsquot be counted until your identity is checked after Election Day

SECTION 14 Section 630101 Election Code is amended to read as follows

Sec 630101 DOCUMENTATION OF PROOF OF IDENTIFICATION The following documentation is an acceptable form [as proof] of photo identification under this chapter

(1) a driverrsquos license election identification certificate or personal identification card issued to the person by the Department of Public Safety that has not [or a similar document issued to the person by an agency of another state regardless of whether the license or card has] expired or that expired no earlier than 60 days before the date of presentation

(2) a United States military identification card that contains the personrsquos photograph that has not expired or that expired no earlier than 60 days before the date of presentation [form of identification containing the personrsquos photograph that establishes the personrsquos identity]

(3) a [birth certificate or other document confirming birth that is admissible in a court of law and establishes the personrsquos identity

(4) United States citizenship certificate [papers] issued to the person that contains the personrsquos photograph

(4) [(5)] a United States passport issued to the person that has not expired or that expired no earlier than 60 days before the date of presentation or

(5) a license to carry a concealed handgun issued to the person by the Department of Public Safety that has not expired or that expired no earlier than 60 days before the date of presentation

The words with the lines through them are the parts that used to be valid (and still are) but under the new law would no longer be accepted New language that was added to the law is in red

while this new law would allow you to use a concealed handgun license to vote it would

not allow you to use your college or university identification issued by a state owned institution

a Hispanic registered voter is at least 465 percent and

potentially 1200 percent more likely than a non-Hispanic

registered voter to lack this (new) identification

The Stars Scholarship Fund is a program initiated by L ampF Distributors LLC and Anheuser- Busch to give students in South Texas an opportunity to pursue a higher education in order to develop themselves as community leaders who will enrich the community Since 2002 over $17 million has been collected through the Stars fundraising events awarding over 8000 students scholarships ranging from $350 to $3500

The Stars Scholarship is unique in that all levels of college students are eligible to apply regardless of what school they are attending The application form is available at the beginning of each year for students to complete and submit Of the over 4000

applications received usually 1000 to 1200 scholarships will be awarded

The City of Corpus Christirsquos Solid Waste Operations Departmentrsquos 2012 education campaign Keep it

Clean Corpus Christi began in April this year with the launch of the My Waste app for Android and iPhone users The app is free and available for download on itunes and Google Marketplace The My Waste app provides helpful calendars that track garbage recycling and brush and bulky collections Reminders can be set up for the night before so that you never miss a scheduled pick up date The Solid Waste Operations Team would like to remind residents to make sure that your trash and recycling carts are set at least 3 feet apart so that truck arms can properly lsquohugrsquo and empty your carts The My Waste app offers helpful tips on everything from garage sales to how and when to properly set out brush and

bulky items

You Canrsquot Mulch a CouchWhen setting out brush and

bulky items for pickup always keep brush separate from bulky items Brush is collected for the Cityrsquos mulch program Residents can pick up mulch for free at the JC Elliott Transfer Station located at 7001 Ayers Also be sure to keep brush and bulky items away from and off of mailboxes utility lines and utility meters Even a minor accident can take a driver off a route for up to four days With limited crews and resources the Cityrsquos Brush amp Bulky collection drivers need your help to remain on schedule and help keep our fine City clean

Cityrsquos recycling stream is residuals- the leftover liquid inside recycled bottles Always empty liquids from bottles prior to disposal this cuts back on insects and rodents

at our recyclery keeps everything cleaner allows for lighter trucks on your residential streets and maintains a higher integrity rate at the recyclery Of course we are in a time of drought so use as little water as you can when cleaning recyclables We use the leftover standing dishwater after our dishes are done and that works well for us

Set for September 22The 26th Texas General Land Office Adopt-A-Beach Fall Cleanup will be held

Saturday September 22 at 29 sites along the Texas coast

Adopt-A-Beach volunteers can register at most check-in locations between 830 am and 9 am on September 22 However volunteers must pre-register for the St Jo Island location and the John M OrsquoQuinn Estuarial CorridorVirginia Point Peninsula Preserve in advance as reservations are required due to limited access

Online registration is currently available at texasadoptabeachorg Volunteers can register online until September 19th If you canrsquot make it to the beach but still want to support the volunteer effort you can make a tax-deductible donation online at texasadoptabeachorg Sponsorship levels range from $25 to $25000 You can also become a fan of the Texas General Land Office Adopt-A-Beach Program on Facebook

Volunteers should wear closed-toe shoes a hat and sunscreen Volunteers will be given data cards gloves pencils and trash bags Most sites along the coast conclude the dayrsquos cleanup with cold drinks hot food and lots of fun

The Texas Adopt-A-Beach Program originated in the fall of 1986 when 2800 volunteers picked up 124 tons of trash Since then more than 430000 volunteers have removed 8300 tons of trash from Texas beaches The Texas Adopt-A-Beach Program is an all-volunteer effort to remove trash from Texas beaches and waterways and to increase public awareness of the problems of marine debris and beach litter Twice each year volunteers pick up trash at sites along the coast

The data collected from the beach cleanups played an integral part in the passage of MARPOL Annex V an international treaty that prohibits the dumping of plastics in the worldrsquos oceans In July 1991 the International Maritime Organization designated the Gulf of Mexico and the Wider Caribbean as a ldquospecial areardquo where the dumping of trash with the exception of finely ground food scraps is prohibited

The success of the Adopt-A-Beach Program is made possible not only by the generous efforts of thousands of volunteers but through the generous donations of community leaders and sponsors statewide

Our founders thought the fourth amendment was so important that it was listed in our constitution

before the right to a jury right to counsel and the right to be free of cruel and unusual punishment Unfortunately our leaders today are not interested in these words In fact our rights under the Fourth Amendment have diminished to the point that when the government wants to search the peoplesrsquo rights are an afterthought Citizens are the last line of defense that remains The problem is that most people do not know how to protect those precious freedoms that our forefathers died for Let me illustrate




In this situation there would really be no harm in abandoning my rights He would have looked through the backseat or wherever found empty candy wrappers a Whataburger bag from a few weeks ago and an air pump So letrsquos change up a few facts What if I had left an empty beer can in my backseat by mistake What if a friend had recently been a passenger in my car and left behind a legally prescribed pill bottle What if I had recently gone hunting and still had a revolver in the glove box You see how quickly this officerrsquos trick has now granted him the right to arrest me put me in jail impound my car and label me a criminal

I want to tell that Police Officer about the Fourth Amendment I want to tell him that our founders died so that I could say no to his questions I want to tell him how offended I am that he automatically assumes that I am a criminal

These are things I want to say but being a defense lawyer by trade I know that no amount of explaining of human and civil rights would change his mind So I responded how we should all respond to that question ldquoBecause you donrsquot have the right to search Am I free to gordquo With that he handed me the ticket and walked off

He didnrsquot do any follow up questions or investigation because with those simple

words I let him know that I know my rights and I wonrsquot be tricked I deal with people who are on the wrong side of this scenario every day in my office Irsquom often amazed when people abandon their rights but I shouldnrsquot be Police are very good at convincing regular people into giving up their constitutional rights Most police even see this as a good thing The more searches the more illegal activities will be discovered and more criminals arrested If deception and intimidation are required to get more searches then so be it

So this leaves you the average citizen as the last protector of your God given constitutional rights To make it harder the government federal state or local has no interest in upholding these rights Typically they are the ones who take cases to the Supreme Court in an effort to remove your rights These rights are not meaningfully taught to young people at school church or at home Most people who give up their rights donrsquot even realize they are doing so I was asked to write this article so that there can be some defense and education regarding our tattered Fourth Amendment

Just Say NoIf you consent to a search the Fourth Amendment

no longer protects you This consent is valid even if gained through deception This is why a police officer will often tell you that they already have the right to search so you might as well agree to it They might tell you will not be arrested if you consent or that things will go easier on you Nothing could be further from the truth The police have no power to negotiate leniency their job is to arrest people suspected of breaking the law

When deception doesnrsquot work intimidation tactics can also create valid consent This is why an officer might threaten to bring K9 units to look for drugs if you donrsquot consent to a search They may pull you out of your car or call two other cars as backup

In the United States if the police are asking for your permission itrsquos because they donrsquot have the right to do it You will always know if they have the right to look through your stuff because they will already be looking through your stuff

Experienced police officers are very good at convincing you to consent to a search You must be the strong one Stand your ground Refusing a search is not reason for a search Police know this If they get a hint that you know your rights they are more likely to move on Just remember to politely say to the officer ldquoYou donrsquot have the right to search am I free to gordquo

The right of the people to be secure in their persons houses papers and effects against unreasonable searches and seizures shall not be violated and no Warrants shall

issue but upon probable cause supported by Oath or affirmation and particularly describing the place to be

searched and the persons or things to be seized

No I Do Not Consent to a Search

I responded how we should all respond to that question ldquoBecause you donrsquot have the

right Am I free to gordquo

You Have the Right to Remain Silent - So Shut Up

Keep your mouth shut The more you talk in any police encounter the more reasons you give them to search or arrest you The police did not stop you to chat they stopped you because they think you are breaking a law Every question they ask is designed to build up a case for a search or arrest If they begin asking more questions than are required for the stop respond with ldquoI donrsquot feel comfortable answering these questions am I free to go officerrdquo Be ready the next question will insinuate that you have something to hide and that you should be searched remember lesson one

No I Would Prefer We Talk OutsideNever invite a police officer into your home This

goes along with the consent issue If you let them in anything they see could be reason to search and arrest you If an officer comes to your home there is a simple way to protect your privacy and constitutional rights Talk to the police on the porch and close the door behind you Simple as that The officer will always ask ldquoMay I come inrdquo The answer to that is ldquonordquo No need to be rude but he is not a guest He is a stranger who came to your home unannounced with unknown motives That is someone you talk to on the porch

On that note I will also let you know that you have the absolute right to not even answer the door Once again if they have the right to enter your home they will break your door down then come in with overwhelming force using stun grenades pepper spray and firearms Most of the time an officer is there for a valid purpose like a noise complaint looking for witnesses or even trying to find the home of a delinquent child

By keeping the police out of your house you protect your right to be free of government intrusion into the most sacred of places in your life

If you follow these three basic lessons nearly all police encounters will go smoothly and your rights will not be trampled upon When an officer knows that you know your rights they are very likely to move on to an easier target unless therersquos a legitimate reason to question you

Always remember to the police any tool at their disposal is justified if they get an arrest They will not lose any sleep if they trample your rights but you might lose lots of sleep on the metal cots in the Nueces County Jail

A Chinese Contemporary art exhibit organized by Dr Lee Gray the Curator of Exhibitions at the Paul and Lulu Hilliard University Art Museum University of Louisiana at Lafayette The exhibition features a wide array of paintings sculpture photography and works on paper showing how Chinese artists have adapted Eastern ideas and art forms to create new styles of art using references to stylistic history in Western art In each of the two- and three-dimensional works exhibited there is an obvious merging of Eastern and Western visual languages While in some works the reference to Western culture seems adoring others appear as parodies to the West and its cultural symbols and values Each participating artist presents a multifaceted view of contemporary China as it struggles to define itself and find its place on the world stage

The very first profile I wrote for CC Magazine was of Robert Cockrell a true Corpus Christi photography gem if ever there was one Today Irsquom writing about James (Jim) Caldwell ndash a photographer of a very different genre but one who credits Robert with reawakening his love of photography and helping to set him on his current artistic path Jimrsquos work embraces the curves and planes of the human form It puts me in mind of the legendary Horst P Horst but grittier more lsquorealrsquo through his greater depth of contrast

ldquoWhen I first moved to Corpus Christi he (Cockrell) showed me a bookhellip it was a coffee table size book that was just shots of all the Hollywood famous actors and actresses from the 20s through the 50s or 60s and I was so taken with the style of that light and the intensity of the contrast that I said ldquoI want to do thatrdquo I credit Robert for showing me and being my mentor in order to get me on this road because he did teach me how to do this Beforehand I had really never worked with strobe lighting at all I had used electronic flashes in my newspaper dayshellip but I never understood how to value it So then I started studying books on how to place the lights and what sort of ratios you have between primary lights and secondary lights and headlights and so forth and so on

ldquoFor the first couple years I played it pretty straight and I followed the book on the values and the distances and so forth Then I started playing with moving things around and getting away from those standard equations of 2-to-1 values and so forth and I started eliminating backup lights or Irsquod just shoot with a headlight instead of using any other lights to create dramatic kinds of effects and I found that it was exciting to me because I was then getting into an area where I really knew that every time Irsquod develop a roll

of film I was going to have something new on my hands Those were exciting times when I was just starting to find out about different methods of using the lights

ldquoI found that the skin tones that I really loved with the old Hollywood pictures I could create just that type of dramatic effect now with getting outside of the box of the equations that were taught in books because I donrsquot think they really knew about equations back in the 20s and 30s I donrsquot think they were positioning those lights that way So you didnrsquot have a lot of balances you had big extreme shadows off noses and off ears and stuff and you found that it just created a different kind of a lookhellip accented heavily on shadows and light

ldquoThatrsquos why Irsquove always found that the nude figure is one of the best subjects for black and white film because the textures and the way

our body is built we have such beautiful shades that can come from the curves of our hands you know You hold your hand up to the light and you can see all of the shadows that you get on the inside of your palm for instance you know Where in nature do you go to find that Itrsquos right here you know itrsquos on our own bodies and thatrsquos why Irsquove enjoyed using the human body as one of my primary subjects It is just such a beautiful canvas to work with and everybodyrsquos got similar parts so itrsquos predictable on what yoursquore going to do the next shoot withrdquo

ldquoIt depends on what Irsquom showing some of my work I can show anywhere a lot of my work I canrsquot Itrsquos not that I canrsquot itrsquos just that some galleries have a limited concept of what they wish to put on their walls The Art Center used to be fairly open to ideas believe it or not but it has gotten more conservative in their opinions of what art is consequently yoursquove found that not just myself but most contemporary artists just donrsquot have anything to do with the Art Center anymore I used to be on the board of directors there for like six years so Irsquom real familiar with the ins and outs of the financial structure of the Art Center It would be nice to keep it open but I think theyrsquore going to be making some very tough decisionsrdquo

I asked Jim if he thought Dianna Bluntzer the new Director of the Art Center would be able to create a more open-minded approach to artwork shown at the Art Center as she discussed in my recent interview with her

ldquoI donrsquot know I do know that Corpus Christi is a little unusual in that you would think it would be a little more progressive being a third of a million people I find in areas like Austin and San Antonio and Irsquove shown work there that the cultures there seem to be much more accepting of contemporary art generally and it doesnrsquot affect people there the way it does here Some people here they just canrsquot accept looking at something different no matter what it is ndash Irsquom not just speaking of my work Irsquom speaking of all contemporary work that they donrsquot understand it so the first reaction is that there must be something wrong with it

Thatrsquos why Irsquove never converted over to digital because I really enjoy the darkroom experience

ldquoI find that itrsquos just a little more enjoyable to live in a culture where people share that It doesnrsquot mean that you have to agree with it but you would certainly like to have the opportunity to be able to agree or disagree I think the more that we spend time in trying to edit out our viewersrsquo preferences the fewer preferences theyrsquore ultimately going to find as time goes along Itrsquos not particularly the jobs of the gallery owners or these groups to pre-edit the work You should put it out and let the consumer be the ultimate judge of that Thatrsquos my belief and I think that pretty much works in a lot of things in society not just artwork Yeah I do find it more acceptable in other places I showed my work to people in the gallery business and some promoters and stuff (in New Orleans) and they donrsquot bat an eye at any of it They think itrsquos cool work because itrsquos a dying trade printing black and white film is becoming a lost art You can tell differences in film versus digital prints especially in black and white

ldquoI got a degree in journalism from the University of Colorado They offered a three-prong program ndash I graduated with an editorial background which included the photojournalism I ran the campus darkroom for two years for the journalism department and that was my specialty in journalism

ldquoThatrsquos why Irsquove never converted over to digital because I really enjoy the darkroom experience Working with the chemicals and being able to mix the chemicals to do different things with the picture and with timing Itrsquos more of a handcraft than it is running it off of a predictable software base

ldquoWhen it comes to my use of it in my present capacity I feel that I like to tell stories with my work I do quite a few works that are units of five or six pictures from beginning to end and I tell a story in those five or six pictures One that was pretty well known that was over at the Art Center was ldquoNighttime on the North Siderdquo That actually featured people that were all friends of mine from work In it we recreated a street scene on the north side of Corpus with kids having a good time at night things getting carried away people getting into arguments and arguments escalating into gunfire with the final picture being somebody lying dead with a bullet wound I enjoy doing those snippet things and I enjoy coming up with the ideas for them Irsquove never used a professional model yet I use friends or people that sign on to the ideas that I come up with and we just get together and do a shoot one afternoon or evening

ldquoThe Images de Bon Temps is a show on New Orleans Robert (Cockrell) and I both went to New Orleans to do all the shooting Itrsquos all been shot over there on the streets and inside houses Itrsquos a good really well balanced show because Robert is a master of environmental photography and he has probably one of the best eyes for composition of any photographer Irsquove ever seen He just has that I walk by subject matter all the time that he gets amazing pictures out of I donrsquot see it He sees something in something thatrsquos ordinary that Irsquove walked by that turns out to be a great work

ldquoOur work is not similar at all All the work that Irsquove got in the show are people of New Orleans and a few horses and mules but mostly itrsquos all people Robertrsquos work is of the environment of cemeteries and city scenes and pictures of the architecture of New Orleans You really get a feel in this show of how historic the city is and what a treasure the city is because therersquos just a few cities

left in the United States like this that are truly historically preserved and people still work in New Orleans is probably the best example of it itrsquos probably the oldest one thatrsquos still got some character left to it so it was a fun time shootinrsquo it

ldquoWersquoll start that show on the 15th (of September at 530pm) Itrsquoll open on that Saturday night and will be in our K Space Studio upstairs the same time as K Space Contemporaryrsquos Third Coast National Opening thatrsquos going to happen downstairs so it should be a good evening and a good turn outrdquo

We can not wait any longer for gay marriage to be recognized by the federal government and equal rights to be applied to all people Gay couples have been waiting too long to get married Loving long-term (same sex) partners have been waiting so long that they are dying with their dreams unrealized and are not receiving the same benefits (social security tax-fee estate transfer medical power of attorney immigration etc) that straight couples are

My partner and I have been together for over 9 years for better or for worse in sickness and in health and we are still fighting for the day that we can actually marry and get on with our lives

Our situation is complicated further because my partner is not a citizen of the United States Binational heterosexual couples can marry in this country and then the spouse has the right to apply for US Citizenship We do not have that same right

Until we have the same rights under federal law (not just State) my partner cannot apply to become a US Citizen Even though he is a college graduate and has formerly worked as a nurse and a teacher he currently has no choice but to work here (illegally) as a construction worker to support himself If we were a heterosexual couple he would already be on the path to citizenship He is unable to pursue his dreams or fulfill his potential He has been prevented from becoming a productive member of our society He cannot get a license to drive travel by plane get a decent job (legally) that makes use of his education and abilities or even return home to visit his family in Guatemala (because he would be unable to return to the US) He cannot claim or receive any of the spousal benefits provided by my health insurance or my retirement If I were to die he would not be entitled to claim my estate He is unable to travel to Arizona thanks to Sheriff Joe

and Jan Brewers ldquoShow us your papersrdquo policy This has forced us to become separated from each other over the last year as circumstances have required me to move to Arizona

All we want are the same rights and freedoms that are currently provided to straight couples Is this a free country or not Are all people created equally

and entitled to the same rights and freedoms or not It seems those things are pretty clearly defined already in the Declaration of Independence and the Constitution so I really dont understand why we are still having to fight for this The heart of this issue is about standing up for the principles of freedom and equality that this nation was founded on regardless of your personal beliefs sexual orientation or religion Failure to do so will mean

the destruction of our core values and the end of freedom and liberty I cant think of a more noble or more timely cause

President Obama (and now the Democratic Party) have FINALLY vowed to support marriage equality and are attempting to secure equal rights for all Americans under federal law regardless of sexual orientation Mitt Romney and the Republican Party under pressure from their supporters have vowed to do the exact opposite

Even if you do not agree with the rest of Obamas politics please understand the importance of this issue and why how you vote in November could substantially impact the life of myself and my partner for better or for worse
