SUBJECT GUIDELINES ON THE ENTRY / EXIT AND STORAGE OFDANGEROUSCARGOES

The general safety and security of the port facilities,cargoes and persons within the port premises andthe protection of the environment are the primary responsibilities of the Authority. In this regard, theentIy / exit and storage of dangerous cargoes in the ports shall be restricted, particularly prior tounloading to the designated dangerous cargo area by the CARGO HANDLING SERVICEPROVIDERS(CHSP).

For this pwpose, the following guidelines are hereby reiterated and prescribed for the compliance byall concerned:

1. The pertinent provisions of existing regulations, insofar as safe movements of dangerouscargoes are concerned, are hereby reiterated:

1.1 CPA Administrative Order No. 01-2000 entitled "CPA General Port Rules andRegulations (GPRR) " particularly Art. VI, Section 3 a & b on Declaration ofDangerous Cargoes; and Section 4 a & b on Defective Packaging.

1.2 Dockwork Safety and Health Standards, particularly Art, XVII, Sections 2-D and 4.

1.3 CPA MC No. 06-2006 entitled "Implementing Ru1es on Prevention of Spillage of Oil& Petroleum Products in the Port & Port Facilities" particularly Art. II Section 3 -Designated Area for Cargo Containing Oil or Petroleum Products.

2. The Port Operations personnel concerned, thru the authorized cargo handling serviceproviders, shall closely monitor and control the movement of any IMO classifieddangerous cargo in the port.

3. All inbound IMO classified dangerous cargo shall be properly and officially declared bythe Master ofthe vessel carrying it. If possible, an advance copy ofthe Dangerous CargoManifest shall be submitted a day before its arrival, to the Authority.

4. A copy of the Dangerous Cargo Manifest and other pertinent documents shall besubmitted to the Port Management Office concerned immediately upon arrival of avessel.

5. Dangerous cargoes that are not declared in the DCM shall be denied handling andunloading into the port;

6. Dangerous cargoes that are not properly packed, marked/labeled shall likewise be deniedhandling and unloading into the port;

7. All unloading dangerous cargoes shall only be stored at duly designated DangerousCargoes Storage Areas (DCSA);

8. All outbound IMO classified dangerous cargo shall be properly marked/labeled, packedand documented before being allowed entry into the port premises.

9. Dangerous cargoes not properly declared marked/labeled and packed shall be deniedentry into the port;( ANNEXES A,B,C,D,E,F)

10. No entry permit shall be issued by the Authority on any dangerous cargo if a shipper failsto present /submit a copy of a duly approved Philippine Coast Guard (PCG) SpecialPermit to Load/Shipout Dangerous Goods;

11. CHSPs shall not accept and handle any dangerous cargo that is not properly packed,marked/labeled and documented;

12. All outbound dangerous cargoes shall be stocked at the duly designated Dangerous CargoStorage Area (DC SA) prior to loading.

13. All Operations and Port Police personnel shall ensure the full compliance by theauthorized CHSP, the shipping companies/agents and the concerned cargoshippers/consigneesof these guidelines.

14. The Port Security, Safety and Environment Department shall institute additional andappropriate measures or guidelines, when deemed necessary, to ensure the compliance ofthis Circular.

15. CHSP and Shipping Companies/Agents found accepting/unloading/discharging/stackingdangerous goods without proper packaging/identification/marking/labeling/placardingand not placed at the designated dangerous cargo area shall be fine as indicated in CPAAdministrative Order No. 01-2000 (GPRR), without prejudice to filling of appropriatecriminal charges.

All orders, rules and other guidelines inconsistent with or contrary to this Circular are herebyrepealed/modified accordingly.

This Memorandum Circular shall take effect immediately after two publications, once a week, in anewspaper of general circulation.

calcium oxide, insecticides, etc.)

Section 2. GeneralRestrictions -

A. The carriage of dangerous goods in ships/vessels is prohibited unless inaccordance with the Philippine Marine Rules and Regulations of thePhilippine Coast Guard or other safety regulations promulgated by othergovernment agencies concerned.

B. The import, export, loading, discharging or transport of dangerous goodswithin the limits of any port or Port District shall be undertaken only inaccordance with this "Standards", and in addition to whatever regulationsor requirements imposed by other appropriate agencies of the Philippinegovernment.

C. No dockworker shall be permitted to work in holds, containers, or inenclosed spaces, which have been fumigated without protectiveequipment and entry has been certified safe by a competent person.Furthermore, no dockworker shall be allowed to work alone in suchaforementioned places.

D. No dangerous goods shall be brought into any port or Port District unlesssuch goods are declared and adequately described in Inward Manifestand are certified in said manifest by the master or agent of the vessel thatthe said goods are properly marked, packed, labeled in accordance withthe IMO's International Maritime Dangerous Goods Code or classified bythe proper agencies of the Philippine government. Such certificate ordeclaration shall indicate the correct technical name and identity of thegoods and the class to which it belongs under the appropriateclassification.

E. No defective package/container with dangerous goods inside shall belanded or brought on to any pier/slip except upon permission of theAuthority.

F. No dangerous goods shall be loaded or discharged between the hours of1800 and 0600 without permission of the Authority.

G. No vessel with explosives or dangerous goods on board shall remainalongside any other physical landing between the hours of 1800 and 0600without permission of the Authority.
